Caylee/Casey Anthony Case: Mock Trial On CBS- They Got The Mock Part Right- CBS Footing Bill For Richard Gabriel Defense Jury Consultant

Orlando, FL-

On Saturday evening, Central Broadcasting Service, the second major affiliate to pay  Anthony family members for “licensing”, $20,000  for the 48 hours segments, aired what was labeled as a pseudo mock trial with a pseudo mock jury.

CBS 48 Hours also  STATES THEY COMMISSIONED the focus group.  Are we clear on that?  CBS has outright admitted to contributing to the costs of the defense expenditures of Casey Anthony.  That is a source of income to this defendant, period.

It was not until one tuned into the program that we learn what was billed as a mock trial of sorts, whereby previews show jurors would acquit Casey Anthony based on the evidence to date, of 1st degree murder, that this is actually a "focus group" where the moderator, Richard Gabriel, President of Decision Analysis, actually works for the Anthony defense team.

Richard Gabriel is the President of Decision Analysis. Since 1985, Mr. Gabriel has been a leader in the field of jury research, jury selection, and litigation communication in nearly a thousand trials in both the civil and criminal arenas across the country.  Mr. Gabriel has assisted counsel in the O.J. Simpson, Heidi Fleiss, Phillip Spector, Enron Broadband, and Whitewater trials, and is currently working with attorneys in the Casey Anthony matter. Three cases he has participated in have resulted in United States Supreme Court rulings.

Judge Perry denied Jose Baez's request for payment to Richard Gabriel as a jury consultant to the defense.  In some fashion, we must assume he is paid.

I say that facetiously- this man is the Jack Welch of jury consulting and influence.  During the broadcast, host Troy Roberts discloses that CBS is footing the bill, as a thinly veiled disclosure of sorts.

Say what you want about Gabriel, he is pioneer in his field, and he is being paid to do what he was hired for.

In a pre-trial engagement, the focus group is the pre-cursor to an actual mock trial, should the defense engage the further services of Decision Analysis.

Forgive my oversimplification for a moment, but in layman's terms, this is a straight up product development strategy, exactly the same in process as any major consumer brand attempts to develop or re-brand something they want YOU the consumer to purchase in abundance.

The "re-brand" in this offering: THE INNOCENCE OF CASEY ANTHONY FOR THE MURDER OF HER DAUGHTER CAYLEE.

HEH?

As a former Advertising Professional, this epiphany gave me my first chuckle for the hour.

Allow me to present a hypothetical scenario, I say hypothetical because hypothetically my former client would have requested a confidentiality agreement with my firm of course.

Scope: Recruitment Initiative, Conduct, Moderate and Quantify Result of Focus Group.

Account Supervisor: Deena Whitman  Draper

Project Code: Condiment Verdi

Let's start with the recruitment.  It is mission critical for any part of the focus group to even matter, to secure the right market analysis which personifies the optimum "buyer" for which the product analysis is being conducted.

In Law: We replace the "buyer" with the juror, or the trier of facts.

In last nights episode, we were never told how this group was recruited.  We do not know if everyone of those folks are paid actors.  We do not know if they are members of any one's family affiliated with this case.  We do not know if any of them thinks Casey Anthony dancing on a table with her bewbs popping out of  her dress, paid for with stolen funds, which resulted in her felony conviction.

You get the gist.

Focus group participants ARE PAID. Focus groups appearing on CBS 48 hours are PAID WELL. Focus group moderators are PAID.  Jury Consultants posing as focus group moderators make a freaking fortune.

WHO IS PAYING ALL OF THESE PEOPLE WHEN THE CLIENT IS INDIGENT???

I digress.  Please allow the following example in demonstration.

Project Summary Excerpt:

The focus group for Project Condiment Verdi indicated an overwhelming negative reaction to the proposed product offering. This data is further supported by the market trend analysis presented in Exhibit A.  Ms. Draper, Account Supervisor to BEINZ, outlines some additional launch concerns in the forward thinking section of the recommendation outline, including, but not limited to, a child's association with similar substances of similar hue and viscosity may be mistaken for said product and be harmful.

