Gianni Martelli McStay had rock star hair at only 4years old. His little brother Joseph, affectionately nicknamed Chubba- did as well. They both rocked a beanie like no other little dudes.

Gianni and Chubba were as inseparable in life as they were in death when they were recovered in a shallow grave in the Mojave Desert on November 11.
Their parents, Joseph, 40 and Summer McStay, 43, were located in a separate grave nearby.
A 3rd gravesite was found-but empty. A protected source not authorized to speak to the media has confirmed that at least one of the parent’s remains was bound by an electrical cord.
While formal DNA comparisons and autopsy protocols are pending, the manner of death in all four victims have been declared homicides.
Just about 50 yards off the intersection of Route 15 and Quarry Rd the family that San Diego County Sheriff’s Department (SDCSD) believed was “likely” voluntarily missing on their own and living in Mexico, was recovered in a 30 hour excavation process. An off road motorcycle enthusiast called the San Bernardino County Sheriff when he came across what he suspected was human remains.
Last April SDCSD forwarded the McStay case to the FBI based on their conclusions that the McStay’s had McGone to Mexico, following a lengthy complaint of their handling of the case by Patrick McStay, Joseph’s Father. Troy Dugal, previous lead investigator of the McStay case, appeared on several news and cable television programs over the last three years explaining there was “overwhelming” circumstantial evidence the family of four that was pictured crossing the border into Tijuana, Mexico the evening of February 8th, 2010 was in fact, the McStays.
Following the recovery, San Bernardino County Sheriff’s Office will maintain jurisdiction of the investigation.
Frenemies.. Frenethieves.. Friends.. Family or Cartel?
Who brutally murders innocent children and dumps them in a hole they dug in the desert?
Logically- someone who is very familiar with the area. Of course it is just as shocking and horrific to murder anyone, but it takes a specific brand of evil to murder a baby. Make that two.
There is absolutely no evidence whatsoever that either Joseph or Summer McStay had any ties to drugs, associates with ties to drugs or cartel, at any time. None.
Contrary to a top selling book on the case, “No Goodbyes” by Rick Baker, there has never been any evidence whatsoever that Summer McStay was some sort of closeted psychotic and homicidal type. The book goes on to malign members of both Joseph and Summer’s families and in some cases outright accuses same of extortion or stealing. Baker’s subsequent public theory is that Summer murdered Joseph and everyone should be looking for her and the boys in Mexico.
Not surprisingly , Baker has requested Amazon pull his book from available stock and has offered refunds to prior purchases. Popular online sleuth sites previously promoting “No Goodbye’s” have since either deleted it’s hundreds of posts endorsing Baker, or moved them to a member’s only private viewing area.
Albeit obtusely, Baker does touch on a troubling and serious abuse allegation concerning Joseph McStay’s oldest son from his first marriage, Jonah, and his step-father, Michael McFadden. He writes summer filed a complaint with Child Protective Services after she and Joseph recorded a conversation with Jonah and placed a copy of same with a private party for safekeeping. Blinkoncrime.com has been able to independently verify that is accurate, but that the investigation was not known to be completed until shortly after the McStay’s disappearance. Under California probate law, Jonah would be an heir to the McStay estate or as otherwise provisioned in the instance of an existing will.
Interviewed by Laura Ling for E! Investigation, Joseph McStay’s web administrator Dan Kavanaugh claims he was the first to become concerned. In Baker’s book, he refers to him as a suspect and details how he alleges he was funneling cash from McStay’s business account before he or anyone else knew the family was missing. Kavanaugh has an unrelated open criminal matter in San Diego County according to court records.
Chase Merritt- Joseph McStay’s business partner in his water fountain design and installation business was the last number ever dialed from his phone at 8:28PM on February 4th. Merritt joined McStay in a lunch meeting earlier that afternoon where they discussed a proposal for a very large car wash chain to feature custom fountains in each facility. According to family friend MacCargar McGyver, McStay was very excited about the opportunity. Merritt claims he passed a voluntary lie detector test, and that he was adamant that Joseph McStay would never have taken his family to Mexico and has always believed they met with foul play.
McGYver spent several days leading up to February 4th at the McStay home due to a painter Summer hired not returning to complete the job. McGyver introduced Summer and Joseph and by all accounts was a close confidant of the couple.
Patrick McStay, Joseph’s Father living in Texas has had some harsh words for the investigation into the disappearance of his son, daughter in law and grandsons.
“…most botched, inept investigation I’ve ever seen in my entire life.”
He also believes very strongly that the list of suspects with motive to kill his family members is very short. Three, to be exact.
He said the department didn’t even bother to contact him to tell him his son’s remains had been found.
“I got a message from someone [on Thursday] on Facebook telling me to go and read an article,” McStay said. “The minute I read the article, I knew it was him.”
“I have exhausted and have so much information on three possible persons of interest. All have a motive.”
The three individuals are not connected to each other, but all of them seem like likely candidates. Patrick says one of them seems to be a particularly likely suspect: he’s a wealthy man with a long rap sheet that includes charges of attempted murder, assault with a deadly weapon and burglary. McStay says he, too, has a motive for killing his son.
Although Mr. McStay did not reference him by name, he may be referring to Michael James McFadden, who was arrested in July 1998 and charged with attempted murder and a litany of other felonies including great bodily harm to a child:

