Caylee/Casey Anthony Case: Is Jose Baez Out or Just Vacay?

Orlando, FL– Following a Thursday afternoon request for a status meeting request by newly self-appointed-by-way-of recusal, Chief Judge Belvin Perry, Jose Baez filed a notice of unavailability to the 9th Circuit court.

In fact, he filed notices of unavailability in every case he has on the docket.

Unconfirmed rumors are swirling in abundance today that the Florida Bar Association has finally decided to intervene.

In a conversation with a representative with the FBA this afternoon, blinkoncrime.com was able to learn that if there is a newly filed complaint against Mr. Baez, they would not be able to confirm or deny that information publicly until such time as it reached a “probable cause for investigation status.”  

This comes on the heels of former Anthony defense attorney Todd Macaluso’s REMOVAL from the California Bar, effective today.

It is also noteworthy that recent follow up motions by the defense that were sent to a media outlet in error, prior to their filing, have in fact, not been filed with the court to date.

Did J. Cheney Mason due his diligence and discover discovery he was not aware of?

Did the long alleged dissention in the ranks result in Jose Baez leaving the practice of law?

UPDATE:

Late this afternoon, blinkoncrime.com was able to confirm Jose Baez WILL be in attendance this Friday for the management hearing, but will be unavailable for 11 days in June.

Apparently someone has given him the heads up that saying you don’t keep track of your billable hours and then billing clients when your not actually is available is a no no.

    Nancy, problem is that under oath, Mr. Baez, an officer of the court, would be lying to the court if that were not true or ‘technically’ true. There is something hinky about this 70 grand ‘donation’ because there is no reason a lawyer is going to give 70 grand to a client– what did Todd Macaluso think he was going to get in return? Just a boost into the criminal defense world in one fell swoop with this big high profile case being run by a rank novice lead attorney with 3 years experience???

    Blink, I don’t have my doc outline of details on this computer, but just a quick check on the mystery hair from WKMG for now, it was my understanding that bits of plastic, the Gatorade bottle, Disney balloon, etc. were in a bag found at the dump site, and the contents emptied onto the paper, hair discovered thereafter on the paper –

    “Crime scene investigators placed the items from the bag on a piece of brown paper to take a photo, and the 5-inch-long strand of human hair was later discovered on the paper, the documents show.”

    What REALLY happened in Mr. NeJame’s office with the Mason and Baez visit? Media showed up, they left, now TES is making a move.

    Were the records not there? That could be one explanation if these two lawyers did not call ahead to have the boxes retrieved for their visit? The docs WERE in off-site storage during time Adam Longo was allowed to view the already publicly available 32 searchers records, so could they still have been in this off-site location when the two lawyers showed up? This would allow the defense to say ‘we tried, did what we were told to do and still no access’? That could be the plan– show up without an appointment knowing the docs would be in storage– foregone conclusion to add to their arguments to convince the judge that Mr. NeJame didn’t come through with his side.

    If that is what game was afoot, it was Cheney’s call that they ignore the media because Baez could hardly keep himself quiet with the media right there, for another blame game ‘we came, we asked, we didn’t get access’ moment. Strategic, media was there (how would they know to be there at that moment??– someone had to tip them and it would not be Mr. NeJame– it would come from the defense). Media saw the lawyers in the office, can report they left quickly for some strange reason.

    Wait until Friday afternoon, the media footage of that will show up on the news and web with the story of how the defense tried to do what was asked and how TES and its lawyer are bad guys who won’t let them see the documents. Betcha– a set up, game play– ‘no one told us we needed an appointment’.

    AJ, I don’t even know what you’re talking about. All Blink did yesterday was report the facts and add her confirmation when she got it. She wasn’t trying to pass off anything extra as fact.     If anyone “started an internet rumour” it would be me. I took the piece, added my own questions and then posted on another blog (with a link to here). None of us have all the facts yet but aren’t we allowed to guess as to what’s going on? I always thought that was a big part of blogging ~ to discuss, question, theorize . . . non?

    As far as saying that all bloggers “see and smell is blood, blood, blood?” YIKES!!! I’d find better blogs. I don’t get that from this one. I actually only see that in the Defense and the media.

