Caylee/Casey Anthony Case: Will Judge Rulings Today Be Defense Doomsday?

Chief Judge Belvin Perry promised to rule on 2 outstanding motions by her defense team today.

Update #1 4:45PM.. Motion to exclude trunk stain… D E N I E D

Rulings on Critical Motions regarding a hair with a "deathband" that could only belong to a deceased individual and either Casey or Caylee Anthony, and the air samples tested by Dr. Arpad Vass and found to contain chloroform levels he has never seen, in his 22 year career.

The air samples themselves are not in contention as the "hardware" and methodology in their extraction are used widely in the scientific community, and the defense team, through a stipulation agreement to withdraw contempt proceedings against him, could not argue about anything else.  The defense argument was largely about the interpretation of the data that was yielded from the samples as they relate to a decompositional event in the trunk of Casey's car.

Both motions were a combination of a Frye/exclusion attempt by the defense that took several days in court to conclude, in which many observers felt were disorganized and poorly argued in contrast to the deft responses by the prosecution.

Yesterday, for the second time, Jose Baez on behalf of Casey Anthony filed a response to the State's motion to let his already withdrawn "experts" Dr. Danzinger and Dr. Weis be permitted to testify as to what Casey told them during their interviews with her.

You may recall, during the State's deposition attempt of Dr. Danzinger,  Judge Perry put the kibosh to it after receiving a call from Jose Baez, and both depositions have since been sealed.  Judge Perry referenced testimony about Post Traumatic Stress Disorder, or PTSD, but legal experts agree that in itself would not be grounds for suspending a deposition and immediately sealing it.

It is this editors opinion that during the deposition,  Dr. Danzinger recounted parts of his interview with Casey Anthony that may have been incriminating to her.

It was abundantly clear that the defense strategy is/was to attempt to have these witnesses speak about parts of their interviews with Casey Anthony as a way to repeat her "defense" without ever taking the stand, subjecting her to cross-examination by the state.

It is also abundantly clear that Jose Baez et al did not understand the Judge's comments about these depositions the first time around.

The only way these "Docs" will be permitted to testify to anything Casey Anthony told them, is if Jose Baez presents an exception argument to the hearsay rule, and since the "declarant" or Casey Anthony, will never take the stand, 'not gonna happen.

Yesterday afternoon, the defense depositions of Tony Lazzarro and Amy Huizenga were filed with the court.

While there was largely previously known information contained in both depositions, there was one noteworthy tidbit in Ms. Huizenga's which the defense glossed over in a hurry.

Reported exclusively by www.blinkoncrime.com,  the Anthony's withheld a major plumbing emergency at their home that sent someone from Hopespring Drive in a panic to locate Caylee.

For the first time, it is confirmed that Casey knew about it, and told Amy it was one of the reasons they could not move in:

    Before selection began-According to Tony Pipatone, The defense asked for a continuance, because they needed time to obtain and review odor decomposition database that judge just allowed into trial. It was denied.

    Todays happenings according to my best recollection–

    Earliier Casey said she does not accept a plea- I do not know that this means one was offered before the start of todays proceedings… or if that is just a formality. Blink or anyone, do you know?

    - Casey began crying while J. Perry was giving the potential jurors instructions- she cried silently on and off throughout-

    The p.jurors are only to be referred to by their number.

    They are trying to eliminate those due to hardship first-

    45 people were set aside in the first group out of about 1000
    So far they have questioned approximately 7 people 3 have definitely been released due to hardship one woman for family obligations one man for financial hardship and an additional single father due to prior obligations both financial and familial.

    This is going to be a very long process, but at least the wheels of justice are finally in motion.

