Jerry Sandusky Subject Of New BOMBSHELL Molestation Allegation: His Defense Attorney Joseph Amedola’s Nephew Jonathan- Federal Civil Suit Filed- Prank Or Prudent?

On Wednesday June 27th, the latest allegation against convicted child molester Gerald “Jerry” Sandusky hit the Northern Virginia Civil Courts.  A Pro Se Federal personal injury suit was filed by a man certifying himself as Jonathan Amendola. He requests a  restraining order based on fear of imminent bodily injury, and that Uncle Joe- does not care and never has.

Jonathan Amendola,  an alleged nephew of Jerry Sandusky’s defense attorney Joseph Amendola claims Jerry Sandusky touched his crotch,  kissed his earlobe while he was urinating and subsequently threatened him in 1991 while traveling with the football team as a “PSU” fan.

Courtesy of The Republic

The request for a restraining order reads, in pertinent part:

THE PLAINTIFF FACES IMMINENT DANGER AND BODILY HARM FROM THE DEFENDANT  AND MOVES THIS HONORABLE COURT TO ISSUE AN ORDER FOR DEFENDANT JERRY SANDUSKY TO RESPOND. I’M THE NEPHEW OF ATTORNEY JOE AMENDOLA  AND I’M IN DANGER BECAUSE JERRY SANDUSKY  MOLESTED  ME AND JOE AMENDOLA KNEW THIS BUT CONTINUED TO DE FEND JERRY ANYWAY FOR MONEY AND DISREGARDING MY PREVIOUS SEXUAL ABUSE FROMSANDUSKY.

IN 1991, I WAS A PENN ST. FAN ANDI TRAVELED  WITH THE FOOTBALL TEAM TO WEST VIRGINIA TO PLAY THE MOUNTAINEERS, AND AT MOUNTAINEER STADIUM IN THE PUBLIC REST ROOM DEFENDANT TOUCHED ME ON MY CROTCH WHILE I WAS URINATING AND KISSED MY RIGHT EAR LOBE AND TOLD ME IF I TELL ANYONE HE IS GOING TO KILL ME. I HAVE BEEN SUFFERING EMOTIONAL DISTRESS SINCE AND I’M ESTRANGED FROM JOE AMENDOLA BECAUSE HE DOES NOT CARE FOR HIS FAMILY AND I’M SCARED SANDUSKY  IS GOING TO ASSAULT ME,

I SEEK A RESTRAINING  ORDER AGAINST HIM.

And Then…

As mysteriously as it appeared,  Mr. Amendola faxed a request to withdraw the suit, and the motion was granted.

On June 28th, via fax, Jonathan Amendola filed to withdraw the suit, and it’s dismissal, which was granted by her Honor Judge Keeley.

JONATHAN AMENDOLA,

Plaintiff,

v.                                CRIMINAL NO. 1:12CV107 (Judge Keeley)

GERALD ARTHUR SANDUSKY, Defendant.

ORDER GRANTING MOTION TO WITHDRAW SUIT [DKT. NO. 4]

On June 28, 2012, the pro se plaintiff, Jonathan Amendola (“Amendola”), moved to withdraw this lawsuit (dkt. no. 4). Pursuant to Fed. R. Civ. P. 41(a)(1)(A)(i), a plaintiff may dismiss an action without a court order by filing a notice of dismissal before the opposing party files an answer or a motion for summary judgment. Insofar as the defendant in this case has not yet appeared, the Court GRANTS Amendola’s motion (dkt. no. 4) and ORDERS that this case be DISMISSED WITHOUT PREJUDICE and STRICKEN from the docket of this Court.

It is so ORDERED.

The Court directs the Clerk of Court to mail a copy of this Order to the pro se plaintiff via certified mail, return receipt requested.

DATED: June 29, 2012

/s/ Irene M. Keeley                IRENE M. KEELEY

UNITED STATES DISTRICT JUDGE

Now you see it, now you don’t.   Uh, I  mean, you still can.  Without prejudice and stricken from the docket do make it invisible.

Early fireworks for the Independence Day Celebrations of the Amendola clan?

Or is this suit one of many pranks that appears to be filed by the same idiot who is not aware that receipt numbers for faxes and certified mail are tracked by the USPS and the FBI respectively?

