 Discovery Review Part II

Orlando, FL– In Part I, we reviewed the Latent Lift Myth.

Adding to the quagmire of why Linda Kenney Baden maintains there are no prints on the duct tape, one reviews Ms. Baden’s amended motion for discovery.

Ms. Baden requests the specific 18 latent lifts and subsequent file information from the FBI reports in “this matter”. However, those tests were performed from items removed from the Anthony home by Orange County Sheriffs Office, not the FBI, thus the “THERE ARE NO LATENT LIFTS IN THIS CASE”.

How does the defense attorney entrusted to interpret the forensic evidence in a death penalty case not know with what agency that information is held? It was released months ago.

HenkelTape

Within the discovery, their is an email indicating a few areas of the tape were swabbed in the final testing process (CU) with methanol. This is performed on the non-adhesive side of the tape. Does it make sense if your sole intent was to extract DNA from this tape that you would be reduced to swabbing only the side of the tape NOT affixed to Caylee’s face?

It only makes sense if your goal is to preserve the integrity of what appears on the adhesive side, and exclude the possibility of DNA on areas that will not compromise the sample in that regard.

Fibers Differ

Although the FBI has concluded  that the adhesive on the duct tape from the crime scene, on Caylee’s skull, and the Anthony home are CHEMICALLY THE SAME, Brad Conway releases the portion of the report that states that microscopically the tape fabric composition of the samples are dissimilar.

Now, admittedly I had the where- with- all to choose the smartest girl in my IPS class to be my lab partner while everybody else joked around and blew each others bunsons out. However, my guess is if you were to match conditions to the tape from the crime scene to that on the gas can and shelf from the shed, they would magically appear “SIMILAR”.

Difference between quantitative and observed, no? If that is the defense teams idea of junk science, I might agree. This brand of duct tape has not been manufactured since 2007.

How hard do we think it is going to be for the State to locate this exact production batch? They are as close to an MSDS report away.

Weed Eaters

Weed control

In the CSI notes from OCSO, initial responders, we note 4 different areas where Agent Bloise marks 4 areas; 3 are under wood chips and the 4th is under the platform of 16×16 pavers from the July yardscaping.

Buried within the FBI contact logs from the latest discovery, we learn that OCSO has at least one of those, if not all, in evidence. Where were they sent and what are the results? Could they be in the company of the much anticipated soil samples taken from the Anthony yard?

The examination and testing of soil samples from the trunk have also not been disclosed to date.

The OTHER Laundry Bag

As reported exclusively at blinkoncrime.com, the original report of the laundry bag had the incorrect model. WhitneyLaundryBag

The rectangular laundry bag, referred to as K33 in the most recent report, was recovered at the Anthony home on a top shelf in the East side of the garage.

In the latest FBI report, K33 appears under the “additional items from the vehicle” category. Not in the items from the residence and is examined with the items found with the Dora backpack or diaperbag as it is sometimes referred to.

What does that mean? Category oversight, OR, did OCSO find out that laundry bag was removed from Casey’s car?

I just do not get the duct tape. Was this put to look like a kidnapping or because of the o effect?

Now, I do realize that she(Caylee) was out in the swamp, but could the matting of the hair also be because Casey drowned her in the pool and duct taped her jaw and hair, and that is what also caused the matting. Just a thought of a possible drowning.

I do live in the south and I know people tape the windows for the storms. I know that Florida had Hurricane Francis I believe in 2005 and it looks to me that it took a path in central Florida. That could be a possible time that George purchased this duct tape. I was just wondering if the Anthony’s were able to see the remains and George recognized the tape (beings it is an expensive tape you would probally only purchase for something like taping windows) It then hit him, and he realized that that was his tape. and he then lost it and wanted to kill himself and ended up in the hotel. I really feel George knows alot, but Cindy has him by the tail.

I am confused… I keep seeing people post that Cindy thinks that Caylee is still alive and in PR. From those pages of texts/emails, what I understood to mean is that the girl (leaning in against a prop wall in a western type outfit, is named Zenaida and she lives in Puerto Rico, she may be the “Nanny” and Cindy is responding that the photo fits the description of the “Nanny” which is completely different from another photo of a Zenaida, on facebook who looks more like a model, the girl in a more “western” looking outfit, Cindy is saying that she sort of resembles what she believes Caylee would look like older, not that she is Caylee alive and in PR.

