Caylee/Casey Anthony Trial: Judge Calls The Defense Liars And The Prosecution Resurrects The Fumblerooski

Orlando, FL-  Judge Perry calls the defense team Liars- Not a good sign. Yesterday, during Chief Judge Perry’s announcement to the jury about the tentative schedule for the remainder of the murder trial against Casey Anthony, defense counsel Cheney Mason objected and asked for a sidebar.

Mason: We don’t have any obligation to put on any evidence at all. and you just told the jurors you expect us to be putting on evidence, and we may or we may not.

Mason went on to request that the Judge instruct the jury that they are not obligated to put on a defense, and claimed Jeff Ashton agreed with him.

       Chief Judge Perry: Then Y’all lied to me.

       Mason:NO. Chief Judge Perry: “Yes the Hell you did…”  If you don’t put on any   evidence, then I will do that.

       Mason: Well, we are, so don’t worry about it.

      Chief Judge Perry: ..” I will take I cannot trust one thing your side says, anymore.

 

Heh?  I would like to give the benefit of the doubt to his honor, as I did not believe a word this defense had to say going into this trial, let alone 3 weeks later. The State, after establishing what they believe is the origin of the disappearing heart residue on the duct tape came from stickers in the drawer with Caylee’s birth announcements, and re-calling Cindy Anthony for a little light impeachment is headed to the finish line tomorrow.

*Insert defense’s motion for mistrial late today*  Denied.

To those of you, and there are many, screaming from the hilltops.. “Is that all you got?”  “OMG, is this girl gonna walk?”  “What about Dr. Hall?”  “How the Hell is Dominick Casey getting out of testifying?” I say chillax.  This prosecution team is simply resurrecting the F U M B L E R O O S K I.

The State of Florida, has ALWAYS known this case is going to verdict on THE LAST WORD from the prosecution, or the rebuttal portion of the trial. 

 Given the defense’s opening statement, there is no question in my mind, nor should there be in yours, that the ludicrous allegations made on the first day, cannot possibly be brought to bear, and while the prosecutions case in chief was meticulous, it is not the “barn burner” for a reason.

Linda Drane Burdick is going to leave that ball on the field for a spell.  Ashton will surreptitiously pick it up and head to the end zone unchallenged. 

 After all, that play did originate at the Orange Bowl.

    The opposing side’s attorneys love it when they can rattle an expert such Dr. Spitz in front of a jury, and JA definitely did so. As an expert, you never want to appear defensive or overly zealous regarding your opinions because it can suggest bias. Spitz’s reactions to JA’s cross examination made him appear to be nothing more than an advocate for Casey Anthony. His opinion that the duct tape was placed on the remains ‘way later’ was not only ludicrous, IMHO, it was illogical and an insult to the intelligence of the jury. But, IMO, the icing on JA’s cake came when Spitz *implied* that he would do a more thorough autopsy for a high profile case.

    What a circus.

    I was dying to hear your take on Dr. Spitz.

    Circus is right. Honestly, I rewound the video 3x to make sure I did not miss anything that led him to the ridiculousness about the duct tape being applied on one side, following complete decomposition to include zero soft tissue.

    I find it simply amazing that a majority of the news reports insinuate that Friday and Saturdays defense witnesses testimony succeeded for the defense. They do not take the state’s rebuttal by JA into account at all. It is so maddening. News reporting has definitely gone down the tube for being factual. It is all hype.

    Yes, my patients were female CFO’s, European royalty, bankers, physicians, concertmasters, tailors, ranchers, teachers…no attorneys at this time, but I’m sure it won’t be long before they join us.

    Regardless of rank, degree, gender, wealth, I work to guard each one’s dignity and save each one’s pride.

    All the more for Caylee Marie Anthony.

She is indigent and is getting high priced attorneys to represent her along with some very good expert witnesses etc. She is getting way more than most folks in her situation would ever dream of getting.

