Courtesy Making A Murderer Avery Cabin

Faced with the prospect that Avery needed criminal defense cash, Avery’s civil attorneys had no choice but to cash him in, and free up his proceeds for criminal representation.  Both civil attorneys were actively trying to locate Steven Avery fearing he was being questioned without representation for several hours (he was) the day of his arrest and said so in several televised interviews.  During questioning, Calumet Detective Mark Wiegert accuses Avery of the murder of Teresa Halbach- whether accidentally or accidentally on-purpose.

Weigert asks Avery, “Then why is her blood all over your trailer?” Avery responds “No It Ain’t”.

Wiegert asks- “why is your blood all over the inside of her car then?”  Avery responds, “Cops got a lot of my blood, they took blood from me many times, vials.”

Avery is originally arrested on a felon in possession of a firearm charge, and subsequently upgraded to the first degree murder of Teresa Halbach following DNA confirmations of her remains on the property.  Although all investigative reports provided to Avery’s initial public defender reflect no involvement in the searches  or collection of evidence by Manitowoc deputies in any capacity, presented at Avery’s preliminary,  a Calumet county deputy was asked just the right question, in just the right way, gleans this gem:  although searched six times, on the 7th search following confirmation of Halbachs blood in her own vehicle, Kucharsky admits he was never told to watch the actions of Manitowoc deputies Andrew Colborn and James Lenk – who by the way, just happened to find the valet key to Teresa Halbach’s Rav 4 that Lucharsky also testified was not there in any prior search.

Colborn and Lenk were central figures responsible for the wrongful conviction in 1985 of Steven Avery. The key contained only Avery’s DNA.

Avery’s civil attorney,  Stephen Glynn, calls Avery on February 16, 2006 and recommended his former partner Dean Strang, and if possible, also Jerome Buting as his criminal defense team.  Strang was well known in cases involving allegations of police misconduct and Buting had experience and name recognition for successfully defending high profile cases in Wisconsin.   After paying his civil lawyers, Avery coughed up a joint $240,000 retainer for the duo.  By then, the Avery family had already consented to participation in Making A Murderer.

Dean Strang and Jerome Buting see significant screen time in Making A  Murderer.  While both Wisconsin barristers are masterful to the point if I were a Wisconsite I might consider a victimless crime just to experience their representation- not even they could foresee how the shell game mastery of special prosecutor Ken Kratz.  Kratz was appointed to the case from neighboring Calumet County so as to assuage the very appearance of any impropriety or conflict on behalf of the county who (ostensibly) just funded Avery’s defense.

Kratz, an elected DA with zero supervision in his role was more than ready to demonstrate his Kratz-as- Kratz- can technique .

The Accidental Targeted Defendant

The MAM series does not highlight this connection directly, but following Avery’s retention of Strang and Buting, Investigators begin visting Avery’s fiancé,  Jodi Stachowski,  in prison.  Jodi was locked up  since August on her 5th DUI charge.  It is not known what those visits were about- they were never presented in court,  but shortly thereafter Jodi was released several months early and returned to the Avery compound and Steve’s trailer.  On camera, she appears in a few scenes with multiple family members professing Averys innocence.  She also accuses police of stealing her purse she left behind.   The couple had some domestic skirmishes resulting in a 3 day restraining order against Avery in 2004, but it was believed to be due to an unfounded accusation against Avery by the mother of his niece.   And according to her criminal arrest record it is pretty clear Jodi was drunk more than she was sober- so there’s that.

Calumet investigator Mark Wiegert is now partnered with Wisconsin criminal investigation division special agent Tom Fassbender.

Within days of the announcement Avery has retained the services of Strang and Buting,  Wiegert and Fassbender turn their attention to Brendan Dassey- Avery’s 16 year old nephew.

