Kyron Horman Case: Terri Horman Sexts Sent To Kaine Horman’s Phone…. WHAT?

In what can only be considered the latest bombshell development in the case of missing Portland boy, 7 year old Kyron Horman, blinkoncrime.com has discovered that the recent sexually graphic text messages or sexts, allegedly exchanged between Terri Horman and mutual friend Michael Cook, may have been altered.  Definitely, alter-able.

Blinkoncrime.com has confirmed that the phone number which Kaine hand-wrote on the originally sealed emergency restraining order dated June 28, 2010, matches the cell phone number he also alleges, through his attorney Laura Rackner, was used by Michael Cook to RECEIVE the “sext” messages in question.

What’s the issue?

Kaine Horman owns the phone and the account it is registered to, and unless the allegation is that Terri Horman, using her own phone as purported by Kaine, is herself posing as Michael Cook and sexting herself, which would seem like a physical impossibility given some of her *glamour shots*, we have a serious problem.

In Kaine’s own handwriting on the June 28th Restraining Order, he pens that  is an alternative number for Terri Horman.

In the contempt order filed by Kaine Horman on July 12, Ms. Rackner states that she has personally seen the “work phone” records of Michael Cook, and goes on to say “a search” of his cell phone reflected that he took snapshots on June 28th of the earlier served restraining order, which had been sealed, and was the basis for the contempt motion in the first place. He took pictures of sealed documents on the phone belonging to the other person bound by the same order prohibiting Terri Horman from showing anyone. As there are no texts on the work number until July, it is the only logical conclusion.

I am going to go out on a limb here and assume that at some point it occurred to someone that using good faith information in your affidavit, which when not alerting the court that your client has complete ownership and access to the data on the phone account in question, can look like bad faith in a nano-second, thus the withdrawal.

However, not everyone is on the same the playbill because the 21 pages of texts, which were released in PDF format, and do not include any numbers for Terri Horman herself, were supplied in an electronically redacted format; which again indicates this was not an original file.

It was not until the unredacted pdf’s became available October 26th and we converted them to HTML files could we see that based on the file format, it is clear these records came from the account owners and were not subpoenaed from the carrier. Original files, also provided to the respondent, are the requirement of the court. We all know texts can be sent from our phone online accounts, and from our phones directly; I think I even have voice command to text widget thingie.

Anyone that had access to the account, which is registered to Kaine Horman, could clone, spoof, or manipulate those messages, period. That aside, let’s consider the possibility that Terri Horman HAD implicated herself even slightly in any messages on phones that may be utilized to illicit information by a woman who demonstrated her complete knowledge that she understood what expectation of privacy parameters she was under the impression she was operating under, and engaging in, with the “textee”.

Terri Horman was represented by counsel, it would not be difficult for Stephen Houze allege that Kaine Horman was in constant contact with MCSO, had already been provided case sensitive information by them, and as such, was acting as an agent in soliciting the text messages. You see where I am going with this?

The fruit of that poisonous tree is more like the fruit of the poisonous orchard.

The implications of this scenario are abysmal. While I completely understand the desperation of a Father wanting to locate his child, since I have yet to really see anywhere Cook attempts to engage Terrri Horman about Kyron’s whereabouts at any time; I do not get the point of the exercise.

Ms. Rackner is a first rate “Super Lawyer”, but she is not above the burden of her duty to insure that what is being provided to her as a “good faith basis” is just that.

Does this information make Terri Horman any less vulgarly inappropriate at best? Hell to the No.

While it is true on the surface because of this information one will be hard pressed to prove it was definitely Terri Horman who sent the electronic ipecac none of us will soon forget, her attorneys have not denied it was her, nor do I expect them to, at least not until they read this.

What it does, yet again, is potentially compromise the criminal case involving the disappearance of Desiree Young and Kaine Horman’s son Kyron.

This afternoon, blinkoncrime.com contributing editor and Legal Analyst, Lea Conner weighed in:

Kaine Horman claims that law enforcement provided the texts records to him, but that does not mean that the records came from the cell phone provider, nor does it mean that the conversations involve Michael Cook or Terri Horman.

In fact, there are indications that the text message transcripts filled by Mr. Horman are not as they appear.  At least one of the phones purported to belong to “Michael Cook” is registered to Kaine Horman.

Just as important, none of these records indicate any information about the texts Mr. Horman alleges were sent by his wife. Mr. Horman does not list any cell phone number, not one message ID, not one cell record that indicates the identity of other party to the conversation let alone indicating Ms. Horman as the other party to the text message “conversations.” In the case of the phone with the “503″ prefix (503-XXX-XX76), Mr. Horman is the registered owner of the phone that was purportedly sending texts as “Michael Cook.”

