Kyron Horman Missing and Endangered Sources: Terri Horman Arrest Is Imminent

Portland, OR– Late this evening, blinkoncrime.com has learned from a source close to Terri Horman that she expects to be arrested at anytime on possible charges related to endangering the welfare of a child.

It is not known if those charges are related to the disappearance of her 7 year old step-son Kyron Horman, or her daughter, Kiara Horman, 18 months.

Following the filing of the and restraining order by Kaine Horman, Terri’s estranged husband and Kyron and Kiara’s Father, the restraining order was subsequently sealed by the court on Monday.

However, under Oregon law, for primary custody to be awarded without mutual agreement in this phase, an emergency ex-parte order must be filed. That requires a fairly heavy burden in the immediate threat area.

This is all adding up to a very sad conclusion for me, folks.

First, we’ve got The Family Statement (minus Terri) released Monday:

“We have been fully briefed by law enforcement on the on-going criminal investigation.

We are in complete support of that investigation. We have asked the Multnomah County Sheriff’s Office to facilitate releasing this statement for us due to their access to the media/flash news.

We understand that we have free access to the media but are limiting statements to the media to keep the integrity of the investigation intact.

Any actions taken by the investigation, or by us, are based on the best interests of Kyron and Kiara and comply with the law. Beyond this, we have no comment on the matter.”

Got to say… I’ve had a baaaaad feeling ever since the term “criminal investigation” was used following the initial groundswell of search efforts. To me, that says, while short a body, it has been determined a crime was committed and, as such, resources were shifted from recovery/rescue to collecting evidence for beyond-a-reasonable-doubt identification of the suspected offender and his/her eventual prosecution/conviction for the crime.

In other (read: fewer) words, the emphasis is on criminal responsibility now. That likely means there is reason to believe Kyron is no longer expected to be found alive, and it’s time to enforce the law against the person(s) responsible for his death – even if, in Terri’s case, she only suspected of being guilty of endangering his welfare. (Though, as opposed to many astute thinkers here, I believe she – and she alone – is directly behind his death.)

As far as the seemingly dragged-out nature of the case, there is, of course, something to be said for the old trope: A watched pot never boils.

But, more to the reality of the situation, detectives assigned to this investigation have to abide by the consitutionally guaranteed rights of the accused throughout its course – that’s why we have not seen an arrest yet, imo. I think (as B has noted repeatedly) they are building a case here that can be prosecuted based on someone’s *intent* to do harm. (And the specific question in this instance is: Who had the means, will and way to intentionally harm little Kyron?)

I also agree with B and other posters on this thread that the procedurals in the case – and its seeming veil of secrecy – totally reflect the Susan Smith situation: i.e., *dual* investigations, with one out in the open and the other hush-hush until the “shocking” arrest was made.

To wit, there was the “public” investigation in the wake of a desperate, sobbing mother’s police report and pleading press conference – here, LE searched for Smith’s allegedly “carjacked” young boys and the alleged kidnapper; the other was “secret,” wherein Smith herself was the focus. While these separate probes were being conducted, LE couldn’t be truly certain which one would be successful, but ultimately they were able to get a confession out of Smith by confronting her with the evidence uncovered during their under-the-radar investigation.

I’s with B – I think we’re about to see that happen here.
This was further underscored on June 26 by Kaine getting Kiara, a powerhouse family attorney, and the F outta Dodge. The fact that he was able to successfully obtain emergency legal custody (without Terri present at the hearing) through Oregon’s FAPA law shows he was able to show the judge that Terri’s ability to access him and Kiara put his child in immediate physical danger.

5 years ago I took care of Kyron at a daycare (he was ages 2-3).

I saw his step-mom and talked with her at each drop off. She was very kind, very motherly.

For the past few weeks I kept thinking…they look really familiar, then I realized I knew her during her body building time. She was dedicated to that new hobby and seemed to enjoy it.

Her older son was very well behaved, and was loved by Kyron-I don’t recall feeling any concern at all. He helped read to Kyron on the rough drop off days. Not one thing in my mind raises a red flag about her behavior then to what is going on now.

But, that is what’s scary- it’s usually someone you just would never have suspected. It’s heart breaking to think about.

As for the dad’s job, my husband works at Intel and it’s a job where you might have manditory meetings all morning but can work from home as well. Depends on exactly what he did. Most engineers are flexible and Intel wants to enable you to work from home if you cannot come into the office for whatever reason. His being home at ‘odd’ times to everyone else could have just been a thing that even our family is used to.

No speculation there. It’s interesting reading everyone’s comments. I’m more of ‘innocent until proven guilty’ not visa versa, but this case is so strange that that’s hard to apply- even having once known this family.