Dassey had already been interviewed twice passively at his residence (next door to Avery) immediately following Halbach’s disappearance.  Dassey provided a detailed account of his whereabouts to include he and his brother had invited two friends over that night but both cancelled, and Brendan went over to help Avery with a vehicle and a previously planned bonfire.  He did this during the execution of a search warrant for the vehicle he was riding in (which belonged to Avery) in back of the cop car who was now supposed to give them a ride back to the family cabin.   On February 20th Wiegert interviews Dassey’s cousin Kayla in the presence of both her parents with prior permission as well.  Kayla Avery was 14.

Pertinent point here- this occurs on the Avery property so there was no effort to cover up the interview or keep it from the many family members who would have been aware of it.

In stark contrast to their interviewing minors procedures a week earlier, on February 27th  Todd Fassbender and Matthew Wiegert yank Dassey out of class for his first interviews following his Uncle’s arrest.  (Disclosure: This author holds advanced certifications in interview and interrogation techniques through Reid since 2012, therefore I am going to provide a brief synopsis only of what occurs between February 27th and March 2, 2006)

On February 27th, 2006 (Read the transcripts here) Brendan Dassey is interviewed for several hours without notification to, or permission of either of, his parents and  is told if he does not confess Avery (and all cops) plan to blame him because he and Avery were the only two in attendance at the fire behind Avery’s garage.  At no time in his accusatory interview is Dassey informed he is a suspect or Mirandized.

After this interview, Fassbender calls  Barb Janda,  requests she to come to the school to speak with investigators.  Her interview has never been submitted as evidence.  Although Janda she drove her own vehicle, she and Brendan , by investigators without the knowledge her 16 year old developmentally and intellectually compromised minor-aged son had just incriminated himself.   Nor does she know Brendan was just told Steve Avery might now get out and they feared for his safety.   Wiegert alerts Kratz and Kratz directs the investigators to take Brendan to Twin Rivers to properly memorialize the interviews and to put Brendan and his Ma up in a Hotel for their safety.  Let’s be real here.  There was never any danger that Steven would be released.  There was however, a concern on behalf of Kratz et al that there were two documentarians with access to the site and the Avery family they did NOT want on film.   In the interest of brevity- additional interviews over four hours on March 1, 2006, which are nearly entirely suggestive of evidence now only known to investigators, they succeed in extracting an involuntary confession from a 16 year old who clearly believes afterwards he is turning in a project in school.

Not in the docuseries, but according to prison logs obtained exclusively by www.blinkoncrime.com, Steven Avery was put in isolation the afternoon of February 27, 2006,  on suicide watch Feb 28, 2006, and was  not returned to his cell until Dassey was arrested.  What was the need to break jail protocol if they were hiding out Dassey in the first place?

On March 1, 2006 Brendan Dassey is arrested for the rape and murder of Teresa Halbach although the account he gave of his own involvement was never corroborated by a scintilla of evidence.   He asks- is this just like for a day or two?

“Steven, I know your gonna be watching be watching this,  I hate you.  I hate you for what you did to my kid so you can rot in Hell.” – Barb Janda

Not in the series,  but in the last minutes before Brendan is arrested on March 1,   a press conference alert goes out over the ap wire.  You read that correctly.  Ken Kratz along with Calumet Sheriff Pagel were scheduling their first press conference in four months before the cuffs were even on Dassey.    Gets better.  Fassbender takes a call during the Dassey interview about the press conference scheduled the next day, where the details of this suspect who does not so much as have a warrant for their arrest at the time.

Kratz would deliver as promised. It would be the most horrific and vile account of a young woman’s kidnapping, rape, torture, murder and mutilation during a press conference by a prosecutor I have ever heard.  In my view it was also the first of more than a few ethics violations by Ken Kratz.  More on that later.  Not only do I find it impossible to repeat the words in print- but because I know at the time, and since,  Kratz is well aware it’s veracity is in the region of nautical depths of questionable. His goal was to create such chaos within the Avery family that a divide would insure two notches on his belt.  Pretty much- it worked.

