Nittany Nightmare Continues Past Sandusky: Former President Spanier Charged- NEW Charges for Curley and Schultz Filed

Happy Valley- PA On the heels of convicted child molester Jerry Sandusky’s transfer to his new home,  what most predicted would follow- has.

 

 

 

Former Penn State President Graham Spanier,  fired by the Penn State Board of Trust the same day as legendary late-Nittany Lions Coach Joe Paterno, is facing serious charges today filed by Sandusky’s prosecutors.

Spanier is facing counts of obstruction of justice,  perjury, conspiracy, endangering the welfare of children and failure to report allegations of child abuse.

Tim Curley and Gary Schultz,  who were facing perjury and charges based on “non-reporting”,  are now facing all five similar charges as Spanier-  additional filings occurred simultaneously.

Linda L. Kelly stated the men “used their positions to conceal and cover up for years the activities of a known child predator,” on Thursday following the announcement.

    Not to be too pedantic about the Madeira molehill, but the “career change”
    timeline is interesting.
    By Fall 2012, the JS conviction and Freeh report seem behind both him
    and PSU, although Baldwin lingers on, as does Corbett, each in their
    own spheres of “influence.” So in Oct PSU gives MM outside
    counsel consulting, not in his prior sphere of practice. That consulting ends in
    Jan 2013, and shortly after we find him working for a “home improvement retailer.”
    That piece is not on Linkedin. It cannot be the U ran out of work for him, because
    that same work was adequate to hire him fulltime physically on site late in the
    year, doing the very same job description.
    I do not believe he’d go “inactive” in Dec 13 just because
    PSU was hiring him, in a job that includes use of his legal
    skills, because he did not go inactive in April 2013 when he Really was not
    in the field. He is billed as Interim, still, at PSU. An active license
    is one way to find a permanent job in State, municipal or federal gov’t.
    Since he lacks “permanent” work, seems kind of unusual to go inactive.

    There is one matter that intersects this timeline in late 2012-2013, and that is
    not Sandusky, nor Lee, both old history. It is Parks-Miller’s investigation
    into the management of the Gricar disappearance.
    In 2012 this was being run by a task force she convened, & Ganim reported in 04/12
    State police did not want to board the investigatory bus. Obviously by Nov 2013, the month

    Since he managed the investigation into the disappearance for 4 years, I imagine
    that body of work made him a key to the present investigation. It’s transition from locally-led to State-led in

    It is interesting MM worked in Centre Cty as the AG’s area drug prosecutor at the time Gricar originated this case in 2003. At some point Gricar turned it over to MM to conduct a State grand jury leading to indictments of locals & the low-level NJ dealor Lee. imo 1.5 M in drugs is baby stuff in organized crime. It is interesting a different State prosecutor handled Lee’s trial because MM had taken over Gricar’s job. Whereupon MM embarked on a career targeting high school and college student sellers. Neither prosecutor went after the top of the food chain, organized crime.

    Personally, I think now that Gricar set off to meet a CI. (I just learned that word on Graham.) If organized crime was involved, perhaps so also were certain elements in State gov’t.

    I have to hand it to Stacey Miller Parks for playing a local level vetting Kane, tho since when in PA Dems investigate anything either is past me.

    Just to clarify to anyone not familiar, this is not in reference to Christopher G Lee, but “Verbal” Lee, the target of a drug investigation at the time of Gricar’s disappearance.

    It is and has always been my personal opinion that Gricar went to meet a CI that day and it had to do with a concern about corruption. It always amazed me the complete lack of dedication to the investigation into his disappearance from Corbett’s office. The man was a dedicated and “winning” prosecutor for 20 years.

    Reading myself (ha): It occurred to me since the Gricar-MM charged-5 were involved in a criminal enterprise
    crossing State lines (PA, NJ), why weren’t the Feds called in? (and maybe Gricar wanted
    to outsource Lee’s case to a Federal prosecution/investigation up the food chain) .

    Unlike some other States, as an example Fla- depending upon the amount of drugs potentially distributed, it would trigger a required Federal prosecution. I have seen it in CA where (McStay) rings bringing in $100K a week ending up as misdemeanors. The issue is when you have Federal involvement you have Federal oversight and less ability to create crime deficits to get more grants and funding. In 2008 Obama (wrt to legalization of THP) basically said- leave the states to decide their own thing.

    You will get to the Johnathan Luna eventually- no crossover, just fyi.

    The Taji “Verbal” Lee case was prosecuted solely by the PA AG’s Office. Gricar had no role in it, except showing up at a press conference.

    IIRC, Chris Lee was arrested in the late summer or early fall of 2005, though the incident was reported in April 2005.

