Caylee/Casey Anthony Case: Casey Anthony’s Defense Has Gone To The Dogs

As previously reported on blinkoncrime.com, the hearing last week ordering Jose Baez and his defense team to submit specific information regarding their expert witnesses, has gone to the dogs.

Woof!

Dr. Fairgrieve, a forensic anthropologist and expert witness listed for the defense, intends to testify that Casey Anthony should have the right to confront her accuser.

Novel, appropriate, good news.

In this instance, one of her accusers with fur, according to her defense attorney, is named Gerus. The other, Bones.

For starters, if the summary of Dr. Fairgrieve’s findings is accurate as presented in this filing, I recommend as a practical matter, he identify exactly what “alerts” he is seeking to debunk.

There are several, all of which are well documented.


Orange County sheriff’s investigator Carlos Padilla told reporters, “We had two different dogs from two different counties that hit on the same exact spot.”

Evidence Bay with a closed car:

Casey Anthony’s Car: Detectives reported a different dog alerted to the same strong smell in the trunk after the white Pontiac had been abandoned in a parking lot.

“They have a hypothesis that the child may have somehow passed away,” Dr. Richard Weinblatt told Eyewitness News.

It is undoubtedly the recent work of Dr. Fairgrieves in a case involving a murdered man, Robert Wone, that got the attention of Jose Baez and his Scheme-Team.

In a successful inlimine motion, Fairgrieves offered testimony in the supporting affidavit that suppressed canine evidence in the Robert Wone murder.

The three male house mates of Mr. Wone were acquitted of the charges they faced as a result, which were not for his murder. The prosecutor himself could not prove his actual cause of death. The trio are currently facing a wrongful death action by the desceadent’s family. 

“My role in the case is basically peer review,” Fairgrieve told the Orlando Sentinel. “I will be reviewing reports on the evidence. So far everything I’ve done has been remotely.”  Scott Fairgrieve, MD

The ole probative vs. prejudicial argument is not unexpected in this case, I get it.

However, two different cadaver dogs, from two different counties, hit in the same area under or near Caylee’s playhouse. This was AFTER the alerts in the evidence bay on the car trunk, and both searches were conducted with permission from the Anthonys.

That would be the car trunk that produced one latent lift from the accused in this case, Casey Anthony.

Under Dr. Fairgrieve’s theory of “necessary corroboration”, we, in fact, have exactly that.

The hairs that were found in the trunk, including the hair with the “signs of decomposition” corroborate the canine’s alert as well as the report from Oak Ridge Labs.

Let us not forget, that a statement from the car’s owner and material witness in this case, concurs with the presence of decomposition in the damn car.

    I am wondering why I can’t find the nearly 1000 pages of discovery Cheney Mason said on Mon 1-3-11 was handed to him. Isn’t discovery generally up in the media within days of when it’s been handed to the defense? Has anyone seen it anywhere?

    I also can’t find the penalty phase witness list refered to by Nora in a previous comment. Can anyone give a link or source for that?

I never saw this video and found Judge Perry & Attorney General Lamar’s remarks to the grand jury interesting, to say the least.     Nilton Diaz, filed a motion for a new trial, claiming he was convicted due to the “defectiveness” of his defense attorney, Jose Baez.

    Baez called it a common post-conviction strategy that often cites defense mistakes to win a new trial.

    Won’t all these articles and legal opinions about Baez’s incompetence help Casey eventually with an appeal that she didn’t have good council? I do admit to getting a kick out reading what most of us think – that the experts agree he’s not doing a great job. But I just worry that it will come up later in an appeal.

Those reports must include “a complete statement of opinions the witnesses will express and the reasons for those opinions, and any data or other information considered by the witnesses in forming their opinions and conclusions.”

    Now, since they list it under ethics/discipline, does that mean they might actually do something about it finally?

    I don’t necessarily think that the articles or legal opinions will aid Casey in getting an appeal on the issue of Jose Baez’s incompetence. But- sometimes I feel the way you do but then I think to myself- they are only opinions.

    Sure these writer’s ect, ask the questions- point out JB court room behavior, his immaturity, his hubris, but for the most part, they ask questions and give opinions. In other words, they are doing their jobs- and are giving the public, their readers, what they came for- their opinion on issues that matter to them. Will they matter in the greater scheme of things? IDK

    IMO Judge Strickland did a mighty good thing when he brought Jose Baez’s alleged mishandling of DC to the board- HJS put a legitimate concern up for the board to rule on- and they ruled that there was insufficent reason to act. Judge Strickland, also did something else to ensure that Casey gets a far trial- He ruled that she must be present to oversee her team in action- she must be an active observer to her own defense, thereby safeguarding herself and the system, and in turn, Jose Baez.

