Kyron Horman Missing: Civil Suit Against Terri Horman DELAYED AND SEALED- Prompted By NEW LEADS

Portland, OR-  As many of you have been following since June 2010,  there is a new development today in the disappearance of Kyron Horman.

As predicted at BOC,  the civil suit brought by Deisree Young, Kyron’s  Mother, against Terri Horman, Kyron’s step-mother and the defacto suspect in his disappearance has been granted an abatement.

In a sealed filing,  motions by Assistant District Attorney Michael Schrunk and Multnomah County Sheriff Dan Staton were granted,  delaying the suit .  The motions included supporting affidavits that continuing the action as already ruled would compromise the investigation.

The decision presents an ironic twist .

Terri Horman’s lawyers originally  fought vehemently to abate the action,  but were unsuccessful.  As recently as last week, the Judge in the case ordered medical records to be accessible to both parties to the action.

In Judge Kantnor’s decision to NOT abate the suit at the request of Attorney Peter Bunch for Terri Horman,  the Multnomah County Prosecutors Office declared “no position” on the matter after being contacted by the court.

It is not known if that order prompted the request to delay the suit .

Sheriff Stanton,  Eldin Rosenthal,  Norm Frink and Stephen Houze declined comment at press time.

On Monday, Judge Henry Kantor granted the motions to abate the civil proceeding and ordered the motions and affidavits filed by the district attorney and sheriff sealed.

A  hearing had been scheduled  for Dec. 14 to hear Young’s attorney argue before the court to compel testimony from DeDe Spicher,  an alleged witness in the case.  Today’s ruling is likely to render a postponement of that proceeding.

Sheriff Dan Staton,  told Oregon Live,  it is based on early leads that are now panning out:

“There are a couple of investigative pieces that are going to open up,” Staton told The Oregonian Tuesday. “Our belief is they’re going to open up several investigative doors.”

He said the new “investigative avenues” are based on information collected in the early phase of the investigation that are now yielding some results.

    That could be, MockingbirdSings, although the bus driver called the school and passed on her received info to K and T that Kyron hadn’t been there all day. Blink has said that MissP was already gone for the day when K and T arrived at the school. Presuming S.Hall was the supplier of this info to the bus driver, she had to base it on something.

    I don’t know if the bus driver followed a protocol and/or initiated the call to the school on her own, or if one of the H’s requested the bus driver to make contact.

    If I were a bus driver, I would call whether asked or not. If I missed picking up a child, I would certainly want to know that and would be expected to report to PPS Transportation.

    The question is, why would the bus driver ask if Kyron had been there during the day or why did the secretary think to check on that right away?

    When the bus driver called the school, the natural question a parent would ask would be “There was a mix-up today about the bus, so could you please let Kyron know we are on the way to pick him up?” Checking on this would require someone looking in the hallway and out front to locate Kyron. Even with windows, you could miss a small boy sitting on the steps. Why would you even check attendance at that point unless someone gave you a reason to do that?

    When Kyron was not found, the next thought would have been whether he went home with someone else and who that might be.

    The NEXT question should have been something like “if he’s not there, where did he go and when” because Terri knew he was there in the morning when she left. No matter what Terri knew or didn’t know about Kyron’s day, it doesn’t seem she would just ask the bus driver to immediately check on whether Kyron had been in school all day – she either wouldn’t think of it, or wouldn’t want anyone to know she did. Maybe she knew, maybe she had a gut feeling, or maybe the bus driver just asked on her own. The Grand Jury knows that much.

    I know from experience what a really good (school) office secretary would have done, these people can be fantastic at multi-tasking in an emergency. It would have gone like this:
    – answer call from bus driver
    – send someone to look around for Kyron – anyone who was standing close by, or call the custodian to look, and use the intercom to ask – all taking a few minutes to do
    – about the same time, call Mrs. P on another line and ask if she knows where Kyron might be
    – be told by Mrs. P that Kyron wasn’t there all day
    – tell the bus driver Kyron was not waiting anywhere and had not been at school
    – bus driver tells T and K who quickly drive to school
    – IF necessary, secretary updates attendance. In any event, this means there is no need to ask any of the students who just left (not on the bus) whether Kyron went home with them because he was already gone. She also should have taken a quick look at the log book to see if Kyron was signed out by anyone during the day.