    Madeira took office in 1/06. He would not have any input in to charging C Lee in 2005. The ARD decision was by April 1, 2006.

    Madeira also started working at PSU in 8/13 and announce that he would place his license into inactive in 12/13. I don’t think his practice was successful.

    J.J. – with much respect, I am used to you having solid facts in your opinions. Those are lacking on this point.

    Madeira was interim DA when Gricar disappeared, and HE IS ON THE DOCKET.     There is no similar case in Centre County applicable for recommendation nor granted ARD because under the law as it is technically a victim (x2) and bodily injury case.

    Incident was April 1, 2005.

    His arraignment and prelim were continued 2 or 3x resulting in a bond in September 2005.

    I started out thinking MM’s going inactive was de minimus & ridiculous to
    scrutinize. Now I think it maybe a clue to the unraveling of the
    Gricar matter, but I am concerned it remains in hands of
    State Police unless Kane is tracking every tidbit.

    But 2 comments:
    From my reading, Gricar initiated the Drugs-5 case,
    and was the first investigation manager.
    4 of them were merely the lowest level of fruit,
    and at some point he turned it over to Madeira
    to handle at the State GJ level. like miller Parks
    starts & moves up cases now. Gricar
    remained a part of the task force. Imo it was Gricar’s home turf and
    Madeira ate the dessert at his banquet table.

    Second, read the mother Rach Dempsey’s comment above.
    While Gricar had handled the matter, Madeira executed the ARD
    on the eve if jury trial after a hearing in which her 2 sons impressed
    the judge.

    Third, Madeira per his ownLinkedIn started working FOR PSU in Oct
    12, laboring for 4 months in virtually the same duties as he later works on inhouse.
    Then there is a retailer hiatus of say 10 months.

    Finally, he once worked for State govt–in the AG’s Office.
    State govt (and federal) had jobs fir a seasoned litigator,
    or a tired one who wants to push papers. He had seniority for
    rehiring in State govt, tho one might have move a bit. And you’d think
    he’d want 7 more years to draw a State pension, though if DA job
    counted, it woukd be 3 he had to put in. I don’t kniw any jobless head
    of household DA after the lost election who with 13 + 4 years in State govt
    would go hang out a sole proprietor shingle, much less go inactive. However
    at PSU he did manage to find a “interim” State job for 3 years or so.
    Still “interim” though on PSU website.

    needed 4 months of outside consulting from PSU as income
    BECAUSE he had just lost the Nov 6 ’12 election, Kane was in,
    and hell would freeze over before he walked back into a State
    Dept of AG job. He never really started a provate practice; it was not that it was
    unsuccessful. . He went straight for
    health ins coverage. But someone owed him an income, and later a State job, and found it at PSU.
    Baldwin was still on the BoT. And wasn’t Corbett, his former Dept head?
    Someone persuaded him to leave the AG job and take an
    interim apptmt in CC DA’s prior to his first eldction, apparently. Who
    appointed him?
    It’s also pretty scarey if in Nov 12 and again in Dec 13, a BoT member’s
    tentacles were powerful enough in PSU Operations to connect him with an outside, then
    an inside, income. Not competitive hiring, as international agreements were
    outside his prior work experience.

    Madeira was a Deputy State Attorney General. It is on his Linkedin site (though he has not updated it). He was not the “interim DA.” The first assistant DA was Mark Smith, who I think is still there. However, the article that was linked indicated when the preliminary took place, and Madeira’s Linkedin profile showed that he was not Centre County DA’s Office in 2005. The newspaper article also indicates that the decision to place Lee on ARD was in April 2006.

    You’re both right. Madeira wasn’t elected until November (defeating ADA KA), and was a Deputy AG prior. However, he is also the one that cancelled the trial and negotiated the ARD with Lee; that was not on Smith’s watch. Madeira jumped on that right out of the gate.

    The cover story was effective collaboration/oversight on the Verbal Lee trial. I believe that initial response to Gricar disappearance was that it was litigiously motivated- so it made sense to me.

    One was an essay online, part of a PSU project, written by a younf ladt last spring who iirc labeled
    herself then as 17. It related her experience as a docent. Included were several picture of young Frenchmdn there as volunteers, one of whom was labeled Louis de Menton who appeared between 15-17.

