Kyron Horman Missing and Endangered: Kaine Horman Accuses Terri of Contempt With Michael Cook

BREAKING NEWS

Portland, OR– late today, through his attorney, Kaine Horman filed contempt of court charges against Terri Horman for showing a previously sealed restraining order to childhood friend of Kaine’s, Michael Cook.

In his motion, he also accused Terri of “sexting” messages to Cook from her cell phone. Cook and Horman exchanged racy and graphic sexual messages back and forth since June 30th.

Michael Cook is best known for organizing the first vigil for Kyron Horman on June 7th and speaking briefly to reporters as he ran errands and stocked food and beverages for those in the home when Kyron first went missing.

    I too am confused about the address of Kaine’s “undisclosed location” being on Terri’s copy of the restraining order. If she was given the address, then it was supposed to be kept from whom? It almost seems like an acknowledgement that she isn’t the danger.

    I have to share a true story situation.
    My brother married a woman and had a girl child from him. He already had a son with juvenile type 2 diabetis (insulin)from a different relationship. the step mom had a son of her own the same age as my nephew when my brother married her. She let her son and the little girl by their marriage together!! beat on my nephew. The last awful thing she did was send my nephew to his aunts my sister for the summer and!!!! took her two kids (to disneyland. my nephew wasnt blessed to have known his mother (her choice) so my sisters raised my nephew. Every weekend every summer and holiday my nephew was shipped to my sisters. He is now 10 and knows he is not wanted by her. It hurt us so deeply !! we couldnt understand my brother allowing this treatment of his own son. My brother is a professionel he should have seen the signs(he did and ignored them) all for the love of a woman and the daughter they had together. He spoiled this little girl turned her into a monster!! no one has ever wanted her overnight or even for the day and were a big family!! you know us mexicans produce and multiply!! lol anyways today I heard that my brother finaly left her and is living with my sister that is more or less raisisng his sick son. His wife took their daughter and her son by someone else and moved out of the city. I say great!!! WHY DO I BRING THIS UP YOU MAY ASK!!
    BECAUSE!!! NNow I dont have to worry that my nephew would end up like kyron!!! men married to women who take the job of raising step kids should monitor them and even ask the kids hows it going? is step mom or dad treating you well are you happy do you feel safe.

    If this is the same man that Shannon writes about, I can’t help but think that he could be more involved in this case than he leads everyone to believe. Who exactly said that they did not meet until after Kyron went missing? He said it himself didn’t he? After reading what his ex-wife had to say about him, I would not believe one stinking word this man said. And, I agree with a previous poster who stated that since this woman has this posted on her professional website, (in which she offers coaching/advice for women in bad relationships) I would tend to believe it true or he would have had it taken down a long time ago. Some of her comments describing her marriage to this man -
    -He drank excessively
    - he was passing out from drinking and missing flights home from work trips, staying out all night, and leaving his drug paraphernalia in potentially child accessible locations.
    -My husband was binge drinking often, using cocaine, having multiple sexual encounters with friends, colleagues, clients, and strangers, hiding large sums of cash from me, and compulsively lying about all of it on a daily basis.
    -the cruelty became more flagrant. Though I still lived there, my husband began bringing his current mistress home, even when my son was there asleep. I walked in on an empty cocaine vial in the kitchen and my husband in bed with the other woman.
    -All the while, he was continuing to drink, use drugs, and proposition other women openly.

    I know that marriages fail every day, husbands (and wives) cheat. But those statements do not describe a typical he cheated/we divorced situation. It doesn’t even describe a person with low morals. To me, it describes a person with NO morals whatsoever. And a person who has absolutely no moral compass to guide him/her would have no problem carrying out such an evil deed.

    Could Terri and MC have been involved before Kyron went missing?

    I think kain had to have had some inkling that something was wrong. He would have had to see kyrons demeanor change! maybe more withdrawn, sullen, sad, maybe isolate more.
    maybe she resented kyron but for what? it’s not a childs fault that they are thrown into certain situations because the bio parents decide to split. parents need to put their kids first and be more observant!! hopefuly it wont be to late.

    Poor Desiree. For those that are wondering why Desiree would let Kyron go back there, it’s probably because she felt she had no choice in the matter. Courts are reluctant to remove a child from the home that it’s been living in for the longest time, and from the parent that raised them. Unless Desiree could prove that Kyron was being neglected or maltreated she wouldn’t have gotten him back from Kaine. If Desiree just decided not to send him back she would’ve been violating her visitation order and may even have had her weekend visitation stopped by the courts.