Can any of us imagine the ripple effect on a family that was previously conjoined in the elation of the possibility for absolution for Steven Avery in the form of punitive relief, finally?   The series goes into, but does not dwell on the fact that that Steven’s homecoming was what one should probably expect- a situation with someone with untreated psychological issues as a result of being incarcerated for a heinous crime he did not commit.  The Avery junkyard was the backdrop of their lives.  This family of meager means was working and  living in a scrap metal equivalent of a beehive and now that same beehive contained the cremains of a young woman.  The disastrous fallout can be summed up best by Barb Janda’s  spit-laden conversation with her brother Steven after Brendan’s arrest.

Janda: “ You got a $100,000 for me, for my son?  “

Avery: For What”

Janda: A lawyer

Avery: He has a lawyer

Janda: I just lost him, hes related to the Halbachs.

Using Brendan’s confession investigators renewed a search, swung by Brendan’s house, with his permission and picked up a pair of his jeans with bleach stains he told investigators he got by helping Avery clean up reddish-brown liquid on the garage floor after Avery told him he accidentally put a hole in something working on his vehicle.   A re-search of the garage where 11 casings of a .22 were found in the open on now gleaned 2 partially intact .22 bullets

According to Mark Weigert, luminol lit up (from the presence of bleach) exactly where Dassey said they cleaned up large stains.  Dassey’s drawing from that interview was used to direct the forensic teams.

Next on the felony public defender rotation is Len Kachinsky.  Len,  a ringer for Alfred E Neuman with glasses gave his first press interview before he ever even met Brendan- an interview clearly indicating guilt on behalf of his juvenile client.

Brendan Dassey’s situation was about to go from bad to worse.

My first statement holds true. The case is a mess with LE and attorneys doing some strange things.

If the courts on review allow a retrial, then the State of Wisconsin should step in to handle the case. Too much funny business with the investigation.

Looking forward to the evidence section.

Prolly going to talk about it tonight and you prolly already know (maybe not) what I am going to say, lol.

However, only one other case has tested my faith in the US criminal justice system so strongly, and to some degree, my self-assessment. Can I still preform as an effective and true practitioner in it? So far, at the end of the day, regardless of the case details, All Americans are
afforded their right to the presumption of innocence under our US constitution and that is the cornerstone for me, period. The rest, I give to God.

I absolutely believe Avery was wrongfully convicted in the Beerntsen case. No doubt for me and it was no honest mistake.
I do not believe he received a fair trial. I think there is very compelling evidence he is guilty in Teresa’s murder.
I think Brendan Dassey was his family’s throwaway, the systems scapegoat and for me- the poster child for illegal, involuntary, coerced confession of a minor I may have ever seen. He deserves a new trial. More on that.

  2. Tarheel says:

So Manitowoc deputies Andrew Colborn and James Lenk found the valet key to Teresa Halbach’s Rav 4 that Kucharsky testified was not there in any prior search? Why in the world would the Manitowoc county deputies be allowed access to a crime scene if it had been turned over to another county? Will that evidence be thrown out?

YES! Searches began 11/4/05 (consent, 11/5/05 warrants) Key was found Nov. 8th and every report indicated it was Kucharsky located it. In fact, the deputy logs did not include Lenk until after Avery was arrested. Both were there also on March 1 & 2.

    Lenk volunteered no less.

The defense made a tactical decision to not attempt to suppress the key as it supported evidence planting as part of their frame up defense. At the time, an earlier Denny decision precluded them strongly from anything else. It was a laughable (if not so serious) part of the series it was so obvious. And Colborn literally used the EXACT legal language to include it – he was actively coached.

Thanks to Malty and Blink for the compliment on the Vol. I thread.

Yes, Malty I couldn’t agree more regarding the balance of a woman and man. Our creator set it up that way, but our general society has not reached the point of understanding and using his way.

I know his IQ is 70, but surely he wouldn’t clean wipe her own car key
with some cleaning solution every speck of her dna, before deliberately
superimposing his own fingerprint on the key, all while he was jailed,
I presume, and the key was in the possession of 2 keystone cops
with a significant grudge against him

Can anyone imagine a key used daily in a 6 year old vehicle ( for me, reminder- this is def a valet or spare key) by this woman and the only DNA on it is Averys after 7 other searches ( and per Kucharsky key was definitely not there- my theory** by then, he was pretty pissed and not gonna take the rap for anyone) come up bupkiss? It can only prompt the obvious- where are the main and house keys and where in the vehicle was this key’s lanyard allegedly found? I have never seen a pic of it, anywhere within the vehicle.