    Casey Anthony has been asked repeatedly – many times, if she is happy with her counsel.
    Way back … Her parents tried to warn her about Baez possibly being in this for his own agenda.
    So did brother Lee.
    Plus, both Judge Strickland and Judge Perry have asked the defendant – Are you satisfied with your attorney’s representation of you?

    Casey Anthony is of age and after 3 years of pre-trial motions and hearings, she’s had plenty of time to watch her “boys” in action.
    She’s made the choice to have this defense team and their assorted circus performers to represent her in this case.

    Yesterdays court proceedings, my thoughts-

    Dr. Rodriguez- and his opinion NOT put in the report-

    I found it quite disingenuous – what JB did- I believe JPerry is correct- JB intentially withheld this opinion from the prosecution. JMO but JB willfully and actively hid it- even in prior court proceedings -He planned yesterdays ambush-IMO

    He wanted extra time -45 days extra- before supplying the State with the lacking report- Then as JB brought up yesterday- when the question of whether or not a depo was taken, if it mattered, in the larger scheme of things- JB KNEW then- He willfully hid this opinion from the State- and he was crossing his fingers behind his back hoping The State would not depose this witness, and if they did, JB was crossing his fingers & toes that they would not think to question this witness on the ducttape-

    I felt sorry for Rodrigues- JB made him look like a rat in cahoots with the the other members of the defense “mischief”

    Quite telling when you take into account that a group of rats is called a mischief-

    mischief meaning-
    1
    : a specific injury or damage attributed to a particular agent
    2
    : a cause or source of harm, evil, or irritation; especially : a person who causes mischief
    3
    : a group of rats; also called a horde, or pack

    - I am glad that J Perry stopped this wirness’ testimony and is allowing The State to depose him, and add experts ect to counter his testimony. I am glad that JB will be held accountable- even if it is only after the trail.

    I hope the State will be able to counter this testimony effectively.
    I can only hope that this will be the end of JB and teams mischief- but I dont think so, since they pulled the same cr@p- With Dr. Huntington and his testimony, allowing him to testify to opinions that he had never addressed in his report ect.

    BTW, Why was that Pig experiment allowed in? It was clearly shown for shock value- and had no value or comparison to what happened in this case.

    I hope JB and “mischief” have learned their lesson. Time will tell, and J Perry did say that any further attempts will result in the experts testimony being stricken- We’ll see.

    Dr. Spitz-

    I did not find his testimony believable. Ashton very respectfully, almost with kid gloves on, destroyed any strides Dr. S may have made, in my opinion.

    The Dr., I think covered one to many cases that involved a conspiracy.

    I dont know if Dr. S’s memory is going, or if it only goes when he wants it to, but It was concerning to watch his testimony unfold.

    I can only hope that a juror does not sympathize with him to the degree that they feel it is necessary to believe his wild theories.

    The Dr. could not recall breaking little Caylees skull. The Dr. refused to acknowledge that the sediment could have been just that, sediment, not “brain dust”- The Dr. would not acknowledge that skeletal remains, a skull, which was left out in the elements for MONTHS, a skull which was immersed in tropical storm waters, could most definitely have gathered sediment inside the cranium. He also refused to acknowledge that ducttape under the same conditions would lose stickiness and DNA ect-

    Sad – desperate and underhanded is how I would describe this defense so far- and they havent even begun to address the sexual abuse allegations nor the cover-up or the “ugly coping”-

    God help the jury separate fact from fiction- truth from sensationalism -actions from accusation…

    Your statement about the news media and its reporting. There is no longer a segment of news reporting that is just What, Where, When, how and who. It is all about opinion written as news. Even TV is being manulipated by producers with an agenda. We are lucky that we are able to have a video camera in the court to record events as they happen so we each have an opportunity to form our own opinion based on the facts as we see them.

    Why would anyone that has some expertise go on a witness stand and make some of the statements we have watched over the past two days of court? The only answer is fame and money. Integrity and their responsibility to their profession to tell the truth seems to be missing.

