Who thought this was a good idea on behalf of THE BAEZ LAW FIRM?

Who raised their hand at the weekly status update and said:

“I’m sick of this crapp-ass coffee, I make $300 bucks an hour.

That is nothing compared to the caught-on-camera cluster that took place during yesterdays  hearing to declare accused murderer Casey Anthony indigent for costs.

 Andrea Lyon, lead counsel and chronic look-of-woehaver, feels approximately $70Geeze of her “charity’s” money has been spent on this case. (Edited to add, methinks she is subtracting $22Geeze, read on)

The Center For Justice In Capital Cases 

SHUT THE DOOR. This is no charity, except perhaps to Lyon as she is a paid staff member, serving as it’s director.

It is a certification study class at DePaul, run by Lyon and paid by the defense PI Morty. 

Furthermore, as the work product developed in this case supports the curriculum and subsequent GPA of it’s tuitionable students, why the hell would the expenses be allocated to the defense of the case against Casey Anthony instead of DePaul? 

There is no charity attributable to Andrea Lyon although she testifies to fund raising efforts through various charities and corporations, and that those charities are now, “in the hole.” $70Geeze, to be exact.

Is this the part where we here her use of the word charity was a charitable way to say she imposed on her budget as a professor? 

I will say, given her penchant for hardass reporting from her students, how is it possible she has no clue what her books and billable hour are?

There are 14 students working on a death penalty case that are not attorneys, and client attorney privilege would not extend to them as their is no established agency. If I were the National Enquirer I would be finding out which of those undergrads have fat student loans and what kind of access to information they have. Catch My drift?

Todd Macaluso, apparently so sure of Casey’s innocence he gassed up the whirlybird, packed his lucky smoking jacket and signed on to the case.  

Jose Baez testified that Todd Macaluso gifted $70 Geeze to the trust account of Casey Anthony. Operating pro hac vice (visitors pass) as representation with his own retainer agreement with Miss Anthony, Mac has violated the rules of the Florida Bar:

RULE 4-1.8 CONFLICT OF INTEREST; PROHIBITED AND OTHER TRANSACTIONS

(e) Financial Assistance to Client. A lawyer shall not provide financial assistance to a client in connection with pending or contemplated litigation, except that:

(1) a lawyer may advance court costs and expenses of litigation, the repayment of which may be contingent on the outcome of the matter; and

(2) a lawyer representing an indigent client may pay court costs and expenses of litigation on behalf of the client.

 As Casey had access to $275K and was not indigent 10 months ago when Todd Macaluso signed on and paid his apparent entry fee, it would be impossible to defend this “contribution” as legal under Florida law.

The Approving Bogs for Children company has paid out $200 Geeze.

“In August 2008, we licensed exclusive rights to an extensive library of photos and home videos for use by our broadcast platforms, affiliates and international partners. No use of the material was tied to any interview.”

..”The deal was done with an attorney representing several owners of copyrighted content,  ABC News spokeswoman Cathie Levine said. That attorney is Baez, she added..”

Really, not tied to any interview? When did those images and videos debut on GMA exactly? Who was on that program when they were shown?

I am quite certain I heard Jose Baez say in sworn testimony that he retained Tim Chinaris, former head of Florida Bar ethical committee to field such inquiries and all were turned down. He added that such agreements would not be ethical.  Maybe he thinks ethical is transposable with visible.

Several owners of content means multiple people were paid for this “extensive library”. If ABC is claiming that Baez brokered this transaction for all then we have an even bigger problem as he was simultaneously representing the interests of all parties at the time. The agreement that was reached between the parties is critical to understanding the income status of Casey Anthony and her attorneys. Judge Strickland may very well just deny the indigency application and alls well that ends well that these barristers will have to buck up on their own.

That is, until John Morgan gets wind. We will see a copy of the ABC contract in the civil case against Casey Anthony on behalf of Zenaida Gonzalez, fo shcizz.  He danced 2 jigs yesterday. There were witnesses.