At the very least- who puts themselves in such a precarious professional position twice?

Who are the people in the above pic I never saw Netflix so I don’t know who is who yet

That kid with 70 IQ is he suppose to be not involved but the LE used him to get Avery or what? If that is the case
This is bad , how long is his sentence. Was he a minor ?

Brendan Dassey (minor, convicted at 17)
Steven Avery across and the grandparents at their cabin. LE used this picture to tell Brendan that he was lying about being afraid of his Uncle- which does not appear on tape anywhere.

Blink you nailed it. The press conference sounded like the closing statement of the Prosecution at trial tying all the dots together. How in the he….do you do that within hours after a 16 year old, challenged..docile..kid gives a statement with out backup proof. Outrages. So graphic that I thought of Teresa’s family hearing details that way. They surely are prepped before court to hear things like this…but on TV in a press conference, it was to much.
Question? was the “niece” in your piece the one that MAM showed on the stand.

I remain utterly and completely blown away at Kratz unilateral decision to schedule that. I watched him intently, several times. He barely glanced at his notes. As a person who studies and writes such narratives often (unfortunately, occu necessity) – there is something so off about that I can’t put my finger on. Wait until you see how Kratz orchestrates what comes next.

  8. erose says:

Apologies in advance, if I’m off point. I’m at a disadvantage because I have not seen the documentary so I hesitate to comment, but I will anyway. This blood evidence reminds me of the OJ case. I am probably one of a handful of people who kept an open mind about him, and as we have later learned he did own those “ugly ass shoes” so he lied, and it was the smoking gun Marcia Clark desperately sought in the criminal trial.

I do, however remember the shoddy forensics and the missing blood in that case. I have often wondered if, because OJ was so high profile, investigators wanted to make sure they had a forensic case against him and planted the blood to ensure his conviction, as the lab could not account for all of his blood. LE wanted to thwart the CSI effect before we had a name for it.

I guess what I am saying is it is possible for a person to be guilty and also for LE’s investigation to be corrupt or inept. The corruption seems to fall into two categories, IMO, either to cover up their own bad deeds, or to play God, and ineptness seems to occur when agencies with little experience in certain criminal investigations cannot get out from under their own egos and accept help, even when they have the jurisdiction over the crime. Perhaps it is time for some oversight of LE that goes beyond their own IA division.

Anyway, get out your tomatoes, because I believed the OJ jury got their verdict right, even though OJ was guilty. We can’t take the law into our own hands, and that includes LE. “Our government… teaches the whole people by its example. If the government becomes the lawbreaker, it breeds contempt for law; it invites every man to become a law unto himself; it invites anarchy.” ~Louis Brandeis

You posit: I guess what I am saying is it is possible for a person to be guilty and also for LE’s investigation to be corrupt or inept.

    My view: definitely.

No tomatoes from me. A critical example of prosecutorial hubris and straight up outlawyering. Interesting contrast to Avery though- as both are exonerated and both will likely die in prison.

  9. A Texas Grandfather says:

I am sure that Blink has developed a time line of the events, but it probably has some holes.

Many people keep a key as a single key to give to an attendant at a valet park facility. This keeps house and other keys from falling into the wrong hands. It should be easy to determine if this key was in very good condition. A key that is used daily soon usually has the written text adjacent to the buttons worn away and the sharp curved areas are rounded even more with the finish rubbed and scratched.

If Teresa’s vehicle was on the junk yard property, it should have been found within two hours, not the length of time reported.

ATG- this yard is 40 acres and the rear area near the crusher is not even visible from the front entrance. To your point- I believe Colborn absolutely knew Teresa’s vehicle was there. I don’t know how yet, but I will get into it in 3.

Me either. Another First. IN III.