And #71 although a good read, Casey is a small girl, I also would find it very hard to believe that she used a shovel to move Caylee’s body, which at 36-40lbs would be almost impossible for Casey to manage, and impossible to get something the size of Caylee’s body onto the end of a shovel, Caylee was too big. Its sad to even discuss. I had a beloved dog die, weighed about 27 pounds and I couldn’t bring myself to pick her up and put her in her buriel site, she was wrapped in a blanket, so I tried using a shovel and it didn’t work at all, the dog was much smaller in girth than Caylee and lighter. I would tend to believe that she intended to bury Caylee at home, and for whatever reason, most likely she started digging and it was just too much trouble, and burying her in the backyard was more a panic reaction, she just stopped, put her back in the trunk and took her to Suburban where she buried all her other “pets”, I think Caylee was never more than a “toy” she wanted to be able to trot out to play with periodically and then “put on the shelf” when she had better “men to do.” Snark alert, sorry blink, made myself chuckle.

ORLANDO, Fla. — A judge ordered Tuesday (read order) that the grand jury testimony George Anthony gave in October 2008 be handed over to state prosecutors in the case against Casey Anthony.

Prosecutors wanted a transcript of George Anthony’s secret grand jury testimony given on October 14, 2008 that led to the first-degree murder indictment against his daughter Casey.

“… the original of said transcript shall be delivered to the State Attorney,” Judge Stan Strickland wrote in the order issued Tuesday afternoon.

  11. Steph says:

    Re: Duct tape …
So if the duct tape was used on the posters then possibly the roll was used up and they never recovered the roll from the house in December? It wasn’t established that they took a roll, right? Just samples from gas cans and on the hooks in the shed? The evidence never stated a roll, IIRC. I am so curious to see what George and Cindy said about the duct tape in their state depos. You know that had to have been brought up.
and if Casey used the tape on little Caylee’s mouth, then she put it back in its place, it definitely sounds like she was killed at home. That would have been a stupid move on Casey’s part. But hey, that’s Casey.

  12. PAMELA says:

I am assuming they want the transcript to directly impeach something George has said since, but the SA are the only ones allowed at the grand jury, other than witnesses testifying individually. So, the SA know what he said they were there. So is the reason they want the transcipt solely to impeach George?
That is my opinion, many do not know this, but the PA was actually turned on accidentally during this proceeding, and some of the testimony was heard.

ProvokingPoirot – I loved your post #71. I can’t wait for the Entomologist findings! Quick question for you: I’ve been to the Body Farm but trust me I’m no expert…I’m very interested in the forensic aspects of it all, though. They study various larvae (among other things) on cadavers in various extreme conditions. I’m trying to remember & hoping you can help – Can an entomologist figure out if Caylee was alive and subsequently died while in the trunk based on the “type” of larvae/maggot? Wouldn’t certain maggots require certain conditions?

Here’s what I’m referring to, which is something I got from another site…it was provided in one of the doc/discovery dumps and goes on to saying that if only coffin flies were present, then that could show that Caylee was actually placed into the trunk alive (as a tear rolls down my face):

Mike, forgot to mention something in my last email. I FINALLY got a call back from Dr. Neal Haskell, my entomologist friend, and he said that the ‘fruit flies’ may really be coffin flies and that might be significant. I think as far as the laundry bag goes. I feel Cindy found it when she got Casey’s other items from the car. I think she felt it was hers and had been stolen by Casey and took it and hid it. Maybe not intentionally to hide evidence at first, but because it was hers. Like the money she took out of the purse when the wallet was opened and money was said to be in there. She took what she felt was hers. It always seemed to be OK for Casey to steal from others, but not from Cindy, then it was personal and a big deal. It is not so hard to see where the Casey’s total selfishness comes from. If you ask me George needs to start some serious thinking and talking, unless he is willing to sacrifice himself for his daughter. I don’t think he would do so well in prison. JMO

George says that he and his family only want the truth about what happened to Caylee. I wonder, if the trial actually happens, and the truth comes out, will they accept the truth and sail off into the sunset? Something tells me they won’t; Cindy’s going to want the last word as usual.