Skyline Parent– Email From Today

We are sending this follow up email because we do not believe that we have received a response from you or your child regarding your and / or their observations on June 4, 2010 at Skyline School. Sometimes we have received partial responses from families, and we just want to make sure that we have all the responses from everyone in your family who was present that day.

We realize it is possible that the reason we haven’t received a response from you could be as simple as the fact that you were not there that day.

At this point, it would be helpful for us to know that as well. A simple reply to this email with your name and the information that you were NOT present can assist us in taking you off of our list requiring follow up.

If you or your child WERE at Skyline on June 4, and you haven’t yet responded, please take a moment now to do so. The questionnaire is attached for your convenience. You can either print it, fill it out, scan and send back OR simply respond in the body of an email. Please remember to include your full name as well as your child’s (or children’s).

According to Terri’s hopelessly “helpful” backwoods publicist, “Terri Moulton Horman was ‘blindsided’ by the divorce papers, according to a close friend.

“A friend of Terri who wished to remain anonymous, told KOIN Local 6 Kyron Horman’s step-mother was caught off guard when she was served divorce papers as well as a restraining order from her husband and Kyron’s father, Kaine Horman.
‘Terri didn’t know she was going to be hit with divorce papers or a restraining order,’ the friend said”

Oooookay. When paired with the gist pieces of the Family Statement (strategically released the day before the divorce “bombshell” got dropped):

This can only add up to one conclusion, the way I see it. Kaine, Desiree and Tony were advised by the Sheriff’s Office last week on Terri’s impending arrest. (And Kaine was likely further advised: Lawyer up. Leave. File. Wait.)

    They were not, but I guarantee it was purchased on contemplation of marriage so it will be a marital asset.

    My theory: the father Kaine was becoming a threat to SM, Kyron and little sister. Maybe he has a temper and is hostile in home. Maybe SM and Dad are vindictive towards one another. I base this on the fact that the Bio Mom filed a restraining order on him when they divorced (true??). If it is to be believed that the SM and Bio Mom are prior friends maybe she thought SM friend would watch over Kyron and protect him from Dad while she was sick and out of country.

    Maybe SM got Kyron out of that environment at home b/c she believed he was in danger. Maybe bio mom mentioned something about regaining custody of Kyron to Bio Dad. The Bio Dad may not want to give up custody/or child support to Bio Mom. Who knows…?

    SM and Dad fight. Furious SM takes Kyron to school with a plan. SM makes alibi with photo of Kyron. Tells Kyron to go around to back/side door and exit school. She picks Kyron up and takes him to “S” island where a friend is waiting to pick up Kyron because no one is around to see hand-off. The friend takes Kyron to safe place. She goes home to wait for husband to arrive from work and to post proof picture on Facebook. SM and Dad go to bus stop. Kyron not on bus. Dad calls school. SM getting revenge on Dad but everything gets out of control. School alerts 911. Before SM can confess to Dad that she was just angry and trying to protect Kyron the police and media are involved. Everything blows up. Too late to say “gotcha” because the SM could risk prosecution for playing “trick” on Dad. So she clams up. I believe (have to) Kyron is safe. The Dad took baby in order to make SM talk.

    It could be that SM found out Bio Dad is mean and her and Bio Mom are in on this to get Kyron in safer situation in the end. Just my theory folks in order to believe child is safe.

    I don’t think Terri is working on cutting any deals at all. I think her lawyer said arrest her or don’t mess with her, she will not be subjected to further interrogation as you have declared her a suspect.

Why won’t he get on the gravy train circuit with Teri and talk about something at least? it is just too quiet with this much going on and where the heck is everyone staying? too wierd this whole thing.

    I really cannot see this for the life of me. Apparently LE advised Kaine to take this action; which means to me, that despite not making info public, they believe Terri to be a threat to Kaine and/or Kiara.

    I know this LE team has come across as perhaps less than competent at times; though that is probably based on the lack of info they are giving. But, I seriously doubt that the police would back an abusive man and advise him to get custody away from his wife, all the while having potentially harmed his own child.

    The only way this explanation could be sold is if the cops are a bunch of misogynistic sexist pigs who have no interest in justice, only in “sticking it to” a “lowly” woman.

    I’m sorry that is just completely unbelievable to me. The police are clearly united with Kaine, Desiree and Tony. They clearly believe the SM Terri to be the guilty party who has at least knowledge of what has happened to Kyron, and possibly is the offending party.

    I’m not sure where these conspiracy theories are coming about in trying to make Kaine (And even Desiree and Tony) the bad guys, and Terri some kind of victim. Does. Not. Compute.