    I’m not sure why I feel so strongly that Mrs. P did not mark him absent at 10. Probably b/c it seemed to take so long in the investigation to find out a simple answer to the simple question. Any of us with the right password and student ID number could have gone to the school and answered that question in under 20 seconds – unless there was some question about the timing or accuracy of the entry. Perhaps LE just didn’t want to say.

JMO, but I think (in order to prevent the potential of things getting brushed under the table), the reporting should be done by the teacher simultaneously to the principal AND either LE, or the hotline.     The guidelines do say:
    “In the rare case of principal or their designee making a report for an employee, he/she will notify the employee that the report was made and document that information in writing. The employee should check back if he/she does not hear from the principal or designee in a timely manner. However, if the employee does not hear back from the principal or principal’s designee by the end of the school day, the employee must make the report directly to the Child Abuse and Neglect Hotline.”

    The employee is still responsible to report. Of course, the principal could lie and say it was done, but that’s not likely to happen and would soon be discovered when no follow-up was done. In what I think were better times for PPS, we simply called the School Police. They had certain people who were trained to do those follow-up interviews and decide whether a child could go home or should be cared for until an investigation was completed. Most principals did not want to report without the other person there because they would be asked questions they couldn’t answer. Much better to do it together.

    As a school counselor, my client (first obligation) was always the child. Fortunately, most of my colleagues felt the same way. Given that, I must say that going through an investigation, being removed from home, talking about your personal and private life, having to go back and face a parent and other family members afterward (even after family counseling), risking not being believed, and the many other things those kids went through after a report was made, was really, really tough for them. You report because you must, and you pray something good will come of it, but at the same time you know the child goes through a lot of pain trying to make it better. I have nothing but respect for those kids who had to go through that through no fault of their own, and admiration for the strength, and often forgiveness, that they demonstrated.

    He works for DSHS as an IT Specialist. This is a more recent request for shared leave of absence, but there was one posted back when Kyron first went missing. I had to post his quote. He seemed to know Kyron was not coming home way back when. Maybe he is a statistical realist, but then how does that line up with KH’s view, and why would he *say* that when the family still had hope? Odd, to say the least. To me it’s as wierd as LM’s 50/50 quote.

    I frequently volunteer in our local schools and have done so for many years. One teacher in the middle school gave me his passcode to get into the computer system so I could log grades for him. I didn’t think much of it until now.

    Incidentally, this same teacher is in jail on suspicion of murdering his wife.

    I’ve mentioned here before that our elementary school janitor had hidden cameras in the girls bathroom of our local school. Suddenly we had a new janitor and no one really thought much of it. It was swept under the rug until several years later when the word got out that the principal somehow discovered the cameras. To this day no google search will turn up any information on the matter. This perv janitor used to give my daughter jolly ranchers for helping him around the school on occasion and I have personally used that girls restroom. We later found out he was dating a local lady who ran an in home daycare which was shut down not long after.

    Creepers are everywhere folks. This fact isn’t even the worst part… when those in a position to arrest, try, and sentence them fail to do an adequate job the safety net is almost entirely removed. I just rcvd notice that an offender who will offend again (per LE) has moved fifteen miles south of us. He has been tried and convicted three times of sex assault against children and teens since the mid eighties. Something is seriously wrong with that scenario.

    All this in a little ‘Mayberry’ town of several thousand with more churches and PTA moms than you can shake a stick at.

    Kyron met a no good SOB and it is essential that LE make every effort to find out who that individual is. Refusing to admit this SOB even exists is ridiculous.