    The most telling statement from Dr. Spitz was when Mr Ashton asked if he would conduct an autoposy in a diferent maner for a high profile case vs a normal case and he agreed that is what he would do.

    It appears that money and fame override his scientific knowledge and good practice. As I stated earlier, Dr. Spitz came across as an old man rapidly approaching a senile state and no longer able to perform at the level of an expert.

    What I find amazing is the number of people that still claim Casey Anthony is innocent…that she’s being framed. Give me a break! Where are these people’s brains? I think everyone deserves a fair trial, it’s in our Constitution. But to have a case like this that is based on nothing but lie after lie after lie…it’s a waste of the taxpayers money. I think Mason and Baez should have to pay back every penny. I also think Judge Perry should get a raise and a vacation after putting up with all the BS he has. Keep up the good work state…we’re behind you 100%.

    In my experience, the term “shoddy” has become the opposing pathologists’ nasty little buzzword in cases such as this. Dr. S. used this same term to describe another pathologist’s work in another case earlier this year. In the current trial, when Dr. S. described all that Dr. G had done during her autopsy of Caylee’s remains, and everything she included in her report, IMO, it was crystal clear that her autopsy was quite thorough. On top of that, Dr. G comported herself beautifully during her testimony. She presented her findings in a clear, concise, and logical manner, and
    kept her cool during cross.

    I have a question I wonder if someone could answer. I have been doing a lot of thinking listening to all the testimony about the decomposition in the trunk being so light and absence of decomp bugs. Did the police investigate the chest freezer at the Anthony’s? That would have been an excellent ‘temporary’ store place since I’m sure Casey knew it was not accessed very often. She didn’t eat dinner at home; George didn’t eat dinner at home; they weren’t entertaining…so why would Cindy be digging in the freezer? And, if this is the case of what happened to Caylee’s little body, wouldn’t that explain the stain and lack of bugs as her body would have been ‘thawing out’ as it decomposed. I know this is gross thinking about it, but it really is a big question of mine.

    In Dr. Vass’s Decomposition Paper he gave the example of a womans body that was found off road down a hill. When found her skin was intact they felt the death had been recent. Until they opened her for autopsy and found the results to show she had been dead four months….She had been soaked with insecticide which prevented the first flies from attacking the body.

    If Casey had Caylee in the back yard in the locations the dogs hit. Perhaps flies where present and she went and got an in sect spray and sprayed the child so she could put her in the bags without being bother by the bugs. I am sure Cindy had insect spray to protect the childs enviorment when she was playing in the playhouse. I believe the car was insecticide sprayed before and after the car was cleaned. Could be a reason why diminished amount of first flies. Tim Huntington did not include this in his exerated Pig experiment.

    Dr Vass papers are an easy read. Happy Fathers Day to all the Dads and Grandfathers.

    After the fact but I was a smoker for 45 yrs & started at age 11. In 1996 I quit because my beloved Casper my little ShihTzu rescue was allergic to cigarette smoke. The second hand smoke gave him pink eye badly & during one case of the pink eye it was so very bad I thought his eyes were going to fall out so I said that’s it he was more important to me then the smoking & that’s when I stopped. After helping me thru many painful times my Casper went to the Rainbow Bridge in 2/2006.

    PT has shown more love and concern for little baby Caylee than her family ever did in her short, neglected life.

    LKB and her merry band of “media high profile case parasites” may have finally met their match in Florida. These leeches, IMHO, have gone from one high profile case to another since OJ circus. What kind of low life would be able to live with themselves knowing their sleazy tactics free a killer? (OJ) These career media parasites are beyond disgusting. Dr Spitz, your time has passed, if he and LKB think the jury is going to believe him because of his distinguished career, think again. A lie is a lie no matter how old, how educated, how respected, the person may be.

