CAYLEE/CASEY ANTHONY CASE: JOSE BAEZ ENTERS LYONS DEN WITH DEATH PENALTY ATTORNEY ANDREA LYON

Orlando, FL– Appearing in court today, in advance of an approved pro hac vice motion, Casey Anthony’s lead defense counsel Jose Baez introduced the latest addition to the Baez Bevy of Barristers: Andrea Lyon. Baez took the opportunity to introduce Ms. Lyon in the form of a impromptu commercial, as pointed out by Prosecuting attorney Jeff Ashton.

Lyon is an associate Dean for Clinical programs and Professor at DePaul University School of Law. From her profile, Ms. Lyon claims to have defended over 30 potential capital cases at the trial level, and of those 30, 19 through the penalty phase, winning all 19.

(Editors Note: If a case is in the penalty phase, wouldn’t the term “winning” be an oxymoron? Perhaps a more succinct explanation means “19 of her convicted clients will not fry.”  Does that mean she tossed the other 11 losers right after conviction because she knew she had no prayer of saving their hides?)  

Baez delivered a 16 page amendment last night following court filing hours and expected the media, who has not as of yet been served, to appear and argue their request for the video of Casey Anthony in the prison infirmary following the news that remains of a small child had been found a few blocks from the Anthony home. Judge Strickland ruled they would have 7 days to intervene and he will hear their arguments to Baez amended motion late next week if requested. Counsel for the county objected several times as to specific incidents contained therein, and deposition transcripts they have not yet received.

Next up, attorneys for Roy Kronk, Jesse Grund and Amy Huzienga argued against the outstanding duces tecum motions surrounding their clients phone and text communication records as an invasion of privacy.

Collectively, a strong case presenting the lack of a good faith basis and materiality for the motion in the first place was argued by all.

Baez responded by alleging Jesse Grund, “for all intents and purposes,” was a suspect in this case who took a polygraph; the good faith basis has been established by the state in available discovery. He went on to say the OCSO should have requested this information from Roy Kronk; at which time Judge Strickland interrupted and informed him he was “straying” and that he did not wish to hear what “they” may have done wrong, but only what the defense good faith basis entails. 

Motion stayed pending attorney agreement, motion granted for non- present parties.

Enter Stage Left; Macaluso. I admit it, this is what I was waiting for. As a professional, I feel compelled to acknowledge I was not disappointed. I am on record from the announcement of his potential involvement on the defense team I felt he was the strongest chance Casey Anthony has at an actual defense strategy. Still do. His current embroilment in millions of dollars in civil litigation and looming California Bar charges notwithstanding. He is engaging, charismatic, said “um” the least and bar none had the coolest watch.

(editors note: I couldn’t get a tight enough shot but I’m pretty sure it was the un-affordable to most, Big Bang model Hubolt. Sweet.)

    If it’s true, it’s strange that he would post it on the internet.

    I think if that were true, the State would be pressing harder to get it out there, and they are not. This is a media request. As far as the Leonard comment that he knew Casey would never speak, that is a bold face lie. Leonard is alot of things, but imo, he did go down there with the right intent. Did he get star struck after the fact? Absolutely.
    I have had very long conversations with LP, and Tony P and I are tight. I can tell you unequivocally from his perspective they went to Fla to find Caylee, and did NOT think she was deceased until they met Casey. Then, they knew.

    Maybe the others ended up not being capital murder cases, or were pleaded out?

    She (Lyon) said, (paraphrasing, too lazy to go back & listen),” BLAH BLAH BLAH, Casey is innocent”. She did not say, “Not guilty”. Interesting, because I believe that you have to present a case that has some cohesion from the guilt/innocent phase to the death penalty phase. I could not be a juror in a potential death penalty punishment trial, but putting that aside, if found guilty , how do you mitigate with mental issues, etc, in the punishment phase, if you had prefaced with a defense of innocence and completely sane? Doesn’t the entire case have to demonstrate an underlying mental issue from beginning to end? Or is she going to try to show all the beautiful contributions that Casey made to society before the death of Caylee? Perhaps, they will bring in some kind of mental defect to explain not contacting authorities? I can’t imagine that a person of her stature will not be intricately involved in the guilt/innocence portion. I wonder how that will go over with Baez, who seemed, in the past, not willing to relinquish any control. Do you think she will stick with the defense that has been floated around by Baez, or a completely new theory? Your thoughts?

