Jerry Sandusky Plays 52 Pick-Up And Hooked On Histrionics- Sandusky Once Again A Defense Coordinator, Prosecution Set To Throw A Rock Dottie Set To Take The Stand

Bellefonte, PA -The second week in the 52 count indictment trial of Gerald Sandusky began today with the prosecution reducing Sandusky’s 52 pick-up to 51.

Victim 7  allegations  involved in 4 of the counts against Sandusky was past the statute of limitations prior to 1997 for only one of the 4 allegations.

The prosecution rested its case following a gripping and heart wrenching testimony from the mother of a victim who had extensive stomach issues at the ages of 15-17 and would frequently discard bloody underwear following an involuntary sodomy encounter with Sandusky.  “I dealt with it”, he said.

Coordinating His Defense

Starting today, Sandusky suits up and gets off the bench.  Perhaps literally.

Sandusky Attorney Joseph Amendola alluded in his opening statement his client would testify.

The PA Attorney General’s Office contacting NBC Friday for an authenticated transcript of Jer’s interview with Bob Costas, appearing on Rock Center with Brian Williams last Friday seems to confirm the possibility.

Among the edited and un-aired version of the televised but edited interview are some of Sandusky’s “hooked on histrionics” examples.

Sandusky:  ”I’m a very passionate person in terms of trying to make a difference in the lives of some young people,” Sandusky said in the interview. “I worked very hard to try to connect with them. To make them feel good about themselves. To be something significant in their lives. Maybe this gets misinterpreted, has gotten depending on. … I know a lot of young people where it hasn’t. I have worked with many, many young people where there has been no misinterpretation of my actions and I have made a very significant difference in their lives.”

Costas : “But isn’t what you’re just describing the classic MO of many pedophiles?” he asked. “And that is that they gain the trust of young people, they don’t necessarily abuse every young person. There were hundreds, if not thousands of young boys you came into contact with, but there are allegations that at least eight of them were victimized. Many people believe there are more to come. So it’s entirely possible that you could’ve helped young boy A in some way that was not objectionable while horribly taking advantage of young boy B, C, D and E. Isn’t that possible?”

Sandusky : “Well — you might think that. I don’t know. In terms of — my relationship with so many, many young people. I would — I would guess that there are many young people who would come forward. Many more young people who would come forward and say that my methods and — and what I had done for them made a very positive impact on their life. And I didn’t go around seeking out every young person for sexual needs that I’ve helped. There are many that I didn’t have — I hardly had any contact with who I have helped in many, many ways.”

The excerpts that were edited and unaired during the “Rock” interview clearly confront the issues within the indictment in place at the time.  Bob Costas was not shy in forming his questions which were also well researched.

So the question becomes- why did NBC edit and withhold what will be construed as damning testimony?

Were there agreements between Jerry Sandusky via his lawyer Joseph Amendola and Bob Costas?

I doubt that highly, but if there was, you can bet it will be uncovered if the transcript is going to be used by the prosecution- which it will.

Judge Cleland Rides the Rail

In a surprise revelation outside of the presence of the jury yesterday, The Honorable Judge Cleland made both sides aware he had his doubts about the evidentiary burden bull’s-eye on the prosecution going into trial and has really only been slight shifted on the fence with enough testimony and evidence presented during the prosecution’s case in chief to meet the threshold for juror deliberation under Pennsylvania law, which is stupid, according to Deadspin.

Are Judge Cleland’s comments incongruent with his rulings on motions to date?  You betcha.

Some say stupid.

Stupid is as stupid does as I always say in honor of my friend Forest, but then again, I never had a friend named Greanleaf.

Senator Stewart Greenleaf, a Duquene alumni and 2005 fellow commission member to Cynthia Baldwin and Attorney General Tom Corbett on the Pennsylvania Courts and the Commission for Justice Initiatives held up the bill immediately after the grand jury was meeting in this case, according to Philadelphia Weekly’s Tara Murtha- “he had problems with it.”