The recommendation of this project director is that BEINZ abandon exploring additional R&D and launch options for this product.  Moreover, in the event that BEINZ elects to move forward with Condiment Verdi, the undersigned does not feel that our firm could best represent Beinz's interests for a launch design or additional campaign needs for this product.


You see where I am headed with this, right?

The hypothetical client launched anyway, and it was an abysmal failure.

Expensive focus group, expensive launch, expensive loss.

The BAEZ LAW FIRM is no stranger to expensive losses, however.  It would seem that although Casey Anthony and members of her family, were the recipients of at least $275K from abc, a large amount of which is still unaccounted for, money is no object.

Also appearing on the 48Hours episode and introduced as a former member of Casey Anthony's defense team, Linda Kenney Baden discusses what is not in evidence.

Did I miss a release floating around somewhere? Would the fact that she is former council for the defendant in the instant case PRECLUDE her from discussing what is tantamount to work product?  Who waived this privilege for her statements?

Additionally, as she claims to have departed from the defense team in October 2010 due to the inability to pay travel expenses, who is paying for her travel expenses and any monies for her appearance on 48 hours?

People- she still works for Casey Anthony as a consultant, she was present and identified at the deposition of  Dr. Timothy Huntington in January 2011.

Again, I say, how is she being paid now?

In theory, if an attorney withdraws their appearance, in her case, pro hac vice, can they return as a consultant paid for by another source? YOU BETCHA.

Last Friday Jose Baez argued before the court that he has concerns that his client would be unduly influenced or PREJUDICED by pre-trial publicity in this case.

He was of course denied, because contrary to what has seemingly occurred to date in this case, the Supreme Court of Florida does not give a rats azz about Nielson.

Short Version: CBS and this defense has engaged Richard Gabriel and Decision Analysis for EXACTLY the purpose of influencing potential jurors.  Says so, right on his webume.

Is that the role of the media during sweeps  now?

Sometimes, successful longevity tested products DO gain some alterations to their iconic reference.

For example, a fave of mine as a kid, and widely sold to this day in hundreds of variations of product distributables, is also used synonymously with suicide and altering rational thought.

Don't drink the Cool-aid folks.  Drink the Kool-aid.  Big difference, one is real.

Wow. What a novel concept.

Influencing criminal case outcomes to sell more advertising based on consumer interest.

I certainly hope the net result of that is not maternal homicide for diaper ads cash to get away with it.

What next, "Big things come in little packages" on the side of a funeral urn?

Be appropriately horrified.  Do something about it.

    You are correct about the forum, and that we don’t know anything about the people who were used in this forum. And this was from the defense point of view, and Linda Kenney Baden discusses what is not in evidence.

    And after snooping around the internet I did not see that it changed anyone’s point of view. I did read others who said that it was tainting the Jury pool. Huh? The evidence is what it is. A subliminal message from the defense is not going to change the evidence. Is the evidence going to be enough to convict Casey. I don’t think so. What I took away from the show is what Pam Bondi had to say, which was nothing. She spoke with conviction, but didn’t offer anything substantial to walk away from the show saying “the prosecution has it right” Casey didn’t want to be a mother anymore(is not what any witness has said) That Casey was the only one that could have done something, (that is not true) No DNA (but that doesn’t matter) And parting and lying for 31 days. I just don’t think it enough.

    I wonder if the prosecution is going to go with June 16th as time of death? or a couple of days?

    Blink caught that one when she replied to you. That big fat “F” was done on purpose. My hands are large and sometimes a fat finger will hit a key that I don’t intend to hit and I do not catch it. Not this time.

    Perhaps I should be more respectful of Mr. Baez, but his behavior makes it difficult and Blink’s caption seems to fit him to a “T”.

    We don’t know what is going on behind those big eyes of Casey. Probably for the first time since she was ten years old, she is not able to manipulate the entire scene. What is her reality? Being a sociopath makes it difficult to seperate fiction from real events.

    I don’t know if, under Florida law, there must be total agreement by the jury in a death penality verdict. Could one or more jurors affect the outcome? This may be the only hope the defense team has.

    I think the prosecution will present a case so strong that the defense will feel like they have been taken apart by a chain saw.

