Caylee/Casey Anthony Case: Cheney Mason Predicted Casey’s Conviction AFTER Caylee Was Recovered

You can pretty well predict there’s going to be a life sentence, either a plea and get it over with or have a circus trial and then be convicted and get life,”

– J.Cheney Mason, counsel for Casey Anthony

Well now, there you have it. Words from J. Cheney Mason, co-counsel of the defense team via THE BAEZ LAW FIRM.  Was he co-counsel when he said it? No.  All the more reason to wonder why he would sign on to this case. Yet bet Ms. Simms is happy she did not have a TV when these aired.

Cheney’s prediction of Casey’s trial outcome comments were made the day after Caylee’s remains were located, and OCSO was still onscene, December 12, 2008.

Casey Anthony’s parents were still guests of the THE RITZ CARLTON thanks to ABC, and their Hopespring Drive home was being turned upside down by OCSO ater finding Caylee’s Winnie the Pooh blanket her grandmother conveniently forgot to mention was missing from her room.

“Hopespring” - now there is the boss of all oxymorons in this case.

Tuesday, in the news-less press conference, Mr. Mason forgot his former comments as an “analyst” for local 6 as invited by reporterTony Pipitone.

WFTV Reporter Kathi Belich asked Mason if he recalled being a commentator on the case and concluding that Casey would be convicted.

His Response In pertinent part:

“… I Don’t recall making any such statement..”

O No? We DO.

AFTER Caylee Anthony’s remains were recovered

…” All that talking and the press interviews.. the parents going on this show and that show, the lawyer (Baez) going on different shows established they have no credibility whatsoever..”

    11/23/2010 Motion
Defendant’s; to Seal Penalty Phase Discovery Response

    —–

If I am understanding this correctly- this is The Defense’s response to The State’s motion to compel additional discovery.

So will this be brought up in the hearing on Monday also? I think it means that we will not be privy to any of the information… How likely is it that the Defense will be successful in this motion?

I try to understand all of the legal stuff- but I fall short- Blink if you could, could you explain what Seal Penalty Phase Discovery Response means exactly and what effect it will have if granted? TIA

IMO Well Blink, It seems you were right this was/is the big one. And The defense wants to make sure we don’t offer any opinions ect on the discovery- any of it. The defense has now pulled out all the stops and are asking that EVERYTHING be held from public view until after the trial. At least that’s my understanding.

I will say that this is the best written motion I have read from the defense. Finell seems to have stepped up to the plate.JMO

Oh, now the inmate and the defense want privacy! I seem to recall that early on the SA asked for a gag order and the defense said no. I wonder if Ms. Finnell is aware of this. I hope this is brought up in the hearing. In the second-to-last hearing she seemed to be finding out some things then and there while in front of Judge Perry. I know I’m ready for the inmate to be either sentenced to death or put away for life never to be heard from again. Same for her famn damily.

How Is Casey’s Defense Team Spending Taxpayer Money?
    Snipped:

In the documents, the defense spent thousands of tax money on talking to EquuSearch volunteers, many of whom they’ve apparently admitted behind the scenes that they didn’t need to talk to.

Casey Anthony’s defense team claims to have found 150 new EquuSearch witnesses who searched the exact area where Caylee Anthony’s remains were found, months before that, and sent its private investigator, Jeremy Lyons, to talk to them.

He billed taxpayers almost $8,000 in September and October. After all that tax money was spent, prosecutor Linda Drane Brudick told the judge the number of new possible witnesses was greatly exaggerated publicly by the defense.

  17. Mom3.0 says:

Sorry Chica- Really nothing new to report- everything has been put off- either until another day- or until depos are taken- We probably will not see much of the information unless at trial.

I did watch the hearing- It was a strange day in court I thought.

The Defense pulled their motion on Kronk and will refile it later “bear in mind” If they do it before the deadline.

Finell succeeded in getting the penalty phase witnesses(50 so far by her accounts) ect sealed, at least temporarily-until a new hearing can take place- in which the media an attend and defend their position.

There was a side bar that the defense asked for, which included someone raising their right-hand as to give testimony- I believe this had something to do with the TE search documents…

Baez did the old- Golly gee, if they want something then all they need to do is ask- we can set up a time to talk- to which Judge perry said (pp) NO- lets resolve it today -and then Baez tried the old- they did it first- so why can’t we- non-argument. IMO Which was ignored by all.