    Baez filing the amendment late and after hours obviously a calculated attempt to stall arguments with the media (about releasing the video). I know most feel he is inept, but I don’t believe the rest of the team would tolerate any real Bozo behavior (nor Casey for that matter). And now, of course, I REALLY want to see that video….

    I think your mostly right, I think it was calculated, but I think he expected the judge to rule without giving the media the opportunity to be heard. Guys- I’ll be honest, this video is not going to be seen at trial. No way.

    I agree Blink, the video will not be seen at trial. The damage is already done though. Everyone has read the transcripts of what Casey’s reaction was..and that will more then likely stay. No need to see the visual now that you can visualize this in your mind..and that will hold true for jurors.

    I think Lyons will try to throw Cindy and George and Lee under the bus. She will try to show that poor Casey lead an abused life, she is damaged goods and not mentally healthy….ie..she just couldn’t help herself. Cry me a river.

    However, I don’t think Lyons will stay unless she makes nice with Casey and Baez…Casey still calls the shots on who her counsel is..and if there is any infighting and Lyons doesn’t come around to Baez and Casey’s thinking…well she can kiss this gig goodbye.

    Nice Lyons gets all this free publicity for her new book coming out in December.

    Anybody remember Caylee anylonger..she is being sanitized from this case.

    I was thinking that exact same thing yesterday my dear DD- Caylee Anthony was killed at 34 months old.
    I noticed Cindy was not sporting her 50 zillion charms, badges and bracelets yesterday in her honor, and she has foregon the grinch color. These people will end up getting exactly what they deserve, of that I’m sure, but Caylee did not and that’s why I , like most of you, will not leave her as some sort of ATM for these jackyls.

    Interesting. But won’t the Anthonys have to testify before the defense has its turn?
    The prosecution will, no doubt, present the “nanny abduction story” and have the Anthonys take the stand, or if not, at least show video of their (and Casey’s) police interviews, while eliciting testimony from investigators/detectives. I can’t imagine that they (defense) can completely wriggle out of it.

    I mean they will withdraw the countersuit, and then Conway will file that their testimony will prejudice a jury.

    They are still screwed. Even if the civil testimony can’t be used. Casey, herself, told this tale to detectives, and friends via text messages. It’s coming in, in spite of what happens to the other Anthony’s testimony (from criminal/civil).

    Maybe Lyon will get her (Casey) off with Ineffective Assistance Of Counsel? Would she dare?

    WHOAH! You think Casey will take the stand, or someone will have her cop to it in their opening statements? Who do they get to explain, through testimony, why she would lie about this, if not Casey, Cindy & George? They have to demonstrate and prove why she would lie. (sorry I’m writing so often)

    No, by “stipulating” she would not have to take the stand, I think they will blame the A’s and that she covered up for them all along, like I said from the beginning.

    This whole case is getting old….WAY OLD..Is she gets away with this, I will lose all faith in the system……To see her even walking into a court room smiling and acting like nothing is going on it sick..she has NO REMORSE and seems not to have a care in the world. All the while her little girl’s ashes are god knows where. i heard last night on nancy Grace that Casey is threatening ti off herself if she truly does get the death penalty….I saw hand her some shoe laces NOW and lets call it a day…Sorry…..thats how I feel about this whole JOKE OF A TRIAL…….The people of Flordia are going to be paying a lot of money for this chicks legal costs and what?     I agree with you about Leonard Padilla. He may be an “original” but he went to Florida to help find the beautiful, missing Caylee. His motives were pure, imho. I’m sure he was heartbroken when he had to accept she’d been murdered by her own mother.

    Don’t know why he has such a hard-on for Cindy Anthony, though. I realize the woman is a manipulative bitch and she’s about as unpleasant as they come when she’s not in control. But she’s never murdered anyone, let alone her own baby. I think she tried to do right by her family, but Cindy has her own issues & shortcomings. Who among us doesn’t?

    It has to be harder than anything I’ve ever faced (including the death of my first husband) to have your granddaughter murdered by your own daughter. I think I would fight for justice for my granddaughter, and my daughter be damned, if I found myself in her shoes, but one never knows for sure. Publicly, the Anthony’s are supporting Casey, but privately they have to know she killed Caylee. What an awful position to be placed in.