You will note some of the charges are from 1998, others 1999 on the anniversary date, McFadden successfully negotiated a plea agreement and only pled to criminal terroristic threats and assault with a deadly weapon other than a firearm. Both felonies.
In the complaint he lodged against the detectives in SDCSD, Patrick McStay specifically references failure to interview key suspects he provided to LE directly.
Given the location of the bodies, it would seem that whoever is responsible would at least want investigators to think McFadden was involved. As a self-proclaimed mountain bike “racer”, McFadden has participated in several bike events in various locations all along the Route 15 Mojave corridor. SBCSO says they will be re-interviewing everyone in the case and have no suspects.
There have been no named suspects to date and the investigation is ongoing. Memorial or Funeral arrangements for the McStay’s have not yet been announced . LATE EDIT: The family and friends of the McStay family will gather at the grave site in Victorville, on Joseph’s McStay’s birthday.

Hi Blink: I was wondering if you could explain a little regarding when exactly is a criminal profiler brought into a murder investigation such as this and whether the FBI has a specific group of individuals who specialize in this. Also do you think this crime has much to offer in the area mentioned. Thank you.
Short answer: When the jurisdiction requires their involvement, meaning there is a potential for a Federal charge and Yes- in a general sense this type of crime would be evaluated by the BAU.

Short answer because disclosing the long answer is a violation of my training commitments: Because this case was nearly 4 years old and leapt jurisdictions, I can tell you that the FBI is going to be very careful about consulting here. They are never going to want to own procedural or forensic errors and imo this case is rife with them. There may be extreme limits on information sharing, and there is, imo, a parallel investigation that might preclude areas of involvement.

My question was would it be a State or Federal parallel investigation that would preclude FBI involvement?
And, Would the parallel investigation be on the same criminal subject matter (murder) or a different type of felony?
Have no idea if this could be tied in, in any way, with the McStays, but it is interesting to note that
a tunnel system was discovered, and people were arrested,at the Otay Mesa crossing. This crossing is minutes from the San Ysidro crossing, which is where the Izusu was abandoned. Make of it what you will!

According to Patrick McStay, on his Facebook page he stated the tentative interview scheduled with Mike on CNN for April 8th is off.
According to Mike, the show has been moved to May 8th per Patrick’s Facebook.
The show will be on May 8 2014 it was cancelled April 8 2014 due to the Malaysia airplane story

The evidence all points to Chase Merritt. He was in contact with Joey all day on the 4th and would certainly have been able to track the family’s movements–or convince them to be somewhere that evening.
Chase also might have had a motive beyond money. He’d had two failed fountain businesses. Perhaps with Joey gone he’d imagined the business would come to him. A wolf in sheep’s clothing, perhaps?
He was familiar with the area where the bodies were found. And he’d been known to call the family out on a moment’s notice before. They would have trusted him.
I would think that Chase M might have retained a lawyer given the logistics of the remains that were found. That is purely speculation, however.

Presuming they are non-standard, as the remains were released, I would say that yes, they are. Whether or not they were conclusive to findings, I have to say I have my doubts given the timeframe and conditions of recovery.

It may have to do with the last pics he put up the day before yesterday – they implicated Mike McStay. I almost copied them, but darn I didn’t and now they are gone. I had already seen the one with Mike at work and had the same thoughts the pics expressed a long time ago. Not sure I should describe them without a link.

