Kyron Horman Missing: Kaine And Terri Horman Face Off In Family Court

Portland, Or– Following one of the largest organized search weekends on Sauvie Island since Kyron Horman, 8,was abducted from Skyline School on June 4, his step-mother and father squared off in family court. Kaine Horman, Kyron’s father, arrived with his attorney, Laura Rackner.

Kaine’s estranged wife Terri Horman, arrived with her criminal defense attorney; Stephen Houze and her family law attorney Peter Bunch.

Mr. Horman appeared in a crisp-white dress shirt and tie, and Ms. Moulton-Horman wore an eggplant hued suit with a long skirt.

Cameras were banned in the downtown Multnomah County courtroom; however, there were apparently several hidden “nests” as the tweets were flying real-time.

Peter Bunch, counsel to Terri Horman, is adamant his client is the subject of more than one criminal investigation:

“The state has the ability to obtain every single bit of information that is produced in this case and that is outside the bounds of what it could do were this proceeding not occurring,” Bunch said in court.

“It is fundamentally unfair for Kitty (Kiara) and for Miss Horman for me to be hamstrung in the divorce case for the information I have compared to what they have.” “The publicity that’s going on is not being driven by Ms. Horman, it’s being driven by Mr. Horman, when he tells national media there’s no doubt Ms. Horman is involved.” “If Mr. Horman is really interested in what‘s best for the child, then Mr. Horman wouldn’t object to any visitation by this child’s mother.” “We’ll concede, Mr. Horman can have the house, right now. Mrs. Horman is going to lose money…”

Terri Horman has not been declared a suspect in either Kyron Horman’s disappearance or the alleged murder for hire plot against Kaine Horman. She is however, seeking access to all of her 911 calls dating back to the DAY AFTER CHRISTMAS.

While this timeline coincides with accusations by Kaine Horman in his filings that Terri attempted to arrange to have him murdered, this is the first public revelation of that call. Bunch went on to say that Rackner and Kaine Horman, who are parties to case sensitive criminal investigation materials involving Terri, are at a supreme advantage to his client who should only be expected to plead her protections under the 5th amendment as a result.

After heated debate by those sides, we learned: Rudy Sanchez, the infamous landscaper/hitman for hire, has an alias, and has eluded service in the civil matter to date, although he appears to have cooperated. Bunch proclaims Sanchez is unlocatable as a result of MCSO unwillingness to share discovery of a witness in the civil case ( blink holds hands over eyes).

Michael Cook, a/k/a sexter king, waited all afternoon via subpoena by Rackner, but was only interviewed by the press. He states he cut ties with both Terri and Kaine days before he was outed for invasive scapular intrusions. No word on that healing process.

Terri Horman had her own personal black Friday this year.

She called 911 THE DAY AFTER CHRISTMAS. Regular contributors and readers of blinkoncrime.com doubt she had sale flyer questions.

Judge Keith Meisenheimer, was sensitive to Kaine and Kyron’s ‘round the clock nightmare, but feels some time may allow things to shake out. January 6, 2011 to be exact.

Following this afternoon’s legal melee, blinkoncrime.com Editor In Chief asked prominent Washington State Family Law Attorney, Lea Conner, to weigh in:

Although I preface my comments with the fact that I practice family law in Washington State and not in Oregon, I am an Oregon native that has followed this case closely.

I’m a bit perplexed by Peter Bunch’s reasoning that if the court were to abate the dissolution, he would respond by filing a motion to modify the restraining order so that Terri Horman could have visitation with the parties’ daughter. Essentially, Mr. Bunch is arguing that the abatement would prejudice his client’s ability to parent her child. My understanding of the Multnomah County local rules is that an abatement means that the entire case is halted. Neither party can bring a motion before the court, nor can the court hear argument or make any ruling on motions.

It was also interesting to hear Mr. Bunch argue that proceeding with the divorce would violate Ms. Horman’s right against self-incrimination in the disappearance of her stepson. This is the first time that Terri Horman has publicly acknowledged any self-incrimination issues. In her motion for abatement, Ms. Horman, through counsel, argued that the ongoing investigation into Kyron Horman’s disappearance had made it “virtually impossible…to proceed with divorce-related issues in an effective an[d] orderly fashion[.]” Were Mr. Bunch to bring a motion to allow visitation, Mr. Horman would no doubt argue that Ms. Horman’s actions demonstrate that Ms Horman or someone she knew was responsible for Kyron Horman’s disappearance, and that her behavior since Kyron’s disappearance shows that she is unstable and poses a threat to their daughter’s safety.