    Thank you Blink. I totally agree that GAL’s are essential to the best interests of children. I’ll be taking CASA training this summer. My own experience with the courts along with reading about missing, abused, and neglected children has inspired me.

    I believe you stated earlier that Kyron would benefit from a GAL since the courts are unaware of his status and this makes perfect sense especially if he is eventually found. GAL’s can be great investigators from what I understand :)

    Arkansas appears to be the location of the physical photo for sale. If you click on others, like Annenberg, it says loc is Arkansas, N Little Rock. Perhaps seattle seller is a middleman taking a percent

    I understand why LE didn’t follow up on Kristian’s allegation of in-family molestation. It was a defense & their goal was to convict him. But after he was convicted, it will be stranger than strange if MCSO did not
    investigate Kristian’s allegation and whether K was ever exposed to the perp.
    It may be Kristian’s anticipated open Court allegation (upcoming trial) couple with Desiree marrying a policeman and K’s upcoming summer residence pushed a molestor toward preventive self-protection.

It states R Neil Horman is the VP of Opus Development Corp. It does look like Seattle, his neighborhood is Shoreline (North Seattle) and was when KH went to HS and the Masonic Lodge he is affiliated with is in Edmonds, WA, all within the greater Seattle area.

    Unfortunately, the above page is gone. Does that mean it was NOT accurate? It was never corrected while it was up. Would be nice to hear from that reporter.

    Simple enough to say Tanner meant *chaperone* not *substitute*, that would throw out Shelby’s comment. But *after visiting other classrooms*. Surely Tanner would know at what event the conversation took place. Before assembling, or after returning. How (and why) did this little guy’s account get totally disregarded by LE? Did he make the whole thing up? Did he make up part of it? Why would he say Porter mentioned getting a drink of water or using the bathroom if she did not? LE is saying that Terri Horman is the last “known” person to see Kyron. How could that be possible if Kyron was re-assembling with his class? If Kyron Horman was never with the group, is it possible that the chaperone, never knew he was even supposed to be, until they returned? Could she have said that there were only five, because she never bothered to do a head count in the beginning, and there were only five in her charge when she and the kids first left the class to begin the tour? Then she gets back to class and does a head count (her first) and it doesn’t match her list. She see’s Kyron’s name (for the first time) and he’s not there? Could it have been that disorganized and messed up? Porter still had Kyron’s name on the list…..because…….because Terri just that morning mentioned the Dr. appointment and she hadn’t had time to mark him off? Could be, I suppose, but then, why tell the chaperone Ky’s in the john or getting a drink?

    None of this makes any sense, and this is one of those issues, that I just don’t understand why it wasn’t cleared up by LE, or Kaine or Desiree or Tony, or PPS. Along with the delay in reporting what time the boy was marked absent, none of it makes any sense to me. I just can’t help but feel someone was/is manipulating and twisting and turning things to make ends meet the outcome they want here. That’s what it feels like, a big bag of worms. Why doesn’t LE want the timing of school happenings known? If they are so sure Terri Horman did this (or even someone else in the Horman family, i.e., isolated incident), then why keep all this other stuff under wraps. Why watch the school afterwards? Heck, we can’t even get LE to say whether or not Kyron had/has any medical problems, nor whether he was supposed to be a talent show. This is just all very bizarre, and makes me so darn frustrated!

    As long as I’m venting……why doesn’t LE give a little more information on Logan Storm? For instance, where was he hanging out last time? What cities did he go to? What were his hobbies besides you know what? What websites did he frequent besides porn? What was his internet moniker? If LE really wants to find these dudes they have to give out more information and then they will get help. Look at that SO they found in the campground last year…..how did they find him? ..because they told the public he liked to hang out with bikers in campgrounds ….tadahhhhh…bingo….you’rrrre busted!