More bizarre, Mr. Horman listed this number as belonging to Terri Horman in his application for a temporary restraining order.  Was this a slip on the part of Mr. Horman? Mr. Horman claimed in a motion for remedial contempt that Ms. Horman showed a copy of the restraining order to Mr. Cook and allowed him to photograph the document.

Given that the phone Mr. Horman is the registered owner of the phone he purports was used by “Michael Cook,” it begs the question as to whether Ms. Horman ever allowed Mr. Cook access to the sealed restraining order.  As a party to the action, Mr. Horman had the very same sealed documents. Mr. Horman, through Counsel Laura Rackner, claimed to have reviewed Mr. Cook’s “work cell phone records.”

It is not clear if the documents Ms. Rackner referenced as Mr. Cook’s “work” cell records are, in fact, for the phone registered to Mr. Horman. If the sealed documents referenced in Mr. Horman’s contempt motion were photographed with the phone registered to Mr Horman — the same phone that Mr. Horman claims was used by Mr. Cook —  it might help explain why Mr. Horman withdrew his contempt motion.

Had he gone forward with the motion, he might have had to explain how it was the documents allegedly photographed by Mr. Cook were the same documents that he had in his possession, and that the phone used to photograph sealed court documents was registered to him, not Mr. Cook.

The records for the phone with a “971″ prefix (971-XXX-XX63) are unlisted.  This phone also purported to send texts as “Michael Cook.” Due to the unavailability of any registration for this phone, it is impossible to tell to whom the phone belongs, or who was actually sending texts from this phone. The unredacted copy of the cell phone records filed on October 25, 2010, only identifies one caller on each set of cell phone records. This means that the records came from the phone, not the cell provider. Text records on pages 1 through 12 of Exhibit 1 are from (503) XXX-XX76 (“Cell Phone A”).  These pages allegedly represent text messages sent between 10:17 pm on June 30, 2010 through 7:19 pm on July 1, 2010.

In separate court documents, “Michael Cook” is identified as the sender of text messages and the recipient of text messages is identified as “Terri Horman.” Cell Phone A is a Cingular/AT&T cell phone registered to Kaine Horman. It is also a phone number listed by Mr. Horman in his restraining order application as a phone number for Ms. Horman.

Pages 1 through 12 of Exhibit 1 does not list any phone number for the portion of the conversation attributed to Ms. Horman, only that the texts listed were received by (503) XXX-XX76. Text records on pages 13 through 17 of Exhibit 1 are from (971) XXX-XX63 (“Cell Phone B”).

These pages allegedly represent text messages sent between 6:49 pm on July 4, 2010 through 8:30 am on July 6, 2010.  The bottom of page 17 has a partial text message sent on July 6, 2010, which purports to be sent after 8:30 am. Cell Phone B is an unlisted cell phone with AT&T (formerly Cingular).

In separate court documents, “Michael Cook” is identified as the sender of text messages and the recipient of text messages is identified as “Terri Horman.” Pages 13 through 17 of Exhibit 1 does not list any phone number for the portion of the text messages attributed to Ms. Horman, only that the texts listed were received by (971) XXX-XX63. All texts in Exhibit 2 are from Cell phone A, and allegedly represent text messages sent between 2:29 pm on July 3, 2010 through 9:40 am on July 4, 2010.

Exhibit 2 does not list any phone number for the portion of the text messages attributed to Ms. Horman, only that the texts listed were received by (503) XXX-XX76. All texts in Exhibit 3 are from Cell phone B, and allegedly represent text messages sent between 8:44 pm on July 6, 2010 through 8:41 am am on July 7, 2010.  The top of page 1 of this exhibit has part of an undated message from 8:41 am., possibly on July 6, 2010, that states “I understand. I’m upset about kitty.  I didn’t do [sic]”

Exhibit 3 does not list any phone number for the portion of the text messages attributed to Ms. Horman, only that the texts listed were received by (971) XXX-XX63. Surely investigators working on this case must know that the cell records filed by Mr. Horman as coming from Michael Cook’s phone were not from Mr. Cook’s phone, but from a phone registered in his own name.

Someone in law enforcement must have noticed that the number Mr. Horman claims belong to Michael Cook is also the number he claimed belonged to his wife in his TRO application. Mr. Horman signed his application for temporary restraining order on Monday June 28, 2010, prior to its filing at 4:39 pm that afternoon.