Do you think that LE have checked with various satellite companies to see if they can get any available images or the crime scenes? I noticed that if you go to http://www.terraserver.com and type in the coordinates for the grave sites, you can see from an image as early as April 2010 that the grave sites are already there. Since the tire tracks would have had to have been made when it was wet, don’t you think it is most likely that the graves were made in February 2010, since that’s when the heavy rain was made. This diminishes any possibility of them ever going to Mexico…?
I don’t believe they ever made it to Mexico and neither does any of my sources. Yes, aerial imagery has been requested.

Thank you! And would you say, statistically speaking, since the business partner lived in the Victorville area in February 2010,that makes him the most likely offender, when you also factor into it other pointers? I ask this cause I was doing some reading on offender statistics…
What other pointers? He did not live in Victorville, he lived in Rancho Cucamango. You cannot analyze this case based on stats. Technically speaking if I did that I would classify this as a murder/suicide, or a murder suicide pact. Sounds ridiculous right? It is, this is a straight up massacre, however, 9 out of ten times in a domestic homicide it is domestic partnership or domicile related.
This is not one offender and the stats you are referring to are not going to depict them on paper.

Thank you for the clarification re where he lived, I must have been misinformed. The other pointers I was thinking of were that he stated he was the last person to see Joey McStay, that he was his business partner, etc. I was just looking at this book “Forensics For Dummies”, not any particular statistics. I feel that, based on the above, that maybe there is some connection to his business partner, whether or not he was directly involved. But that’s just intuition.
I think for me, the fact that Chase Merritt passed a polly, if true, has weight for me. However, I will be the first to say that I am aware that he has been less than truthful about some things I cannot post by agreement. I think he knows more than he has told previous investigators.

Rick, also with due respect, how is that you are in possession of this information? It’s a bit difficult to believe that LE simply informed you that they would be arresting MM by the end of August, and within that particular time frame. Or, is this just your opinion?

If this is true, MM will be the next to come up missing. LE would have to be watching him because I could see him running away. Maybe he will go to Mexico now. I don’t think he will hang around so he can be arrested. Just my opinion.

MM is probably being arrested for something unrelated to the murders. There is absolutely no conceivable way RB would know in advance if it was for the murders and they surely wouldn’t wait until August if they were. It’s likely unrelated or a ruse to make Mike panic or cough up info.

I remember years ago after the disappearance first took place, a tarot lady stated that this case would be solved eventually and that everyone would be shocked at who was responsible for this crime. She did a reading and it was posted online. I think this was before Rick’s book even came out.

He was wrong on how many, Summer did it, Joey did it, it was a drug deal gone bad, they are in Costa Rica, there was a witness to a $100K in a safety deposit box and Joey paid someone 10K to keep it quiet. Should I go on, oh yes, Summer had an affair with a man in a black corvette, Joey stopped that day to by medicine, He knew where they were and Joey called him, the Haiti claims, the guy in the water, Joey living in Spring, Texas close to me and I didn’t know it. The pictures from Spring that he claimed were Joey. The claims he has talked to and sent dental records to the SB Coroner months before the remains were found. His claim to have relationships with the SDSD, the SBCSD and the FBI. We know the Special Agent for the FBI denied any such close relationship with Baker and that came out concerning the Spring picture. If you have time I can go on and on and on and on and on and on with his lies and phony information. Oh, I forgot the fake emails of Summer that he admitted to making a phony email account in her name and writing those himself!
Here’s a question for all of you, in his blog and different sites, why does he post something and then after minutes or hours after some people have had the time to view them, he then removes them? Also why do you see all these comments made by “anonymous”? How many are real people? Don’t you think it would be more sensible and truthful if these people used or were required to use their real names? Wouldn’t it be far more reputable and truthful if you really want a believable place where the truth and real facts were spoken? How many alternate ego anonymous comments can he make up?

Or is he saying he doesn’t believe there was anything wrong with his son doing it? He’s very confident his son will not be arrested for anything. Even those who don’t think MM killed the family knew he wasn’t going to get away with this.

What’s interesting is I don’t recall Patrick mentioning MIKE’S name in the transferring of money out of JM’s accounts into his own. He always mentioned DK’s name but conveniently left out Mike’s. Since Patrick has always said it was a crime to steal this money, doesn’t he realize it was criminal for Mike to do the same. Patrick, Mike is just as guilty as DK in pilfering the funds. Mike is also guilty of pilfering the estate. He did not have a Temporary Conservatorship to conduct business for the estate. 50% of the estate belongs to Summer’s mother under CA law. Mike and DK broke the law and should be arrested, IMO.