    I understand there are multiple sources that people read; and it does not help that Nancy Grace is perpetuating this fallacy, but it’s really tiring to see it mentioned over and over, about how SM and Desiree were friends, when Desiree herself said that is not true.

    Sorry, hope I don’t sound cranky, I’m just tired of that bit of misinformation being stated over and over.

    I know. It’s hard enough to speculate, based on lack of info in this case, it’s just frustrating for the misinformation that keeps getting back into the mix.

    Where did you see confirmation of this? From what I’ve read, it was still highly questionable. First off, from pics of Kyron’s classroom, it appears book bags and coats are hung on hooks at the back of the class, not left at desks. Also, Tanner is supposedly Kyron’s “desk-mate”, meaning they share something like a table? If that was the case, wouldn’t Tanner recognize that Kyron’s stuff was there all day? Instead he made the comment that the teacher said Kyron was in the bathroom and would probably be back soon. If so, when say a half-hour passed, why didn’t Tanner mention to the teacher? Why did he not notice again that Kyron wasn’t there until the school bus?

    I have to stick with the idea that the teacher believed Kyron was at a dr. appt. and didn’t think anything of the fact that his book bag and coat were there unattended.

    I have to say that the scenario you proposed is very credible. Parents have been known to send their children into hiding to protect them from the other (abusive) parent. Often, they feel it’s the only option because the police do not take their claims of abuse seriously enough. If this was the case in the Horman household, sending James to live with his father was an easy solution. Perhaps Terri felt she could protect Kiara herself, and maybe Kiara was less vulnerable to abuse since she’s still young and cute, and female. But, as for Kyron…

    Wouldn’t it have made more sense, if he was indeed in an abusive environment, for Terri to encourage Desiree to seek full custody of her son? I see no reason why the courts would not award custody to Desiree and Tony, especially with Terri’s support.

    Sorry to put a hole in that theory. It seemed so promising.

    There is no proof that Kyron saw his Mom and step dad more than once a month, which is why I still fill the wording of Desiree statement was odd. She could not physically see him “whenever she wanted”, I still say that statement was written by LE to put distance between Terri and Kyron for someone else’s benefit.

    I would love to interview Tony Young in this case. Somehow I feel he knows everything there is to know in this case.

    The public/media has not had access to many details while the investigation is in progress. But as far at the RO is concerned
    (even with the judge ordering it sealed), Terri & her attorney would have more information than us.

    The RO contains some clues about where the investigation is going AND gives the details/reasons to restrict TH access to her children/step child. It stands to reason that SOMETHING here is connected in a way that would implicate her guilt.

    If the details/reasons for the RO really had no connection to the Missing Child Case, why would it be sealed (siting this very reason)?

    If Terri assumed her freedom was not in jeopardy – because while RO may accuse her of something, she had not implicated in regard to Kyron’s disappearance – I believe she would have lawyered-up with a prominent Family Law Attorney, specialized in Child Custody.

    However, if the RO contains information that would lead her to believe she would be arrested, it would make sense to fight that battle first. Mommy in jail has zero chance of physical custody.

    I am in the camp that Terri knows more than she is willing to share. I believe TH somehow (actions/associations) precipitated this child’s disappearance. Of course, this is only my opinion.

    I agree with ‘heat’s comments. Would like to add that I don’t think Terri or her lawyer will want the RO unsealed either. It can either be unfavorable to Terri as far as public sentiment goes or even if she feels she is protecting Kyron by keeping her mouth shut. I just don’t see it as beneficial to Terri at all by unsealing the RO.

    Since there is no evidence to the contrary, the MCSO believes Kyron is alive.

    So…In the midst of a deteriorating relationship with Kaine,Terri sends Kyron away with someone she knows..she’s just not in a position to talk about the “real” story yet. I do not believe she’s a murderer and I do believe she will talk eventually. In the meantime the case has cost the county $300,000, and thus far no body, no arrest imminent. They have nothing to charge anyone with. Hopefully, since she retained an attorney they will find this is a domestic dispute issue and Kyron will be found alive and safe.

    The plumber/apprentice electrician who says he makes $250,000/year, has an odd myspace page, and looks odd with his odd looking seedy friends. Perhaps Kyron, through knowing Tanner, saw evidence of a criminal enterprise involving some people, not necessarily these people. If a witness was needed to be safe to testify against this enterprise, I do not think that LE would hesitate to move him to a safe house, until after the fact. Or just to be safe in general.

    By criminal enterprise I mean meth lab or something of that ilk.

    Could be the parents are in on the safekeeping of Kyron, and the disappearance is to keep him safe.

