Kyron Horman Missing: New Years Eve Settlement Ends Horman Marriage

Portland, OR- In a surprise court hearing,  Judge Henry Kantor signed off on the agreement between Kaine Horman and Terri Moulton Horman to end their marriage this afternoon.

Details of the agreement have not been released publicly, but according to KGW,  a financial settlement to include child support and a lump payment to Terri Horman has been reached.

In what can only be described as a bitter family court feud-  the divorce matter was last in court on December 16th to decide if the Horman landscaper,  Rodolfo Sanchez Estrada -who alleges Terri Horman tried to hire him to murder Kaine Horman at a lunch meeting – would testify.

Judge Kantor has not yet filed an order from that hearing but Attorneys for Terri Horman were granted a continuance from the pending temporary custody motion scheduled for December 19th and 20th.

    @Blink,

You know, I just adore you! I have some other things I’m getting up..as my battery charges. Public Domain.
(You do know that I just wanted those without FB access, or the mag….to be able to see what the flurry was) Good to be reminded about he copywrite….of course my MLA Handbook is circa 1985.

Anyway, the hater reaction, and Truth’s posts, have piqued my interest in the writer.

I have been reading Elaine’s articles. And I have to say, I am just disgusted about the way this professional reporter is being regarded and potentially harassed.

If anyone has the time, and it didn’t take me too long, reading her articles for PEOPLE has been a breath of fresh air. Truth has mentioned them above, and I think she agrees.

This reporter was basically embedded in Oregon for quite awhile. She followed the case and as she did she won the respect of many of of the characters in this horrible play.

She was invited to stay with the Horman’s just prior to the Sting, and she gained the trust of several of TMH’s friends and family members as well as the bio-parents and the LE mouthpieces/sources.

She was the one who never stated that TMH “failed” the polygraphs. She got quotes from friends that described TMH as distraught about both her kids. She got Dede to sit down She related in her stories more than once that TMH had “denied” the MFH allegations and stuck with that.

Most of all she knew the story that first year. Inside and out. And even from a distance, when she left Portland.

No wonder she was able to get the Roseburg neighbors, etc. to talk. They knew she would tell the truth, without a spin.

Here’s an excerpt. (excuse me, Truth, if you’ve already referred to this article)

    People: EA 6/30/10 http://www.people.com/people/article/0,,20398252,00.html

“Those closest to Terri – who has not been named a suspect or person of interest in Kyron’sJune 4 disappearance – however, say the criticism may be uncalled for. Her father, Larry Moulton, who recalls Horman making homemade costumes for her children on Halloween, tells PEOPLE: “She’s really good with kids.”
Terri has not spoken publicly about the incident, but those closest to her say the entire ordeal has taken a huge toll.

“She sends me text messages at random and says, ‘I miss my son; I want my son back.’ It’s heartbreaking to talk to her,’ ” friend Jennifer Jones tells PEOPLE.

And while in some situations “the finger points back at stepmoms,” says her dad, “she’s trying to be as cooperative as she can.”

I do VWoolf, thank you. I am not thrilled sometimes at the ole rules but I like to look out for the good friends and contributors of BOC.

I agree with you about Elaine- and I will also say she is very well respected by the National outlets. I truly believe the hater crater mentality is absolutely misguiding Ms. Young’s reaction.

I look forward to reading your new public domain stuff, LOL.

blink. I have to respectfully disagree about who is leading whom.
Warrior Green published that article originally to no outcry. I will not
go back to see, but I think there were even some
positive crater comments &/or likes. I do not believe there was
any crater negativity outcry or “write the editor” until after Desiree’s letter. She says
she was alerted by a caller with concerns, family or friends. I’m betting it
was the former. Imo the crater family’s reaction then changed.
Of course I don’t read Roseburg. Desiree needs to have her actions’ impact
held as her responsibility when she is clearly the precipitating leader imo

    Fair point Rose, agreed.