  11. Malty says:

How many family or people lived on this 40 acres in all and why was this girl there taking pics of that place I understand she didn’t want to go there but what was going on was The Avery bunch running illegal activity and Avery killed her to cover
I guess you can tell I am not understanding why she had to die Or was it sexual and she was there

unclear for verification purposes, but Dolores and Allan Avery, Barb Janda and 3 Dassey Boys, Earl Avery, Steven and Jodi, appears some cousins possibly. By the time Avery was exonerated from the 1985 case, all 3 of the Avery boys (men) were convicted felons.
    B

  12. Malty says:

It sure was a messy crime Evidence here there everywhere. That makes me think

  13. erose says:

Just listened to the Podcast, coincidence wrt my bringing up OJ earlier though on a different point, anyway…

If Avery was exonerated of the original sexual assault charge, how was he subsequently charged with the firearms charge being a convicted felon? What was his prior felony? I must have missed it, was it the DV assault? The cat?

Are we wondering if Avery was being watched by LE because of his civil case and someone seized the opportunity to frame him? Such a dark thought. But if you follow the money a case can be made, whether true or not.

IMO, The phenom of MAM has all the components of our guilty pleasures (cringe) or addictions (cringe x2) or obsessions (cringe x3); armchair criminologists, social media with purpose (for peeps who want to use and express their brain power), binge watching and a commonality of growing distrust in, or at least yearning for public oversight of the system.

To Dana’s OJ point, I thought he meant that this case is the 21st century’s turning point in how the public is involved in criminal cases as was OJ’s in the 20th century. (As in something we have all never seen the likes of, but you are right this hasn’t reached that scale.) Back in the old days we watched a live slow car chase and Court TV and had 24 hour news cycles on TV. Now we can get news updates from our computers from multiple sources, not just MSM, we binge watch docu-series and we blog about it, thanks to people like you.

Blink, Very interesting as always. You made the best point about advocacy on the take-away.

P.S.(Where will you ever find an extra 690 hours?)

He was convicted of burglary (felony) of a tavern of some kind with some friends.
It is a fair statement some think the MCSO had $36 Million reasons to kill Halbach and frame Avery- personally, I think that type of conspiracy fodder is silly and I do not subscribe. Avery was having domestic issues with Jodi, was accused by the Mother of his niece of an inappropriate sexual relationship as well as an alleged sexual assault of a 41 year old woman ( we learn these things pos arrest in Halbach and was never charged)

Spot on with MAM as a phenom.

As I said this seems like a real messy crime. Key, blood, sweat, bullet , ashes and bones. If some one didn’t plant evidence maybe Avery was missing the guys back in prison

  15. Malty says:

As far as OJ is concerned I always thought he was young fit and broke but he could have still made something out of the rest of his life and he didn’t he writes that book and got in trouble He is where he wants to be IMO

Great to hear your voice on Dana’s show. It was a valuable piece and very easy to follow. I know why I xo you, you said so many things that I have screamed myself while watching this program. I have begun watching it for a second time. The first time as an entertainment of sorts and now the second time I have a better idea of the players and what to watch out for more closely. I have to give Kudo’s to the editors of MAM. Dana pointed out the cutaways to expressions of those on the stands and in depositions and a point was made without words. Do I think that everyone of those cutaways were in real time? Probably not. Still they were very effective.

Yes the cat incident almost made me judge SA as trash and I am not going to watch this. My daughter who had already seen this and harped on me to watch this was watching it again with me said..”Oh Mom he did not mean to it was a mistake just keep watching” so I did. It was not just a mistake as I learned but I am glad she said it so I would continue to watch. OT I will always now root for any team that is playing against a team with Michael Vick on it, I can not help myself.

I believe those facial expressions were genuine in context- however it should be noted most occur in pre-trial to remove Manitowoc from participation in the trial. I cannot believe some of Colborn’s responses in particular. I subscribe to that fool me once theory.. however, that guy couldn’t fool grass it is green. On a sort of lateral note- deputies from the jail sector rising in the ranks this way to participate in active investigations is always a bad idea, imo.