From what I have read and understood Mr. Morgan had Baez listed. That he was to be questioned about Zenadia Gonzales. How will this affect the civil trail? Please respond.

    Mom and I returned from my x husbands funeral!
    sadly to say at every funeral there is major drama and thus forth I have been disowned because they are all fighting for his money. My elderly mother had to be taken aboard by wheelchair with 70% blockage to her heart ! she should of been in the hospital but loved my x s much she insisted on going. we were so disrespected! and verbaly attacked now I may even loose mother because she is not doing well.
    I am sorry to get off the topic I just wanted to vent my sadness and broken heart to the friends I have made here. please keep us in your prayers especialy my mother.

    A bloody mess was reported early Monday at Haleigh Bug Headquarters.

    A Putnam County Fire Rescue ambulance picked up an unknown subject who had been bleeding from the face at about 1a.m. Monday, April 27, 2009 at the Haleigh Bug Headquarters on South US 17 in Satsuma, FL, the agency confirmed this morning.

    Due to HIPPA laws, the identity of the subject was not released.

    Witnesses tell WSKY that a hatchet was also found inside the Haleigh Bug building.

    WSKY cannot confirm witness claims as to why the hatchet was out in plain sight inside the small Haleigh Bug building or for what possible purpose the hatchet may have been used.

    Peggy, Adam Longo did NOT search the records, he saw NOTHING that was not already PUBLIC RECORD– that is, the 32 searchers information that was given to the defense already.

    Mr. NeJame had those 32 records ONLY in his office, as they were being accused of withholding information, Mr. NeJame wanted to make it perfectly clear that they were not. Everything they had was given to the defense as ordered by the judge– the records of the 32 people who were anywhere near where the body was found.

    Mr. Longo, as a member of the media, was allowed to view the 32 searchers records but NOT make notes, NOT take photographs, video or any other record, nor was he allowed to share any information from those records– the sole purpose was to allow an understanding of the type of information that was collected in those records.

    To be absolutely sure that NO record was possibly claimed to have been seen by Mr. Longo that was not already allowed in discovery, Mr. NeJame arranged for the other records to be stored in a facility some 20 miles away from his office, so that there could be no confusion, no accusations.

    Peggy, the orders of the judge are being followed, nothing is being leaked. The defense has a reasonable right to view and investigate appropriate records, but not thousands of searchers who were nowhere near the area the body was found. Their privacy has been protected by the judge.

    All this is in the court records and recorded in the motions written on behalf of TES by Mr. NeJame, and orders by Judge Strickland.

    Why should the public now say gosh, let everyone have at those records because of what the defense is putting out to the public, forget the judge’s decisions?

    Let’s see, he HAS only done a handful of depositions, has only read approx. 8 pages of the 4000 TES documents, and has, by all appearances, brokered media deals and sucked up to Geraldo.

    He HASN’T kept track of his billable hours, hasn’t apparently fully kept track of monies received and from whom, hasn’t bothered to keep track of his paperwork (drops them from his binder when flustered in court) or made copies for the other attorneys in hearings (unlike Mark Nejames), and certainly hasn’t bothered to turn over his mythical “evidence” that SODDI.

    June 1 – June 11? Has anyone checked the cruise ship manifests? Maybe Baez is taking a cruise with George and Cindy?

    I think I can answer that for you…I’m not gonna go dig for the link but in a phone call to Lee from Casey in jail to home or on of his visits states that while waiting to be processed/booked/held for transport into jail she was asking other women if they knew of a lawyer and Baez’ name given to her. Quite innocently I believe. Whoda thunk of the outcome?

    melissab, the story of how Casey got Baez was a question asked by investigators of George Anthony in his early LE interview. George thought it was someone in booking, that is, an OSCO staff person. The investigator told George that was against all rules, they can not refer lawyers, it is not allowed.

    So another Casey story– how would Casey have access to talk to some other people being booked? Not likely.

    But we know now that jail personel do help lawyers cards get into hands of inmates as Baez’s card was given to Robyn so Robyn could talk to a new lawyer. What a crock– Robyn having Casey’s letters, now Baez would have loved to be in a position to talk to her. Talk about conflict of interest. This is the same jail employee who helped pass the letters from Baez’s client to Robyn.