As it sat gathering dust, state Sen. Stewart Greenleaf, chairman of the Judiciary Committee, offered various tone-deaf reasons for the stall.

In December, to the surprise of both of the bill’s sponsors, Greenleaf told PW he needed to “fine-tune” the legislation. In February, Patriot-News reporter Sara Ganim, who broke the Sandusky story, wrote that the reason for the delay was that “Greenleaf wants to make sure any bill allows for the defense to bring an expert into court, too.”

After more pressure from groups like Pennsylvania Coalition Against Rape, HB1264 finally passed out of committee on March 27—but it still isn’t law and, with a 60-day effective date along with the news today that the trial will not be delayed again, it will not be in effect during the Sandusky trial.

Cynthia Baldwin is the pending former counsel  and Board Of Trust member for Penn State University who has recently hired her own attorney following a lawsuit filed by fired former Nittany President Graham Spanier to access emails so he does not end up in the perjury pool with colleagues Curley and Schultz.   I mean, so he can refresh his recollection which is apparently in conflict to prior statements Mr. Spanier has allegedly made.  Baldwin accompanied both Schultz and Curley to their respective trips in front of the grand jury.  Mr. Greenleaf’s Son Stewart Jr is the Montgomery County controller.

Tim Curley and Gary Schultz are currently awaiting trial on perjury charges stemming from their grand jury testimony which resulted in the current Sandusky indictment.

Despite Senator Greenleaf’s recent turning over a new one in finally passing the bill through, the creepy love letters the prosecution introduced into evidence during the testimony of the first witness have allowed the defense to provide an expert  to explain those writings are from an individual with histrionic disorder.

In order for the prosecution to be in a position to cross examine the defense expert as well as rebut or impeach any testimony, Cleland ordered Sandusky to undergo a Psychological Evaluation on the very befitting Father’s Day.

It is likely among the topics of discussion during the prosecutions cross of the defense expert will be the fact that although published in the Diagnosis of Mental Disorders, it will not be included in its next publication.

The fifth edition of the Diagnostic and Statistical Manual of Mental Disorders (due out in 2013, and known as DSM-5) has eliminated five of the 10 personality disorders that are listed in the current edition. Narcissistic personality disorder is the most well-known of the five, and its absence has caused the most stir in professional circles.

The currently awaiting “law status”  PA bill signed into law will not be usable during the Sandusky trial so the scope of the expert’s testimony will be limited to the letters, not applicable to Me. Sandusky’s guilt or innocence in the accused crimes.

Will He Or Won’t He?

While many legal analysts disagree on whether or not Jerry Sandusky will take the stand in his own defense following what has been described as a “Tsunami of evidence” .

It is this author’s belief he absolutely has to testify on his behalf if he is to have any chance at an acquittal or more in the realm of reality, a mistrial.

Will at least one of the jurors be “Touched” by Jerry Sandusky’s own words in his defense of the charges against him?   It would seem Sandusky’s defense coordinator background has not left him.

Only one hold out is his fumblerooski.  Dottie Sandusky set to take the stand today.

The jury may begin deliberations by the end of the week.

This predator consistently implicates himself in every statement he’s read. If he believes he’s not a pedophile, he’s state as such. I AM NOT A MONSTER. I AM NOT A PEDOPHILE. He has NEVER claimed NOT to be one. If anything, he’s enabled his behaviour with his sick, twisted explanation of what mentoring, attention and affection means.

Putting him on the stand…wow. All I can think of is that the defense wants to prove he has no understanding of the charges…mentally incompetent????? What other reason would the defense set him up like this?

    @Blink, @Beejay, @Rose,
Thanks for drilling down to the truth, and so much rests in the evolving (or lack of) PA law. So much more here than people can, or are willing to absorb. I hope this jury are the “Un-Touched.”

erose, you are such a generous and kind advocate, and I know you don’t care whatsoever for praise for your efforts, but I do- and I linked your “financial incest” article in the piece as well.