The cat thing is NOT shown! It is clear however from the record he absolutely did what he was accused of. As I said- such an act in itself DOES color my thinking as to criminal capability. You know, it is an interesting notion that I can work toward and accomplish understanding a criminals perspective in so many elements but tell me about anyone torturing a defenseless pet. I mean, it just signifies one thing to me.

The Google image is dated 6/1/2015. It is situated South of the City of Maniwitoc, Wi. The general elevation is about 660 ft. MSL.

It is an old style auto junk yard with vehicles parked singly in rows, rather than having vehicles stacked on top of one another. It is clear with a few areas with trees,

So far, I have identified eleven buildings and there are probably more. This yard could have been walked by a single person in an hours time.

The TMZ report is typically the response of a mom that lives in a dream world of bad behavior, drugs and alcohol.

I am going to say at this point that the county criminal justice system is very badly broken. In fact, so broken that the state needs to come in and relieve every one of those involved in this case from duty replacing them with hand picked people of good moral standing and experience in the area of the appointment. The people of this county deserve nothing less.

It’s just heart wrenching. I am so conflicted about how I feel about this family. I have great compassion, and on the other hand it reminds me of why I absolutely abhored Jerry Springer and refused to watch it. The danger in that is that people watched and thought- look at them- hey I don’t have to do a thing to better myself- they are worse than me. I don’t know from whom or how- but there are deep abuse secrets in this family. I can just feel it.

I just don’t know what to think at this point.

    1. They never asked permission from his parents- in contrast to an interview they conducted with his minor cousin a week prior.
    2. No, his Mom never demanded a thing to protect this child. Which boggles my mind to this day as she was arrested on Nov. 5, and in my view in light of that this makes even less sense.

The interesting thing about the Avery family is I have never read anything about any drug problems. I agree there is bad behavior fueled by alcohol and obvious a lower than the average IQs. I also was struck by Steven’s description of his childhood in the junk yard. He explained about his youth exploring the 40 acres and it was good according to him. Just an observation.

agree about lack of evidence for drugs overall in terms of charges, but that does not preclude any possible usage. Janda was busted trying to go to her house on Nov 5 at the barrier – for weed.

The main entrance to the yard is a private road that runs South from Hwy. 147 to the North property line where it turns West terminating in a loop near the West property line. The property width East to West is approximately 1,310 ft.

There are quarries on all sides of the property. The South end of the property appears to have been explored for a quarry operation and is not in use as auto storage.

Avery rode traverses the North portion of the property. Vehicle access roads are mostly North to South for the storage operation.
There is evidence that it is possible to gain ingress and egress to the property at the Southwest corner by using the adjacent quarry road to connect to County Road Q. There are trees along the West and South property lines.

This corner is where I believe that Teresa’s vehicle was hidden. I included the ability to drive into and out of the property for the fact that the vehicle could have been placed there without anyone seeing them at the front of the property. The question is who placed it there?

Seeing that interrogation of Brendan was heartbreaking. It was very upsetting watching a child literally lose their innocence and future right in front of my eyes. This is reprehensible. Hearing him ask if they would be done in time for him to turn in a school project really got to me. I think he was used as a scapegoat by the state and his family.

I am in agreement with all of those who think there is a long history of abuse in the Avery family. I don’t know how to put this politely, but from my previous work in child welfare, we had many families in the system that were generational and the averys reminded me of several families I came in contact with, I would be shocked if there isn’t a long history of involvement with the child welfare system in Wisconsin in regards to the Avery’s. The dysfunction in that family is glaringly obvious and runs very deep.

Is there anyway the marriage between Jodi and Brendan’s father and/or the marriage of his mother to Scott Tadych could have to do with spouses not having to testify against one another in the future if perhaps one party has concerns about facing charges related to this in the future or is that line of thought a sign that I need to go to bed?

My money is on that very notion. Real or perceived I don’t know.

