Caylee/Casey Anthony Case: Baez Motionfest in Court This Morning

Orlando, FL– If yesterday’s antics at the press conference of attorney for the search group Texas Equusearch, Mark Nejame, were a precursor to this mornings motions hearing, it should prove to be a long day.

Exactly what pending motions are slated to be heard as there are several before the court at this time, remains to be seen, however, all have been initiated on behalf of the defense team Jose Baez and Andrea D. Lyon.

It is presumed the court will hear: Motion to delay the economic charges against Casey Anthony, motion response on behalf of TES Founder Tim Miller to be certified as a witness in the criminal case, Motion of 90 pages regarding evidence tested by the FBI (insert yawn). Motion regarding Anthony Lazzaro phone records, motion regarding Dominic Casey records and motion to preclude Leonard Padilla, Tony Padilla, Tracy Mclaughlin and Rob Dick from testifying as prosecution witnesses. Motion for anything I forgot.

First Up-Mark Nejame vs. Andrea Lyon TES motion 10:18 AM

White shoes. Repeat. White shoes in court. Got the petty out of the way, thanks for indulging me.

Mark presents to his Honor, Stan Strickland, the vast problematic issues with a broad request, which could encompass 4000 different individuals.

Andrea Lyon argued this is not a fishing expedition, it is the equivalent of the defense relying on the “Trust Me”  argument on behalf of the state. They are not looking to expose people’s personal information. Ms. Lyon went on say the defense is willing to hang out at Mark’s office until they get what they need.

Judge Strickland in recent receipt of the answer, deferring ruling upon review in short order. 

Jose Baez Argues Tony Lazzarro phone records 

Baez argues Lazzarro was served, and that the motion has been narrowed and only received response yesterday at 4PM.

AttorneyJay, for Tony Lazzarro, argues he was not served either, was notified by a third party as to ammended motion. Jay agrees to requesting the 6 week period of records from AT &T, but is not optimistic he will be able to. Furthermore, the materiality of the defense request post July 15, 2008, has not been shown. All communication had ceased by then.

Judge Strickland grants a portion of the defense request, June 1 through September 2008, within 30 days.

Jose Baez Argues Motion to Preclude Leonard, Tony, Tracy and Rob

 Baez calls George Anthony. Casey begins weeping openly. George discusses his interaction with the team.

Linda points out Mr. Padilla puts up $50k  bond, so how is it he was unaware that his intention was to find his grandaughter. George is doubletalking that they volunteered to provide security only once she was out. Jim Campbell, was the retired LE officer was staying at the home at the time. Mr. Baez had to be present when any person spoke to Casey or was around her, if he were not, a family member had to be present at all times.

George states he knew nothing about the privacy arrangements they agreed to. Linda pointed out there were several people that could have transported Casey back and forth, and that they requested this service. 

Ms. Drane Burdick presented the audio interviews of Leonard, Rob, and Tracy, about 3 hours worth which the Judge will review. She requested an original copy of the signed agreements for all parties.

*Secret*.. What Baez presented as the true and correct copies of the executed agreements by all parties is NOT.. Ms. Burdick is aware of this

Judge Strickland points out that Baez has had well over a year to file a temporary restraining order as Padilla as he has been “breaking that agreement” all over TV under this argument.

Ms. Drane Burdick argued Baez motion is essentially a gag order, and their has been no agency established, they posess the burden to establish privlege in the first place.

Oral agreement was hatched upfront between all parties, and prior to the written agreement. The agreement to provide security was a condition of posting the bond in the first place.

BAM… What I eluded to, Tony Padilla did not SIGN that agreement in the motion.  Hello, Florida Bar, please hold… 

I am intentionally shortening this segment, The State ate his lunch, and I have no clue why, but ruling deferred.

Motion to Determine a Trial Date Check Fraud

The state argues the check issues are relegated to specific dates and feels although witnesses may overlap, there is not an issue as to hearing testimony in the murder case. Baez is the only attorney on the docket of the case. The victim, Amy Huizenga, is asserting her right as a victim for the matter to be concluded. As an alternative, the State advises they are willing to go the bench trial route, which would allay the concerns altogether.

Ms. Lyon argues it is not their position it should never be tried and it is the states fault for seeking the death penalty in the murder case. Ms. Lyon sugested the state postpone the check fraud charges 60–90 days behind the murder charge.

Judge Strickland is considering this ruling as well

    Pettiness here: Maybe if Andrea sees that her hair (which IMO is age-innapropriate) looks like long snakes down her back, she might consider getting a hair cut. Between the hair, the ill-fitting clothes and the shoes, she’s a mess.

    The only witnesses who signed the contract are Padilla (x2), Mclauglin Dick, and a notary. Typically, the notaries don’t carefully examine the text & content and only assure that the signatures are genuine.