This was two days after the Multnomah County Sheriff’s Office conducted its failed sting operation at the Horman residence on Saturday June 26, 2010. MCSO was unable to confirm the murder-for-hire plot that had been alleged by the landscaper.  As a result, MCSO was not able to arrest Ms. Horman.

As such, why did law enforcement then give the green light to Mr. Horman to obtain a restraining order on the basis that his wife had hired to hire a hit man?  Or did Mr. Horman act unilaterally without the endorsement of law enforcement? Surely Mr. Horman must have known that law enforcement could not verify the landscaper’s story, yet he went ahead and filed a restraining order based on the very allegations that law enforcement could not verify. So why did he sign his name to allegations that he knew were not true?

The text messages don’t check out.  The murder for hire allegations don’t check out.  The only common thread here is a man whose son disappeared on June 4, 2010. As tragic and anguishing as Mr. Horman’s circumstances may be, that does not excuse misrepresenting information to the court.

Mr. Horman cannot claim that the phone registered in his name is Michael Cook’s work cell phone, nor can he claim that the phone allegedly used by Michael Cook was used by Ms. Horman. When Sheriff Dan Staton talked about knowing things that might surprise people, could he have been talking about cell phone records? Maybe Stephen Houze and Peter Bunch will force the sheriff to reveal its source for the records.

Although the answer would not bring Kyron home, it might at least alleviate some of the blame heaped on Ms. Horman, as unpopular as that may be.

If it were me, I’d have a post with the photo the included the missing flyer and info. or I’d remove that particular photo altogether. It is a really cute pic of Ky, brought tears to my eyes again…sigh.

    I send messages of “hang in there” to anyone stuck in heavy snow on the east coast. I’m from NJ, but have lived in upstate NYS for 30 years. The lake effect storms we get off Lake Ontario would make NYC close for a month. Funny how you get used to 4 feet of snow, five times a year, and hold back your unsolicited advice when other parts of the country get half that amount and shut down.

    About the magic date, Feb. 1st. I tend to be an optimist. I think LE “knows” who they want to arrest (arrest first, among more than one person) but their hands are tied on only circumstantial evidence. Thus more funding will be requested and approved because LE will inform those who need to know: “It’s more than one person, it’s people who are not casual transients but involved in a routine of trafficking, and yes, TH knows them but that’s all we have on her for now.”

    Any other hunches?

    Once your post comes out of moderation it is posted according to the time that you wrote it, not the time that it ended up posted. So think of it this way, if you wrote a post at 9am and it was in moderation, and another 20 posters wrote posts after you between 9:00am and 11:00am which were all in moderation, when BLINK sits down to moderate and post them all at say 11:30am she could push them all through, but your post will be back 21 spots because it was written at 9am and others were written at 9:15, 9:30 etc. It only really becomes an issue when Blink is running behind on posting items, that’s when I find that once my comment gets posted it can sometimes be quite far back.

    I also find that sometimes she will post a quick short post before she posts a really long submission. For example I once wrote two posts back to back one was very simple and short and one was long and complicated. The short one came out of moderation quite quickly, and the longer one a little bit later. I assumed it required time for a more thorough read though. So for a while only one of the posts was up and the other one was still in moderation. But when the second one posted finally, it appeared chronologically with the first post side by side based on when they were both written.

    I really don’t think it is personal at all. They are literally time stamped based on when you hit submit, and when they are posted they appear in order based on that time stamp, not the time stamp of when they were moderated and posted. Sometimes I notice that posts written after mine get posted on the site before mine and I always assume that Blink is at her computer working from back to front though the pile of posts she needs to moderate, and mine must have been one of the earlier (ie. further back) posts.

    But they always end up posted, and if you look at the times they are always posted in exactly time order.

    PS – I understand about the posting and storm related issues, etc., and wish you well, Blink. What I’ve never been able to figure out is if I am missing anything because of the count. My computer right now shows “comments (6353)”. If there are 50 posts per page that I can see – as my computer tells me there are, I would think that is 50 pages plus 3 posts on a new page (not thread, but page). However, that never quite adds up right. I have 5 posts on the new page right now.

    This shouldn’t be related to what is pending and not posted. Anybody snowed in and on their 3rd cup of coffee have an idea about the counting? I have a couple of really sad personal situations going on right now and BOC helps me take my mind off them for a little while. Plus, I trust and value all the hard work that goes on here to get justice for victims that no longer can speak for themselves.