I also think the part of the reasons OJ and Anthony got off was because of the media circus surrounding their cases. I think the jury tries to be careful to only consider solid evidence in these cases because they are afraid they may have been biased. So now that this case has been on Netflix and in the news so much we now have a media circus. Seems like a big boon to Avery’s defense. One more reason why I believe Terri will never be successfully prosecuted for any crime against Kyron in Oregon.

    Good insights.
    1. I think OJ represented celebrity status to this jury and the defense portrayal of Fuhrman as a racist was masterful. Totally agree as to high profile.
    2. Anthony was definitely a CSI effect, but mostly, it was an idiot move to sequester a jury in a high profile case in this way AND imo, prosecutorial hubris, sadly.

He had moved into the trailer by then. That ice fishing hut is on a trailer hitch and is movable. The trailer is at the lower North-western part of the property at the end of the access road that runs parallel.

Blink, in the interview you did you mentioned this story is like a layer cake. I have started in many post but never said that the layers are what is fascinated. I guess I am having trouble prioritizing in my mind what area to concentrate on first but they are all meshed together like a layer cake that has been thrown in the garbage. Do you look first at the Judicial and Law enforcements bungled actions or do you look at the crime and try in your mind to see what happened….they are all just a big piece of cake stomped on and pitched, and someone putting it back together but doesn’t know if chocolate was the first layer.
Barb seemed to honestly not know what happened to Teresa following her son’s arrest. The bleach on the jeans gave me pause but it was said (I don’t have a source so I could be completely wrong) that Scott said in effect that his clothes got mixed up with the families laundry and there was blood on some clothes. Quick question…does someone as a rule shower before hunting? Does the scent on a person play into hunting.

For me- when I am analyzing- and I think is a good practice overall- is to bifurcate my investment into whether or not a person is guilty or innocent in my view- as opposed to whether their verdict was arrived at through a fair trial. I truly believe in a presumption of innocence and I truly believe in due process when ALL PARTIES adhere to the rules across the board- it works out with few exceptions.

I can’t ask myself if I would have convicted someone or not if I was never there and I can pretty much guarantee I am never serving on a jury of a criminal case.

Yes. Hunters I know always shower before they head out.

The two residences near the turn-around are the trailers. One is very old approx. 10 x 50 ft. and the other is 16 x 80 ft.and newer.

A diagonal measurement from the NE corner of the property to the SW corner is approx. 1,900 ft. This is over a third of a mile. If one takes the little human icon in the Google navigation area to get a street view, you will see all the rise and fall of the land that creates difficulty in seeing the South part of the property. One can also track the elevation of MSL across the property by paying attention to the ground elevation underneath the cursor located at the bottom right of the screen.

Modern junk yard operation is different than it was prior to the 1970′s. Today, it is computerized as to inventory and yards are connected via radio and the internet. Parts like alternators, power steering pumps, batteries, wheels,,tires, radiators and water pumps along with some others like good leather seats are usually removed, then tagged and stored in a building.

In the case of the Avery yard, there is a building where vehicles are restored and re-titled for resale. Not all yards have that facility, but there are people who will buy a vehicle from a junk yard that have been classified as “re-builders” and do the rebuilding at another facility. This is probably the prime reason that Teresa was called multiple times for photos.

There are publications available to repair shops, insurance adjusters and junk yards that list all the parts of an auto or truck. These were originally in paper only, but are now on-line or sold on a CD or DVD with a search engine such as Folio Views now owned by Lexis and Nexis that are used for legal searches.

Alternative to existing crime lab protocol, fwiw.

    snip>

Elsewhere in Mexico and in all of the United States, forensics falls under the strong hand of law enforcement. On the never-ending reel of CSI shows, agents dust for fingerprints in one scene and pull out the handcuffs in the next. Here in the midwestern state of Jalisco, it’s different. Specially trained civilians do the DNA testing, while police must keep their distance. It might sound like little more than a bureaucratic nuance, but this small detail packs a decent amount of reform. And it’s a model that has found purchase north of the border, as crime labs continuously come under new scrutiny for their dysfunction and the toll of botched convictions notches ever higher.

    From above:
Brendan Dassey, who was convicted of participating in the gruesome 2005 murder of Teresa Halbach, has taken his quest for freedom to the federal court system.