    You know, sitting directly across from the jury, its one of the things that I just don’t understand from this team. They have done stoopid before, but are they really going to have ICA face the jury on a daily basis, watching her non-mother type of reaction to everything that is being said, regarding her innocently pure, adorable 2 yr old, trusting baby girl,that the inmate unceremoniously suffocated and tossed like a used Kleenex? Something’s up…..unless, of course, the inmates ego is again in hyper-drive and she thinks she can convince those 12 people without saying a thing.

    I think the Defense moving the their table to face the jury is a strategic move for four reasons. One, the jury cannot seeing any touching that might be going on under the table: touching in the sense of squeezing someone’s knee to “remind” her to cry or not to react angrily/contemptuously or touching in an unprofessional/familiar way, as Baez has been previously warned about and Casey has been exhibiting in court. I found it hilarious that after the jury room meeting last Friday with JBP, Casey, the Defense, and the State, that Mason physically stepped back several feet to give Casey a wide berth when she returned alone to the table. It was equally telling that from that point on Baez, Casey, and Mason were careful to keep their personal space for the rest for the rest of the hearing.

    Secondly,moving the table forces the jury to concentrate more on the person testifying and less on Casey. It also makes it easier for Casey to not be looking at state witnesses or her family head-on. Apparently, the video cameras at the front of the courtroom have been making her, Baez, and Mason feel very uncomfortable. You can tell because of their antagonistic behavior toward the camera man (Baez repeatedly accusing the camera men of zooming in on what his client is writing/their computer screens/etc., Baez blocking the camera, Baez making silly faces ,Casey shooting her middle finger up the left side of her face at the camera & camera man, the barely contained contemptuous looks Baez/Casey/Mason often shoot at the camera/camera man, etc.). I cry, “FOUL!” on all points here. Why should the state of FL be so concerned about accomodating this one inmate? I’m not the slightest bit concerned about her comfort because she wasn’t about Caylee’s. It’s sickening to hear Cindy go on and on with her concern for Casey-Where was her concern for Caylee three years ago?

    Thirdly, Casey can try to play up looking all sad, forlorn,young, and innocent to a captive audience. Of course, this strategy will backfire because she has no real emotions other than her excitement over partying and scoring herself a man. I’m sure Tony has thanked God numerous times that he’s “the One that got away”. I’m sure he had no clue what he’d really hooked up with.

    Finally,any future book/made-for-TV movie deals are going to need good shots of Casey, Cindy, George, Lee, and Casey’s defense team, don’tcha know? BLECH!

    All of the above is my opinion. I’m not worried though. The Creator of Heaven, Earth, and Caylee is on the throne and justice IS coming. If Casey and the Ants had any sense, they’d be running to repentance (a sincere change of heart accompanied by heart-rending sorrow and admitting personal sins; followed by visible long-term change in behavior and demeanor). That’s fact.

    Adding a P.S. to my above post (#4). The state needs to point out that not only did Casey kill Caylee, she actually eradicated all of Caylee’s descendants as well. She eliminated an entire branch of the family tree. That’s why God hates murder. Not only does it destroy a Designer Original, but all of their descendants as well.

    Blink, you know what will really suck about actual jury selection? That there probably won’t be any single moms on the jury. I would imagine that any single mom, who has possibly struggled and sacrificed and put her child (or children) first would be appalled and very likely to give Casey the needle themselves. However with the high probability of being sequestered in another county for up to 3 months or more, that alone most certainly will exclude them. See, unlike the inmate, they are working their behinds off to do the best for their precious children.

    What I didnt write is that everyone I talked to after the show, came away- not even realizing that this is a death penalty case.(Iknow it was discussed but no one seemed phased by it, I guess 48hrs glossed over that little tidbit too—or maybe it was lost in the never ending commercial breaks. Unlike my family and friends ect, the real jurors will know undoubtedly they are seated on a death penalty case.

    The whole feel sorry for Casey & dont be like the messed-up protesters message was lost. IMO Everyone I talked to was convinced of her guilt & ready to give her the maximum sentence- for first degree murder, whatever that may be.