  4. Mom3.0 says:

Why would NBC edit the words of Sandusky?
Thank you Blink for letting Sandusky speak for himself- it seems this man just like you told us- sees his actions as helpful and loving racj and everyone of them- and he wants to make sure everyone knows it is not because of any wrongdoing on his part- he is in this predicament because some boys “misinterpreted” his…kindnesses.
Just like georgiamom brought to our attention yesterday, he STILL is adamant about this- (pp) SEE the kid didnt start acting out until after he was with me.

I hope he testifies- and he may just be able to sway a jury member- because like you Blink I dont have much faith in high profile juries-

I hope they restore my faith.

The law is Stupid and those lawmakers that blocked changes are in essence adding and abetting child molesters and pedophiles.

What will Dottie say? I hope she for once has a moment of clarity and does the right thing… I know its not gonna happen.

    Great piece Blink- -

I do not know about the editing, but I can tell you I am a tremendous fan of Bob Costas as a journalist and I doubt he had input to it’s final editing. I would love to hear from him on that.

Right now, the faith I hold is that the Feds already knew and figured out some of the alliances here, and in all sincerity, there is more to see regarding Mr. Sandusky and compadres regardless of this outcome.

I would very much like for the victims in this case to feel validated against the man in a way they so deserve.

  5. Word Girl says:

“I would very much like for the victims in this case to feel validated against the man in a way they so deserve.”

Thanks, B. This exactly how I feel and I fear that reducing charges or finding JS not guilty of some of them are is to re-victimize the victims. I pray not…They need to know they were very brave and it needed to be done.

I am now curious about “Mr. Sandusky and compadres”–have any of them testified yet?

  6. Mom3.0 says:

    So much for Dottie-

Jeez she certainly does have a good memory so many kids helped- including foster children…

The only questionable things she saw were- one kid jumped up on sanduskys lap while watching tv
and another one ran up and hugged him-
The one in the hotel room was argueing with her husband cause he didnt want to go to the luncheon which they paod 300+ dollars for
Sandusky was arguing with him only because he knew how angry Dottie would be over the “wasted” ticket…. she says the victim was “clingy” and another “conviving”

Boy considering her husband has hysteronic disorder youd think she would have seen lots of things that could have been “misinterpeted”
Did she help him write the “creepy” letters too? and what about the stalking of the kid in highschool? Was she aware of that too?

BTW according to her the basement wasnt sound proof so does she think that helps her case or makes someone question whether or not she gave a hoot….

ohDottie also testified that they shared a marital bed- and she would retire for the night after her husband…so see no way he could have been doing anything at anytime … ever

Jerry Sandusky is just SO BYEOND creepy, I could scream! If he takes the stand, he’s TOAST! All of his interviews are jaw-droppingly breath-taking. It’s as if he honestly doesn’t undersand that pedophilia is crime!

Some reports said that he picked boys who were either fair-haired and/or had no father/father-figure in their lives. What a low-lfe. These kids didn’t have enough going wrong for them – and then Jerry has to pick them.

I felt particularly heart-broken for the mother of the last victim to take the stand …when she admitted that she even made her son go to be with Jerry when he didn’t want to..OMG!!!

I’ve got my fingers crossed ….because of other high-profile cases with a tsunami of evidence where the guilty defendant has walked away scott-free. Praying that there’s no repeat performance here.

As always – thanks so, Blink, for your tireless work on these horrible cases….

  8. Word Girl says:

I hadn’t seen a report of Dottie’s memory of the hotel bathroom scene where the victime recalls her asking Jerry and him, “what are you doing in there?”

“She also rebutted one victim’s claim that Sandusky tried to engage in oral sex with him while in a hotel bathroom at the Alamo Bowl in San Antonio, Texas. The man said the assault was interrupted when Dottie Sandusky walked into an adjoining room.

“They were just standing … in a hallway kind of thing… they had their clothes on, they were fully clothed,” she said.”

It’s a long article but also discusses the two police officers and what they discussed in the courthouse hallway.