Lawyers for Dassey, 25, recently filed a petition for writ of habeas corpus in the U.S. District Court for the Eastern District of Wisconsin. The legal move is designed to prompt a federal judge to determine whether Dassey’s arrest and conviction were legal
    ******
Is this Brendan’s current course? New territory for me. The article is from Dec. 2015.

Yes. I have studied this writ. It is going to come down to inefectiveness of counsel and/or structural errors, imo.

I didn’t answer your question about which building Teresa was held in or where she was killed.

The old trailer, the one nearest the West property line is the prime suspected location for me. There is nothing that we know presently that directly ties her to that location. However, it is the most distant building from the main business buildings of the yard. It also has a two car garage building near it to the East. By following the West property line South one will see the group of trees where I believe that the vehicle was hidden.

There is a major problem with the known evidence regarding how and when it was obtained. Nothing other than the key supposedly found underneath the night stand in Avery’s bedroom was reported in that trailer if in fact it is his.

I think that investigators failed to work the case from a planned approach and because of lack of a plan, they missed a lot of information. The red stain clean up with the bleach in the garage is from a sixteen year old with an IQ range well below normal. Hydraulic fluid used in power steering pumps and automatic transmissions is colored red so that people will not confuse it with motor oil. It will leave a red stain on concrete if spilled.

There is also the possibility that Teresa was taken off the property to another place using another vehicle than her own via the SW corner unimproved trail to the quarry road. When Blink produces her evidence piece, there may be something that could clear this up.

The work buildings for the yard are large metal fabricated buildings (one is approx. 80 ft by 100 ft.)with side wall heights of sixteen to twenty feet so that a lift can operate with a vehicle and not hit a ceiling. Those buildings are often built with an area in one or both ends for an office and storage that would be considered a second floor.

If you want to see the type of lift I am referring to, search for Norther Tool & Equipment on Google and then on their site search for lifts. You will find post type lifts with two or four posts.

Blink writes about a metal crusher being on site. It would have to be in one of the large buildings as I do not see it from Google Earth. Using the crusher is the last step in salvage when all the sale-able parts have been removed from a vehicle. That would include body parts such as fenders, hoods and bumpers. Engines would have been removed, cleaned and stored for rebuild.

The story about cleaning the garage floor with bleach rings true if one understands that a dirty or normally stained concrete floor is easily cleaned with a pressure washer and liquid soap that has a powerful detergent. These range in price from 100 to 3,500 dollars. Any respectable shop has one. I have a small one for my garage which is also used for cleaning the deck surfaces of the house.

The more I think about this case the more I am drawn to believe that Avery was discovered by some others in the family and they joined in working to prevent LE from finding the truth.

  43. Tarheel says:

Finished all the episodes. Wondering how some of the people didn’t lose their jobs. Although I wasn’t certain of Averys guilt there was something about Kratz I didn’t like. That was cleared up for me around episode 9 or 10.

Brendan’s pre trial attorney was a clown and a disgrace to the judicial system. I still don’t know what to believe from him but I do know he needed better representation. Even tho his trial attorneys were much better than the pre trial attorney I felt they lacked something important. Maybe fire or interest…can’t put my finger on it.

Averys attorneys were awesome. But for over $100,000 I would expect nothing less from them. I noticed a huge difference in the paid attorneys and Brendans public defenders.

I can’t believe there isn’t something in place to help people that seem to be of lower intelligence like Brendan. Someone to help them understand more about what to expect even from their own attorneys. Was Brendan automatically tried as an adult?

That is an excellent question I have asked initially and I do not have an answer yet, unfortunately. In my jurisdiction- his age would require a decertification hearing-

Did she accidentally take pics of some thing? Illegal

I believe he probably did this and some one may have added some extra evidence to make sure he goes away a long time But I can’t think this whole thing out And why get that kid into it

Malty- your question is sound. The Avery bill was scheduled for the floor the following day, Nov.1. I do not have an answer to the question as to how that relates to motivation but it stays with me.