    Did Hernandez tell Baez about his client’s letter writing? Was this some inept scheme that included Baez? Not likely.

    But jail personel do help inmates get lawyer’s business cards– maybe Hispanic lawyers. (Why just get Baez’s card, why not give Robyn other lawyer’s cards as they visit inmates too).

    That seems to be his experience trying cases under Judge Perry in Orange county criminal court, at least.

    Lots of working out deals for this client. But Mason has a lot of defense experience with defending acts against children, so he won’t falter when the abuse issues come up in trial.

    Interestingly enough, this isn’t the first time Casey has made this claim. She also told Ricardo Morales she used baby medicine to put Caylee to sleep.

    Also, the so called rotten pizza box theory attracting magnets…. According to test results, they didn’t find any traces of pizza or meat. They did find a broken pizza box in the garbage. Can it be determined maggots were indeed the result of a decomposing body in the trunk? If it wasn’t Caylee in that trunk, then who else could it have been??????

    These documents are a good refresher.

    To the maggots, what do they reveal about DNA? What do they reveal about residual drugs in their system?

    If the maggots reveal DNA, the maggots were only in the trunk, they could provide the definitive link for the confirmation of a body in the trunk and its identity. No need to argue over junk science or mytochondrial dna doubt possibilities.

    Kleat, I would never have thought that maggots (almost typed magnets again) could contain DNA from a decomposing body. I’m re-reading a lot of these docs. The fact that Casey told Amy her car smelled like a dead body…er….squirrel is huge to me. HOW ON EARTH could she continue driving that car with that stench? I would have taken my car right to a garage and had it inspected for a dead animal. What a wild statement to make in the first place! I just can’t comprehend how she was contently going on with her life and expecting no one would notice Caylee was missing. Is she that delusional to think she could go a lifetime giving excuses to Caylee’s absence while living the high life? She was setting up her father for Caylee’s disappearance/murder….but yet, that still wouldn’t have worked in her favour. The partying. The tattoo. Not reporting her missing. For every action, there is an equal and opposite reaction.

    It is too presumptuous to think this was pre mediated? Can the duct tape over Caylee’s mouth implicate premediation?

    Mason may be comfortable explaining away child abuse but these circumstances are far from ordinary. He hasn’t defended anyone like Casey.
    Mason needs a trick bag full of magic and miracles. Too much in this case needs ‘splainin. How can he cover every detail and make it work for Casey? If Casey isn’t talking and/or changing her stories, then Mason’s prepared to lie in the court of law for her?

    I hope he’s giving her a reality check and introducing the idea of pleaing to Casey. Still, he has his work cut out. Casey LOVES to believe she may have committed the perfect murder but she’s too narcassistic to plea. She probably would rather die believing she was a martyr than tell the truth.

    Do we know for sure that Friday’s “hearing” will be live streamed from the courthouse? I read on HD that the judge called for a management “conference”. Is there a difference between a hearing and a conference? Don’t want to get to the office to watch a half hour early if I don’t have to! lol TIA

    btw, that request to withdraw was filed LATE. The lawyer was to notify the prosecution and the Judge no later than 26th! Judge Perry is a stickler for late trains. Also, Macaluso argues that Casey is in good hands etc as if he has to ask permission to be allowed to withdraw. The judge can not require that Macaluso stay on because Macaulso is not allowed to practice law and he must comply with the court for his state bar.

    Will this late filing be noticed by the California Bar and the requirements that all correspondence be copied to them, in Macaluso’s proof that he has complied with all directives, including this one? Yep.

    Isn’t Baez suppose to be called to the stand in Morgan’s civil case against Casey? I believe that she will plea guilty in that one, too. I can’t see her attorneys letting that go to trial because too much info., that could be used against her in her murder trial, could be leaked. Also, do we know yet if George really did have an affair with River???

    Hey! I just read this request and it lists Baez as lead and I get so mad when these attorneys do this crap! Baez CANNOT be listed as lead councel in a DP case! How many times do I need to tell them this?!… lol sorry I just get sooooo mad and I know I shouldnt as it gives them pleasure.