  17. ChicagoJudy says:

Pamela, I believe in those docs that the beautiful woman in the American flag is supposed to be the real Zenaida who is related to the Zenaida in Orlando who has filed the suit against Casey. There was some mention that this Zenaida was covering for the real Zenaida who is in Puerto Rico. And the little girl in the western get-up is supposed to be a more grown-up Caylee — or how she might look now, a year later. The “real” Zenaida supposedly took Caylee to Puerto Rico to hide her. At least that’s the way I understood those docs.

If the grand jury testimony is going to be released, but sealed, what’s to stop the defense from sharing it with the Anthonys like they did with the last document dump? (Technically, legally, it can’t be shared, but there is history and connection there).

  22. Linda says:

Hi ChicagoJudy and Teri. I agree. Casey is not sophisticated in the least and I’ll go ahead and call her out right stupid…but I think all of her lies served her well (not that she planned it that way) because as the time passed…the evidence was becoming more and more decomposed and exposed to the elements. Casey’s best friend was the hurricane. It’s amazing to me that anyone found Caylee at all after that. IMO Casey lucked out plain and simple.
That being said…she’s left a mountain of evidence behind…it just would have been a lot more if Caylee had been reported missing sooner or her body not found after being under water and scattered all over. JMO.

George has made himself to be the last person (other than the culprit) to have seen Caylee alive. Personally, I think he lied. The SA is trying to reign him in, he must have lied during his deposition, doesn’t match his GJ testimony and I think he also lied about Padilla when he took the stand recently. I’ll bet George (and Casey) don’t understand that even though the GJ testimony is “secret” it won’t come back to bite them. When Casey was arrested one of her first questions was about how the GJ was supposed to be secret. IMHO she knows what he knows.

I fail to comprehend how the rectangular “fabric laundry bag” we have long been led to believe was found with Caylee’s body in the woods is now considered to have been found in Casey’s vehicle and a never- before-heard of round “fabric laundry bag” is now considered to have been found in the woods. I would love to know how this round bag suddenly appeared out of thin air and the exact location at which each of these bags were found.

I think the rare, industrial-grade Henkel Duct Tape used in the commission of this horrendous crime will prove to be the only adhesive needed for the Murder #1 charges to stick to her otherwise emotionally detached mother.

Blink- your response to post 88- the computer salesman. I thought his statement read like a yellow back novel. He was really into describing how she looked. (hot to him anyway) The only thing he left out of his “story” was a fantasized ending with him and Casey hooking up in the store room. Because no one who knew Casey ever had anything bad to say about how she treated Caylee and this calous walking 10 feet ahead of her and letting her struggle with a heavy door just does not ring true. (my opinion only) If this occurred at a Walmart then there might be video showing that event. Is there a video? Probably not at this late date. Most stores re use the tapes on a monthly basis. But in any event on this issue I disagree with you.(Re: his credibility) But I still think you are brilliant!

How about this, I agree with you his verbiage is smarmy ( recall my statements about the Maxim’s in the bathroom) so while I say his account is credible, I personally see through the thin veil of “eew”. That said, I believe Casey took him right back to the time under the bleachers with Sandy Albright who was unusually developed for her age and he was not- the moment creeps back every now and again, like say June 9th.