    Well done Mom3.0, perfectly observed. I joined the selection after lunch break and at first felt Casey seemed anxious and subdued but it didn’t last! She took to pad and pen as at previous Hearings and acted as if she were one of the legal team. I find her behaviour towards her elders very disconcerting, finger beckoning to the defense attorneys, giving orders/instructions to uniformed jail staff, all typical Casey behaviour. When JBP read out the list of charges she didn’t look so cocky but an hour further on, it would appear she is having some input re the jury selection. JBP has ordered a further 21 jurors be sent up to join the remainder of the 45 original selected. He intends remaining in Court until the full 66 have been questioned. He is a real no nonsense Judge – love him!

    I’m learning Casey was booked prior to court. Sorry, but is this regarding today’s jury selection or is this back tracking to original booking almost 3 years ago?

    Interesting to watch Casey’s reaction to the jury selection process today. A little more emotional than usual. She genuinely looked scared, hence the tears, perhaps. Still the ritualistic grooming and hand rubbing. Other than that, she seemed to be running things behind the defense desk as per usual. Adjusting the comp monitors and such. Not a defendant, part of the team. Her ego and pride get the best of her, regardless.

    Several jurors have been put on call back for Wednesday. Several have been let go due to hardships, or language barriers
    One young, sounding male said he could not serve because he believes Casey to be guilty based on what he has seen and heard in the media.

    One single mother of 2 year old was let go by J. perry (agreement by both sides) because she had a child between the ages of 1 and 2

    One juror, female, sighted religious beliefs- does not feel comfortable sitting in judgement over anyone- she is being called back on Wed

    One juror, a Spanish speaking female was asked back by prosecution and defense- Baez informed the court that this juror attempted to speak to him, in fact did ask him a question IRT whether or not he could speak Spanish- he informed her that he could not speak with her, although I do not know whether he said this in Spanish or English

    Several p. jurors are checking with their employers regarding pay ect and 1 female juror with a 5 year old daughter, is checking with her school ect_ while speaking this p. juror said (pp) she would like to remain with her daughter as mothers care is different than fathers care- Casey nodded her head in agreement…I guess she is referring to her experience with her mom working and her dad staying home or being home because he worked nights…

    So far more men than women seem to be on the call back list.

    Did appreciate the candor of the one male who declared his opinion that the accused was guilty of the crime – - – the accused’s facial expression and body language were SO obviously reflective of her nature. (IMO)

    Some are predicting the ‘sniff test’ will become an appellate issue. What I found interesting is that Mr. Ashton was the first to use DNA in the country AND gain a conviction. It would have been an appellate issue at that time, too. This man knows exactly what he’s doing. (If this bit of info has already been posted, my apollies. This is the first I’ve heard of this myself).

    Regardless, Casey is going to be found guilty of one of the charges and she will serve a long time. I do not see how she can be fully acquitted:

    Four counts of obstructing a criminal investigation and giving false information to law enforcement officers; Aggravated child abuse; aggravated manslaughter of a child; first degree murder

    Sorry for my manic posts. I promise this is the last…

    I was interested in watching CJBP’s reading of convictions during the initial jury selection. I wasn’t able to watch most of today’s session. His voice carried an authoritative tone not unlike a scolding father. He did struggle with the pronunication of Caylee’s name. At one point….he seemed to stall somewhat. JMHO but he appeared a little choked up. Once the ‘child related’ charges were read, he appeared more settled.

    It answers why Casey was crying at the beginning (-3:50 in video focuses on Casey’s reactions from this point on). She only looks down during this process. She cries (apparently), covers her mouth with clasped hands. No sympathy is shown towards her from her attorneys. I’m sure inside her mind, she is grovelling for this attention (even Mason rubbing her back…..ACK!!!!!) This is not a position Casey is used to. Running out the door and disappearing for days on end is not an option, anymore :D

    They were discussing the “other” chemicals pertaining to Dr Vass work I believe??
    I tuned out briefly – and when I came back to live stream, Judge Perry was bristling and with a raised voice he said he didn’t care how or who submitted the info but it must be submitted.
    Mr Ashton said that it was the DT’s job to request the info from the FBI … and they didn’t.
    So Judge Perry suggested to Mr Ashton that he may want to make that call and get info for them.