    What’s with Baez texting? While Jeff was questioning Dr Spitz, Baez was texting or was he playing Angry Birds. His disrespect for the court is maddening!!!!!!! UGH

    Baez/Mason could be crazy like a fox. Trying to get a mistrial. Blink, if there was a mistrial would Baez be able to step down as her attorney? Would another attorney be able to possibly go for a plea bargain?
    Baez may want out so bad but still wants to be KC’s hero.

    I am from UK but here in America at present. I am beginning to wonder if this trial and hopefully a sentence will be rendered before we are due to go home in December.

    Just wanted to quickly comment on your opinion regarding medial opinion being expressed in their reporting.

    Working as a journalist a long time ago, I found it difficult to separate fact from opinion many times. It took writing, editing, reconsidering, checking notes. Many times even the quotation selection or original note-taking was suspect–why did I choose one and not the other?

    This only concerns straight news items. I wrote many feature articles and could make myself cry over them…naturally I knew they would be tear-worthy “brights” in the next edition.

    Nonetheless, there is art behind the craft. Or diabolical craft behind the art. I dunno…I never tried to mislead or sensationalize. Once or twice, I let a person’s comments stand even though I was aware the fan would blow and the bridge would fall.

    Just a little food for thought. Any other former hacks out there?

    Hi Guys… January here (formally sjso) I am still posting from my phone… darn laptop! When concern was raised about Caylee being on her side, yet found face up I thought I knew why. Didn’t. Kronk say that when he found the bag, he kicked it a little bit which caused the skull to roll out? I thought Dr. Spitz sounded like he was failing mentally, especially when he couldn’t remember all the high profile TV interviews he had done. I thought his defensive tone sounded like an old man, who refused to admit he was losing it, demanding to be right even though he was wrong. I felt after cross, that that Ashton won.

    What I have to wonder is, what did Baez/Mason think Spitz would come across as? Were they under the assumption this man would be able to sell his theory of the evidence & events based upon his years of experience and notoriety?
    He started out as a possible powerful adversary to the State and in the end he became a fumbling frail out of date mess. And the laughing of the defense during this circling of the drain was, well odd. Were they laughing at Ashton & his ever elevating aggravation or to their own witness? I haven’t decided yet. I will say that at one point I was feeling overwhelmed at the awful circumstances surrounding our sweet victim here, and that a guilty mother is sitting there letting this go on. Heck, she was cracking up too!
    As far as the Baez punishment, I am with you all- Why no admonishment on Friday wrt Huntington’s testimony. he too didnt write a report containing the info he testified to. I wonder if Perry then realized Saturday that he really is pulling the ambush card and called him on it. I think he should have been restricted there as well. Oh well.
    I can’t imagine what else we may see this week.

    I am slightly confused, as a follower, and hoping a member here will chime in. I have read Blink’s replies here and felt that she “knew” Casey’s DNA/fingerprints were on the duct tape, in regards to Caylee.

    Now, it seems, that is a fallacy. I feel gutted that the State’s Atty would have this evidence.

    Hello Everyone. After a fab family filled weekend I finally got to get all caught up on the trail.
    I found myself smacking my forehead during the testimony of Dr. Huntington. Another, you HAVE to be kidding me time for me! He was so unprofessional and arrogant and for what? I kept thinking are these people for real?! Are they supposed to come across as hostile witnesses even though they are called for the defense? I kept wondering how the jury was taking him in and again if it was just me that was noticing the tacky smirk that was on his face and when the judge would overrule and objection from the State he would smile like he just won something. It was so distracting when I was trying to take in information from what he was saying. And his unwillingness to agree to any answers and need to be right. To me it felt as if it just ruined his credibility. So ridiculous! And then after all that he got totally destroyed when it came down to it. JA just could not be stopped. It was a joy to watch him (JA) working so hard for Caylee! It’s nice to see the people that are working FOR her (Caylee) justice are so competent and totally prepared for whatever the DT throws at them. For a while there I felt as if our dear Judge was being a bit too harsh on JA, I still am not sure why he came down on him so hard all the times he did. I think part of it was to keep control of the courtroom and JA may get a tad emotional but he is nowhere in the league of unprofessionalism that JB is! Maybe if someone can explain that to me that would be great. If you are not sure of what I am referring to then I can look them up and put links but it would take some time and this girl is tired. It’s a lot of work to keep up on this case, care for my lil boys and not make my husband want to throw my laptop threw the window. LOL he has been close!