    #98 cindeefromwisconsin and #110 Pamela –

I wouldn’t try to get anyone to buy into my theory, which is why I said “these are just my thoughts”. I believe two things though; 1. The package was wrapped very tight with duct tape, very secured, in the beginning and deteriorated with time, the elements and small animals, rodents and bugs, etc. … 2. Casey was strong for her size and build; she was fit and lean and loved working out as is well documented. I think she could have balanced it after conducting my own experiment of sorts by using one of our shovels and a bag of small river rock that weighed 35 lbs., wrapped in an old blanket, put into TWO black lawn bags and then into one of my “carry-all” totes that is almost identical to the “laundry” tote description provided by Blink (thank you, Blink, because you cleared up a lot of misconception with that particular article)…duct taped it up and carried it around my back yard, lifting, setting down, picking up, walking on uneven grass and down into a small drainage ditch behind my house. I wore what we call here in the Cape Fear Region of North Carolina, Sneads Ferry Sneakers. (You can see my Sneakers here – http://sneadsferrysneakers.blogspot.com/) I don’t like spiders and snakes! I am 5’2″ and 50 years old…I am a small lady, not a girl. At first I had a little trouble, and then I began to get the hang of it. I spent about an hour on my experiment and I was tired when I finished my chore but I accomplished my objective with no real problem or struggle. Now here is the tricky part…I used two different types of shovels that we own…both have fiberglass handles, both have heavy weight capacity but one is flat head and one is round head. The flathead was easier but not that much different in my sweat production. My husband wanted to find out if the handle of the shovel Casey may have used was wood or fiberglass because he believes a wooden handle might have broken under the weight. We have only fiberglass and it didn’t break and I didn’t either. When I got on the downhill slope of the drainage ditch, and didn’t want to go any further, I tried to place it as far as I could, wasn’t satisfied that it was far enough, then retrieved it and flung it as far as I could which was about 7 feet further.

#100 Suz and Blink…I took the statement, even though it wasn’t bolded to be by Blink:

“In my opinion, she was flung. Broken postmortem tibia, IIRC. B”

My drainage ditch is deep with water most of the time and where Caylee was found, if placed there when the evidence indicates, probably did have water but not deep-deep…so that is why I thought Casey placed it at the bottom of the hollowed out tree trunk and packed it down, thereby (THERORETICALLY MY OWN) causing post mortem damage to her little body (maybe tibia), the bags, etc. I believe she could have flung it just as easily…I did. I account for movement and scattering about the remains as being water levels, elements, varmints…..

My husband is LE and when I told him I wanted to test this out a few weeks ago, he smiled and “understood” how important it was for me to do it, but he wouldn’t help me…he wouldn’t touch any of it. I felt different that very late August night after my day of trying to play detective. We sat outside with a little fire going in our chiminea and I cried and let my emotional overload lose a little water weight.

I admire the forensic experts and wish I was in LE but I am not. I don’t want anyone to think I am strange, cold or callus. I am a mother, wife and retired teacher, expecting my very first grandchild in four months. I cannot grasp the totality of how one commits this type of crime, nor do I want to, but this case makes me bluer than blue and sad beyond words. Our family is so full of love, respect and our 4 grown children…well, we are just so fortunate and blessed. When I read how bloggers about this case are ridiculed and called names and done so without any thought of how much most of “us” bloggers care, it breaks my heart. When Cindy does it, I see red and pray for her soul.

My interest in the science did not start with the Caylee case. I began to research genocide, the war on terror, Iraq, Iran, Afghanistan, mass graves, after 9-11 and became enthralled and amazed at how “the life cycle of a fly” could tell us so much and answer endless questions. If you get a chance, read this 78 page PDF document and you will be shocked. It is a really good read and provides a good understanding of what is pure fascination.

    http://www.scribd.com/doc/17203643/Crime-Scene-Intelligence-An-Experiment-in-Forensic-Entomology

Crime Scene Intelligence: An Experiment in Forensic Entomology by Albert M. Cruz proved to be cutting edge and groundbreaking science in the forensic community. His thorough research and original analysis included a newly found forensic/intelligence analytical tool which could help bring justice, fight the war on terrorism, and find “ground truth” in cases which involve domestic and international terrorism, war crimes, torture, drug trafficking, and chemical explosive identification by utilizing the common carrion fly. In addition, the project may be effective in counter-denial and deception operations which are known to be highly relevant and valuable to the Intelligence Community (IC) in cases of deceptive mass grave movement and genocide. More importantly, this unique forensic experimental project revealed that explosive compounds such as TNT could be detected biologically—in this case by blowfly larvae which have fed on body tissue exposed to explosive residues—when toxicological analysis was no longer procurable. The results of the unique E2 forensic experiment provided empirical evidence that forensic entomology is unbiased and has a high degree of applicability to the IC. The science here is very helpful and when applied strategically to international war crime cases can provide myriad answers and help bring the guilty to justice in any war crime tribunal court system. Such information gained would also enable analysts to identify a specific batch of explosive, compare it to a known source of TNT, and relate it to a terrorist crime or cell. This original study is remarkable. LT Cruz has provided a new model of explosive fingerprinting by utilizing the common insect. He has provided an outstanding “step by step” product for the intelligence and forensic communities. It is clear he has stepped “out of the box” and paved the way for future forensic intelligence experts by providing a valuable future tool which can offer answers to help fill valuable intelligence gaps in fighting the war on terrorism and crimes against humanity.