    What does this all mean in terms of Dr Vass being able to testify?
    Why does it fall to the State to get info that Baez was too lazy/stupid to obtain.
    Did Baez wait until now to bring this up intentionally – hoping to cause a delay in the trial?

    WPG, that is so observant about that blue top, I have to admit I was focussed on those glitzy-pearlesque beads that embelished the collar line, looked like an overly pastel colour almost like a nightgown. Never thought of it as the same as Caylee’s colour– gotta think that is not a good idea, but wonder also if the woman who appeared at the end of the day at the defense table, and seemed to say ‘nice to meet you’ to Casey, was in control of her attire for the day, as she herself was in the same, but richer, blue for her jacket. Reminiscent of the institutional sea-foam days, but so prissy, and princessy for Casey, unlike anything her mother or her lawyers have dressed her in during their hearings (as try outs for what worked best). That all seemed to be tossed out the window.

    I made a tiara on one of her photos today in a quick bit of photoshopping before morning coffee, one in which she appeared to have her best ‘I’m Princess O’ Pinellas County’ decked out in her pearls and best toothy smile.

    It was at the very end of the day (the potential jurors were gone) and Judge Perry very clearly sounded perturbed and worried by all this.
    Last 30 minutes of the day.
    His voice was startling to me … you could hear the importance of this in his tone. IMO
    He said something like “this greatly concerns me too” + “I don’t want this to come up in appeals” that the list of other chemicals/compounds were not included yet. (paraphrasing)
    Wants the list of all the chemicals – not just the 30 chemicals that Dr Vass’s sniffer machine relates to decomp.

    Judge Perry seemed to agree that it is the DT responsibility to get this info from the FBI and it is the DT’s fault that those are not part of the record yet.
    BUT … he informed Mr Ashton that they are needed- and if the DT is not going to do their job, that Mr Ashton should get this info from the FBI pronto.

    Once again Baez does a half azz job and expects others to do his work. (or this is all intentional and he hopes no one does get the list from the FBI – and then he can object later to all of Dr Vass’s work)

    Mr Ashton, Mr George, and Ms Drane-Burdick have the patience of saints when it comes to Bumbles + Mumbles clown show.
    They’ll do everything for a clean trial for Caylee. (even clean up after Baez) so there are no loose strings to snag an appeal.

    Hi, lizzy. Started thinking a couple of weeks about different looks and options, whittled them down to my interpretation of this particular DT’s “way of thinking”, and came to the Mommy and Me, grown up look/version of the tiny, innocent victim in this case. The Father’s Day video (the last known images of Caylee alive) has been played in the media and there was a good chance that a portion of the potential jurors would have seen it. Little Caylee was completely endearing to the senses . . . thought the DT might play off of this video to subconsciously put the accused in an “innocent” and endearing light. Who knows if this was really the intention or just a coincidence.

    Agree, when HJBP faltered, reading Caylee’s name he appeared to choke back emotion. He like so many others have been a light in finding justice for Caylee since the beginning.

    Interesting, little exchange, on video between Baez and KC yesterday right before juror 1129 was questioned. Sounds as though Baez can be heard saying to Casey she is acting like a two year old. CH 9, video #4, 22:32. IMO

    Good Morning All! I was watching the beginning of jury selection yesterday on In Sessions and of course noticed Casey with her brown paper towels and red nose. I thought she was being her typical narcissistic self already. If she is the only one in the room wiping her nose and fake tears, she is drawing attention to herself. Those motions draw attention away from everything else going on in the room and like a magnet draw the eyes towards her. So absolutely transparent and this is only jury selection! True narcissism at work here.

    Interesting comments from some local attorneys that were on a Tampa/St Pete morning news show today.
    The consensus from the attorneys was that in this day and age the defendant and DT must outline a “story” for the jury.
    It’s now harder for cases to be won by the defense simply by trying to poke holes in the govt’s witnesses/evidence/theories.