    I keep reading in hope of seeing arrests have been made and the case is progressing. My gosh, I watched that clip of Desiree this morning. Her pain is so raw and real it even hurts me all the way on the East coast. I pray for Kyron, his family and his friends.

    @pps_mom…I’ve been following that board since the first board they started and they have folks actively searching where Jacqui sends them. I wish them well but I honestly think in the end it’s going to come down to old fashioned police work to solve it and some poor unsuspecting soul that will find him.

She has a very active blog and as far as I can tell she has not waivered from her original description that seems to match BP.

    Why is Desiree doing yet another interview this morning when she and Kaine just put out a statement a couple of days ago that they weren’t going to be interviewed this week due to heavy activity with LE? Did the set court date change that? Is that what the heavy activity was?
    It’s interesting to me that not only DY, but TY (who is a detective) also states that he absolutely believes that TH is responsible. Hm.
    What do they have to gain by saying so other than continued media coverage and public interest…which I think is the idea? Or is it possibly to take the focus off of someone else at the moment?

    On another note-I just read this morning that someone who lives on SI reported they saw LE and and FBI vehicle drive by at around 8pm last night.

    If we take all the intrigue out of the equation, get back to basics and, reduce this to it’s simplest form, I would say TH ALONE “got rid of” Kyron and is sure his body will not be found. Why would she admit to anything? There are no accomplices, that would be too risky. TH murdered Ky and did it by herself. No body, no arrest. TH feels quite confident in that. This is JMO.

    I`m sure this guy is hurting as much as the Mom and i find it a tad cruel to lay blame, albeit understandable at the same time.
    His wife was looking to have him murdered, with him still living with her until recently you gotta feel he had no clue what was going on behind the scenes.

    Lay the blame at the person who took Kyron from the school.

    So sorry if this has been asked and answered previously. This is really bothering me: Why didn’t Desiree have full custody of Kyron?
    Especially if she always thought Terri was lying and didn’t seem to particularly like her (judging from interviews lately).

    I know Desiree had surgery in Canada a few years ago and that’s why Kaine had Kyron, but once she recovered and remarried, etc., why hadn’t she tried to get full custody of Kyron? I’m just really curious. I totally sympathize with Desiree now and she comes off really well in her interviews, but she’s saying how Kyron had been crying lately about wanting to live with her, etc. So why didn’t he??

    I am still on the James thing, I will always believe from the bottom of my heart that he had no knowledge, yet I would like to explain why I believe he is the key. Has anyone stopped to think why James is 16 yrs and Kiara is 19 mo? 14/15 years is quite a gap. I suspect that the early years of James life was very tumultuous and that she had to feel very secure and take a tremendous leap of faith to get pregnant again, thus the wide gap in her childrens ages. Because I believe they endured much (what I do not know) I believe she has a special connection w/him like most people do that have endured something together (the worse, the more intense). When I thought about his name change to Moulten this last January I found it odd on 2 fronts: 1. 16 is a difficult age when they are really forging their own identity and to change a last name during that period makes no sense. (2) why Moulten? had he not spent the last 7 years in the Horman home and wasn’t everyone in that home a Horman? To me I think she “branded” him has an extension of herself. I believe if he & Kaine sat down and talked they would find that they did not know the whole story each time they fought. That she manipulated it & it was to get James out of the way to shield him from another tumultuous time. I further believe that she does get enjoyment seeing Desiree, Tomy & Kaine on tv and it is not working; accomplice is not talking, so she must crack. James is a minor but I would beg his father to allow James to write an open letter to his mother asking her to reveal all. I truely believe that he is the only one in the world that can get through to her.

    Meanwhile, investigators are re-interviewing people who say they saw Kyron at Skyline School the day he disappeared.

    One person who has been asked again about what he saw is Skyline seventh-grader Tyler Kessinger, whose science fair project was on antimatter. He said investigators came back to interview him last week at his home.

    “I just saw him (Kyron) in the gym, and I saw the truck out in the parking lot,” he said Wednesday. Kessinger said Kyron was looking at other students’ science fair projects, seemed happy and was with friends.

    Kessinger said he hopes it’s all cleared up soon because it’s a frightening situation for him.

    “Just knowing someone took him and not coming out and confessing, and that he’s probably in some other random place,” he said.

    He said when he saw Kyron in the gym he didn’t see Terri Horman with him. He and his family have turned over pictures they took at the science fair to investigators, but they’ve been asked not to disclose the timeframe in which he saw Kyron.

    Additionally, Kessinger said that investigators didn’t ask him anything new.

    I’m not sure if it would be the same for all schools, but my daughter was being diagnosed with ADD and part of the diagnosis process was having her teachers fill out questionnaires/forms regarding her progress/behavior while at school.