I do not believe Mr. Horman would raise Ms. Horman’s 2005 convictions for DUI and reckless endangerment, as not only later chose to have a child with Ms. Horman since that time, he also left both of his children in her care for extended periods while he was at work. Under those facts, it would be hard to conclude that Mr. Horman believed Ms. Horman posed a threat to their daughter. The judge’s comment that “[e]ventually, Terri will have to decide whether or not to plead the fifth, regardless of the timing of the proceedings,” seems to indicate that the judge may not be willing to hold the action in abatement past the January 6, 2011, hearing.

I’m also interested in Mr. Bunch’s comment that “Rudy Sanchez” is an alias. If that’s true, then what is Rudy Sanchez’ real name, and how exactly did he first come in contact with Terri Horman?

It was also strange to learn that Michael Cook was subpoenaed to testify at the hearing. I’m curious if there were others scheduled to testify as well. I cannot speak to how the Oregon court operates in practice. However, I note that each party provided written affidavits in support of their respective motions.

Is there some reason that Mr. Cook’s statement could only be presented in oral testimony?

I’m not sure I understand Mr. Bunch’s logic in saying “If this is not abated we will not get reciprocal discovery.”

The state is not a party to a dissolution action. In a dissolution action, the parties can seek discovery from each other, and depending on the court rules, from third parties as well.

I’m not sure why Mr. Bunch would have the impression that there would be reciprocal discovery with a third party in a dissolution action, especially when that third party is law enforcement.

There’s a disconnect between Mr. Bunch’s argument that Ms. Horman cannot defend herself because she would incriminate herself in the disappearance of her stepson, and his statement that “If Mr. Horman is really interested in what‘s best for the child, then Mr. Horman wouldn’t object to any visitation by this child’s mother.”

The apparent logic is that Ms. Horman admits that if she speaks, she will incriminate herself in some as-yet-to-be-named crime related to Kyron’s disappearance, yet Mr. Horman is now supposed to trust her to care for his other child, because that’s so obviously in their daughter’s best interest.

    Ken Kesey brilliantly offered up elucidations of the psyche of native Oregonians in most of his works. Oregon is intoxicating in it natural beauty and possesses possibly the most progressive culture in the US in the city of Portland. However, most of that progressiveness has evolved from persons coming to Portland from other parts of the US or world.

    Many, many years ago I moved to Portland from a state that is very pro union. I was shocked by the employer/employee relationship in Oregon. I was shocked by the crooks and the lack of oversight. You’d better work for Intel, Tektronix, Nike, Google or some other outfit which cultivated other state’s corporate cultures or you are a low paid cog who must daily pray to the altar of the “man” to dredge out a meager living.

    This makes for a hard life and I believe contributes to the brazen dislike native Oregonians show to those who have relocated to Oregon. However, it was native Oregonians who sold off the entire coast and all available land around Portland to outstaters to develop. So now everyone there is stuck paying southern California prices living on Oregon wages or unemployment. It is very depressing.

    And just as depressing, you would be hard pressed to find a native Oregonian who has read “Sometimes A Great Notion” or even seen the movie. I can tell you that it is actually unnecessary to suspend disbelief about the family dynamics in that novel. When I used to fish for Chinook on the Siletz River, we would take the boat up to the house where the movie was filmed. I never ran into a local who had any idea what the novel was really about.

    I have felt Mother Hen’s pain. I got my feet wet in the northwest (literally) in Portland but I no longer live in Oregon and my wounds have healed. I do have close ties with children living in Portland and grandchildren who are native Oregonians. My two closest friends are native Oregonians. I moved to Washington state. It was like moving from Kyrgyzstan to Sweden. I don’t think whatever LE wishes they did not know will surprise me at all.

    At first look I agreed with Mockingbirdsings, but when you insisted it might be her I compared the photos and I think you are right. The nose, lips and eyes are the same, and the age is right in there. The hair style and the weight are what has changed. A lot of people put their BEST picture on the internet even if it does not accurately reflect what they look like in the here and now.

    If this is indeed the same woman, you have hit on something I think is important enough for LE to have a look. Maybe report a possible location for the missing children?? You have linked AV, Elsa/Elsie, Oaxana, possibly Friends of Pimpollo? and a Sanchez. Isn’t AV linked to BP linked to Sauvies Island and aren’t they both linked to TH and Skyline?

    Please print or save all that you have found, who knows if it will go private or disappear. If you have the link where you started (I don’t have myspace) or can share the first name of the Sanchez, it would be most appreciated. Kimberly, I think you may have really found something big. KUDOS!

    I am getting more into DeDe and starting to not dismiss her like I
    have her cousin/her just keep on talking And talking

    I would be hid out hoping no one remembered me
    and that nameless. All 3 puzzle me now where I just ignored

    These are the facts I took away from that article:
    KH believes Ky left school with TH.
    Someone caused unimaginable harm and it may have been her.
    The MFH plot is credible.