    The defense and all of their team did not present any evidence to the contrary. 48HRS never showed the evidence that was presented to the focus group- – they never gave any reasons for why the public should just accept that Casey is a liar, not a killer… and why The Zanny lie wasnt a grossly thought up premediated lie/ attempt at an alibi, but just a continuation of Casey just being Casey ( whatever that is supposed to imply -ect

    The 31 days missing/partying was mentioned and poo pooed away.
    The 7 mnths of searching for a kidnapped/missing child was mentioned and poo pooed away
    The disposal site was mentioned and poo pooed away.
    The fly evidence was mentioned and poo pooed away-
    The smell in the car was mentioned and poo pooed away.
    The hair evidence was mentioned and poo pooed away.

    The most dramatic moments of the whole show was the footage of the protesters- Thanks to you, Blink I now understand why- “subliminal message” indeed.

    I do hope the jury hears, sees and smells all of the trunk evidence.

    I too feel sorry for what the jurors will have to endure- but I think you are 1000% correct Blink- they will never be able to think panicked clean-up-accident-and loving mother.

    Casey went to great lengths to clean that car… the car she says reeked like something died in… and the car in which she stated something was dead “plastered” to the frame o , but she had got rid of “it”…why clean if you are gonna leave the source of the smell in the trunk? She left the trash because no matter how she tried the stain and smell remained- The truth assaulted her senses at every turn- she cleaned because she was trying to rid herself of her deed that couldnt be erased. She abandoned the car for the same reason- “Out Damn spot”

    The jurors will never be able to equate the trunk evidence Stain/smell with a trash bag which contained nothing that would account for the stench and stain.. no milk- no cheese -no salami- no pizza…they will understand the amount of cleaning that went into the cover-up and the effort that went into the lies. They will understand why there was only a few hairs left behind, they will understand why the trash bag was left in the car, & why the car was abandoned. They will know why Casey went on with her bella vita NEVER alerting authorities and why she made up the Zanny alibi and all the rest.

    Its as plain as the nose on her face- she did it- she meant to do it and she is glad she did it- everything that came after was her attempt to get away with it.

    I did not watch. My nerves are shot as it is and I know my husband loves the tv he saved for. Besides, who really wants to see these people blown up in HD on a 48″ screen, really. By the comments themselves, I can see it was a ‘biased’ on most levels.

    It would seem that the defense’s objective to ‘taint’ backfired. I wonder if they ever considered the possibility of failure. It makes me wonder, though, who’s @$$ they’re protecting at this point. IMO. their careers are on a fine line. Claiming Casey as an indigent while seeking other unethical avenues of payment is disgusting on all levels. If anything, I hope the Florida tax payers are enlightened as to how the defense has been wrecklessly squandering their hard earned income on this disaster. BTW, nice suits Baez. YEAH, I went there.

    Actually….the table the defense asked for gives us better shots of casey’s reactions. The cameramen were NEVER trying to get shots of the defenses’ laptops. But from across the room there will be better shots of the WHOLE table including casey’s under the table actions. IMHO, this was one of their biggest mistakes. NOW, they are wide open to the camera and its ability to pan the wide shot. Whereas in the current spot, the camera was limited in its abiltiies.
    I hope this gets shots of casey she never thought about. And Simms and her ridiculous insincere worries will get thwarted for once and for all.

    1. Cindy (the RN’s) initial reaction to the smell in the car.
    2. George (the detectives) statements regarding Casey to law enforcement.
    3. Casey’s little trips all over town with LE making up stories as they drove.
    4. The destruction of Zanny’s life. Perhaps CBS might assist her in her honest recovery of damages? This story might actually grab an audience.
    5. The lies and theft Casey exposed her friends, extended family and her Grandmother too. Cindy didn’t protect her mother from Casey either.
    6. The testimony of her friends.
    7. The horrendous disregard she had for the life of a baby that couldn’t defend herself. She wasn’t even buried with the dignity of a pet.
    8. The evidence left with Caylee by the roadside, such as: , clothes, bones, weeds, stickers, tape and God willing fingerprints.
    9. The dogs hitting on something in the backyard.
    10. The intense cell phone calls and the plumber.
    11. All of the Professional testimony, the trunk liner and the evidence that LE is saving (I hope, hope, hope).
    12. The many things I probably forgot?
    I am not a brain in anything that is legal. I am just drawn to this story of an unwanted little girl who wasn’t saved by any of her family members. I can’t imagine what happened to Caylee, but I pray for justice. I love this website; because, it attempts to defend the defenseless. “The Money Trail,” what a great article. Thanks Blink!