    If someone else from his office reviewed the contract and signed as a witness, that could make his case for the authenticity better. However, it appears that he didn’t do that. Do the other parties argue that this was not the contract that they signed as well?

    I bet Stan Strickland will not take Amy Huizinga’s position on the cheque case and just put her involvment in stuff, re: the murder case, as causing her the stress, not the cheque case. I hope that he sees that her case should be tried sooner. Maybe Casey could suggest to Amy that if she doesn’t drop it, she’ll be on the line for more implications, like Jesse, like Tony, like her mom said last year, ‘Amy’ is one of those she thinks might be involved.

    Amy needs to have this cleared up, the money is not all she lost, in fact, she lost more hundreds to Casey’s light fingers, that she can’t prove easily.

    I also owe Amy Huizinga an apology as early on, I thought it was she who was in the car photos with Casey partying– it was not. I believe that Amy is a good hearted individual who got manipulated because of her good nature, and from her comments to LE early on, she showed how she recognized the worry in Cindy’s voice when she called her about finding Casey and made the decision she would talk to her. ‘It was worry and it was concern’ in her voice… Amy said, and that she recognized it before because she had heard it from her own mother, when she was concerned. I think Amy is a good young woman– that’s my impression– whatever lifestyle, partying, exhuberant youth, that’s not an issue. It’s who she is that let her be victim of a predator like Casey and that is not a ‘weakness’, except in the mind of someone like a Casey sociopath.

    When I see these lawyers representing Casey I think they are a good advertisement as to who not to hire for your defense. They
    are usually a “gang of four” – where was Linda Baden? Strickland
    leans over backward for the defense in my estimation but I understand that he doesnt want to leave room for an appeal. The argument by the State regarding Padilla et al, was excellent, but Strickland did make a comment regarding Padillas many TV appearances and said to Baez
    “isnt the cat out of the bag, so to speak”. When it comes to what
    Padilla, Tracey and Rob heard the cat is most defintely not out of the bag IMO. Tracey has never spoken publicly. There is a rumor flying around that Tracey heard a confession or something close to such that
    Baez of course says is ridiculous. As to the last motion for a date to be set for a fraud trial, if Strickland will set a date he only has three more months to do so as in January doesnt the pre-trial start for the murder charges? We also now have an idea of what the defense is going to contend. That Caylee’s body was moved while Casey was in jail therefore she was not the murderer. I dont buy it and I dont think a jury will either.

    Kleat, what I saw at the end as they were filing out of the courtroom was I could see George and Cindy straining their necks (with smiles) to make eye contact with Casey but Casey was punishing them by not looking at them. Even though she was sheilded by her possé she would not look in their directions. Kept her baggy eyes cast downward.

    it’s a little to late for regrets the only regret is that she will spend the rest of her life in prison thanks to her mickey mouse attorney and her parents.

    When George was testifying and said “I don’t see the relevancy of this question” can he do that. I thought only the lawyers are allowed.
    Again George’s attitude does not bode well for the trial.

    Wow, Casey looks quite drained. Dark cirles, and pail face. Looks as though her carefree daily feasting and no responsiblities of a toddler as starting to bore her. Possibly starting to set in that this is her daily life for at least a year, until her trial.
    She is toast and as someone stated here before, if the defense looses on their motions up til trial, they may opt for a plea, but answer me this, does the state have to take a plea deal??

    one other thing. On Court TV Todd Macaluso(?) on caseys defense team just stated that they just got some results back and there was definately NOT any signs of decomp in the trunk and also that there were NO fingerprints found on the tape, that these were leaked from the OCSO. He also is claiming that the body was placed there after Casey was in jail. He claims that Casey is innocent and that this is definately not a death penalty case. Also he states that the AIR test is just junk science. This case makes me soooo angry because, I just have this feeling in my gut that she will get off, because of the defense using the tactic of confusing the jury with minor things.

    Till Tappin’ Todd has evidence that Caylee’s body was moved to the remains site AFTER the perp was incarcerated?? Wouldn’t most defense attorneys run straight to the judge with that kind of evidence to get their client out of jail and the charges dismissed??

    And just where do they suppose Caylee was being “stored” until after Killer Casey was arrested?

    I’m not a judge or an attorney or any thing close, but if I heard that in my courtroom, I would have been in Todd’s face asking him to elaborate with that business lickity split!

    I wish I had kept count of how many times I said…OMG Are you kidding me??, this morning! I can’t believe what this defense team is getting away with in Stan’s House.

    Say, anyone catch Baez’s comments in his presser post-hearing about the photos that supposedly were to show water in the area in November, and that Dominic Casey’s video proves there was no water? Then he adds… ‘Who are you gonna believe, you… or your own eyes?”