The Prosecution will have to get the information regarding the experts testimony, & payment ect the hard way- through depositions

Although, we did find out Dr. Lee seems to be avoiding the Prosecution, and there will be a WRITTEN report from the touch DNA expert, which is new because, according to Baez, there are no written reports or notes by any other expert from the defense- and there was no wining and dining either…

The defense’s funding will most likely be found out the same way-through depos.

It is my understanding, that Judge Perry did not deny the state’s request, he said if the information can not be gained through depos ect- then he will hear the motion again.

yeah- strange day in court- IMO – BTW Casey seemed in good spirits- She no longer looked ill. She seems to have somewhat of a friendship with one of the interns. Cindy was dressed to the nines, IMO she looked nice.- George was not there. Marine Dave was very cordial, shaking hands and talking as everyone left the courtroom. The defense seemed in good spirits as did The Prosecution- perhaps it is because everyone had a good break for Thanks giving….

    Snipped from WFTV

    http://www.wftv.com/news/25921057/detail.html

While the prosecution argued their point, Judge Perry said they have other means for obtaining much of the information they are seeking.

“The discovery rules were never designed to eliminate attorneys doing things on their own they can obtain,” Judge Perry instructed the prosecution. “As to the request dealing with one, two, three, and four, I would deny those without prejudice unless they cannot be obtained through their vehicle of deposition. As to five, six, I will grant that request.”

The “five” and “six” Judge Perry referred to are the photographs and notes pertaining to the experts and their work. Judge Perry also ordered the defense to provide information to the state by Friday at 2:00pm on what experts will be testifying about, as well as the aforementioned photos and notes.

  18. chelsea1515 says:

Chica – hi, just you and me again!! We must have too much time on our hands. This feels like my ‘second’ home and will be until the trial is over and Casey is punished for her terrible actions. I am actually in Florida at present, returning to the UK for Christmas but will keep up with you all whilst away for the Holidays. I don’t believe the Caylee Anthony murder is very well reported in the UK but no doubt will be once the trial gets underway and the papers become aware of the DP being on the table for a young attractive mother. Casey Anthony Defense Attorney Files Request In New Motion

ORLANDO, Fla. — Casey Anthony defense attorney Jose Baez says his team’s experts should be reimbursed for their prior travel expenses.

Baez did the old- Golly gee, if they want something then all they need to do is ask- we can set up a time to talk-

But now it seems as if Jose Baez IS trying yet again to wiggle his way around the court order to produce what his experts will be testifying to-

    excerpt from JB email-s-
“Okay let me see if I can clarify not only what you know about the list of experts and if you have anymore questions we can take it from there. the goal here is to work together, right?”

“Check my last email and if you need anything else let me know”

As Ashton writes in his email- the court ordered you to reveal “the substance of the testimony of the witnesses”- all Baez sent him were- their names addresses- and what branch of science/criminologist forensic pathologist ect.

Have you read these e-mails Blink and all? BTW Ashton, even blacked-out portions of Baez’s commentary that was not pertinent….

I am continually amazed at the arrogance shown by Baez as well as his grade school approach to such a very serious matter, the murder of an innocent child. Mom3.0, how right you are. That Blink had lunch with Judge Perry is already on 3 blogs that I’ve read so far.

    Sheesh……

But it is what you CANNOT read in public.

That saddens me. Seriously, like I an blogging about a judge?

  27. OutofOrder says:

“But it is what you CANNOT read in public.

    That saddens me.”

You lost me on this one, please explain your first sentence? If you remember, the same thing happened (and then some) when MD stated that he had lunch with Judge Strickland. In fact, he’s still playing games with that to this day, not having the basic human decency to admit that he lied to his readers about it.

It’s a shame that ego is so often swapped for truth.

  28. Mom3.0 says:

    outoforder- hello-

Blink wouldn’t compromise this case- I haven’t read that on any blog- I am sorry to have started a rumor- I seriously was just trying to be funny- I forgot that rumors seem to have a life of their own-

Speaking of rumors… have you all read seamus Blog lately? http://seamusoriley.blogspot.com/2010/1 … andal.html

    Snipped-
“In what appears to be the worst possible attempt on the part of the Casey Anthony “dream turned nightmare team” to falsely accuse yet another innocent person, an uncomfirmed report says that a scandal may be emerging, that if true, will have long term ramifications for the defense.”