Will Others be arrested, also? I am thinking this would be about taking money from Earth Inspired Products–Joey’s company. It began immediately before the Family was reported missing. Will this arrest be used to see what he knows? It does seem as though he knew that they weren’t coming home.

Well let me say this, I have had continued contact wit hthe FBI and the SBCSD and none of them have any relationship with Baker period! So now he has claimed Michael will be arrest, so I hope he is aware that is flat out libel and he is subject to be sued. He knows nothing and I saying now Mr. Baker you are a flat outright liar!!!

Why doesn’t anyone post under their real name around here? Anyway Rick you said the other day that you did not know who killed the family but your announcement would get the killers attention. This is a pretty big statement from you and I’m disappointed that there was no additional information. If you say he will be arrested then what is the charge? Why would this information be shared with you and not the family? Why in August? If there is a charge LE confirms will lead to arrest normally LE issues the warrant and picks up the person they are charging I have never seen news of the arrest be released to a third party to post in public before the arrest is final. LE hasn’t said a word since last November so its really hard for me up believe they are ready to make an arrest in such a high profile case and chose to let you be the one to announce it. I’m just trying to be practical based on normal police procedure this doesn’t make sense to me without further information to go with the original statement

I am not going to be tasked with Mr. Baker’s motivations, but I am guessing whatever his most recent agenda is had a deadline that precedes that.
I can tell you that his assertions that SBCSD is approving him or behind anything he is posting is utter bunk. Those assertions are about to about to go poof, if they has not already.
I seriously do not understand why any intelligent person bothers to read there- OR why anyone questioning or wishing to confirm his info does not pick up the phone and call SBCSD themselves.

Blog is Back, Big Announcement Coming Soon!
My blog is back – to stay – until the murderer is sentenced to death.
Has been a bizarre few months, with the blog up, then down, then up. It stays now with a newfound purpose.
With the blessing of the SBSD, I will have a big announcement in the next few days.
Let’s keep praying for the SBSD investigators, who are working hard on this case.

Please see Link below: If someone offers a reward like this, are the funds put in some sort of escrow account to assure payment? Of sense this isn’t going directly through the SBCSD, do they have any control over payment at all? What if someone solves this and Baker can’t pay?
There was no link, but that is ok, because I am no longer going to allow it. The lead investigators in this case have no authority to approve a reward and after speaking with their office- I can tell you, pretty sure Baker has not prepared funds for escrow/assurity under statute.
I would congratulate Mr. Baker for becoming the Leonard Padilla of the McStay case, except Mr. Padilla actually put his money where his mouth was and Padilla knew he was a schmuck, and did not hide from it.

That Jackwagon is utterly FOS. His big announcement is that he is going to offer $100K reward- which interestingly, he has done before, withdrawn, and the like. I posted to Patrick that I hope that he is working with an attorney to properly post an award in this case- to include placing same in escrow as appropriate to the laws of his state, or that of CA.
Dude needs an eval. Seriously- a family of 4 to include babies and he thinks it is his personal Rumplestiltskin.

What? I am not a hater of anyone, I am an advocate for the McStay’s- and integrity in criminal investigation and analysis to support a prosecution in their murders. Honestly- I have no idea how anyone following that hotmess in motion from the beginning is not simply keeping a balance sheet on credibility and facts.

I’ve followed this in detail and it honestly makes patrick and you both look bad when you discredit anyone who offers a reward for tips to solve this crime. A reward is a reward and money has a funny way of making people act…just look at what it did to people who were closest to this family early on. Lets be happy anyone is putting up money, rather than being bitter or letting personal feelings cloud something that is ultimately good for the case oin the whole scheme of things. Peace
I respectfully disagree with you and I think Patrick McStay has every reason to feel bitterly towards Mr. Baker- he has mocked the murders of his family and is consistently making sensationalized statements regarding his other son. I am on the record both with Patrick and in general that I believe strongly that the misappropriations of Joey and Summer’s funds is a possible criminal, and definitely civil matter.
That said, I can assure you, if I thought a VERIFIED award was going to progress this case, I would be all for it. I do not. That is not only my personal feeling, it is my professional opinion.