    I can’t believe George or Cindy Anthony had anything to do with the death of Caylee or hiding her body. As horrible parents they are and were to Casey, they loved their grandchild and tried to protect her.

    I think Cindy lost her temper and patience with Casey for her preying upon her grandparents in the nursing home, stealing checks and money from them. When you think about it, it’s absolutely disgusting to be victimizing elderly loved ones who are struggling just to survive. Casey’s preying upon them had to have enraged Cindy, rightfully so.

    Who knows how many times George and Cindy were victimized by Casey’s stealing & lying, as well. There’s a limit to how much anyone can take before you just lose it.

    I don’t think Cindy or George, in their wildest imaginations, ever thought their granddaughter was in danger of being killed by Casey. They would have taken steps to get custody of Caylee (not just threaten to do it) and gotten a restraining order against Casey. All Caylee ever was to Casey was a manipulative tool to be used for her own purposes. She did not love that child, she simply found her useful, perhaps occasionally amusing, but mostly a burden.

    In a vindictive rage of her own, Casey killed her child in the ultimate act of revenge against her mother. Casey is a monster who should have a bullet put between the eyes. She’s evil.

    So much for the dream of a nonprofit organization, after trial. NO ONE will donate money when suspicions of foul play or possibly the murder of one’s grandchild are cast toward the Anthonys. But then I guess everyone could go to plan B, books or movie deals. What a mess! Do you think that they are willing to ‘hang themselves” so to speak? Or will Casey lose their support, if this defense arises, and they will start singing?

    Have any of you had a chance to read Jose’s amended motion on the video? The only actual law I saw pointed to was that the jail had violated the 4th, 5th, 6th and 7th amendments by video taping her reaction.

    Now I am no lawyer, nor do I play one on TV, but a quick Google search tells me that those amendments address the following:

    *Amendment 4 – Search and Seizure
    *Amendment 5 – Trial and Punishment, Compensation for Takings
    *Amendment 6 – Right to Speedy Trial, Confrontation of Witnesses
    *Amendment 7 – Trial by Jury in Civil Cases

    His whole motion goes on for pages and pages talking about that Richard and Uncer think that letting Casey see the TV was cruel. So why in the world did he not site this one and not reference the others at all:

    *Amendment 8 – Cruel and Unusual Punishment

    Another one of my favorites is on Page 13:

    He goes on to say that the one sided release of the interviews of Dets. Graves and Casper were misleading b/c they stated that during their interview w/Uncer she said that Casey “collapsed in the chair”. He goes on to say that Uncer did not say that she collapsed but rather that she just sat down. Then the brilliant attorney that he is decided to reference the Uncer transcipt he got this from:

    Q: Then you say she walked into the medical clinic and immediately looked at the TV, which is on Channel 9-
    A: Correct
    Q: -and collapsed in the chair, correct?
    A: Yes
    Q: Did you put her in the chair or did she collapse in the chair?
    A: She sat in it herself. She kind of just collapsed for lack of a better word. She sort of fell by herself into it. I didn’t physically place her in a chair.
    Q: She just sat down, correct?
    A: Yes

    Now from reading the portion of the transcript that he copied right into his motion. How could be say that Uncer never said she collapsed in chair?

    Does he not proofread this stuff before he sends in it? No wonder Ashton, can’t help but sit at the Prosecution table with a big grin on his face.

    Blink, can you get the scoop on when Lyon got to town, and if she had a meeting with George and Cindy prior to the hearing? They were in a new and different state of emotion (and physical appearance, as well) than ever before, and I wonder if Lyon had already met with them and told them in no uncertain terms how things were going to be handled from this point on, including her expectations of them. Maybe cease and desist on the public appearances, for one thing.
    She has NOT met the A’s.

    Who did all the replacements? The bedding, the laundry bag, the book and the toys? I think Casey admitted what she had done and they laid her to rest. Buried, not dumped, in a shallow grave that became unearthed by the storm. Why, else, would they make such a fuss about a body search? They wanted tips, because, they had already moved their agenda from Caylee to Casey… tips create doubt.

    Lucky for us, Caylee was found!

    Not lucky, she was on God’s time. My friend from Orlando told me that when I was distraught one day over this case.
    He was right. Sometimes, that’s the way it is. No doubt, baby girl will be heard, regardless of the vultures that share her surname.