@woolf wrt “I am just disgusted about the way this professional reporter is being regarded and potentially harassed”
Not potential. real. so far restricted to a written campaign.
to a Borderline, “professional” doesn’t prevent a full-court press rageful fixation on the person.
if acting-out behaviors exceed a writing campaign, as with Terri, then she can worry.

Looking back at Desiree’s letter, she elaborated on
a person she felt she experienced a relationship with,
    by whom she felt betrayed.

  4. Rose says:

Desiree began by describing her emotions as she read the article.
She then focused at length not really on People but on its reporter and her sense
of betrayal. She finally shifted to Terri. There the crux was a previously
stated theme. Why should Terri go on with activities of daily living
when Kyron is not living. I interpret the writer to question why Terri is alive.
Combined with calling her “the devil,” an RO is indicated.

I watched the restaurants: Pie,Burger Barn, Soulve, Murrays Sandwhich on youtube, though I can’t be certain they were complete the others I couldn’t get. Here’s the listing for 2/2/14:

Has mcso requested the FBI conduct a case review and make recommendations?
If not, speculation as to why not, or why bios don’t demand it of mcso?

    No.
I sincerely believe that in the minds of MCSO, the fact that they had FBI assistance is the same thing to them. It is not even in the same zipcode. They do not want the FBI to weigh in on strategy/tactic and what we know will be LE error. To review the case, all of that would have to be forthcoming.

I have no earthly idea why they have not requested the FBI review this case- Has never made any sense to me and likely never will.

Thanks for the update on the situation regarding the weather Blink.
Sorry to see the loss of the big tree.

We had 16 degrees a daylight this morning and snow for about an hour. This usually creates an icing situation.

After reading the lengthy story in your link regarding the twists and turns of the District Attorneys and the questionable polygraph results in the drug murders, I can conclude that Multnomah county LE and DA offices need to be more careful in communicating with one another. It also tells us that sociopaths are so adept at lying without remorse that a polygraph is useless. They do not get the physical changes of normal people that is needed to make polygraph work.

Some may not remember the Cuban “boat lift” that allowed so many to come to this country. That was a fiasco from the beginning. The federal government was totally disfunctional in allowing it to happen. There were so many criminals from Castro’s prisons that the US was finally forced to round up as many as could be found and house them at the WWII built Fort Chaffee, Arkansas facility. They didn’t get them all and some escaped as did the people in the article.

Illegal drugs of any type always creates an underground criminal society in a community. As long as there are people who want to use drugs, it will be there. This starts sometimes in a doctors office with over-prescribing behavior altering drugs. At other times it begins with smoking dope and leads to other illegal drugs. The presently sold pot is about 100 times as addictive as that of the 1960′s and early 1970′s. The cocaine and heroin are being sold with other drugs mixed with them making them much more dangerous than a single drug.

The drug culture always drags down the moral behavior of a community. Portland and the surrounding area are prime examples. It creates corruption in schools and all other functions of government.

I imagine a stepmother packing her newly born baby around and struggling to find the energy for a growing boy who was not born of her body.

Blood parents who would not see the building resentment, who claim surprise at hateful emails but who undoubtedly had an idea the resentment was building.

There are any number of households with similar issues and children who survive them. Why Kyron? What made him the target on that fateful morning? He was shy, told to listen, school cards watched closely, his cries of living with his mama unheard, his daddy blind to his needs, his baby sister so cute taking attention, his big brother gone away.

I wonder, did he evoke the same smiles from adults when putting bowls and toys on his head at 7 as he did at 4, or did the adults decide it was no longer endearing? How tired was he from losing sleep because of his sisters cries in the next room all night? Whose was the last face he saw, the last voice he heard? Maybe he still has a voice to be heard?

Kaine said four years… that is only four months away. He would have never said such a thing if there weren’t elements involved beyond his wife. The parents would not have given public statements indicating Kyron was still alive if there weren’t indications this were true, followed by searches for a body or evidence up in the wooded areas of Skyline.