    She said as a 17 yo she was traveling to Chateau de Menton (iirc the latter name)
    last July for a month to “volunteer.” Lee arranged the month if “work” she said.
    The pictures of the “castle” are gorgeous. It has many tourists. An ancestor did brave work
    in WWII. But, I went off to look at the Comte who imports 17 yo girls.
    We house international students when they need a place. We do not import them vua an informal personal exchange program for volunteer labor. Since he got an award in Israel early this year for his predecessor’s heroism, he was online. In my opinion, I would not send my 17 yo to his “host facility” for a month unless I was sleeping in the next bedroom. It seems per this young kady, and her pics, while Lee swung boys here, he nay have swung girls there. At least, he arranged it.

    recommended for ARD was Michael Madeira, who stepped into an office still in flux after the April 2005 disappearance of longtime county prosecutor Ray Gricar. In Centre Daily Times articles at the time,

    Madeira defended his decision, saying he was sparing the children a trial, despite opposition from the mother of the two victims, who wanted to see the charges proceed to trial.

    “I respect her opinion, her concerns,” Madeira said at the time. “It was just a risk I was not willing to take.”

    Not sure if I mentioned this before Rose, but Mrs. Madeira is also the biological sister of one of Sandusky’s adopted sons. Both the siblings were adopted by separate families. To his credit, at least the last time, when the case hit his desk, he voiced his potential for conflict.

    Lastly- on the Lee front. It should be noted that the primary ADA assigned to child sex crimes or child abuse, J. Karen Arnold refused to prosecute Lee’s case. She would have been 2nd chair to Madeira, regardless, but keep in mind she was gearing to run for DA AGAINST Madeira. In my view- ain’t no way she was signing off her name pre-election to an ARD for a Harris Supervisor.

    He said he didn’t know the man, who had no legal relationship to his wife, & had rarely met Sandusky.
    Imo he did not have an ethics conflict, but if he suspected one, he should have gotten a written opinion from the State Bar first. Imo he knew he lacked the resources & skill to prosecute. I’d respect his move after a written Bar opinion
    if he’d booted it up federally rather than to the State. I’d be unsurprised if Corbett approached him
    directly or indirectly & said I want this one.

    J.J. I am telling you that Arnold “refused” to prosecute Lee- be certain now. She encountered him frequently at benefits geared to raising campaign funds and in her words- “it was already awkward.”

    I am beginning to believe you are not “the real one”, lol . We are discussing easily researched information and I have known you to be very updated, knowledgeable and factual in the past.

    Arnold was never appointed to anything, she ran AGAINST Madeira for DA and lost.

    Sigh. That is incorrect- there were 5 continuations on the docket- he had no prelim until September- I realize you my not have a legal background in either criminal prosecution or criminal defense, but I can assure you that issue was orchestrated by, and discussed with Amendola or those continuations are unlawful.

    This has been here multiple times before. If so, she says she was “Discharged Jan 2006.”

    Rose- that is correct, I was told that information directly from JKA, confirmed through a different source independently as well.

    Ms. Arnold was pretty vocal that she did not think enough was being done to investigate Gricar’s disappearance and she was reasonably sure that for reason’s that to this day remain unclear, that Smith, Madeira and Corbett were of the immediate opinion that Gricar was dead. My personal take on Ms. Arnold from just what we know about some of her employment difficulties of the past was that while she was affable enough- navigating that good ole boy mine field during that time specifically was challenging at best.

    Yes, she definitely wrote that.

    Disclosure: over the past few years I have requested through FOIA, documents relative to Gricar, still no dice, lol. Which if one considers that for my Terrorism dissertation on BenGhazi I had more compliance in securing Federal info which had been previously classified in matters regarding national security. Wth is up with that?

    Randy Feathers retired from public service Wednesday and said accusations against him are politically motivated.
    Feathers was accused of being on a pornographic email chain while working for the Attorney General’s office. Now he’s accusing the current attorney general of going after him and other people for political reasons.

    Last month the State Attorney General’s office named Randy Feathers and seven other government employees and accused them of either sending or receiving pornographic emails at work. Feathers says there were jokes emailed back and forth but he never initiated them or viewed pornographic videos.

    The accusations came out of a review of the Jerry Sandusky investigation, where the computers of several state employees were looked at. Feathers says current Attorney General Kathleen Kane is targeting him because of the Sandusky review.

    While a biased source, he quotes primary documents.
    Pity the psu3 were not given all emails sent to or originating from them in
    the relevant time period. If the AG has reconstructed them, why
    suppress them, unless it aides the prosecution’s workload and speeds

    Porngate: Moulton discovered that some staffers (including some still there) shared adult pornographic images on their OFFICIAL computers. Three former staffers that Corbett appointed resigned (one that was about to be removed).

    It also was discovered that Supreme Court Justice McCaffrey also sent them to these official computers from his private computer, which raises some questions (since they were prosecutors).

    @ Blink, what do want on Gricar? I have his FBI file, estate information (both redacted), and his financial disclosure statements from 2004 and 2005.

    Thank you J.J.- I have those docs as well- I sought the cell records as a “public official” while engaged in official duties of the elected office. I also requested time cards, course of business non-classified emails, etc.
