Caylee/Casey Anthony Case: Baez Motionfest in Court This Morning

Orlando, FL– If yesterday’s antics at the press conference of attorney for the search group Texas Equusearch, Mark Nejame, were a precursor to this mornings motions hearing, it should prove to be a long day.

Exactly what pending motions are slated to be heard as there are several before the court at this time, remains to be seen, however, all have been initiated on behalf of the defense team Jose Baez and Andrea D. Lyon.

It is presumed the court will hear: Motion to delay the economic charges against Casey Anthony, motion response on behalf of TES Founder Tim Miller to be certified as a witness in the criminal case, Motion of 90 pages regarding evidence tested by the FBI (insert yawn). Motion regarding Anthony Lazzaro phone records, motion regarding Dominic Casey records and motion to preclude Leonard Padilla, Tony Padilla, Tracy Mclaughlin and Rob Dick from testifying as prosecution witnesses. Motion for anything I forgot.

White shoes. Repeat. White shoes in court. Got the petty out of the way, thanks for indulging me.

Mark presents to his Honor, Stan Strickland, the vast problematic issues with a broad request, which could encompass 4000 different individuals.

Andrea Lyon argued this is not a fishing expedition, it is the equivalent of the defense relying on the “Trust Me”  argument on behalf of the state. They are not looking to expose people’s personal information. Ms. Lyon went on say the defense is willing to hang out at Mark’s office until they get what they need.

Judge Strickland in recent receipt of the answer, deferring ruling upon review in short order. 

Jose Baez Argues Tony Lazzarro phone records 

Baez argues Lazzarro was served, and that the motion has been narrowed and only received response yesterday at 4PM.

AttorneyJay, for Tony Lazzarro, argues he was not served either, was notified by a third party as to ammended motion. Jay agrees to requesting the 6 week period of records from AT &T, but is not optimistic he will be able to. Furthermore, the materiality of the defense request post July 15, 2008, has not been shown. All communication had ceased by then.

Judge Strickland grants a portion of the defense request, June 1 through September 2008, within 30 days.

Jose Baez Argues Motion to Preclude Leonard, Tony, Tracy and Rob

 Baez calls George Anthony. Casey begins weeping openly. George discusses his interaction with the team.

Linda points out Mr. Padilla puts up $50k  bond, so how is it he was unaware that his intention was to find his grandaughter. George is doubletalking that they volunteered to provide security only once she was out. Jim Campbell, was the retired LE officer was staying at the home at the time. Mr. Baez had to be present when any person spoke to Casey or was around her, if he were not, a family member had to be present at all times.

George states he knew nothing about the privacy arrangements they agreed to. Linda pointed out there were several people that could have transported Casey back and forth, and that they requested this service. 

Ms. Drane Burdick presented the audio interviews of Leonard, Rob, and Tracy, about 3 hours worth which the Judge will review. She requested an original copy of the signed agreements for all parties.

*Secret*.. What Baez presented as the true and correct copies of the executed agreements by all parties is NOT.. Ms. Burdick is aware of this

Judge Strickland points out that Baez has had well over a year to file a temporary restraining order as Padilla as he has been “breaking that agreement” all over TV under this argument.

Ms. Drane Burdick argued Baez motion is essentially a gag order, and their has been no agency established, they posess the burden to establish privlege in the first place.

Oral agreement was hatched upfront between all parties, and prior to the written agreement. The agreement to provide security was a condition of posting the bond in the first place.

BAM… What I eluded to, Tony Padilla did not SIGN that agreement in the motion.  Hello, Florida Bar, please hold… 

I am intentionally shortening this segment, The State ate his lunch, and I have no clue why, but ruling deferred.

Motion to Determine a Trial Date Check Fraud

The state argues the check issues are relegated to specific dates and feels although witnesses may overlap, there is not an issue as to hearing testimony in the murder case. Baez is the only attorney on the docket of the case. The victim, Amy Huizenga, is asserting her right as a victim for the matter to be concluded. As an alternative, the State advises they are willing to go the bench trial route, which would allay the concerns altogether.

Ms. Lyon argues it is not their position it should never be tried and it is the states fault for seeking the death penalty in the murder case. Ms. Lyon sugested the state postpone the check fraud charges 60–90 days behind the murder charge.

Judge Strickland is considering this ruling as well

    RE: Kleat’s post (#22): Yes indeedy. The first thing I noticed was the very stratically positioned large men behind KC and in front of the Ants. I don’t understand the reasoning for this though. Wouldn’t Baez want KC to at least make eye contact or show a small acknowledgement toward her very ‘supportive’ parents? KC’s obviously doesn’t want to look in her mother’s direction for even a split second.

    michigan fan, Dominic knew the body was there, and he was hoping he didn’t ram that bbq skewer (aka scientific body searching apparatus with the long metal pointy end ) through anything and he hoped that he would not actually see the body. Their job was to set the scene, to PROVE it was not there in the almost exact location in mid-November when it was still too wet to search.