What kind of games was this abductor playing? Why didn’t the FBI take the lead role?

I know I should be looking at facts instead of unanswered questions. The facts we do know require us to fill in blanks and those blanks could be so strange that only when we know more can they be adequately filled in.

Staton’s statement (… we have a knowledge of things we wish we didn’t… there will be things that will surprise you… that you’ll think about later on…)

  12. Amys Sister says:

@ Rose, IMO Desiree is accountable for her own words and choices. She has an obligation to her missing son to get clear and use her voice wisely in a way that will either advance the case or enable the media and public to see the case realistically. Cryptic statements are misleading and will only hurt her position.

Re: Kantor’s decision. In December he is saying “I’ve decided. Now give me information on how this will affect your client.” Houze/Bunch responds with “This is how it will affect our client and your decision will follow you.” Or, as Blink said, “I dare you.”

Maybe Rudy will be stricken from the record completely?

  13. Amys Sister says:

There are accusations against Terri of abuse, neglect, and alcoholism in the various facebook pages. Desiree has leveled accusations of lies and hatefulness toward Kyron. Kaine has stated she is a master manipulator.

If there are no statements or evidence of any of this in the custody dispute everyone leveling those accusations will be seen as fools and hatemongers.

Oh my, that is weird. Never thought of that.

The Bio link, that I got for 2/2/14 showed different ones. I copied and pasted above. (Wonder if the aired them earlier in the day as well, darn I wish that poster would have been more specific.) I was able to find Prince Albert’s Diner on Youtube, not sure if it was the whole thing, was in two segments, anyhoo no Ky or lookalike there. Intrigues me is “The Tomahawk”, it looks like a place to take a kid to cheer’em up, but the youtube video that was available has been deleted, along with Haugen’s Cheicken & Ribs and Stoney’s Bread Company. In fact the Totem Polls out front reminded me of pic’s I’ve seen of Kyron.

If one lives in Canada you can watch the full episodes on line, here:
http://www.foodnetwork.ca/ontv/shows/you-gotta-eat-here/videos.html?titleid=265117 (click on season 1 to find them)

The main reason I find this poster’s sighting interesting, is because she mentioned “teeth” looked the same. That was an interesting comment. I’m guessing, since these aired in season 1, 2012, they were filmed in 2011. Just a guess. I hope someone can watch these.

I went back and read Blink’s report here where she talks about an older student being present that no one could remember his name and I’m assuming he is not on the released list of attendees, or he would not be unknown. Have to wonder if there is some significance in Blink writing about that. She also talks about how one student’s parents look like, or resemble, both Kaine and Terri. Once again, wondering if there is some significance there. Thinking about how a description of SZ hasn’t been released and how it has been suggested that SZ possibly looks like other parents or people present and so a description is not being released to keep all those similar looking people from being harassed or put under the microscope. Wondering if it’s possible that Mrs. Matthews though the man asking for help was Kaine or a Kaine look alike?

As a parent I would not care if my life was put under a microscope if it would clear me and help LE move forward in finding this dear little boy. Surely most adults would agree that it’s worth a little sacrifice to find him, so I honestly don’t know why they wont release a description and take it from there.

successful effort to prevent appealable legal

How could a probation officer not arrest Whiteaker when she found him in such shape. If she were afraid for her life, she should have called for backup and taken him to jail. Whiteaker is the responsible party and probation officer Dick is the enabler.

Until leadership in the LE agencies changes its behavior and guides their officers in the right direction, this will continue. As long as the insurance agencies are willing to pay the major part of claims for such acts, this will not change. In fact, the people of the city and county just had one million of their tax dollars misspent by LE failing to do their job. That million is just a part of it. The other is the likely increase in the cost of insurance that will take more tax dollars.

