Caylee/Casey Anthony Case: Fingerprint On The Trunk, New Discovery Released, More Motions By the Defense

Orlando, FL– Yesterday, the defense team of Jose Baez, J. Cheney Mason and Andrea Lyon filed a motion to strike the Statement of Particulars including aggravating factors claiming that is does not list the States “facts” to support them. Team Baez is claiming that “may rely” does not meet the burden of the Steele citation used to compel the order from Judge Perry in the last hearing.

In essence they would like state to kindly hand over their theories and work product, if you please-

Also filed by the defense, this time including Linda Kenney Baden, is a 49 page motion with exhibits for discovery from the Oak Ridge Laboratory otherwise known as The Body Farm.

It is within this motion, we learn something very new, and very critical to this case.

THERE IS A FRAGMENT OF A LATENT PRINT ON THE EXTERIOR TRUNK OF CASEY’S CAR.

According to Baden’s supplemental request, there are 18 latent fingerprint lifts, 8 areas of latent lifts developed via dye stain and one fragmented lift from the trunk. Wonder who they will belong to?

This morning, the State is releasing an additional 500 pages of discovery in the murder case against Casey Anthony.

    Baez was texting furiously on his cellphone when Mason was telling the Judge that Casey could have killed Caylee … but if somebody else moved the body that opens a “huge door of reasonable doubt” …. and they want the illegally recorded Joe Jordan tape. Motion was DENIED.

    I believe Mason exposed the Defense strategy – they want to throw “somebody” in, to confuse the jury and make the jury think that “somebody” else was “helping Casey” and moved the body …. which would cause the jury to think that if somebody else was involved …. maybe Casey is not the one who killed “the child”. It gives the Defense a chance to create confusion about multiple parties involved in Caylee’s death and movement of her corpse = REASONABLE DOUBT = possible hung jury or acquittal.

    Joe J. was interviewed by the Defense investigator Mort Smith. Joe J., his own attorney Kelly Sims and Mort Smith were all 3 present – JJ illegally recorded the interview, without the other 2 men knowing about it.
    JJ later told the detectives that he had recorded this interview for his own protection. Detectives informed JJ that what he did was illegal.
    JJ had said in this interview (allegedly) that he had searched the area where Caylee was found, and the remains were NOT THERE, and the area was NOT under water.
    JJ later changed his story, when he realized that he had been confused and he had NOT searched the exact area where Caylee’s remains were found.
    JJ had also sent an email to detectives saying he had searched and remains not there.
    The Defense DESPERATELY wants the jury to hear JJ’s original story which is on tape (illegally), saying that he searched the exact area and Caylee was not there. The Defense is now trying to say that Prosecutors scared JJ by telling him what he did was a crime, so JJ was coerced into changing his story.
    We have to remember that Baez had said that JJ would appear to testify at one of the previous Hearings, but JJ never showed.

    Thinker, when did Jordan say he searched? If Caylee hadn’t been found up to that point, why take the chance of being seen? Why not leave little Caylee,some where else. It doesn’t seem to help Casey to put her in that swamp so close to home.

    Or are they trying to say she was still alive at this point?

    Can Casey’s lawyers ask for a plea?- or does one have to be offered to them?

    I have posted a few times but I am always lurking and reading all of the wonderful post’s. And I must give all of you regular poster’s a round of applause for all of your time and effort that you have put into understanding what the due process of this case. And helping others to understand what is going on.
    My question is has anyone notice that their was no mention of George being at yesterdays hearing and we all know he was not at the last one. So what do the great Blink minds think?

    How can parents NOT visit their inmate child after hearing (and watching on video) that she took a hard fall and busted her mouth? What mother does not want to see her child’s face and let her know that she cares and sorry that she got hurt???? What mother allows a Defense attorney to forbid her to see her child? Especially a mother who was described as a “rabid Doberman on a lunge line”???

    I may be mistaken, but the only ones who can deny the visit would be either the facility itself (which in this case would not happen) or the inmate may refuse the visit.
    IMO the ants don’t go to visit because they don’t want to be refused by their murdering daughter.

    I went looking to see exactly where in the video of the Hearing, the foxorlando freeze frame photo of Cindy making that face was captured, and to see what was happening (being said in Court) before Cindy makes that face, and after.

    The attorneys have been called to sidebar, so Mason can tell the Judge why they need to have the jail visitor logs sealed, to protect the identity of one of their experts.

    Cindy alternates looking toward the group in the sidebar (Mason, Baez, the jail attorney and court reporter)and the guards sitting at the table near the sidebar, then over to the Prosecutors who are in a huddle.

    At 8:49, A female guard goes over to the 2 male guards sitting at the table near the sidebar and tells them something. Cindy appears to be watching that when Cindy does a lot of quirky facial movements. Cindy puts her tongue out to the side of her mouth (9:01), and purses her lips together (9:02), and moves her mouth all around …. it is odd indeed.

    Cindy makes the (foxorlando) bug eyed scarey face at (9:04), while looking in the direction of the group in the sidebar and the guards at the table.

    (9:35 and 9:45) shows the prosecutors in a huddle, who Cindy had been looking at earlier. The prosecutors did not have to be in the sidebar – only the jail attorney was in the sidebar with the defense.

    (8:49) shows the female guard going over to the 2 male guards at the table near the sidebar and bending down to tell them something.