  9. erose says:

It is a good thing the charges against Sandusky are stand alone charges. Poking holes, yes, poking 52 holes, I can’t see how. But even if they do, like Blink stated, the feds are on this. Whether he sleeps in the basement of his house, or in a cell, Sandusky will probably spend the better part of the rest of his life in a coutroom, IMO.

Victims of prison rape are inflicted with serious physical and psychological harm. Victims may experience rectal bleeding, soreness and bruising. In the case of a violent attack this is much worse. Insomnia, nausea, shock, disbelief, withdrawal, anger, shame, guilt, and humiliation also results from the abuse.

Long term consequences may include post traumatic stress disorder, rape trauma syndrome, ongoing fear, nightmares, flashbacks, self-hatred, substance abuse, anxiety, depression and suicide.”

  18. A Texas Grandfather says:

Did Dottie tell the truth? Since there are no witnesses other than the victims to challange her statements, we cannot really know.

I am waiting for the transcript or the video of the Costa interview.

Great article Blink and a big hooray for erose and beejay.

  19. A Texas Grandfather says:

Thanks for you remarks about the father in Shiner, Tx. The 911 call indicates clearly that he did not intend to kill the perp. Texas law protects his act even though the perp was invited to the property to perform a grooming service.

The human body is about four times as strong as our brains generally recognize. With a big jolt of adrenilin, the father broke the perps neck either with a blow or by twisting it to get him off the child.

The perp was an illegal operating with a forged green card. The name Flores is a common one for Mexicans so that may be an assumed name.

  20. Rose says:

Sigh, Sara. You called them two psychologists.
Idk Dr Atkins. Maybe a masters in counseling before the EdD?

But, Dr John Sebastian O’Brian ii is a psychiatrist…and fully qualified to diagnose!

Did the prosecution not highlight the credentials difference?
One a forensic hired hand EdD, the other a full-fledged psychiatrist?
This, Sara, was not a dueling psychologists’ he said /he said.

I hope he is just ready to vomit each time he has to think about JS or be near him! He knows his client is guilty and is laughing at him all the way to the bank, maybe…hopefully. He probably told JS it would be a wonderful idea for him to get on the stand and “tell HIS truth”!!!!! Jail is too good for JS!!!!

  22. christy says:

This is such a hard case to read about. I feel so much sadness, I have to stop.

Erose: you are very sweet. I’m measured by those I really care about using the same measuring stick as yours: “At my house I am only as good as the last dinner I cook, lol.”

I’m afraid one way or another that we haven’t seen the last of JS. If for no other reason than that some other “important” people have their fate tied to his. And won’t go down without a fight. More money for the lawyers!

@Rose: I have to get in some research tonite on your greenleaf linkeage. I had the wrong one at first. Mercy. Will we ever have more than a fist full of suspicion on these operators?

I’m losing my electronics for a good while I’m told. During prep for that today, I was reduced to watching trial coverage on TV. I hate that; only one window open at a time on that screen.

Everybody keep the faith. With the other investigations we know about, and an ongoing grand jury, something is bound to come to fruition eventually. As much as I want a conviction, and no appeal, and I want that for these brave young men and their loved ones. But even more than that, for the safety of his future victims, I want Sandusky imprisoned for life. Goal #1–STOP him.

beejay- my thanks to you of course.

Wise words, and I do have faith ultimately in this case in spite of my jaded experience with high profile juries.

Especially since he was busy finding ways to court his prey.

I have to wonder if the prosecution neglected a lot of subject matter to take some of the air out of the defense strategy. I am disappointed that we are not going to learn more.

I am still bummed Ganim is calling Dr O’Brian a psychologist in her headline “two psychologists” and article.
That is a major fact to have wrong as it goes to professional differences between the two witnesses.

    an accurate description might say:

Dr Atkins, an Education Psychologist who practices Forensic Psychology, the profession of testifying in civil and criminal cases, said based on …hours of evaluation and his book, JS’ letters to Victim 4 were the product of a Histrionic Personality Disorder but were not inconsistent with ….
Dr O’Brian, an MD Psychiatrist, disagreed with Dr Atkin’s HPD diagnosis in part because it is inconsistant with JS’s successful functioning at work and in his family and community.