Seems there is a rumor going around that while one of The Grund’s was disposed yesterday-some info was leaked that may point to someone planting evidence at the remains site inorder to frame an innocent person.

Richard Grund-wrote on his FB a very beautiful quote- So beautiful and so true- I wonder if it was written in response to this latest rumor?:

“Life lesson: do not believe rumors. The facts, in certain cases, are bizarre enough. Sadly rumors are like feathers. Once put out there they cannot be retrieved after the winds of gossip get a hold of them.”

Blink, your response to outoforder, left me reeling- I so agree- although I am not sure to what you were refering, for me, I find this statement to be so very profound, in this case particularly-

“But it is what you CANNOT read in public. That saddens me.”

There is a quote that plays in my mind often in Caylee’s case, especially when referring to The Anthony’s-

“There are none so blind as those who will not see”

The sadness can be overwhelming- Will the truth ever see the light of day? Will Caylee’s family ever accept it, and do what is right for their baby granddaughter?

For the Anthony’s sakes I hope so.
Even without her family seeing the truth, I am confident others have taken up the cause of justice- The State, Blink ect. They refuse to let the sadness overwhelm them- they keep working for the victims. For this, I say thank you-

  30. OutofOrder says:

Mom3 – it wasn’t you that started the rumor. You only stated the truth in that Blink’s statement of having lunch with Judge Perry would become a rumor, and it did. After MD doing the same thing, it was to be expected.

I had asked Blink for an explanation of her line, “But it is what you CANNOT read in public.” – I guess she didn’t have time to answer.

Might you offer one instead? TIA.

  31. Mom3.0 says:

    Hi OutofOrder,

Yeah – I see your point. I guess sometimes its hard to judge something as “just a joke”- especially if someone *wants* to believe it.

I am not sure what Blink was specifically referring to, but I can tell you how I interpreted her statement for myself-

The things that are just too horrible, and sad to print, the details that never see the light of day(and probably never should) are often the saddest.

    autopsy photos-
    photos from the crime scene
    details of abuse
    last words/moments of the victims
    aspects of the victims life
Feelings/thoughts of friends & family left behind- ect

I imagine there is alot of info that the general public never gets to see, or hear. Information which the prosecutors and the families and the investigative journalists are privy to, and must live with knowing and not sharing.

This is how I personally interpreted Blink’s response to you- again I don’t know what she was actually referring to-

Another way to interpet Blink’s response is:

Perhaps she was just referring to the behind the scences stuff- the way this case is being handled by the defense and the family-ect The way they defense was initially paid-ect ect It surely is sad.

Again, I don’t know what Blink meant- I am only interpreting her response. Which probably isn’t a good idea- but gosh darnit- she left it open to interpretation.

    Happy Holidays OutofOrder

  32. Mom3.0 says:

In the hearing today- clearly J. Perry has had enough. JMO

Judge Perry said that since the Defense and the Prosecution can not seem to work together- he will step in-

    “The trial is fast approaching.”

    The Honorable Judge then ordered:

Where experts have not prepared reports or examinations both the state and defense are required to provide the following-

    *The Experts curriculum vitae
    *The Experts field of expertise
*A statement of SPECIFIC subjects on which experts will testify
    * A statement of subjects of facts where experts are to testify
    * A summary of experts opinion and grounds of opinion

All must be completed by 3pm on Thursday, December 23rd -except for the expert witness who is being disposed on Wednesday of next week Dec 15th ( I believe an anthropologist) and The Botanist expert that is to be disposed on the 20th of Dec. For these two expert witnesses, all these must be completed by next Tuesday- early afternoon.

Jeez Blink, that must have been some lunch you had….. JOKING I AM JUST JOKING LOL

Lol. The Waffle House will never be the same.

What outstanding posts you have contributed across multiple cases over the last few days Mom 3.0- Seriously.

His honor, to his credit, has had it. I agree.

Perhaps someone needs to tell Mr. Baez that J. D. does not stand for Jackass Dictionary.

    B

  33. Sister says:

Dear Blink, unfortunately, in the case of Mr. ByAss (sounds like that to me when His Honor speaks it), J.D. does stand for Jackass Dictionary. . . my laugh for the day and I needed it!
Justice for Caylee may be getting closer than we think.