    Pre 9/11, the defense might get by without explaining to the jury a “story” as to what occurred – and only used a strategy of trying to poke holes in the States theory/evidence of what happened.

    But that since 9/11 … more people are increasingly pro-LE.
    Just as the State paints a picture of what happened during that infamous 31 days … the DT must also explain and tell the story.

    In this case KC’s DT (or KC herself) must explain those 31 days.
    The DT trying to put on a defense that consists of only trying to poke holes in the States science/evidence will not work in this day and age with jurors.

    I believe Baez asked for all the chemicals that were detected in Dr. Vass’s testing of the trunk (IIRC). CJBP was p.o’d! He told Baez he had access to that information himself. He implied if he was unable to do it himself, Mr. Ashton could make the call to the FBI and get them for him (ouch). This is information he should have already, imo.

    Same today as yesterday so far- more men then woman selected for call back

    Mason seems like a meany-he seems to desperately want single men on the jury JMO He disagreed to hardship cause for a man with his own business and a man on disability with 7 dogs to care for-

    Today’s selection seems to be going faster several people were let go for medical reasons-

    Most females are being let go becuse they are mothers with children and it would be hard for them to care for children while away for 6-8 weeks-

    So far, it seems that we might end up with mostly men on the jury. Who knows though this is only the first group of 100….

    Court is on a ten minute break.

    I’m glad someone else caught that too. I thought maybe I was making something out of nothing. Caylee’s name has not been mentioned much in court. It cannot be easy to overlook a trial on the death of a child.

    Recess is over I just wanted to share that according to the defense they are very concerned that their conversations at table are being broadcast over the internet…somewhere someone could hear something and posted it- The defense tried to get all mics turned off- J. Perry said we are in a public courtroom people will utilize there ears- be careful-
    Still not good enough- prosecution turned off its mic Judge P offered for the defense to move to a different table…

    IMO it is hard to hear them when they speak anyway…but that is just me.

    Now I cant hear anything they say- ARGGG!

    Adding that the very next p. juror up is telling the Judge that he doesnt feel that he can serve on the jury because he has heard too much coverage- although he hopes he would be able to put it aside- he definitely does not want to serve IMO- doctors care- job concerns- and marriage concerns-

    RD, I read that she wasnt given a plea…that she was only asked by Judge perry if she entered a plea…and she answered no I have not entered into a plea- Where did you hear that she was offered one, if you can post a link,, I’d appreciate it, because I think that figuring this out would give us some insight into whats occurring behind closed doors.

    Update- another female was dismissed because she said she thinks Casey is guilty- Casey didnt even flinch – a different female was put on standby even though she has memory issues due to meds.

    Critical care trauma center nurse (female) unfortunately IMO can not serve due to hardships with job ect-

    9th grade drop out, got GED in Navy, and you cannot attend law school without a Bachelors first.

    Personally I think watching todays proceedings is like tan paint drying—especially now that I cant hear masons witty comments (snark)

    What I do find interesting is that Casey is being proved a liar just through jury selection alone- JMO
    Each single parent, both female and male- are sighting hardships in getting competent reliable childcare for so long…they are also saying that they could not stand to be away from their children for so long, nor could they afford to be a way from work for so long…

    Hmm I guess in the real world there are no Zanny the nanny’s nor do working single parents willing take month/s long vacations away from their children, nor could they pay for their days away from their jobs—Go figure

    That explains the chip on his shoulder and why he feels a need to put on a show. My father in law did not complete gr. 8. He had 14 brothers and sisters. He had to help w/ the farm. He’s someone you cannot argue with. He knows it all, even if you have proof, he’s right. I’ve learned to keep my beak shut. If he makes a comment, I’ve learned to just nod.

    To give Baez ‘some’ credit, at least he didn’t give up.

    Did I read correctly that the court has a base jury pool of 1,000?

    It appears that the court may go through the first pass in the first 110 prospective juror group by noon Monday.

    Anyone have a feel for what number of jurors that could serve without hardship the court is trying to get as the final pool?