Without question, Mr. Baez should be REQUIRED to produce this agreement in response to proof their is no recurring revenue or subsequent earnings to his client based on the structure of the agreement. It is not uncommon for such agreements to include royalty clauses, which would mean that someone is getting paid every time a photo or image from that collection is used. 

ABC newsroom laid off 1/3 of it’s news staff earlier this month. Nice.

Billable Hours

Perhaps the *thud* moment for me yesterday was when Mr. Baez admitted in open court that he does not track his billable hours on this case.

Apparently, the reaction is sticking with me.

Under the rules of the Florida Bar, there is a very stringent set of requirements when determining reasonable fees for clients.

Short Version:

RULE 4-1.5 FEES AND COSTS FOR LEGAL SERVICES

(b) Factors to Be Considered in Determining Reasonable Fees and Costs.

(1) Factors to be considered as guides in determining a reasonable fee include:

(A) the time and labor required, the novelty, complexity, and difficulty of the questions involved, and the skill requisite to perform the legal service properly.

How can you bill someone $90Geeze, and have no idea how you got there, or whether or not such activities are reasonable to the client and or case?

Judge Strickland ruled that by end of business today the defense team needed to provide a full accounting of requested trust account disbursements.

I am thinking they will take the rejection of her indigency status before another trip to the dunk tank, but that’s just me. 

 Can you imagine the car ride home with Cheney Mason?

  7. Blink, I’m with you on the fact that this Mason dude will not be able to get Casey off on murder charges. there is just too much there, that even he cannot make go away. I have the utmost faith in the SA and they will prevail. it just seems that the wind went out of so many sails when this man was bullying and being disrespectful to the court and the judge. and as for Casey selling Caylee’s short life, every time I see her sitting there in court smiling, she makes me want to throw up in her mouth. she was so giddy and full of herself in court the other day. she acted as if she was an attorney sitting there with the pen and legal pad, and pushing the button on the mic. she is going down and the judge of us all is going to see to it that she does. I will be so happy when they cuff both her and George. and Brad Conway should be Cuffed and charged to. can some one please tell me why he is always at Casey’s hearings? he must not have any other clients.

Blink, are you saying to comment#12 above that, what Casey wrote in her letters to her former jail inmate contains something about George and Cindy being directly involved in a criminal way (which they were) in this case. maybe she mentioned that they knew that Caylee was deceased all along and that they helped cover up and lie for her? If that is what you are saying, I had a feeling every since the letters were found out that she was throwing them under the little short bus.

    I am not commenting at all about the content of the letters, or how they were passed back and forth, or who facilitated it, over what I already have.

    You’re probably right but Cindy doesn’t need to explain herself to anyone. If it supports their cause, then it’s a justifiable term.

    It would be nice to foresee a gaggle of charges in the future for George and Cindy, most definitely. Clearly they’ve obstructed and threatened always thinking they’re above the law. They knew Caylee was not a missing child. That is bar none the most unforgiveable. I believe Baez knows, but when he learned of it, I’m not sure. As for Conway, I can’t imagine his career rising above this gong show. He should have pulled a Mark Nejames and bolted.

    Yes- In a round about way he did. He also threw in a punch when he was introduced about why he joined the defense- something along the lines of the injustice being done to Casey. I can’t remember exactly but it is there in the beginning of the hearing.
    I would also like to add that a lot of people (from different sites and the media) think Casey is calm and collected, but I think when she is constantly rubbing her hands, hair and eyebrows it screams “I am scared out of my mind”.

    Michelle Bart called into the show at around 51:52.

    She said to Clarify question, Casey was hired by Baez, G Rivera promised to give $ to Baez to pay for private investigators. She said that the Milsteads witnessed the contract between the Anthonys and D Casey….THEN SAYS that Casey never was never hired by the Anthonys.

    She didn’t say whether Baez rec’d that money or not. Apparently D Casey never re’cd that money and went to work for the Anthonys instead.