If so, we will be sure to make his acquaintance in the near future facing Federal criminal charges.

she’s the Nat’l Political reporter, so it stakes out a political point of view

She is, but I found this piece poli-neutral, but I respect that you were sensitive to the undertones so thank you.

I loved it, their is only one criticism I have that made this piece miss the intended bullseye for me, but I admit I come at it as a journalist and a fact stickler.

    This excerpt:

emails between Paterno, fired school president Graham Spanier, former athletic director Tim Curley

It is inaccurrate. Paterno never emailed anyone, and nobody ever emailed him.
Imo, his family knows this well, and we have to be careful of how we word things in our craft when we are editorializing.

I mention this because it is like the time I went to the theater in leather trousers.

I was sliding across the cab seat, and the seatbelt caught the seam at my butt and tore them open as I was getting out. We went hotel to cab, and were headed out, so I had no overcoat. I had to put my husband’s jacket on, with a wool/cashmere turtleneck and let me tell you, I run hot, lol.

I have no idea what I will do when the hot flashes start except embarrass myself and blot my forehead often.

Afterward, we went to a friend’s gathering uptown and once there and assessing the group as “all friends” I took hubs jacket off and told my story.

Lesson learned. I had black skibs on so nobody could see the split in my trousers whatsoever, but everyone of them wondered if I had some sort of female issue because I was wearing the jacket.

Long way around, but I know whoever is reading this, male or female you have had at least one similar incident- Had I not tried to hide it, nobody was the wiser. I tried to hide it, and everyone was suspicious.

I chit you not, a friend of mine won an account at a pitch meeting with this story, but did not tell me until years later when I HEARD IT REPEATED.

Not about me, although it happened- The moral of the story is try to hide it and everyone sees it.

Who was the person in authority that the Paterno family believes is trying to smear the coach? What might we have learned if the GJ questions were hardball? How can a prosecutor make a victim relive a traumatic experience to prove a case, but not explore what a witness knows with the same fervor? Why did they not say, “Mr. Paterno, tell us in detail exactly what you were told, what you know, in graphic detail because the GJ is the time for graphic detail.” This does not ring true for me. Is there a reason why his testimony was limited? Is there a reason why he was *legally* cleared by the DA? Has the DA made that statement about any one other than Paterno?

    Paterno’s family fears smear campaign

With Paterno no longer able to come to his own defense, his family fought back, with their lawyer accusing “someone in a position of authority” of trying to smear the late coach.

Family spokesman Dan McGinn said he wasn’t worried about the various investigations’ impact on Paterno’s legacy. McGinn said Paterno never directed him to protect his legacy or clear his name during their discussions after Sandusky’s arrest.

In January 2011, Paterno testified before a grand jury, saying he reported McQueary’s complaint to Curley. McGinn said that despite the very limited nature of the questioning, there was no agreement beforehand with prosecutors to limit it.

    December 26, 2011

Florence S. Curley, 86, of State College, died Friday, Dec. 23, 2011, at the Fairways at Brookline Village.
She was born March 16, 1925, in St. Marys, the daughter of Ralph and Thecla Schatz. She married William N. Curley on Aug. 27, 1947, and he preceded her in death on June 26, 1996.
She received her bachelor’s degree from the Indiana University of Pennsylvania in 1947.
She was a bookkeeper at Bostonian Limited for many years. She was very active and supportive of State College Area High School and Penn State sports. She took great joy in watching her children and grandchildren participate in their sports activities.
She was a member of Our Lady of Victory Catholic Church and attended Penn State Catholic Ministry.

    http://smdailypress.com/content/florence-s-curley

Now here is how they sadly lost their Dad at the now Mt Nittany Medical Center.

On June 25, 1996, 73-year-old William Curley, the retired director of Penn State’s food service and father of Penn State Athletic Director Tim Curley, entered Centre Community for a routine hip replacement.

A day later, he was dead.

A subsequent lawsuit brought by Mr. Curley’s widow, Florence, revealed that a nurse anesthetist had suggested the surgery be postponed while Mr. Curley – a diabetic with heart disease, high blood pressure, and unstable angina – was evaluated further. The anesthesiologist refused to delay the operation, and apparently did no preoperative evaluation. In depositions for the civil suit, two colleagues said the doctor “had admitted to them that he did not perform preoperative evaluations because he was not paid for them.”