    The official designation of a co-founder does not appear on the UT Knoxville Dept of Anthropology webpage, only Dr. Bass is listed:

    As this brief overview says that Dr. Wm M. Bass arrived at UT Knoxville in 1971– he was 43 years old at the time. His type (typewriter typed http://web.utk.edu/~anthrop/faculty/cv/Bass.pdf) CV lists 3 articles co-authored with a William C. Rodriguez in 1983 1985 and 1986.

    Many other articles are co-authored, and this appears to be co-authored with students. It seems likely that Wm C. Rodriguez the third, was a student under Dr. Bass in the early through mid-80′s.

    Baez has been noted in trial, as having used Wikipedia as an authoritative reference, at least for his accusations of Dr. Vass as to his credentials, plus Facebook of course, as someone other than Dr. Vass, posted that he was a ‘chemist’, and Baez tried to discredit him based on both of these sources.

    (what would stop Baez from adding a few of his own credentials to Dr. Rodriguez’s information, on Wiki…. not much, until someone else raises a problem).

    Would be interesting to solve this question– first, when was the body pharm founded or opened? Was it during the time Wm C. Rodriguez the third was involved at the UT Knoxville?

    Did anyone notice the look of fear that crossed Casey’s face when Judge Perry finally got mad enough at Mr. Baez for not following the rules and decided to admonish him in court? I think for the first time the thought occured to her that she was in deep trouble.

    I watched Judge Jeanne Perrio’s 2-hour program on Fox News over the weekend about the case. I was SHOCKED beyond words. Dr. Michael Baden and Dr. Cyril Wecht were both on the show; both claimed that Dr. G was wrong not to remove the skullcap; Dr. Baden at first indicated that he didn’t think it was a fatal error, but at the end of the report called Dr. G’s autopsy shoddy as well. Dr. Wecht also agreed. Dr. Baden also stated that never in 50 years has he ever been turned down when he has asked to observe an autopsy.

    The whole thing made me feel shaky and disturbed. Dr. Baden I can see taking the defense’s side, as it wasn’t all that long ago that his wife was on the defense team. I don’t respect Dr. Wecht too much over several incidents in previous cases either.

    I don’t understand the need for ME’s totally disrespect a very highly respected ME like Dr. G. Just left a bad taste in my mouth.

    jb appears/acts like he needs a 3-party gate keeper [who works for the judge not state side or defense side] to follow him around 24/7, to witness ALL conversations-in person/emails/phone calls/”verbal evidence” etc- so the “court order” can be followed.

    When I hear him “talking back” to the judge [which I still am amazed he does}, he really NEEDS a slap up side his head …

    I am beginning to believe that it is entirely possible that after all the evidence and testimony is distilled during jury deliberations, a Murder 1 conviction might come down to one simple issue in the minds of some jurors.

    Does any juror have reasonable doubt that the duct tape was used to intentionally cause poor Caylee’s demise?

    Of course, even if the duct tape is not considered the cause of death (by one or more jurors), what about the chloroform evidence.

    There is still the possibility that there could be unanimous jury agreement on aggravated child abuse. This could then still lead to a premeditated murder 1 conviction because of felony murder.

    However, it may be difficult to expect that none of the 12 jurors will hold on to the notion that Caylee succumbed to an accidental overdose of chloroform – i.e. manslaughter and not murder.