    Desiree if you read here hon i’m begging you not to feel guilty. You could never know this would happen dear. It makes me sick to see people talk bad of Desiree. I even registered at Oregonlive.com to post the same thing after reading a few posts trying to blame her. Terri was the LAST PERSON to see that child alive. I’m thinking if she killed Kyron she prolly did it with poison, a common method women use to get rid of someone or had someone do her dirty work for her. I think she’s a sociopath & a narcissist & therefore not worried she could kill herself but any doubts i had about her involvement disappeared when she didn’t contest the RO to see her lil girl. THAT spoke volumes.

    I’m with ya on that Liam…..Kaine would be dead today if Terri had gotton her way months ago & if he didn’t see that coming i doubt Terri let him see her resentments towards Kyron either. In light of all we’ve learned about Terri & her behaviour & actions i feel it’s unfair to blame Kaine.

    Answers for those who thought the divorce was already in the works, or that this was KHs big chance–and Good news for the case: “Everything public that we’re seeing related to Terri Horman is being played out interestingly in a family law, civil divorce case and if you carefully at all the documents from the very very beginning that divorce case was actually filed only after the investigators gave evidence to Kaine Horman. So it’s been clear from the very beginning the divorce, the restraining order, the motion to move her out of the house, now this latest bit of business on a contempt of court order all of that is playing out not in criminal case but in a family law divorce case, but the thing is if you look at the documents, the District Attorney and the investigators have their fingerprints all over those this process.” Great news, actually!

    More good news: “This also keeps the pressure on Terri Horman, not just psychologically but legally, she some court dates now where she has to make an appearance before a circuit court judge where she has to answer some questions in family law setting.”

    A: “The last thing her current defense lawyer really wants to see is to hand over his client to a divorce lawyer where he loses control of that process loses control of what she might say in family law court. …actually something else jumped out at me more importantly as a lawyer and that’s was the reference to Terri allegedly telling Michael Cook to lie to her own defense lawyer that’s not a good sign to a defense team.” Oh so true.

    Well, this makes me feel a little better today than I did last night. Last night I’d read that LE & FBI was on SI, and I was afraid of very bad news today.

    RE: the paperwork for Kyon. He may have been displaying behavior that was yet undiagnosed. I guess if he was never seen by a MD for this behavior, we will never know what it would have been diagnosed as would we? That could prove to be pretty convenient.
    Also, about DY’s noted change in relations with KH. I would wonder if she hasn’t become aware of some information we do not yet have. I would doubt (JMO) that it is based only on generalized guilt. I think she displayed true feelings of sorrow toward Kaine regarding the MFH plot. I bet over the wknd, some new details were shared with them that placed KH in a new light. Particularly since TY accompanied her in that interview today. We really haven’t seen him other than in the very begining. Maybe he hadn’t been totally truthful with DY about his relations with SM of late. LE may have uncovered something that she felt he should have shared or acted upon. Just speculating here.
    I too agree James holds a wealth of info and hope his Dad has allowed him to be interviewed.

    Could someone post where Michael Cook lives on the map that was so generously provided by another? The reports say he lives in the neighborhood but where? Does it jive with the report of a truck on 26 (?).

    A friend told me that she heard TH went to coffee with friends the morning of the abduction but I had not heard that. Is that true and did said friends corroborate?

    I wish I was there to snoop around.

    re: 38: I posted earlier about Harry Oakes (he had the search dogs). I personally spoke to him. He searched Sauvie Island after many psychics had called and written to him about “hits” that they had gotten of where they believed Kyron was. He did not have a scent of Kyron but a pseudo scent to use and he searched Multnomah Channel (where Pumalo’s home is at) and also Warrior Rock and Alice Rudy Light House plus other areas that were requested by him. He personally called me about the two I just mentioned. He found no trace of Kyron and the dogs did not pick up anything either. The dogs didn’t pick up a “death scent” but just a scent of a sock. It wasn’t of death. I don’t know where this “death scent” is coming from.

    One more thing: Does it really matter about who’s to blame right now? Fact: Kyron is missing. Last person with him was SM. Fact: she failed 2 polys and has 4 hrs of unaccountable time on the day he went missing. Fact: she attempted to hire a hit man (police did a sting operation with him even). Fact: her character is a bit immoral (June 30th sexting Kaine’s childhood friend who helped on the candlelight vigil). Fact: Not cooperating with authorities. I don’t really care about the Desiree/Kaine parenting issues right now. Really, do you?

    Soooo, they found something in their search, right???????? Do you remember that KOIN put on their website on June 17th that Kyron’s body was found? It was in the afternoon. Then they quickly removed it and apologized for the error.