    Conversely, it could be that Kyron saw something and was taken because of what he saw.

    Lately LE has said that TH IS,and HAS BEEN cooperating with police fully, as far as they know.” This seems to be a contradiction between the family’s statements “imploring TH to cooperate.”

    The moving out by Kaine, with daughter, seems also to be a contradiction, whereas most families under these circumstances would bond tighter, (at least from what I read.)

    The “looking for a suitcase” on Sauvie Island, news report has not been fully explained by LE, the glasses and clothes being replicas, or actual, has not been explained.

    We do not know if the family is under a threat of sorts, and responding to kidnapper threats, which demanded that Kaine move out.

    Another contradiction is the disinterest by family in having Harry Oakes search, could be that kidnapper demanded searches stop?

    Too many strange things, contradictions, in this story, to make any sense of what is going on.

    I think the perp must know that if he or she comes clean at this point he is in deep doo-doo, and that may be an impediment to ever finding Kyron. Even if TH sent Kyron away because of Kaine being too harsh on Kyron, she should come clean now that attn is focused on story, but she would also be in so much trouble for not revealing this when LE first became involved.

    It seems obvious that Kyron did not just wander off, and it also seems obvious to me that anyone who ‘comes clean’ now is in a whole heap of trouble.

    That may be the impediment to finding Kyron.

    Now this does begin to take a twist in my mind. I believe she loves Kyron and just unhappy in her marriage. Perhaps she felt that Kaine was a poor father, given the way she has seen him interact with her older son. Perhaps she had someone kidnap Kyron for a period of time and planned to join him after divorcing Kaine. She knows that if she were to divorce him, she would have to forfeit Kyron as he is not her biological son…just a thought

    Re: blaming Kaine for Terri’s weight gain and bloated appearance.

    The woman just had a baby 18 months ago, and I think looks much like most other new mothers who have gained weight during their pregnancy.

    Personally, I think there was some intimacy going on between Terri and the Landscaper..maybe he’s married; didn’t want to say anything then Kyron went missing and he decided to talk because of the seriousness of the case.

    I hope you are right that is LE wording not her own, because that bothered me a lot. She should hope that Kyron can see HER whenever he wants, not vice versa. Seems so immature and self-centered, and made me even sadder for the poor boy.

    Maybe it bothered me because I haven’t been able to shake concern about her statement in the first letter that Kyron had saved her life once long ago.

    “Kyron Horman’s stepmother is accused of hiring a hit man to kill her now-estranged husband.
    That’s according to an explosive article in Sunday’s Oregonian newspaper.

    The Oregonian article notes sources who say that as investigators followed leads, they became curious to find out that the stepmother – Terri Moulton Horman – had hired a landscaper six months ago, without telling her husband Kaine Horman about it. When detectives questioned the landscaper, her reportedly told them that Terri Horman had offered him “a large sum of money” to kill Kyron’s father, Kaine.
    The paper also says that shortly after they related that information to Kaine Horman, he moved out with the couple’s daughter and filed for divorce.

    Multnomah County Sheriff Dan Staton Sunday said he had “no comment” directly about the facts in the article, and he was “not sure how the information was obtained”. However, Staton did imply that events could move quickly during the next few days. When asked for a timetable of upcoming developments, he told KOIN Local 6, “I should be able to answer a lot more questions this coming week. I’ve got a lot of decisions this coming week.”

    In my mind, loving a child and wanting to have his father murdered are mutually exclusive. How could she love Kyron and want him to suffer the pain of a murdered father? Poor father doesn’t warrant hit man for hire. Just does not compute, mho.

    Remember, this is just “he says, she says”. There is no corroborating evidence thus far as the public knows. Obviously it was the reason Kaine left the house with his daughter Kiara; filed the RO and Divorce papers. We shall see….

    There have been very few comments here recently. What happened? Did people lose interest in the case or go elsewhere?

    She wanted to have Kaine killed because of an affair. Divorce is a better answer. What does her son know of the living situation?

    It certainly doesn’t not bode well for our Kyron. It would be a miracle if he come out of this alive. I am hoping for a miracle.

    I get lost easily, too, and I’m not used to commenting on blogs, so here’s what I do: go to the main site blinkoncrime.com, and then the most recent posts will have the newest info. There are several hundred comments for each of the posts. I just start at the beginning and read thru all of the comments, knowing I can skim some. Anyway, hope that helps!

    Thank you Jackie. This is a week later and I lost the thread I read last night on the landscaper. It is time consuming to reread all the threads to find the one I am looking for. I don’t understand why they all don’t interlock or come under one name.