    Could the divorce wait until after the trial? I’m not sure why they are pushing that. Do they think it is a way to get info from her that LE can’t get?

    I think TH thought RS was just another pawn in the games she plays. I don’t think she ever in her wildest dreams thought he could be the person that I’ve come to believe he is. She either owed him money, or he was out to get even for the police being called to his home, for all I know it could have been a threat from KH during the confrontation that made him act out and take Kyron. I’ve always thought taking Kyron was aimed more at KH than TH, and as weird and strange as she is, I do NOT believe she planned his murder.

    Either something went terribly wrong with the kidnapping and Kyron was accidently killed, or who ever took him killed him right away.
    This is where my thinking gets more than a little disturbing, and where I kind of see what Panda might mean, I’m gonna try not to have to put it in black and white. RS was in landscape maintenance, what kinds of machines are used in that line of work? Mulchers….wood chippers…..etc. I’m pretty sure you can figure out where I’m going. I hope and pray I’m wrong.

    Sorry, I think you’re exactly right. Houze is looking to get discovery underway–find out more about what LE might have. That’s at least one good reason for Bunch to file for expediting the visitation. And that’s a good reason for KH to be filing to NOT expedite it. And giving a million reasons why it shouldn’t be expedited.

    This is mostly about legal maneuvering. OK, and TH would, of course, like to see her child.

    I’m trying to read through everyone’s thoughts on Elsa/Elsie. They can’t be the same person unless Mama Elsie graduated high school at the age of 30. Her flier lists her as born 1978. Elsa’s FB page has her graduating Beaverton High in ’08. Can’t be the same person but perhaps a neice is what I’m thinking.

    No I don’t think Kyron will ever be found. I lost hope of that with the last search of the Sauvie Island. LE keeps going back there for a reason. That is where the trail ends. They were looking for bones and they never found them.

    The next logical step is the river. A big American river with a shipping channel. The kindest way to put it is that Kyron was buried at sea.

    IMO, of course.

    TH didn’t have time to do anything with Kyron on SI other than hand him off to someone else. One, if by land, two, if by sea. I take two.

    One of the things that bothers me about the MFH plot as a basis for the FAPA RO: In order to get a FAPA RO, the timeline has to be that the threat was within 180 days of the application for the RO. How coincidental that the MFH plot fell within that 180 days requirement. Well, barely did. It happened 6 months prior to KH’s filing.

    And it wasn’t an ongoing threat, as LE knew on June 26, because Rudy said he never intended to carry it out.

    I call it LE strategy against TH. (KH was happy to use it; he wanted out of the marriage by now anyhow). MOO

    In addition, KH said that LE said that there could have been other attempted MFH solicitations by TH and they were looking into it.

    Again, my call on that is LE strategy.

    I want to share an Oregon moment — even if I have to give up my home state. When my son was a toddler we took a winter road trip ending in Portland at a party for my uncle. We were stuck in terrible traffic and torrential rain on I5. My husband had to hit the brakes right while I was reaching in the back seat to give my son a juice and he stopped more abruptly than he intended. The person in the car behind us just laid onto his horn.

    That car followed us all the way to my uncle’s house. We arrive at my uncle’s home at the same time as my other aunt and uncle. My other uncle immediately started complaining about the driver in front of him from California who didn’t know how to drive in the rain. My aunt and I looked at each other and immediately separated our husbands before they could figure it out.

I absolutely believe that TY is working on this case one way or another, and he certainly has the experience and knowledge to do so. Further, I’m sure KH, DY and TY are still receiving updates from LE and their actions are based in part on what they have learned from LE.

    FWIW, IMO the Elsa Mejia that Kimberly found on FB does not look like the missing Elsy Mejia. The FB one looks much younger, thinner, etc., BUT the FB photo could be 10 years old, right? IF, big IF, they are the same person then the connection to persons and places in this case could be a huge loop that ties RS, “nameless”, & AV together. That said, this would be an awful lot of folks involved in something and yet no one has snitched as far as we know. IF one runs with this theory the implications are endless and give me a headache! I would need more info. before pursuing it further…we’ll see what pops up.

    Remember the Roloff Pumpkin Patch w/ “KHFundraiser” & there were people that had NOT heard/seen ANYTHING about Kyron ?

    @riverpearl- Yes, I saw that on the news. IMO a lot of people go to the Roloff Farm because they are on TV, and it has become a huge tourist stop. I’m sure a lot of folks come in from Washington and other parts of Oregon to go there, and others put it on their vacation agendas. That being said, I do agree there are people that don’t watch the news, read the damn newspaper or internet, etc., which is very frustrating. Point in fact: my sister in law up on the Olympic Peninsula in Wash. that had no clue who Ky was. I would like to think that these people are a small percentage of the overall population.

    Sorry to say I’ve got one foot in this camp.