    Well Red, you know we have heard Baez reference Wiki on several occasions, it must be his “go to reference” he uses to verify witnesses background & as a science resource. lol.
    Very cool videos of Drs Bass & Haskell. I wonder how Dr Rodriguez III

    I cannot believe this JB — totally agree with Bill Shaeffer that JB is disingenuous. How common is this behavior with defense attorneys? An apparent flagrant disregard for the court’s orders??

    It’s obvious on so many levels that JB omitted this information intentionally. It’s especially obvious to me by his OWN admission when he tried to suggest to the court in earlier proceedings that the court better watch out. JB TOTALLY knew he was trying for a ‘gotcha moment’ and that the state would correctly cry fowl later. In that earlier proceeding JB suggested the prosecution was using the report rule as ‘both a sword and a shield’ in not deposing witnesses (whose reports were intentionally left blank!) and referenced his earlier proclamation to the court that “this may be an issue later…” JB TOTALLY knew what he was doing…

    Unreal..court in recess until tomorrow. Blink, you knew it all along…Baez is a first class clown and in my opinion a liar. Ashton may have gotten emotional but who would not if they had to listen to Baez’s dialogue this morning? Baez…saying the state is not genuine….good grief. Casey Anthony looked to be almost smirking as she left the court room….Bill Sheaffer at a loss for words…Blink please give us your take as soon as you can….in the midst of Baez’s use of sword and shield as if he has on the armor of God…we need the truth and the light from you!! You are respected!

    Blink, today the 20th, someone has filed a motion to quash a subpoena. Doesn’t say which side. Will be really interesting if this was today’s female third witness that did not appear for some reason.

    (update on the body farm co-founder issue. Rodriguez was a student during the early 80′s, 1985 and 1986 looks like his co-authorships were his PhD research. He said in his testimony, that he co-founded the body farm, so whoever put the info on Wiki, could have been himself, or Baez, because Baez asked him the direct question on the stand and he said yes.

    It’s Rodriguez’s interpretation that he was ‘co-founder’– he was not faculty or staff, but a student, and because his mentor and professor, Dr. Bass, chatted with him about the idea for research, guess that makes him co-founder. Plus, he worked on the fences and poured cement. (how many student volunteers would have done that!! Lots of co-founders possibly!)

    Lol, had a few conversations today that make me think this is coming back.

    (or maybe the subpoena has nothing to do with this list, maybe Dom Casey is still fighting any testimony, or Baez is fighting him as a witness.)

    But but but Judge Perry it always works out for Perry Mason, Ben Matlock, to have a “gotcha” moment why can’t I have mine, whines Mr Baez. Mr Baez is a piece of work to say the least.

    The disrespect he shows towards the judge and the court for that matter is astounding. As the judge was admonishing him he was talking to his client, Simms and Mason.

    Mr Baez’s ego is running amok. Casey Anthony will never realize, the judge and the state were looking out for her welfare far more than Mr Baez. Judge Perry is doing everything in his legal power to protect her from her own attorney and his misdeeds.

    Does anyone know if a mistrial is called would Mr Baez be able to leave the case? My mind won’t let me accept he is this egocentric or just plain stupid. He seems to be working harder to cause a mistrial than defend his client.

    You are absolutely right on with Jeff Ashton smoking Dr. Spitz’s testimony. It was excruciating to watch as he crumbled under Mr. Ashton’s cross. Spitz’s comparison of an autopsy on a case like this vs. an 85 yr old with heart disease stunned me! “Shoddy” is what his testimony was!

    The opposing side’s attorneys love it when they can rattle an expert such Dr. Spitz in front of a jury, and JA definitely did so. As an expert, you never want to appear defensive or overly zealous regarding your opinions because it can suggest bias. Spitz’s reactions to JA’s cross examination made him appear to be nothing more than an advocate for Casey Anthony. His opinion that the duct tape was placed on the remains ‘way later’ was not only ludicrous, IMHO, it was illogical and an insult to the intelligence of the jury. But, IMO, the icing on JA’s cake came when Spitz *implied* that he would do a more thorough autopsy for a high profile case.

    What a circus.