Just in…the defence has rested WITHOUT calling Sandusky to the stand. His own lawyers must know that if he cannot even get through an interview with Bob Costas without making statements implicating himself, he would be in huge trouble being cross-examined by the prosection. Let’s pray for justice for all of those boys brave enough to testify and for the dozens more out there that have suffered in silence at this predator’s hands.

They would have done anything to keep that interview out, it was necessary.

That said, the closing arguments will be substantial, imo.

  37. Rose says:

I felt not calling Jerry was pretty decided this morning due to the swap out for the 20 year old juror. (besides her Penn State & Jerry the Grad speaker, her chief prosecution weakness is never having had children and not thus have experiential understanding of them, and parenting, as opposed to class courses. I see her as a slam dunk reasonable doubt juror. The very young find doubt in most everything.) So, calling JS was not likely necessary.

This has changed my opinion of the Judge, though. I saw his efficiency as professional and disciplined. Now I think it’s a byproduct of trying a case outside of his home area, living in a hotel, and wanting to get right back to his country club golf course, by Sunday anyway.

i think he should’ve required a doctor’s note faxed saying she’d be indisposed over 24 hours before excusing. If less than 24, a one day recess wouldn’t hurt a thing. I can’t believe the prosecution agreed to the substitution unless it required over one day for the feeling sick thing, medically verified.

  38. sunshine_4me says:

Is this normal for a closed door meeting without the prosecution, or am I reading this wrong?

I apologize that I am not more hopeful of a guilty verdict but what kind of clown show, sick circus is this? Jerry Sandusky is a sick monster- more a simpleton with severe problems- The Audubon Society or Greenpeace would be more severe on him than his own back yard. And for goodness sake get his dog Bo away from him- he is just clueless. Lord only knows what that dog has been through. My verdict- he is a menace and danger to society. Prison is too good for him. Just had to vent.

So much for the courage of his convictions
Imo someone threatened more than his Board position.
They threatened his livelihood stream, or imo more likely a lady in his wife’s bridge or
    Methodist group cold shouldered her.

This “retraction” was orchestrated by the
lady behind the podium (Board Chair) who
recognized the legal liability to the Board
    threat of his statement.

Hope she was on Board during events in question so
one day she may be held liable.

Bring on the civil suits! lower burden of proof.

My bet is McQueary will not file whistleblower as he would have to throw
senile Dad and self-interested Dranov under the bus, as they threw him then
and now, and this fine young man would be unable to do so

Tsk tsk, Masser. You didn’t follow the rules of the “board game” that are included in every box for every different board from the smallest to the largest and for all sorts of organizations and businesses.

The Image of Ms. Peetz standing regally on the podium and Masser standing with his hands folded is begging for a parody image. I am super fantastic at those (reference Anthony case) but I can’t find it in me on this one.

Some press need to check out the sick juror, be sure she’s home in bed.
maybe feds will check the bank accounts, just to be sure this isn’t a Grisham novel.
    Remember Gricar….

Cheese and rice, I never even considered poor Bo might be a victim. But humor aside, you are absolutely right. Gross….

Is this normal for a closed door meeting without the prosecution, or am I reading this wrong?

“The defense rested after an approximately 40-minute closed-door meeting involving attorneys, Sandusky and the judge overseeing the case.”

The prosecution would be included within the “attorneys” group. The judge could not meet with the other side without them.

He will easily be found guilty IMO. Putting him on the stand would have been insane, though I have sometimes thought his attorney was trying to throw the case.

I know, right. Makes me want to see the doctor’s note, but even then it’s probably from the Hershey MC. That is the problem for me, I don’t trust anyone related to this place, and I’m reasonably sure statistically the majority of people are trustworthy. If only they would wear jerseys so I could tell the players apart.