I agree with your assessment Cindy of the drugs being partially driven by greed. The criminal element is always looking for a way to make large amounts of money off the public wherever an opportunity presents itself.

Didn’t want to have to repost the whole exchange, but that is so right-on. Why, oh why is DY spending her time with “long interviews” with media instead of long discussions with the people in charge of the investigation? I don’t understand any of this. OTOH, maybe she is and just never bothered to mention it.

Her followers, I don’t know what else to call them, should be encouraged to send letters to the Multnomah County DA and Sheriff’s office, and the AG, not People Magazine, WW or any media outfit. The latter are entities in business for a profit, and will most likely print whatever bring them that. If there has been injustice in this investigation, why is she not following the steps that would right that? Take on the City, the County, the State….whatever it takes to further the investigation. Why pick on a media outlet who just put your missing son’s story and face out once again with questionable interest, for you to lead your minions to boycott their publication? Bizarre.

Kyron Horman’s stepmother served with documents for restraining order, divorce

One friend, who asked not to be identified, said that Terri Horman still felt as though the county sheriff’s office was on her side.

    ______

Terri and several friends (including Dede according to this report) bought bat phones during this time.

    @mbs. I read bsck to find TRuth’s treasures & re-found your lawsuit “baiting” q.
I think the value of dropping a very weak, unfounded imo really, tort suit, then “tempting” the prior defendant to file a tort (slander?), which would also be very weak, would be the matter of attorney fees in litigating either suit. If Plaintiff in
civil 1 loses her weak suit, likely she pays Defense costs. If TH files
a difficult to prove suit against DY, and loses, imo she’s stuck with DY’s Defense costs.
My lay opinion as to a possible “baiting” motive.
Donations are essentially nonexistsnt to DY’s Ramirez account recently, so
I wonder if there’s now a private donor site.
No comments, so there may be a communication tree elsewhere.
    —————————–

@Rose – I understand the risks of losing a suit and none of these people seem to be in a position to adequately fund their own suit, let alone pay for the “winner’s” costs. DY, however, doesn’t seem to think very far ahead. If she thought she could bait TH into filing a suit against her and/or her followers, even by doing or saying something so obvious that it might cost DY the case, BUT it might get TH to “talk” in order to bring the suit – I think she’d do it, if TY didn’t stop her.

It would be really interesting to know what financial support DY has for her “pursuits” and where/who it comes from. I wonder, as you did, if there’s a private way to donate.

    New thought:
It was said early on that Houze had an excellent PI he has used in the past. I don’t think we know if he used a PI in this case, but we all seemed to think that’s a given.

If Houze used a PI, wouldn’t it be to check out what TH told him about herself and anything else she offered Houze that might help her case? Let’s assume she didn’t have much to offer, did what she said she did, and had no other information other than to point to RSE and Kaine/steroids. Wouldn’t that be the end of the PI assignment? In other words, Houze (or any other defense attorney) would not hire a PI and broadly say “go solve the mystery of what happened to Kyron,” would he?

Just wondering how far a PI might have gone in researching this case and what answers Houze might have that we (and maybe LE) don’t, if any.

Probably not worth going in til 2/10 or 11?

@T.Ruth- I’m not sure. I feel it’s better to report something and be wrong, than not report it and find out it was right. I was able to watch the episode on Bio’s comcast on demand channel. If anyone else is able to watch it and weigh in on what they think it would be much appreciated. As a side note, I couldn’t see the boys teeth so I don’t know why that was mentioned as being similar to kyrons, maybe he’s shown more than once and I missed it. I’m torn on what I should do

Thanks for looking. Do you think it’s worth forwarding to the investigation?

If so, I’d send it here first: http://www.missingkids.com/missingkids/servlet/PublicHomeServlet?LanguageCountry=en_us

    then FBI

    then MCSO

ducks in a row and all that.

I would like to think that LE is holding back on what they know in regards to SZ, although that might be a fantasy.