    OrlandoNative, I think so too. The jury will be facing ICA, all of the time. I think this was a big booboo too, because although we won’t see the sneakies that they are always doing, we will see how hard the inmate has to work at looking innocent all the time. I don’t think she can hold it up through out all of the testimony. How can she not show how she really feels? And the jurors will be looking for those tell tale signs to judge how they feel about her, right now she is prolly the most hated female in American history…..

    Casey Anthony’s lawyers have turned over a recording of the news report to prosecutors, suggesting they will use video of that duct tape (at the shpping center/ Caylee table) at trial to defend their client.

    If so, the video could confirm he had access to the duct tape, which prosecutors call a possible murder weapon, Local 6 News reported.

    However, the defense could also suggest that Caylee Anthony’s kidnapper stole the duct tape from the table and planted it with the body in the woods to frame her family for the murder.


    Gee George or whomever – NOT Casey and NOT Zanny…wistfully and stupidly used the same duct tape to put up missing signs …we are supposed to believe he/or anyone would not simply throw out the duct tape and remove it from the gas cans ect..if he or any other Anthony was aware of its use in the “crime” why would they risk its exposure?

    As for someone stealing it and planting it yeah right- it was put on before decomposition occurred- which begins very soon after death..and was holding Caylees mandible in place and was attached to the hair mat…good luck with this ploy guys- go ahead point out the obvious to the jury..Casey had access to the duct tape the gas cans the car the trash the trunk and the body…and wasnt afraid to throw it all back into Georges face

    True they made a major problem there!! because she will be closely scrutenized by the jury!! Baez didnt want the cameras in the courtroom for that reason!!! the excuse he gave was lame considering he has been in the media excessively and especialy lately!!

    I was kind of upset that the judge didnt come down on him friday and came to the conclusion that he is giving baez enough rope to hang himself!!
    The judge did reference a 48 hr reversal to let baez know he had his number!!!

    baez doesnt have much room to complain about the jury because he shot himself in the foot on that one by going on t.v!!! his inexperience as a lawyer along with his over blown hubris are not allowing him to take baby steps and learn from his many mistakes.

    Something I would like to say, I always look at both sides of everything, while I am up to date with this case currently, when I first learned about Caylee, when she was still missing, the one thing that constantly comes to mind is the 911 tape. If I were a member of the jury, I’m not sorry to say, but I would have made up my mind as to a guilty verdict as soon as I heard her talk to the operator. The more I listen to the recording it feels like Casey has a sense of pride in her voice when she says “My daughter has been missing for the last 31 days.” Notice it’s not 30 days, it’s 31. Looking through evidence photo’s, I’ve never seen a trunk so clean (meaning the carpet), besides the ‘stain’, my stance is she moved the body, cleaned her trunk, and put garbage in the back thinking it would cover up the smell of decomposition, or someone would think it was due to the garbage. I think that’s why they only found one hair, not to mention the fact that the baby was placed in two bags, not one. Another question I have is who drives around or puts garbage in their trunk for supposive weeks at a time anyway? I’m thinking they probably should have went with a mental defense, there are no other explanations to this crime. I have also never seen two incompetent attorney’s in all my days of watching cases unfold, half the time Baez can’t even spell when he’s doing his wonderful little powerpoints for the court to see, jee all the time he probably put in those! I don’t get her mother, Cindy, trying to make up her mind about statements, and how magical medication helps her ‘remember’ things after two and a half years, and the way they give attitude to the prosecution and even the judge at one time or another. I can’t wait to hear an anynomous guilty verdict for this case. Honestly, I can’t even be happy with her getting life in prison to ‘think about what she’s done,’ because she simply doesn’t care what she’s done. I want her to know she is sentenced to death, and I wonder if we’ll see tears then when we didn’t see tears when her two year old baby was alone, most-likely drugged, couldn’t breathe, died, was thrown out like garbage, first in the car, then in the wet, filthy woods. It breaks my heart, and I want justice for Caylee, not for her scum of the earth mother. I also can’t wait for this ‘compelling’ information the defense has to offer!