  34. Mom3.0 says:

I have told you guys before that I tend to over think things, right?

Well- I do believe my previous interpetations of Blink’s response were waaay overthunk- LOL

I think I just figured out what Blink really meant by her response to your post OutOfOrder.

    It was a joke!! HA

    She wrote:

    “lol.

But it is what you CANNOT read in public.

That saddens me. Seriously, like I an blogging about a judge?
    B”

Blink was being her regular, witty, snarky self!

“But it is what you CANNOT read in public.” meant to be taken like-(wink wink, nudge nudge, he he, know what I mean?)and maybe a little bit thrown in regarding rumors about MD

This part was in direct response to your information OOO :

“That saddens me. Seriously, like I an blogging about a judge?
    B”

She was reacting to the news that the rumor had been passed around on three different blogs, and maybe a little sadness thrown in because of the initial rumor about Marinade Dave.

The next part was another snarky zinger:

“like I am blogging about a judge? B” -meant like: Yeah Right! As if! Whatever! Please! That would never happen! Who do they take me for?

You gotta love the written word-so many ways to interpret the writers meaning- it can lead to alot of Three’s Company Jack Tripper moments….Know What I mean? oops, wink wink, nudge nudge…

Blink, Thank you for acknowledging my contributions. Thanks for never making me feel like a complete “Crissy” – Its always nice to know that you read our comments and value our opinions.

    Ps Jackass dictionary- classic! LOL

    Yep. ‘Xactly.

I have to say it, if Mr. Baez has not received “the memo” that his LACK of representation is adversely affecting his clients defense, he had better.

During his response argument to Jeff Ashton, I heard Billy Crystal singing Walter Wanderly.. “Don’t be afraid, you just call Moi, call me and I’ll be AARROOUUNNDD…

2 Years ago today, a little girl I never me to reminded me to never give up.

    Caylee Marie, will be heard.
    B

  35. Mom3.0 says:

Well “quite frankly” Jose Baez’s lack of representation of Casey’s can be summed up best by Jose himself:

“I quite frankly don’t know why we’re here.” says Baez in court

    http://www.cfnews13.com/video?clip=http://static.cfnews13.com/newsvideo/cfn/1210CaseyHearing_121020101047.flv

    Says Baez after ruling:

“People want to talk about tax payer expenses look at the resources that went into 4 deputies bringing Casey to court… 4 sitting there waiting… a couple of clerks… the judge… the prosecutor… numerous court personnel.”

“What for?? (shrugs shoulders) because they couldn’t pick up the phone and ask us (shrugs shoulders) I uhhhh just( shrugs shoulders) strongly disagree with what occurred.”

-His words are unbelievable enough, but with video, his demeanor puts him over the top into inept- pompous- buffoon. JMO

Baez “quite frankly” thinks that this is a game in which the prosecutors, must bow down to him and beg for any information even ifo that J.Perry said they were due-

Afterall, Ashton several times in his response emails, tried to get Baez to elaborate & follow the court’s ruling. Ashton wrote several times, that the info Baez had sent was not specific enough- In court going as far as to say:
(pp) The tenure of the emails, he’s (Baez) already telling us that he giving us only what we already know.

And still Baez figured Ashton would keep asking him for more clarification!!

    Said by Baez in court-

“I feel that this is a huge waste of time.”

Sums it up, doesn’t it? Wait, but you already knew that…

It is not the prosecutions actions that brought Casey into court yesterday. It was Baez’s inaction and constant shrugging of his shoulders, thereby shrugging off his responsibilities as Casey’s lead council that brought Casey into court yesterday.

BTW- If Baez is SOOO concerned with tax payers money, then Why is he okay with Mr. Freeman being paid $560 an hour for his depo?

Without the information Judge Perry ordered, The state would have had to pay out countless amount of dollars to figure out What Mr. Freeman would be testifying to at trial.

Paying for 4 guards and some court personnel pails in comparison to what taxpayers would be shelling out for Mr. Freeman’s depos.
But wait YOU ALREADY KNEW THAT

Baez should be ashamed of himself-IMO and if his A$$ being handed to him yesterday wasn’t enough to wake him up to the seriousness of this case- by God Nothing will.

PS Blink, 2 years? Such a sad milestone- Thanks for all your hard work and I agree Caylee WILL be heard- regardless of who is representing her mother.

    Peace