I WISH someone would point-blank ask and report whether LE has a sketch, description, something on the SZ. It might jog someone’s memory.

The reason for my thinking is recent cold case in California – showing a quilt the murder victim was wrapped in on the news today- it was homemade – who made it???? Why not show this 25 years ago when the crime occurred???? Makes me go grrrr…….

Above is link for my comment above No. 31.

Cindy, thank you for posting that. For all reading that link you need to click on the pic and scroll right to see the quilt. While I applaud LE finally releasing this, when they determined through family members the quilt was not hers or familiar to anyone in the family, it should have been released right away.

LE is trained to utilize hold back information as an interview/interrogation tool and as a way to know if someone falsely confesses. The problem with that, and to your point, if the assessment is made that a case is going to or has stalled, and LE needs to generate leads, that should always be the priority.

This is why cold cases should have better standards for review and resolution.

    @Cindy

Makes me go GRRRR too. “Asked why police never before asked for the public’s help with the quilt, Kajani and Investigator Michael Brown told the San Jose Mercury News that detectives initially wanted to hold back some information only the killer would know about, such as the method of strangulation.”

Lame response. All these years later and whomever may have known who made that quilt could very well be deceased. I understand withholding certain things, but this was ridiculous. GRRRR.

  44. T. Ruth says:

So, is LE not releasing any more information in Kyron’s cold case, because they are afraid of being wrong, or is it because there is nothing more to release?

I don’t care what the DA calls it, Kyron’s case is stalled and getting colder by the day. We are rapidly approaching for years.

Wow, that’s a powerful example of unique evidence that could have led to tracking down the murderer back then. That’s a one-of-a-kind sort of item. Probably more unique than a photo of a person, because it doesn’t change with a haircut/glasses. Hard to believe it was held back; an education for me for sure.

Rose/Blink: What is the difference between an *FBI review* and what they were brought in for back in February 2011?

    (snipped)

“The FBI has stepped up their participation,” Staton said Wednesday. “They’ve offered up the BAU unit and any assistance.”

Beth Anne Steele, FBI spokeswoman, said the BAU agents assisting bring an expertise specific to violent crimes and kidnapping.

“They sit down with investigators and go through the case files page by page, and try to help brainstorm ideas,” she said. “They may say, ‘you want to try this,’ or ‘have you looked at this?’ ”

They’ve examined the investigative documents and other evidence accumulated so far — everything from GPS marks picked up from cell phones to taped interviews of persons of interest to what media outlets have caught on camera.

“They have a way of being able to tell us what it is they’re observing,” Staton said.

As a result of the BAU agents’ visit, the FBI is dedicating a group of agents from its Portland office to work on running down certain leads or conducting interviews with people who have not been reached.

“We are providing a core group of investigators to help deal with some specific tasks that were identified by the profilers and the task force,” Steele said.

    Blink,

The latest is up. The newest, as of last Wednesday, docket. After the last Bunch 16 page Memo in which Bunch sets up a full, complete cross of Rudy vs TMH’s 14th amendment rights, etc, Engels goes on the defense and asks the judge to “strike” the memo. Then there’s another response by Bunch, but i’m not sure it’s in Response to the “Strike it” memo. There’s talk of postponing in Engels Motion to Strike.

This is all after the memo cited on Olive, and KGW.

Anyway…i’ve got what’s new in the files up.
I’m going to read them again. I don’t have a good feeling about Kantor giving Rudy up for complete cross, though.

    @Cindy
    Interesting about that quilt
I have bought something like that at garage sales just to have in the car in case I get stuck some place
And none of my family would know about it
Anyway after 25 years I wish them luck

  49. Malty says:

As for People mag. I only look at it if I am stuck in a dr office and there is nothing else interesting to read
So I don’t understand DY putting so much faith in them
I really did shed tears with her at first but after this Roseburg deal I have not felt the same
But of course I want Kyron found and united with her
    Don’t we all