    KOIN News Director Lynn Heider said the post was a mistake and only appeared online, not on any broadcast.

    @Eloise and Packleader5: I’m with you. I wonder if the teacher expressed concern about Kyron’s behavior and requested the Dr’s visit. That would explain why she was given the paperwork to fill out. Kyron has been described as shy and timid; maybe exhibiting signs of depression due to home situation? Might the Dr’s appt be motive for Kyron’s disappearance – TH/LS/BP/? fearing what would be discovered during a professional evaluation of Kyron and subsequent involvement by DHS leading to possible criminal charges? At very least, TH may have feared losing Kiara.

    Wonder if teacher still had the paperwork when Kyron disappeared, or if she already returned it to TH? Even without paperwork (assuming it was in TH’s possession), if teacher initiated Dr’s appt, she has knowledge of purpose of Dr’s appt and contents of paperwork, and has passed this knowledge on to LE.

    These are all facts that are bugging me.

    LSL
    –Since LE knows that the sexual lures used for MC were also used for LSL, this probably means that LE has LSL texts and photos to go with.
    That means they know who the LSL is, so it’s the person in the sting, not another person.
    That means they have TH in writing before Kyron’s disappearance, and if she trusted LSL, she may have alluded to something between sex shots.
    If LSL has info about Kyron’s location, and LE has any kind of info on LSL, forensic, written, etc. then LE can leverage that against TH. Did LSL have an associate who worked cheap and didn’t mind handling a 7 year old?

    The doctor’s appointment
    –No word on this from LE, but that is a yes/no, and I think it must be important info since there’s been nary a peep about it.
    If TH lied to the teacher about an appt, and there wasn’t an appt at all, that’s a serious faus pas on the part of TH.
    If TH told the teacher that the appt was for 6/4, but it was really for 6/11, then it’s the teacher’s word against THs, but since THs word isn’t worth anything at this point AND she has reason to lie…
    Also, interesting to know if the teacher is really hard of hearing, or if that was a TH lie on the fly.
    And why have there been no media interviews with Ms. Porter. Odd, that. Is it possible that when asked by LE not to speak to the media, Ms. Porter complied to help Kyron?

    ETD
    –first story was that TH said goodbye to Kyron at 8:45, and left.
    Then we heard that Kyron was last seen at 9 a.m. but LE wouldn’t say by whom or with whom.
    Then LE recently stated that TH left the school around 9 a.m. That’s 15 minutes later for the ETD on TH. Meaningful?
    And who saw Kyron at 9, and who saw TH leaving at 9 instead of her reported 8:45?
    This has never been clarified, and questions result in “no comment”. But if Kyron was last seen at 9 a.m. by someone and TH’s ETD has been bumped to 9 am….

    The “other person”
    LE has leaked information that another person may know what happened to Kyron.
    Is it LSL?
    Or a new beau, perhaps one after LSL or simultaneous to LSL?
    Is the new TH/MC sexgate being used as leverage by LE to show the other person how little they really meant to TH?
    IF LE knows that there is another person, and they know who that person is, then I’m going to hope they have some leverage and some evidence against that person.

    Kiara
    –Where was Kiara that morning? She’s 20 months old, so she can’t account for her own time, but she had to be somewhere.
    There are conflicting stories on this: at the SF with TH according to KH & DY, but no one saw her and there were no pictures. At first, we heard at “daycare” or with a “sitter” but nothing/no one has been identified with that.
    Whoever had Kiara had to have an idea of when TH dropped her off and what happened when TH picked her up. Could it have been LSL? At first I thought “no way!” because who would trust their child to someone who they’d asked to murder their husband, but then quickly got a grip! No normal person would try to have their husband murdered, so… Where was Kiara?

    The store videos:
    It’s been confirmed that where TH said she was, and where she actually was conflict based on cell phone pings *and* bank transaction trail (future criminals, please take this advice: Cash, baby, Cash!) SO if LE wants to see if TH was at either of the two stores from which videos were requested, they may already know that TH was there based on a bank trail.
    If she says that she was there and that she paid cash, LE may just be reviewing tapes to see if her story is true.
    But if she was already using her bank cards, maybe cash transactions aren’t the issue, and LE wants to see the videos for other reasons–like to see who, if anyone, was with TH. To see if Kiara was with TH? To see if anyone with TH bought anything?
    To check her clothing (like hipwaders would be a big fashion faux pas for her that day) and demeanor? Why did they need video tapes from those 2 stores specifically? For those who don’t know, some Fred Meyer stores have outdoor departments and hardware supplies.