    Opus Development Corp. did work in Shoreline and Tumwater. The project in Tumwater was in the ’80′s, but a couple plus hours away from Shoreline and Horman. The Shoreline project was in 2008-2009. The branch office is cited in Bellevue, WA (across the lake from Seattle). Maybe Horman was the VP of that branch.

    That’s the best I can do, but cannot say it is correct. There just is no other Opus, to my knowledge. Of course the day care center part of that picture is the potential red flag. As long as he built it and didn’t run it, I guess we’re okay.

Because he is an author of some kids book(s)? Or is there some other reason for listing this now? Does this seller check google news or something and see a bunch of hits and then go looking for photos? IDK, just interesting. One more weird thing to throw in with a bunch a more. (Makes me sometimes wonder if all the weirdness and weirdos turning up in this case are somehow planned.)

    We are getting close to the end of the third week since Judge Kantor said he’d make the decision about “in about two weeks” regarding LE/DA’s motion to impede in the Horman’s civil divorce case. I have no idea what is delaying his decision, but I hope it really means that they do indeed have new leads on Kyron’s case and at least something factual has been given to Judge Kantor.
    I can’t see him allowing interference in a divorce matter without something concrete being offered by those who seek the interference.

    However, if that’s the case, then Kantor should recuse himself from Desiree Young’s civil case, shouldn’t he? If he does, could he be deposed by the attorneys in that case should it continue come August? What a wild mess.

    @Rose, maybe LE did get warrants for all the family’s computers? Seems like they surely would have already had access to whatever WA LE had on brother Kristian. I do recall them saying they were looking into him, which I would assume means his contacts as well. Who knows? All that money went somewhere.

    Kind of interesting Rose, is that the owner of The New Fiddler’s Green Photography in WA also lists the Edmonsons Masons as one of his likes on FB. So, I’m guessing he may know the Horman family through that org. But what I also find interesting is that he lists Missing Kyron Horman, but NOT Bring Kyron Home. From what I’ve seen Missing Kyron Horman is Desiree’s supporters and Bring Kyron Home and the Kyron Horman Foundation are Kaine’s. Maybe not?

    for what he plans to do. He may still hope supportive
    case law will drop out of the sky.
    Takes longer on written opinions imo when

    have his fellow Edmonds (past) officer as his website’s domain owner &
    administrator. Missing is the first & original FB. BKH, of which Neil has 3
    variations of earlier domain incarnations, only started a Facebook site recently
    and very little is on it. Mainly for activity notices. I can’t see why anyone but true
    case followers would ever look at the BKH FB. BTW, since Kristian’s event (who was
    also an Edmonds officer), Neil appears to have shifted his primary Officer
    activity (now Swordsman) to Shriners.

    Thinking back on that odd “it could be five years…” comment by KH, wonder if he would be smart enough to engineer some kind of snatching of Kyron with the help of his brother or a friend, and they have him there – out of sight – until KH gets rid of TMH finally and permanently, maybe in jail. (Too bad she has a smart laywer….)

    Don’t know how smart is brother is, also I can’t imagine any kind of parent (KH)leaving their child with a convicted pedophile/molester. And I can’t imagine LE or FBI not checking into this thoroughly. Sheesh – sometimes I think the people here have to do ALL of LE’s work for them!

    I just really wonder if KH was also abused when he was little; it’s a reasonable assumption if his brother was. And it would be scary thing to think about little Kiara left with him. But I also think that if that is in the least bit possible,mom TMH would have moved heaven and earth to get her daughter to a safe place. Unless she is thinking of herself only. That poor little girl has absoluely NO protection. Does anyone know who is with her while dad is at work? Or if she is safe?

    I can honestly say I have never heard a line like that from the parent of a missing child believed to be abducted. It haunted me then and haunts me now.

    What I posted was, that I found the PA connection interesting in the above domain involving 1&1, an apparent internet hosting website. For some reason I could not post the link after trying multiple times. Hope it works. 1&1 has some really mean business reviews, which seemed to start after 2007.

    (Have no idea what relevance this has, other than the RNH connection.)