    How can she say he never worked for the Anthony’s?? I have seen the contract, minus the contingency portion, and Dom Casey has testified to working for them, Baez, and Casey Anthony simultaneously.

    Diana Tennis objected to his testimony on the vary basis of confidentiality ( no standing in criminal law, but whatever) to the Anthonys.

    She seemed to be talking out of both sides of her mouth. I think that the Anthonys must be worried that Dom flipped. She said Dom was hired to find a “live Caylee” That she never would have hired him. Then how do you explain the woods search as well as the dirt digging emails?

    Not really sure if she got aid, she said something to the effect that she got involved out of the goodness of her heart….

    Is Geraldo the NY link between Padilla and Baez? Aside from his slimy Fox show, does he have a development co, or anything? This whole case stinks to high heaven with all of the different networks and media people enmeshed in this.

It has me thinking that perhaps the licensing deal may have included ABC getting the rights to sell those images for use on other stations, perhaps….like a dual copyright of sorts.

Next she spent copious hours in Baez’ office selecting those photos.Then she and Baez stated that the murder case was going to court. All this before she was charged with murder.What!

    In my opinion, the great thing about having Mason on board is that he will care less about Cindy & George. Mr. Mason has not been involved in the scamming deals that Baez & the Anthonys made. He will think nothing about throwing the Anthonys under the bus if it helps his client.

    Then wouldn’t Jose’ be in a MAJOR conflict of interest???
    Furthermore, in late July -mid-August …if they’re trying to hawk pictures of Caylee…isn’t this predicated on a dead Caylee?? Who is going to buy pictures for mega-dollars for just a missing child??

    2) Furthermore – I do not believe that $275,000 was all that they brought in….Even if in later interview deals or….even for Baez …a future TV show. Do NOT insult our collective intelligence by saying “we only got $275K …and it’s all gone.”

    3) In the jail house visitation tapes (which are a treasure-trove of veiled comments and secret messages), Casey tells Cindy: “opportunities were presented [for me to get out of jail] and they were not acted upon” – or words to that effect. And Cindy stated “I don’t know where you are getting your information from …but we don’t have that type of money” and Casey very coldly responded “Never mind”. ..maybe Cindy and George deferred some payments …thus keeping Casey behind bars.

    4) If Duh-fense DOESN’T object to the release of the jailhouse letters ….than – IMHO – that means that the letters trash talk Cindy and George – which opens up the Duh-fense’s strategy of:
    “Ladies and Gentlemen of the Jury – How can you expect my client to be normal when she grew up in Cindy’s BIZARRO world?? She was programmed from infancy in destuctive behavior …and there wre never any lies in Casey’s world ..only half-truths. We will nwver know what happened because Casey was defectively wired by her deranged Mother. Ask yourself this question: How would you have turned out if Cindy Anthony were your Mother!!??”

    IMO there is definitely something hinky about that $70,000 X 2. I can’t believe that Todd Mac just up and donated $70,000 to the defense. Sounds illegal and completely illogical. Ya know that he knows she’s guilty — why would he just give away the $70 G’s? Nope, I agree with whoever suggested that he was a conduit for that money, that it originally came from somewhere else, perhaps the media.

    And why would a Illinois university charitable fund donate $$$$$ to help defend a person in Florida who wasn’t even declared indigent at that point? Doesn’t add up, doesn’t made sense.

If Dominic Case was hired by Jose, who hired their Public Relations Mgr. & paid $10,000 for scheduling Broadcasting appearances and press conference, Jose? As for $5,000.     I noticed, whether or not she has emotional or mental problems, when she is caught in something not completely honest, or nonsensical, she goes out of her way to spin a tale. “I didn’t want to bother you guys”, in response to not handing CD evidence to the state, but providing it to Baez instead. She says that the person at Best Buy would be lying, if that person said that she requested items to be deleted so that the police couldn’t see it.