    Remember that Tim Miller was looking at a search of the whole area, not just the high points near Suburban Rd where the water may have already receded. It’s a big operation to plan an area search as we’ve seen, organizing the people, decisions on what resources where and how, then setting the date. So the defense will argue that the body could have been found, show a few higher areas in the video, prove it’s non-existence by it’s non-existence in that search (while DC said he knew the body was there, remember but didn’t tell LE, didn’t call 911, so the baby was left for another month).

    Point is, no organized search of that particular area. Cindy and George would know what months are the dry months following that unusually wet August, and when to plan their little ‘reveal of NO body scenario on video’ and how to do it– like use a psychic as the source.

    Perfect– if they get Casey back home, they deserve what they ask for!!

    all you guys crack me up!!!!—hair adornments and woolworths. i was astonished too to see what Lyons had on. what’s up with this high priced famous lawyer. i would be scared if i had a lawyer that came to court like she had slept in her clothes, maybe in the Pontiac–( I go to a lot of dog shows and i always comment to my husband that all the men that are showing dogs have on nice professional suits while most of the women instead of trying to wear something professional–so they too look like they know what they are doing wear any old thing and like with dirty tennis shoes etc.) something that they would groom their dogs in NOT show them. anyway, so i am very sensitive to women making sure they equal how the men look, to me that is just common sense but its obvious that Lyons DOES need a to do list. it’s not like she cant afford it either. she is also a big lady why wear white for God’s sake, i am a plus size and i would Never wear all white, even before Labor Day or whatever that rule is. anyway, i had to give my opinion of that too. thanks, hope everyone has a nice restful weekend after all this circus–bring on the dancing bears!!

    George’s testimony– all of our lives were threatened– this was today’s double meaning, ‘our lives were threatened, our safety threatened, not just by protestors, but BY THE KIDNAPPER/Co-conspirators/Casey’s ‘help’ or whatever– ‘they’ that planted the body in their neighbourhood.

    Ok – if the defense contends that the body was placed at the site while Casey was in jail – which nobody believes for a second – what about the fact that Casey has been in/out of jail? If the defense looks like they’re winning points on this – the state could argue that Casey told someone where the body was and it was moved by Casey or somebody else on Casey’s behalf. I just think this strategy is ridiculous.

    I’m not usually the one that speculates on the far-out. Somebody stop me.

    word is over at the ‘TVGuy’ guy’s commentary, that WFTV’s legal analyst, Bill Schaeffer doesn’t think the defense’s position (well, what they WANT us to know via Toddy Mac, past and again today) is going to fly.

    So, where is Schaeffer’s interview?? Not yet on the site. Could this whole deal be a roose, to try to gain some ground early? Maybe… then on to Plan A (secret Plan A).

    I TOTALLY believe that the grounds where Caylee was found were probably wet and inhospitable for a search. This however, is based on my assumptions on what the people involved have stated. The photos released do nothing, unfortunately, to convince me of such and this – without question – is what the defence will ride upon.

    I abhor the dishonest representation of facts that I see (my opinion only) coming from the defence but I am truly looking forward to the FACTS! I cannot wait for the real FACTS to come out!

    Just watched the slide show (or should I say “sideshow”) of Casey crying in the courtroom today. It seems she no longer thinks her notoriety is really cool & exciting. Remember the footage from her first arraignment, when she was wearing the blue hoody that she bought with money stolen from Amy? Casey could not hide how pleased she was at all the news cameras there, just for her. Fame!

    Guess the thrill has kind of worn off, huh Casey? Boo hoo for you.

    PINK, I bet that should this come to trial, the jury will take a ‘swamp’ trip (vs field trip) with snake sticks in hand, to see those low areas that have ‘black’ areas which were water. And from there, they can see the topography.

    Anyone else think that Todd Mac’s end of things today, was more of a red herring?– yes they want the stuff, but they are still fishing and they haven’t found the fish yet, just seen some jumping. Something that Baez said in one of his pre-or not-so-pre ‘ambles’ today talked about how he and his defense aren’t giving up anything about their defense.

    Fishing– and they want to sneak a few undersizlings into their creel.

    I think the reason that Casey looked so sad today (I can’t believe JVM actually said she felt sorry for her!) was just an act. It was the first time she didn’t have any foundation on or under-eye cream or any eyeliner on her lower lids. And if she really was crying, those tears were for herself — not for her dead daughter. There were no tears when the “remains” were discussed.