    At times I’ve been so frustrated with the investigation that I just wished the boy would be found in order to bring some closure for the parents and the prosecution would happen when it happened. Sadly, I don’t think Ky is going to be found … and I don’t know how that ultimately impacts the case against anyone.

    I do not think that LE would allow TY to work on this case in any capacity for obvious reasons, but I would bet that he and KH have discussed their theories of what happened that day. The expression on TY’s face during that first presser and the Dateline interview tells me he is living his worst nightmare as a LEO and a stepdad.

    I hope you are right Idahogal. I think we’re all getting frustrated at this point. Regarding Kiara at the SF, what we haven’t heard is if anyone in the school saw TH with Kiara. Maybe Skyline parent can shed some light on that. If she was not seen inside the school with Terri I think TH either picked someone up on the way to the school and that someone stayed in the truck with Kiara or she dropped Kiara off for someone to watch. What is known is that TH had Kiara with her at the second FM stop.

    I so much appreciate your responses. I am very familiar with Lincoln County, although I no longer live there. I would recommend to any tourist that they have a full-tank of gas before passing through ;) I completely understand the contencious relationship between employers and employees. While that relationship classicly lacks a fair balance, you did an excellent job portraying reality here. I never had a union job before moving to Oregon and have had only one since living here. Frankly, there was no representation.

    Over the last 7 months or so, I have considered going north and have looked at job opportunities there. These are tough times to make large decisions. However, I am tired of playing games that I will never win and feeling like a manic-depressive choosing to move one day and then being too afraid to do it the next. Even if it means living momentarily in a homeless shelter, anything is better than this.

    NelMell and S, I will definitely read and view “Sometimes a Great Notion.” I am amazed I have not done so yet.

    I remember this video and watched it again, thanks. Both of them sound confident that Kiara was at the SF, however neither of them were at the SF and they know Terri lies about things. Maybe LE confirmed this with them, or perhaps another parent mentioned it?

    Given Terri’s FB picture history, I would have expected her to take a picture of Kiara at the SF too. Maybe she did and hadn’t posted yet, or maybe Kiara was in the truck as some have suggested. I hope she didn’t leave her in the truck (which would have been out of her sight), but it might explain why people didn’t immediately say they saw Kiara at the fair.

    What struck me in same FB album were large, long Slip ‘n Slide photos.

    I remember in summer scroll-and-roll reading a creepy anonymous comment in one of numerous summer news organizations comments (or maybe a blog comment?) on Ky case, something to the effect:
    if one wanted to, they could slide a small person into a sewer pipe of water grate down a big slip ‘n slide, just pour a child’s swimming pool water to get momentum going.
    Where is DDS slip n’ slide is located, private property? Are any ground pipe grates nearby?

    Sauvie’s Island is flat, but not hills around Skyline.
    Slip-and-Slide FB photo maybe just a coincidence.

    While many are far-fetched (Craigslist) I’ve always wondered if someone who knew something planted seeds of hints in blogs early on, before (TH, DDS) lawyering-up silence?

    Does MCSO typically have someone with a culling eye on thousands of wild and wooly blog comments, many inappropriate (early FB trolls on Ky websites) and deleted along the way?
    In your experience, are there intended web comment “plants” to steer in a wrong direction? Tip line leads alone likely keeping DA on overload. Does new task force still include ICE, FBI, etc?
    So many disturbing and unanswered questions.

    I think it is the going hypothesis here that TH met RS at Skyline school, where RS Landscape Maintenance was working on special projects under a grant. IIRC those grant funds were available in fall, 2009. Someone will correct me if I’m wrong.

    Hi Falstaff, I’m definitely not picking on you or Oregon, just stating a fact about the land along the coast, not the sand on the beach. Everyone who has ever lived in Oregon knows that the “beach” belongs to everyone. And everyone has heard of the McCall legacy including the one about, “please come to Oregon to visit but don’t stay.” I will qualify my statement that the “coast” was sold and say I meant all the property along the beachfront. If you turn your back on the ocean(which one is to NEVER do) you will see row after row of motels, vacation rentals and homes owned mostly by person’s not native to Oregon. It makes me sad.

    I don’t know if anyone has offered this before, so forgive me if this is a repeat. I found an unusual question on one of the LE questionnaire’s for search area residents that I don’t remember having noticed before. The questionnaire isn’t dated and I don’t remember exactly when it went out. Here is the question and the link to a copy of the whole document:

    I'm just wondering why they wanted to know everyone in the area that may have had a visitor that day. I mean, I understand LE wanting and needing to know that-I'm just unsure how many people would be honest about it. People in the midst of affairs, drug deals, other illegal activities, etc., would not list their "visitors"! So too many potentially important people would be missing to be of real help. JMO