  28. Blink I have flowed this case from the beginning. I’ve never posted on your site but have been a faithful follower. I think the fact that she didn’t report her daughter missing along with the statement that she made to her family that she feels that she is close by will nail her.

    You think that Cindy found something in the yard that told her something was wrong. Do you think she found Casey’s diary and read Casey’s horrifying actions and thoughts on her new life. Case would have had time to write the details the day that Tony picked her up at location where she abanded her car.

    I so agree with your comment that Casey has destroyed a designer original and eradicated an entire branch of the family tree.

    Cindy stated that Caylee did not just belong to Casey she belonged to all of them. My thought on this is that once Caylee was born she belonged to the world. As with all innocent children who have been murdered by a parent, pedophile or other type of whack job we will never know what they might have grown up to be. Maybe someone who would have discovered a cure for cancer, an answer to the climate change problems, a peacekeeper or simply an average joe. Could one of them have done something that would have a positive impact us or our childrem or grandchildren. All of these children would have grown up to be somebody. While we may never have known them personally they would have been important to someone. We will never know what Casey has taken away from the world.

    I hope they bring the liner into the court room or at least the teplar can and sample that Dr. Vass received, causing him to ‘jump back 2 feet’ when it was opened. If the stain is still visible on the liner, and HHJP allows it into evidence, that would be very powerful stuff for the jury. I also hope they take the jury to Suburban Dr. so they can see where Casey dumped her precious child. Even better if the area is flooded so they can see why the searchers couldn’t check there. This trial will be excrutiatingly painful for jurors with children or grandchildren, to say the least. No matter where they come from, I cannot imagine them not convicting Casey. Her demeanor and the unprofessionalism of Team Anthony will will make it a no brainer for them.

    Defense point of view? I thought they covered both sides. I heard a counterargument for everything from Pam Bondi. Did everyone seem to miss that? Or do people on this site only hear one side of things? They’re okay with Pam Bondi making statements, and all the statements from police and the prosecution since day one, but they’re not okay with someone making statements that might shine doubt on the evidence or Ms. Anthony’s guilt? We’ve heard in the media constantly information that promotes the prosecution’s made-up scenario without proof, but how dare anyone look at the other side? Let’s just make up our minds and come to judgments after hearing one side alone because then we’ll be sure to satisfy our lynch mob mentality. Who cares about Constitutional rights!

    I heard no counterargument, I heard the same lame drivel I have heard for what will soon be 3 years-

    “It will come out at trial”.. Except for this next 40 minutes, where we play “courtroom” and let the viewing public hit the bathroom vanity for the alka seltzer an hour before bed for the privilege.

    What I saw support AG Bondi’s position for the state was photos, and witness accounts.

    Maybe I missed it, was there someone else caught in a photo tossing a baby in the swamp?

    Turning cardboard into maggot infestation?

    Was there a photo or witnesses to a Zanny?

    You are missing the most pivotal element that the DEFENSE has going into this case-

    NOBODY wants to believe a Mother of a 34 month old could harm her. N O B O D Y.

    Where that would have helped, is if Casey would have told the truth and struck a deal.

    Now it is just a temporary mindset for a few minutes while the jurors here why that is an absolute reality.

    I have to add one more time, I wish media people would stop saying Casey waited 31 days to report her missing baby..she never did. And never would have, had her mom not called..

    Also..anyone else think LKB has had a lot of surgical/makeover work? She looks very different than around the Spector trial..

    what the anthonys and defense fail to comprehend! the anthonys because they have never gone through this before and baez because he should have never been allowed to take this case with what little experience he has had!!

    WTH???????????? How can they do that? It screams hearsay, imo. It’s not like the prosecution wouldn’t tear it up on Casey stand in.

    Have at her. Let her rip! No matter what, it’s going to backfire and at least demonstrate that the defense knows Casey is her own worst witness.

It was Cindy’s intervention and persistence alone that revealed Caylee was ‘gone’.

    Anyone remember the “promise” Lee howled out to CMA at the memorial? she may be cashing in her chip. Maybe Lee will be the martyr for the clan to try and get their princess back. Everybody is focusing on George but Lee is the one that publicly swore to CMA that he’d keep his promise…and I sure don’t think it was to his niece.