    I also think she’s had over a year to think about what her mother did. If it wasn’t for Cindy making those 911 calls, Casey would be living the Bella Vita. I really believe that if Cindy had found out that the baby died (accidentally or not), those calls to 911 would never have happened. That lying family would be making up stories left and right. G & C would be saying Caylee’s with the nanny anytime anyone would ask — just continuing enabling their wacko daughter. That’s one sick family. And where the hell is Lee?

    I was trying to think what evidence the defense could have in regards to the body being placed at the scene after casey was in jail. The only thing I could come up with is possibly the found some plant that grows only in the fall OR possible one of the items found wasn’t manufactured till Oct ..

    Personally, I think the defence advised Casey to look less “attractive” and all “made up”. amd to appear very sad and pitiful. More like a mother grieving and innocent of any crime. Lyons (Big Girl) has had years of practice in this sort of thing.

  41. concerning post#39 and the signed contract that Tony said was not the document that he signed in BOZO’S OFFICE.even though that is his signature,I think this cover up started back then and BOZO is in on it just as well as the Anthonys. also,I think the judge is bowing down too much to the defense and.HE NEEDS TO BE REPLACED! HE IS NOT BEING FAIR TO THE STATE OF FLORIDA. with all of the attorneys on the scheme team,there is no excuse to allow the defense to get a delay on the fraud trial.they are calling all of the shots and the judge is letting them get away with entirely too much.

    maybe the poor clothing choice is a ploy to convince the judge that Angela needs her second job as a professor..hence the requests for a later trial date, her clothes clearly state “hey Judge I dont make enough money as a lawyer I need two incomes, the economy is tough and my hair is a mess, I cant even afford some Loreal to hide these greys”…and Baez needs some hair plugs to hide that unsightly hair line if his lines get any sharper he might cut someone… don’t even get me started on Linda Baden, se looks like a frumpy Tammy Baker maybe she can share some of her makeup with Angela…what a mess…what a total mess I cant even take them serious

    re: Tony Lazzoro, It was my understanding Judge Strickland granted phone records through December 18th not Sept. 30th? on http://www.marinadedave.com He has done a few stories/videos regarding the remains stie. He just did one recently and in the video it is apparent that some terrain has been cut down. That was this month. His other video was last month. It definately looked as if someone had cut alot down perhaps to take photos. Dave takes not of that in the video. I’m wondering if that wasn’t the defense in there,seeing it is now August. Maybe the conditions are much dryer this year opposed to last year. “Their new evidence”? just a thought. I have to say it is kinda sad seeing how hard Cindy tries to get contact from Casey, and she so flat out ignores her. I also think Baez purposely got George upset so he would ruin the press conference. Padilla & Crew, I hope you are laughing all the way to the witness stand. There seems to be something really wrong with the DC/JH searh/video attempt in November. The whole thing doesn’t ring right..and then Cindy making it a point to say she had that area looked at in November only after the remains were found. They were busy eating crab puffs as NG would say, when the remains were found? Something is wrong in Denmark. I take it, we will be hearing much more about this?

    why in the he!! would someone else dump Caylee “while Casey was in jail” what kind of sense does that make, if someone else did this would’nt they desose of her when Casey as out, he!! if they were smart enough to go into the Anthony’s house and steal all the items she was found with and depose of her close to the A’s house would’nt they be smart enough to despose of Caylee while Casey was out of jail, therefore setting up the appearance that Casey did this to her….what kind of stupid A$$ defense is that?????

    and the video of DC in the woods…those video shots were not where Caylee was found, close, but not where she was, maybe he didnt find anything cause the body was still under water a small amount of water in NOV, we are talking about a tiny little skeleton (God rest her soul) not a 300 lb man, it wouldnt take much water to cover her. DC wasnt about to go trucking around in a pond, I didn’t see him with waders on…he was in dockers and a button down not dressed in what I would consider swamp clothes. if she was desposed of later why the scattering of bones, someone sprinkled them around or hid them like
    easter eggs? no way would she have been skeletonized in a few weeks the way she was. that is as stupid as the rotting pizza in the trunk story.

    this makes me sick to even talk about, but it just make no sense

    Baez & team…wake up…we were all born… just not yesterday..that is a seriously sad example of reasonable doubt

    i know the defense has to have some kind of theory but how about a theory that makes sense

    I don’t know why she’s going there boo. Remember, in the last document dump, in an email, the Body Farm had already backed off the chloroform issue. The scientist was upset that someone leaked this info prematurely. Dare I say, he might have even been angry. I don’t believe that the state is even going with chloroform as part of their theory.
    However, the defense will use it to demonstrate, in part, that the science is unreliable. This is part of why they want all communications.

    However, Body Farm science, or not, people have testified to the odor.
    But then the defense will argue that that is a subjective measure and not proof; that the smell was from other items rotting.

    I wonder, if the car has been sealed all this time, and if it is still as odoriferous, if the state would have a field trip of sorts to allow jurors to smell it. If so, I’m glad I can’t be in that pool!