    And then there’s the ‘trust me’, remark and about ‘relevance… we’ll decide, not just because someone doesn’t think something is relevant’. Can he spell hippocrit? (oops… not being sarcastic about team attire )

    I don’t like how it seems that the judge is always in favor of the defense. It just seems as if the defense always gets what they want. I hope it is just so that there won’t be a mistrial, but to me it just seems like he is more leniant with the defense as opposed to the state. I would like to think that if the defense has any evidence to prove her innocence, why hold back now?? Unless maybe there is another SCRIPT that we are not aware of which involves the defense attorneys being harmed and they must wait until after her trial, you know like the 31 day script from Zanny!!! LOL
    I wanted to know and I asked earlier, what is the law about plea deals?? Is there any laws and does the state have to agree to one??
    Also, I don’t see Casey making it through days and months of a trial.
    Wouldn’t you just love to get inside her head and hear what she was thinking as she sat there??? Cindy thinks that Casey was so emotional about seeing her dad and catching his kiss. NO, I doubt it.

    Ok– NOW we know why GEORGE was sent off the deep end, so rudely flying into the offices of Mark NeJame to cut the news conference off at the pass (successfully too). That ‘innocent because someone else dumped the body in the woods because those woods were DRY and completely searched’ was today’s media THEME, along with all the talk of the much needed ‘SECURITY’ which could suggest to a potential jury pool, fears of threats to the family and Casey, which go to the threats of the bad people who took Caylee and kept her and killed her, and then maybe kept her longer, until Casey was in jail a good long time, which, would implicate someone else being involved, so that Casey herself wouldn’t be blamed, because they dumped the body at a time to protect Casey from guilt in killing her.

    george was so quick to point out..er, go on the attack as a deponent during the M&M depo, accusing the deposing attorney of flipping the bird at him (though merely adjusting glasses), yet now in court, when he’s got Judge Stan’s attention, he lets casey’s gesture go…seems like mancuso & lyon weren’t paying attention to her subtle gesturing, either.

    When George said “that isn’t relevant” (or whatever words he used), it made me think how much fun it’s going to be when they’re on the stand in the real trial. I think George will try that crap but will easily be beaten down by the judge and the state. Sindy, on the other hand, doesn’t know when to quit. She’s probably going to be “objecting” to questions and evidence. It’s going to be like watching the monkeys at the zoo.

    - Judge Stan promptly squashed him like a june bug. George brought his belligerent personna to court today — didn’t get him far. Still had to answer the question.

    Then, it seems like George was lying on the stand about not knowing that Leonard had posted the bond & the amount of the bond..seems like I’d seen & read the actual bond paperwork online, & that Baez had a “pow-wow” to discuss with GA, CA & LA & their attorney how things were gonna be, etc….so is George’s testimony in line with previous testimony therefore he’s sticking to it, or is he perjuring himself?

    One more thought. I think Macaluso got his evidence about the body being dumped after Casey was incarcerated from those people that George was watching. The ones who he knew had taken Caylee. Remember them? Wonder where they are now? George? Tell us please. Maybe Dominic Casey knows. I think the Anthony family lying gene has somehow passed on to their attorneys.

    I guess NeJame really did steal the thunder of the defense, holding a press conference one day ahead where he states that the site was underwater and Caylee’s body wouldn’t have been discovered. Next Day, Mac is in the court and on TV saying they have substantial evidence that the body wasn’t there…

    Do you believe that this “substantial” evidence has anything to do with the terps? Or are they simply going to rely on Dom Casey?

    When George is on the stand at the trial, he will not be allowed to ramble on and give vague answers. I can hear Linda now saying,”Just a yes or no Sir”. AND the judge saying, “just answer the qiestion, Mr. Scamothy.” Hostile witness indeed.

    Cindy and George gave a little interview and Cindy was quite polite!
    She stated that Casey did in fact get to “mouth” I love you! to them
    and she did make eye contact, this was on her way out of the court.
    She usually avoids looking at them. Hmm Cindy being polite thats a new one – she seemed happy today.

    Sorry for all of the posts, I am sooo addicted today. One thing that is REALLY bothering me is that Baez says that the video of the area shows that it is DRY. Yes it does appear DRY, but this is not the area where she was found. The big question is WHY DIDN’T HE SEARCH A COUPLE HUNDRED FEET OVER (where the body actually was found)?? Was it because there was too much water over there???

    I hope I didn’t miss where you guys already hashed this out – but remember the night that the two ladies were ‘chased’ after trying to place another cross at the memorial? I wonder if the defense is going to try to say that the people trying to leave a cross were the same people that put Caylee’s body in there after Casey was in jail? That they were trying to leave a message to Casey about her not following their list of instructions and therefore this is what happened? I wonder if they have other secret video of someone going to the site – leaving things. Thus the ‘real perp’ revisited the scene, etc.? I know its a stretch but so is ANYTHING other than a confession and a plea.