Despite his frail condition, Mr. Curley received “the same dosage of anesthesia as would have been provided to a healthy, young male,” precipitating his death, according to court documents. The jury awarded Florence Curley $750,000 against the physician, a judgment later upheld by an appeals court.

In July 1997, Centre Community – which is changing its name to Mount Nittany Medical Center – was cited by the Pennsylvania Department of Health for several “deficiencies” in its anesthesia department.

Joe and Sue Paterno celebrated the setting of the final beam on Mount Nittany Medical Center’s East Wing expansion project with a $1 million donation to the cause. About 200 others joined the Paternos for the “topping-off” ceremony, which included speeches by Carl Raup, the chairman of the hospital’s board of trustees, Dr. Jon Dranov, chairman of Mount Nittany’s foundation fundraising campaign, and Mount Nittany President and CEO Rich Wisniewksi.

Wisniewski took over as president and CEO at Mount Nittany after the departure in early May of Thomas J. Murray, who had served in those positions since 2001. During his tenure, Murray signed a master affiliation with Penn State Hershey and approved a master campus plan with Penn State, changed the hospital’s name from Centre Community Hospital, incorporated the foundation and launched the capital campaign to support the East Wing expansion.

BTW, Allison Hill neighborhood in Harrisburg is, and definitely was in 2004, a very crime-ridden area. One of the commenters on that murdered child story asked why in the world a foster child, esp one with special needs, was ever placed with a family there.

  26. beejay says:

I wondered why those PA sentences with “less than one day” language in them. Looks like it’s to allow the perp to serve his sentence in a county fail vs. state prison? For ex., in the shaken baby case which Gricar was working on before he disappeared, the father was sentenced that way:

“…The reason for the “less one day” language was to keep the sentence within guidelines for a county jail sentence, so he’ll be able to serve his probation under the county’s supervision.”

    http://www.thepowerhour.com/news2/mendez_freed.htm

I know I’m alone in my interest in that case and its tie to Gricar, but the dead baby’s mom met his dad in dad’s home country of Costa Rico. Dad was with a family tour company of some kind. They fell in love and married and he gallantly gave up his career to move to State College area.

I’ve never found out what work he did after he moved to the USA. Seems, if any employment, it didn’t involve leaving the house. Baby developed some sort of fatal illness or was shaken to death the first morning that his mom returned to her teaching job (Spanish, State College area high school). Lance Marshall finished up the case. I believe that Mon a.m. hearing that Gricar missed due to his (murder) might have been on this case. If not, it was much in process.

DEA? Or other? IDK and for my own protection I haven’t tried to find out. I’ll read it in the papers with everyone else, if it’s there and is ever made public. But, that’s just me.

I think the blogger was making a reference to Anthony Sassano, but I can’t be sure.

That hospital story I posted was a whistleblower story, as well. Dench and Powers were considered troublemakers.

    snip>
He [Dench] further alienated his supervisors when he refused to handle simultaneous surgeries on different floors. To Dench, that was unethical and probably illegal, partly because he would have been billing for procedures where he wasn’t always present. The administrator told him, “It won’t matter. It would help the schedule work better and you won’t get caught.”

It didn’t take long before Powers, too, grew concerned about practices at Centre Community, which is the primary hospital not only for the 38,000 permanent residents of State College, but also for Penn State’s 40,000 students.

“My life became miserable at the hospital. The scheduling became absolutely unbearable. They started trying to slander me. They started making stuff up about me. I got written up for the first time since I had been there.”

Later that year, Powers’ fears about poor care were realized when Charles Conrad, 69, of Bellwood, Blair County, died after elective knee surgery at Centre Community.

Dranov was on the board and McQ was in administration, if I have my facts straight. Hard to think they were pleased with the Curley’s, but more to the point, the Curley’s must have wanted to exact some sort of punishment on the administration that had more than ample warning that things were going wrong in those operating rooms.

Now…2001, one year after the settlement, McQ’s kid sees Sandusky in the shower with a victim. I just wondered how the wrongful death dynamics played in to it all, if at all.

Sorry, all I have is data, no info, lol. I think Ganim brought up the story of B J Jordan for a reason. In August 2011, she was aware of the Sandusky investigation, much more so than the public. She filed two stories, one as a cold case story, the other about the donation. As for Gricar’s friend and journalist, I await your findings.