    I was pondering sealed evidence…. On Februry 26,2010 Nancy Grace was talking on her show about a motion that Judge Strickland had issued that was sealed.
    Here is a quote:

    “My question is, it`s often deemed unconstitutional to withhold evidence from the defense. Now, clearly, we`re not about to rush into the courtroom for trial. This thing is going to be delayed. It`s a death penalty case, not that that`s really an excuse. But I`ve the motion right here in my hands about evidence that is so damning that the trial judge has allowed it to be kept secret even from tot mom`s defense team. Have you ever heard of that?”

    My question Blink is: Is this still sealed, or has it been revealed to the defense? Based on the answer to this question, when will it be released to the public, and/or will the jury be able to see this evidence, or will it be too prejudicial?

    If memory serves Mom, that motion was denied to the State, and they had to turn it over, after giving a set period of time, iirc.

    Evidence deemed to be too prejudicial to the defendant, is never grounds for the State to withhold it from the defense. It has been and can be withheld from the public- there are many exclusions to the sunshine law we have discussed here before.

    I just want to take an editorial moment, on Mom 3.0′s dime, because I know she won’t mind, to address something I heard on the radio today.

    On a Sirius program, which I am not promoting the name of, I heard a parody song sing to the tune of Fergie/Black Eyed Peas “Lady Lumps”. It was sung by “Casey” with regard to “Caylee” in the trunk, and going over bumps or some crap.

    It broke my heart. B R O K E it. The Dj excused the playing of it because he felt there were Casey sympathizers that were concerned over her fall in the elevator.

    That is utter BS. How anyone can think a murdered decomposing baby in the back of a trunk is fodder for a song parody is demented.

    Thank you Blink. I did some research last night, and think I found exactly what this motion was referring to, it was the jail house letters from both inmates that had interacted with Casey. The judge granted it for thirty days, I believe, until the state could investigate.

    I am sickened by that parody Blink. First, let me say that I am basing my comments on your words, as I have not heard it.

    I realize some people’s tastes are different, and that often times people make light of things that actually bother them, but I can not imagine an instance where this would not be gross and over the top.

    For me, it is not about making fun of Casey, but demoralizing that poor innocent baby girl. What is wrong with people? Someone, actually sat and rewrote those words, thinking about what happened to Caylee at the hands of her mother. Not funny, ever.

    What makes it even worse IMO, is that Casey herself would probably find something like this funny- as I was reading your comment, I pictured Casey laughing with Tracy about the hair with the death band being found in the trunk, proving that someone was dead(Casey or Caylee) and Casey jokingly laughed and retorted– Well I’m alive!!

    With all the news of Joran Van der Sloot and now, Drew Petersen, does anyone think that we will see Baez & the Anthonys coming out of the woodwork to try to get as much media attention as they can? I mean, you know that probably these new stories are going to take the limelight off of Casey’s case for quite a while. Baez & the Anthonys will not be able to stand that, IMO. What do ya’ll think?

    I have to disagree with those saying Casey does not want a plea. I think her defense team will work as hard as they can and “hope and pray” the prosecution “offers” them something.

    The defamation lawsuit (Zenaida) against Casey Anthony will likely go to trial in the early part of next year, a civil judge announced during a brief hearing.

    The civil trial was initially set for June. However, Anthony’s civil attorney, Jonathan Kasen, who was not at today’s hearing, and Gonzalez lawyers wanted more time to prepare and requested the trial be postponed.

    Orange Circuit Court Judge Jose R. Rodriguez agreed — but warned them the earliest date he could offer is sometime next year.

    The trial had been scheduled for June 14, but because of things not being completed, rulings still awaiting decisions and more information to review, both parties said they would not be ready for the June date.

    RE: Casey’s “monkey joke” – Casey had this “I like Monkeys” document while she was in jail. It is dated January 10, 2009. It was released in the document release that had all of Casey’s letters to fellow inmate Robyn (“cookie”). It is a one page, typed “story” about someone buying 200 monkeys and the monkeys all die and the difficulty in getting rid of the smelling, dead monkeys. It IS quite disturbing, in light of how Caylee died and how her decomposing body was disposed of.

    My question is … WHERE did Casey get a copy of this “story” which has been circulating on the internet since at least 1995?
    Apparently, many people on the world wide web find this “story” quite funny. I am interested in understanding why Casey, in particular, found it funny?
    I would like to know if Casey sent it to Robyn? Or Robyn gave it to Casey?
    WHO gave it to Casey? Who had access to the internet website where this story is posted? Who copied it and thought Casey would enjoy it, and gave it to her?

    Reading these letters, I am really disturbed by Casey’s nonchalant attitude about prison. I’d wouldn’t be writing about my new sturdy contraband pen or how the guys find it comical when I try to sign my name with handcuffs on. We’re calling them the guys these days, are we? I doubt I’ll got further with these letters. If there’s an emotion beyond hate, I’ll find it where Casey is concerned.

    I don’t know what the defense is thinking- but if they tried to use that monkey joke to show Casey was crazy- IMO they failed- It only showed her callousness and lack of concern over what decomposition must have happened to her baby girl-

    FTLOG, her baby girl was found skeletonized, in trash bags, scattered by wild animals, and she can find the humor in the smell of death and decomposition, even after her Mom said: it smells like there’s been a dead body in the damn car?

    It is my understanding that they can’t switch gears and go for the crazy defense now- but I am not sure.

    Can any one help us out- Thinker?