    Judge Strickland had also made other decisions which help to ensure there are no grounds for appeal- He asked Casey Anthony if she was satisfied with her council, he did this in open court, as the public was watching, and we all heard for ourselves, that Casey is satisfied with Jose Baez. Last, but not least, Honorable Judge Strickland recused himself from this court case, rather than give JB and the defense fodder to hold over the public’s eyes.

    There have been several other complaints brought before the Florida Bar Grievance Committee, alleging unethical behavior ect. Dominic Casey alleged improper behavior ect IIRC and the issue of How JB and Casey funded her defense were also brought before the Bar. Each issue has been investigated and as Jose Baez himself stated-, “I have been cleared of all Bar complaints filed against me.”

    IMO the State’s attorney’s themselves, continually go over and beyond in making sure that Casey Anthony’s rights are protected, they have several times brought up issues regarding what they feel should be done inorder to help ensure Casey gets a fair trial ect.

    Honorable Judge Perry has also been doing his utmost to ensure Casey Anthony receives a proper defense and that she is guaranteed a fair trial. Last week, JP made sure that The defense team was well aware of a witness that alleges that Casey Anthony didn’t commit the crime of killing her daughter, and he made sure that the defense was well aware of the claim that this witness has evidence to back up his statements. Each time we watch a hearing in which HJP resides, it is obvious that he goes to great pains to make sure that JB and team have what they need and understand what they are doing ect.

    Therefore, IMO many people have helped ensure Casey Anthony is getting an appropriate defense. Those that brought concerns to the Bar, did their part and had the concerns not been dealt with, the issues would be real cause for concern which may have led to bigger issues. The State, each Judge, and the Bar, did their part to ensure that Casey’s rights are protected and that she gets a fair trial.

    HJPerry did not sanction the defense, IMO to punish him for his hubris, or to make The public or we bloggers happy- He did it to ensure that Casey Anthony gets a fair trial- He did it to ensure that JB plays by the rules laid out before him by law.

    Judge Perry handed down a sanction for a ‘willful’ violation of his previous orders to share expert-witness discovery with the State, in order to ensure there is no “trial by ambush” -Thereby making sure that Casey Anthony gets a proper defense, and can not hide behind “mistakes” of her defense in appeals ect.

    IMO HJP and the State will continue to work hard to make sure that Jose Baez does not get handed down a sanction that would result in the accused, Miss Casey Anthony, being denied the right to present certain witnesses or testimony ect. However, I think it is now obvious, that J Perry is no longer just warning the team. He is prepared to do whatever it takes to make sure JB & team play by the rules.

    What it always comes back to, for me, is that Casey’s opinion has always been, from the start- and through-out, that she stands behind Jose Baez as her council.

    IMO Jose Baez may be immature and he may be inexperienced, and completely full of himself, but I give credit where credit is due- Jose Baez has managed to defend Casey Anthony to the best of his ability. And his ability has been deemed just fine by his client.

    Jose Baez has managed -( possibly through no action of his own), to get many fine legal minds on his dream team, working for his client, yes, some have since left, but they aided in Casey Anthony’s defense while they were there.. IMO, Casey Anthony is well protected- extremely well-defended. Here’s the thing- Jose Baez and his dream team are doing their jobs, but, it is an uphill battle.

    I think Casey Anthony refuses to make it easy. I think she is now the one pulling the strings- and her defense team has its hands tied providing their client with the defense she dictates they must.

    Casey Anthony is a woman that throughout her young adult life has never backed away from her lies. No matter if she is cornered, no matter if their is evidence of her guilt, no matter the consequences to herself, or her ‘loved-ones’

    She sticks to her charade, come hell or high water.

    If her parents couldnt get her to tell the truth, if her brother couldn’t get her to tell the truth and those detectives couldn’t… What makes anyone think that any member of her defense team can get her to back away from her lies- even if it means it will save her life?

    Jose Baez & the rest of the team are doing the best with what they got- and everyone else is doing their best to ensure that the defense’s best, will be adequate for defending Casey Anthony- safe-guarding her right to a fair trial, by law. Despite what opinions I or anyone else may have, that is what matters.

    Come what may- appeals or no appeals. As Honorable Judge Perry said in open court, he does not mind trying this case twice.- I would think that means appeals- or no appeals- sanctions or no sanctions- Whatever it takes. All JMO

    Sadly you are right, even seeing her baby daughter’s face did nothing to make Casey Anthony want to tell the truth.

    I often wander if and when Casey will hit the end of the hall again, and offer up some little shred of truth- Will it only be after the case is tried and the jury is deliberating?- or will she get an Epiphany and tell some bit of truth earlier? Or has she said all she is going to say, in the way of truth, and she will let it all play out- no matter the consequences, nomatter how much evidence is against her, forcing the jury to make the ultimate decision -sending her to death? Thereby, Never taking one shred of responsibility for anything, and continuing her family’s suffering long after she is dead?