    “Dropped off”
    –This is semantics, but as we know from reading Seamus O’RIley’s blog, semantics matter.
    During one of the first interviews, I think the one where it was just KH & DY, they said that all they knew was that Kyron was “dropped off” at the SF. Odd choice of words, I think. I think “took him” would be more common. But those words have bothered me since because “dropped off” is commonly associated with “picked up”. To test that, I’ve been using “drop off” instead of “bring” and “leave”. Inevitably, the response I get back includes the words “pick up”. So… was Kyron “dropped off” for someone?

    Forensics
    –I was happy to see that word used today, because it seems like nothing has been found. So maybe something has. I’m hoping so for the obvious reason, and because if Kyron can’t be found, no forensics there, and if Kyron is no longer alive, then as someone pointed out, with the heat and the moisture…
    Awful thought, but if the worst has happened, I want LE & the FBI to be able to have evidence so that they can fully and successfully prosecute those involved.

    And if anyone finds the Kyron stayed in bed link, please share.

    I have always thought that Kyron was at school longer than the 9 am time frame we've been told. I don't know why-I have just always felt that. That in no way excuses TH from being the one or arranging the one who took Kyron. But I feel he was likely at the school until close to the 10 am start of classes. What that means, I have no idea.

    This article states that the 7th grader and his family were asked not to divulge the time they saw him. So for whatever reason, LE needs to keep that quiet still. But it makes me wonder why the official time line says TH was the last person to see Kyron, but this boy saw him with friends, at the science fair, without TH around, so how does that work? Or was TH or her helper possibly hiding somewhere in the school and then popped out right before classes started and grabbed Kyron when he was alone?

    So this young man saw Kyron at the science fair, he was having fun, he was with friends, he was not seen (at that point) with TH. That is a lot of info put out in just a couple of sentences!

    I am guessing that if Kyron was seen touring the science fair with friends that he was already in his predetermined group. I have also always felt that he was able to group with them and do the required tour of the projects. Who was the group leader? We still don't know and I didn't think much about it, because Kyron was supposedly gone before they grouped to tour the fair. Now I wonder more about that.

    I am really confused by the boy stating, “I just saw him (Kyron) in the gym, and I saw the truck out in the parking lot,” Does he mean at the same time? Could he see where TH parked the truck from out of the gym window? If not, why would this boy remember seeing TH's truck to begin with? Were their families best friends, would he instantly know her truck from any other white truck? I know I wouldn't, especially at a distance. Hell, I can't pick my own car out of a mall parking lot! Not slamming the boy mind you, just really wondering?

    What that leaves me uncomfortable about, is exactly who was the adult that led Kyron and his group around the science fair??? I have been surprised that has never come out. Of course until today, we have been led to believe that he was gone by 9 am. I think that he disappeared closer to the 10 am class start. Any chance that group leader and Th were in cahoots?

    Which brings me to even more thoughts, such as:

    If Kyron was at school even longer than we were led to believe, his teacher must have seen him around the fair, and his absence later would be even more noticeable.

    Many, many more people than we knew about had the chance to see him, since he was touring the fair with a group.

    His friends had to have seen him, as this article stated he was with friends. They would have noticed any immediate absence and alerted someone.

    In some articles I read at the beginning of this case, it was said that Kyron's classmates pointed out his things and asked where he was when they got to their classroom after the fair. That's important. Why didn't his teacher simply say to them that Kyron had a Dr. appointment and would not be back that day? There's just a weird disconnect here that is hard to understand.

    *I wonder if they should have retracted the 7th grade witnesses name from this article? I sure wouldn't want my kids name out in a case like this! Especially with his science project being about anti-matter!*

    The RO states specific locations TH is restricted from (including KHs address). This orders her to stay away from these places 24/7.

    TH might *accidentally* be at the same grocery store as KH, and be given time to leave. She could claim it was a coincidence. But she CANNOT accidentally be at or across the street from his “safe house” or accidentally in the parking lot of the athletic club. Those places are off-limits entirely. Just showing up (even if KH is nowhere around) would be a violation of the RO.

    I don’t think that we can assume that a body was found by any stretch, but I do think we can all hope and send out prayers that, YES, there is physical evidence related to Kyron that can be analyzed. Just guessing at some possibilities: tire tracks, footprints/footware, trace evidence, biological evidence, residue, to name a few. As wet as it was in Portland early June, the first two on the list jump out at me.

    I will add that I did not read the KOIN piece, and I’m so glad. And I can’t imagine that if it were true, all the people that would’ve then known about the truth could be quite about the truth for almost a month. JMO.