How on God’s mercy could C and G Anthony continue living in that house? I’d run out and never look back then I would drive to the jail and seek revenge. I guess most of us consider the Ant home the place where Baby Caylee took her last breath and if there is proof will C and G be able to overlook that?

After all this time with casey never telling the truth, the only plea she will take is the Alford plea[IMO]. Or if she does, she will say it was an accident, because she spins one lie after another. The thought of her finally confessing and having her parents hear it from her own lips would be too much for her[IMO]. Also the maggots found in the bag in the trunk can be put in a blender and tested for DNA, ya think?

Ok back to the computer salesman and what he said about the Walmart. I went to the walmart by me and they have automatic doors not ones you have to pull or push open. Anyone here live near this particular Walmart that can see what type of doors they have?
They have both the “manual” and automatic, keep in mind according to his statement Caylee was pushing the door out and leaving.

Post 136 PPirot- So do you think that they can find out if Caylee was drugged by analizing the magots from the trunk of the car? They have them dont they? But the bag was tossed into a dumpster and doesnt that have something to do with chain of custody of the evidence? Couldnt flies other than those from the car have contaminated the trash after it went into the dumpster? Couldnt stuff from the bag have fallen out in the tossing of said bag? Couldnt they have picked up unrelated trash when they went dumpster diving or at least couldnt the defense make such a claim? Sheesh makes my eyes hurt.

There was video segment that showed JT pushing a Walmart door. As Blink notes, the Walmart Stores near me have both types of doors. They have double automatic doors at the front of the store and a single manual push door at a front/side entrance. This side entrance leads from the side parking lot, into a side part of the entry which runs along the front of the store and contains machines to recycle soda cans and bottles, and on into the main entry area. The video clip showed him pushing a single door.

    Blink,

Thanks for all your wonderful work and insight. A thought just came to mind, wondering about the “trash bags.” Cindy had given LE some items from the home and put them in a black trash bag /yellow tie. The bag with the items was put in LE evidence storage. The bag was just like the ones that held Caylee’s remains. After Caylee was found, they discovered they still had that bag. We haven’t heard any results on whether they are from the same batch or box and could definately be linked to the Anthony home. One more link to the chain?
I remember how freaky it was, watching Nancy Grace and they kept showing George taking out the trash with that “Black bag/yellow tie” over and over again. Very damning evidence, no? I know it sent chills down my spine

I believe its possible it will come in as evidence, yes.

I was wondering if on 6/15, CIndy threatened Casey about the stolen money from grandma. She could have Shirley press charges against Casey, then Cindy would have access for grounds to get custody of Caylee. That is the only way I see Cindy having any specific proof of abuse by Casey, Casey can’t take care of Caylee if she was in jail. Maybe this is also when Cindy told Casey she was a spiteful b, for taking the money again! or she could have ben called a spiteful b when she wouldn’t let Cindy celebrate 4th of July with Caylee… or when she wouldn’t take Cindy to Caylee prompting the 911 calls….. way too many spiteful b moments!

PamTX, yep, the medical examiner in the autopsy report says the remains were in black trash bags with yellow handles (6444 http://www.docstoc.com/docs/7501718/Casey-Anthony-Caylee-Anthony-examination-autopsy, and 3377 http://www.wftv.com/_blank/18740699/detail.html—-page 3379, they collected black trash bags with yellow handles from the Ant’s house too; also see item 39 here “Q75″ on page 3591 http://www.wftv.com/_blank/18740700/detail.html)

Basically, the Ants had both kinds of bags (red and yellow handled).

PamTx, if you look at pic 13 in the slideshow you sent, i think the middle of those three black bags on the upper shelf might have red handles peeking out. I wonder if the laundry bag was in that one…!