Beej, I am very interested in following any trail to Gricar cases.
I believe he was murdered. I don’t understand how he couldn’t not have brought a charge against Sandusky, but he may have wanted to investigate further.

So thanks for bringing other cases to our attention.

Oh, and thanksmuch to those who alleviated my concern that Sara G. was off to CNN land or something. She’s got a lot of work to do on the ground first and, hopefully, last. (Don’t go to CNN, SG. Stay in print.)

PS I didn’t know one follows twitter online. See,iz got nu tricks.

What do you think is a normal life for Dottie Sandusky? Based on what we already know, her life has been anything other than what I know as normal.

    Rose, erose & beejay

You guys just keep digging. This whole thing is IMO going to be tied together with the university, the hospital system, TSM and a lot of government and criminal justice people. There is major criminal activity associated with this case.

  40. beejay says:

Well, last Sat nite around 10 or 11 pm there was a call to police, from the Sandusky home, which they proceded to investigate. Papers said it was “suspicious activity”.

So, if holing up in your house listening out for every sound 24 hrs a day is a “normal” life, then Dottie’s life is normal.

Everybody note that Blink is putting up things she’s held up on, so if you want to see them, do scroll back a little.

Thank you beejay, I should have noted that as well.

Frank Noonan was nominated by Governor Corbett on January 18, 2011, to be Commissioner of Pennsylvania State Police (PSP) and was confirmed by the State Senate on April 12, 2011.

Frank Noonan is a career investigator with more than 30 years of experience. He began his career in 1971 as an FBI agent, investigating public corruption, drugs, bank robberies and kidnappings.

Following his retirement from the FBI in 1998, Noonan was appointed as Northeast Regional Director for the Attorney General’s Bureau of Narcotics Investigation. After 11 years as Regional Director, Noonan was promoted to Chief of Criminal Investigations for the Office of Attorney General in July of 2009.

I get that he is Corbett appointed, but I like him very much.

@atg. i do nothing but thank beejay, erose & WG etc for their good reads, esp yesterday’s Dailykos TreeClimber.

I agree Curley had reason to doubt hospital owners(Dranov)/mgr (Mc Senior), but I believe as to his job he was influenced primarily by Paterno first & Spanier second. And the Budget Officer for his Dept.

I thought blogger referred to Sassano, based in Altoona & on drug cases.

I heard the CNN Altoona alum on TV a couple days ago. Before I looked at the screen to see her name I thought it was Blink making the bigtime (accent plus smarts).

    Who has an accent? lol

BJ’s cys file may be lost, but his Court jacket with cys reports (initial hearing, status reviews) won’t be.
question: was he in a foster home thru probation dept or thru Child Welfare?
at least here foster homes were often lower middle or lower income homes & often in bad neighborhoods.
idk elsewhere. the payment is part of the motivation for some.

PA child welfare. He never committed any crimes and was not in the probation system. He was also special needs ( undisclosed diagnosis)

i looked here for Karen’s comment, above
    http://www.pennlive.com/midstate/index.ssf/2012/07/gov_tom_corbett_criticizes_lea/3032/comments-newest.html
I don’t think this Karen’s writing style is the DA’s Karen.
On newest pg of Comments (7/5), Patricia Nelson’s comment made me think if JP did have a followup conversation with Curley, as documented in Curley’s email, of course he would have to deter “reporting” to Child Welfare or TSM because in a CW investigation of sex abuse (which would involve youth detectives) all the facts surrounding JS’s then recent early retirement based on his conversations with JP would come out. And possibly earlier incidents.
I can just hear the hypothetical JP–Curley convo: Hey Tim. Don’t ya remember we retired him & didn’t report? Ya really want to go to jail with me? We thought he might calm down out of the stressful workplace. Let’s try counseling next. No need to hurt the wife.

  45. beejay says:

No disrespect to the commenter doppelganger at pennlive, but unless he has insider knowledge, I will bet any DEA agents thought to be at Sandusky’s trial were actually at the trial held there at the same time for the guy(s) with Russian mob connections. Dude threatened to kill some folks, the judge and prosecutor, IIRC, per his cellmate(!)

No DEA agents testified at trial. Confirmed.