I have friends that are yoga instructors, front desk workers & childcare workers…we’ve had conversations about the case & none of them have ever mentioned that she has been there…. otherwise, people are waiting for the case to unfold…. There are a few that are very nervous that she is living so close to our neighborhood school….

    Post from my phone never made it through earlier today. Wondering about an article in the local news earlier this week, and if there has been anything found to link DAD to Kyron. The article indicated that “something big was happening late Monday night” on Sauvie Island. Haven’t seen anything in the news yet on what exactly was happening. That coupled with Blink’s comment to Ode at about the same time has given me an awful sinking feeling. Praying for Kyron and Desiree.

    It's good this is all still happening to get his face out there, but I wish this had all been pushed more in the beginning. The truck company featuring the huge pictures and now this show-just seems like it would have helped out a lot more 8 months ago.

    Does anyone else think that Kyron is out of the area and LE knows that? These new ways of getting Kyron's picture out there(after 8 months) makes it seem like there is some knowledge that Kyron is not in Oregon anymore. Or are these just things the family is pursuing on their own?

    I was looking at the swim school site and there are several photos of Kiara with the instructor, and one of Ky and Kiara with him. When I hold the cursor over the pics is says “Horman” on them. Just thinking about other possibilities for how SZ might have found or come in contact with the Hormans. It seems possible that a SO or ped might hang out at a swim/fitness center where there are lots of kids, especially when they are changing clothes and showering in locker rooms. I hate that I’m thinking about this, but I’ve had to consider it in my life wrt to my own family. At any rate, it is another example of the Horman kid’s pics being put on the internet for all to see, with a last name attached, no less. Knowing what I do now from my BOC education, I would not agree to have pics of my dear ones on a web site. All just IMOO, thinking out loud again.

    DAD’s landlady is on NW Lucy Reeder. Her name is in recent MSM articles. I believe it’s her parents who own their own house on Sauvie Is, which in past few yrs they put a huge addition onto. Its landscaping is gorgeous. (I very quickly checked into the Fazios, so can’t swear its his landlady’s parents, but believe it is some relation that own big house).

    IDK what to think of the new TV spots I mentioned yesterday and the truck signage. Is it an indication of info. that LE has about Ky’s status or that this case has gone cold for them? I know KH & DY are not giving up and I totally understand that, I won’t give up either. It’s just making me nuts that there is NOTHING that points towards any resolution. Some people think he was taken and is alive somewhere and others think he was/is not. I remain broken hearted.
    Would love to hear other’s thoughts.

    Jden @ 12:02 Thanks for posting the comment from Adam Farber about how he never would have guessed that Ky was Terri’s stepchild. I made this point a few months ago regarding LS. Many speculated that he may have taken Kyron as revenge against Terri for dumping him. Others then asked why he would take her stepchild rather than her bio child if he really wanted to hurt her. My gut says he also had no idea that Ky was a stepchild. Kyron did, after all, call her “Mom”.

    If she was so horney that she took on the landscaper as a sex toy, I doubt that she would be revealing intimate family knowlege to him. He was, after all, nothing more than the hired help. How many stepparents talk about their personal family relationships with workmen? Even if you did decide to have a fling with the milkman, I doubt you would discuss those topics…you wouldn’t want emotional intimacy with a sex toy.

    If she did solicit him for the MFH, again, she wouldn’t be talking or whining about her stepson. She would be drawing him in with sex, much as she tried to do with Kaine’s friend Michael Cook. If you read those texts, you will see that she is not sentimental or emotional, even in the wake of Kyron’s disappearance. She thinks like a man and just goes directly for what she wants.

    I would be willing to bet that, if LS is involved in Kyron’s disappearance, he never knew Kyron wasn’t her own biological child. As a Mexican myself, I can tell you that the first born boy would be the prize, not the baby girl. Terri would not have fit the Mexican model of how a woman should behave. She was not submissive and SHE was using HIM. Once he figured that out, his manhood/macho sense of himself would have been insulted and he would have been hugely pissed.

    I think the good sheriff will find the money to stay the course w/o a new budget request until he gets a hoped for break–maybe the March divorce hearing. I wouldn’t hold my breath for a formal task force report in Feb. That was an arbitrary goal he set.

    Clarification: I believe Sheriff Stanton need only go on the Council agenda if he is requesting more money. No Dept head really wants to ask for more money mid-year. If he conserves (no more big SI searches for example) and/or moves surplus $ around, he can delay providing a formal task force report (as opposed to informal phone updates for political relations) until he must have more money.