    As for the Florida Bar- I don’t know what to think- they must need a whole lot in terms of evidence inorder to find an attorney at fault.
    Regardless, The Bar’s findings is what allowed Jose Baez to continue to act as Casey’s attorney.

    I would think that the Bar followed the rule of law each time- inorder to protect all involved in this case, including those that brought the issues to them, and themselves, not to mention Jose Baez and Casey Anthony. If not, as you pointed out, there is going to be alot of explaining to do later… JMO

    Mom3.0 – brilliant! helps me so much as it answers all my fears and questions that I am loathe to post for fear of looking legally uneducated. Thank you Blink, Mom3, Sister, Kleat, Chica etc. for the time and effort you put into this site, I truly appreciate it. I don’t always find the links so please continue to point the way for us slow coaches. I was fascinated watching HJP at work, he restored my faith in the justice system. I just don’t understand Mr Mason’s attitude. I consider him rude, disrespectful and at times, plain ‘cranky’. His presence seems to be more of a hinderence than a benefit, he is all over the place with his paperwork and full marks to the Prosecution, they have been patient and polite in the extreme, their pure profesionalism glaringly obvious by comparison.

    Yes, this is is their third go-around. The first was illegal and shut down, we produced a 90 page report on it, the second the IRS kicked back because their statement of purpose was too broad.

    It is a charitable foundation, anyone that has contributed has the right to request a report.

    Blink I have a question, I don’t understand how asking Casey Anthony a High School Drop Out, if she is happy with her defense team, her answer being yes, holds water, I don’t understand how come Baez has not been removed by a higher more educated power that recognizes the injustice he is doing to her and her case, please help me understand because I am confused as all get out…how does this process work, I believe she deserves a fair trial as do all, and this circus act has my head spinning circles…..anyone please educate me on this process….Thanks in advance!

In hindsight, Casey seems to get po-ed when the detective tells her they have more than speculation alot more- she seems to rethink her willingness to be ‘forthcoming’ at that point- (How dare he not accept her motherly feelings as gospel) She emphatically answers ‘yes’ to Jose’s question of (pp) Do you want to go in another room and speak to me?…. then when they return JB seems flustered as he states that Casey has now changed her mind.

    I guess it is all in how you look at it- I wonder how the jury will see things?-

    For someone who did not want to be sanctioned (Mason), it is my belief he is walking on thin ice. How does bozo get Mason to do this for him? I don’t think momster is the only one who has fallen down in the elevator. The duhfense is stuck between floors.

    I personally think that one of the reason’s Casey is SO happy with Baez is the rumor of a “close” relationship at the beginning of the case, when she was out on bail and spent everyday/allday in/at his office. I think there is a closer connection in her mind that reg attorney/client. JMO, And as I stated this was just a rumor, not fact.

    Well, it seems the shared hubris effect strikes again Blink. Cheney Mason is the person on the defense that seems to be the most bothered by the Sanctions being handed down for Baez. He of course, being the attorney that has the most to lose regarding his reputation ect. Mr. Mason wrote a twelve page motion.

You see, we, the defense, do not know what our defense /strategy is going to be- we are trying our best- but we are forced to provide the best defense to our client, Miss Casey Anthony- who still clings to the assertion that she is innocent of any and all wrong-doing in the matter of her 2 year-old daughter’s, ‘disappearance’ and homicide, despite any and all evidence to the contrary… As you know, Jose and the team have floated many many err… ideas ect of why our client is innocent, and even who else may have done this- Not one has resonated with the public…

    Please, your honor, reconsider these Sanctions, I am at my wits end in trying to protect my law career, I am embarrassed and I am unwilling to accept that Jose B. Good Esquire and his hubris has now tarnished my reputation. I assure you, that we have provided The State with everything we have, the problem is what we’ve got well… it ain’t much.

    Let me demonstrate :- Our experts are willing to testify- to something…(but only if they really have to…) One of experts, performed the autopsy, well…he is umm willing to say … essentially, that the remains were placed on the left side-as shown by the debris inside the skull- well as you know, the skull was found upright- So we really hope that can only mean that someone besides our client placed the body there. Thereby proving The State’s expert must have mistakenly wrote about the debris and the tooth. The expert didn’t even open the skull- Hence, that must prove that the State’s expert has to be wrong in stating that the body was placed at the site before complete skeletonization, and was moved by scavenger animals and water levels ect.

    I hope you understand my frustration err uh.. I mean our position now your honor, you must have misunderstood before, perhaps misread, we are all trying our very best….really-. I hope you will give us another chance … I really do… the last thing we need is sanctions… Oh My reputation…. this is definitely NOT fun…

    Ps Jose wants me to add that he is doing the best he can, considering he is now getting paid below minimum wage- I gotta go now. He is screaming- over and over *I want my three dollars* I want my three dollars*