    It should be noted that Mr. Sanchez has not been charged with any crime in this matter and local references to his business are highly complimentary. In fact, Jean Ann Van Krevelen a friend and “mentor” of Dede Spicher has used RS Landscape Maintenance on a few occasions, leaving positive reviews on the ServiceMaster listing which deleted his business from the site on 6/21/10. Heather Walters, owner of Rosemont Farm,which is not West Wind Farm, where Dede Spicher was working the morning of June 4th and out of reach by phone from approximately 90 minutes, has never met Terri Horman or heard of their family prior to Kyron’s disappearance. When I asked her if she knew Rudy Sanchez or if she ever hired his firm to work at WWF, she replied “not that I recall, no, but we did have a blackberry clean up a few years ago so it is possible.”

Michael Cook made a statement about knowing Terri during a telephone interview just a few days ago. According to Michelle Sigona (sp?) she was interviewing Michael Cook for a piece she was doing for “Missing in America” with Jane Velez Mitchell as host. Michelle Sigona on Air stated to Jane Velez Mitchell that during the telephone interview Mr. Cook made the comment that he had been ”ESTRANGED” from BOTH KAINE AND TERRI for some time “BUT, because of this AWFUL EVENT” they had been brought back together. Seems to be some question now as to just how long these two have known each other…very interesting!!!

    @jan- Good catch! IMO this is freaking weird. Here you have found the above link and it lists Ubaldo Sanchez under trucking jobs with a comcast email contact. Comcast is doing the ads for missing kids… Elsy & kids are Sanchez but no mention of them anywhere in MSM & they are not being put on trucks or in ads, so far as we know.     The front page of the Oregonian is very ominous this morning. Only have time to share a small bit but the article should be easy to find. They are searching 2 areas based on “very specific reasons”. They also have 7 cadaver dogs. “Time has gone by yes, however, the things that we’ll be looking for, if they’re there, they’re still going to be there”. Very scary words if you ask me.

    OMG – we have been in these areas driving and hiking A LOT in the past 2 months! There is a lookout on Dixie Mtn. off of Skyline Blvd. where you can see the Columbia River basin, Mt. Rainier, Mt. St. Helens, Mt. Hood, Mt. Adams, & downtown Portland on a clear day. It is a trail head for hikers and one of our favorite places to go. We always see elk, coyotes and other wild life up there as well. I thought these areas had already been searched heavily, now I wonder if some hunters or hikers found something.

    Investigators suspect more than one person was involved in Kyron’s disappearance and thatmore than one crime occurred: an alleged murder-for-hire scheme by the boy’s stepmother against her husband before the boy went missing, Kyron’s kidnapping, and who knows what else. They’re still unsure what happened to the child, and have had to consider all options, including his being abducted, becoming a victim of human trafficking or being killed.

    The sheriff is pushing for something to shake loose by Feb. 1, the end of a 120-day deadline he set for the task force and when he reports to county commissioners about the status of an investigation that has cost nearly $1.4 million as of Nov. 29.

    “The scope is narrowing. My belief is we should be relatively close to something by then; that’s why I set the time frame I did,” Staton said. “While we may not be at an arrest or an indictment phase, we’re going to have it narrowed down to a point where we may be calling out a suspect, identifying certain people or things.”
    Yet prosecutors and task force members aren’t about to set any deadlines.
    “This is a marathon, not a sprint,” Capt. Jason Gates said.

    They point to one undeniable fact: They lack any physical evidence of Kyron, or physical evidence that links anyone to his disappearance.
    “I think about this case constantly,” said Sgt. Keith Krafve, the task force supervisor who was the night shift sergeant when Kyron was reported missing. “Our biggest hurdle: We don’t have the kid, alive or dead.”

    By September, the sheriff became worried about the direction of the investigation as costs mounted.
    “I wanted to know what’s going on because I lost confidence in the investigation,” he said. “I felt the case was moving towards a cold case, and I was concerned. We had collected a ton of information, and nothing was being answered.”

    They must look at all potential theories: They suspect Kyron’s stepmother’s involvement, but did she pass the boy off to someone? Could the boy have been taken along the I-5 corridor and out of the country? They also must identify and interview child predators and sex offenders living in the area.

    “They’re a lot further along,” Staton said. “They started out with a long laundry list. … They’ve gradually been able to eliminate people who they can say are absolutely not involved. This investigation has narrowed it down significantly.”

    And, with “not one shred of evidence to indicate the child has died,” Staton said, investigators must push forward as though Kyron is still alive.
