<p>I freely admit I have caught many a fly in my trache while my yap was left hanging open at some of the legal filings by Jose Baez et al, in this case.</p>
<p>The latest motion to suppress the recorded conversation between convicted felon and “lifer” Robin Lunceford and Jose Baez has insipred the first ever Blink <a href="http://en.wikipedia.org/wiki/Darwin_Awards">Darwin Award</a>, or, <strong><span style="font-size: medium;">THE BLARWIN</span></strong>.</p>

<p>In his Motion for a protective order to keep the call out of discovery, Esteemed Blarwin recipient, Jose Baez, claims he did not know his conversation was being recorded, and apparently, what type of phone line was being used although he states the call was transferred to his cell phone.</p>
<p><strong><span style="font-size: small;">HOLD THE PHONE</span></strong></p>
<p>Pun intended. It would be impossible for him to be unaware that Lunceford was not calling from the Lowell Annex. As Baez is aware, inmates at Lowell Annex MUST have the number they are calling on an approved list in advance AND they may only call collect. From Lowell Annex Rules:</p>

In the event of family emergency (such as serious illness or death in the family) you may contact the chaplain&#8217;s office. The chaplain will notify the offender. </span></p>
<p class="MsoNormal" style="margin: 0in 0in 10pt; line-height: normal; mso-margin-top-alt: auto; mso-margin-bottom-alt: auto;"><span style="font-size: 10pt; font-family: 'Verdana','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: 'Times New Roman';">Offenders, except those in administrative confinement, disciplinary confinement, close management or on death row are allowed to make <strong>collect</strong> telephone calls. Offenders are allowed to place up to 10 telephone numbers on their authorized phone list. <strong>If the offender has not placed your number on the list, he or she cannot call you.</strong></span></p>
<p class="MsoNormal" style="margin: 0in 0in 10pt; line-height: normal; mso-margin-top-alt: auto; mso-margin-bottom-alt: auto;"><span style="font-size: 10pt; font-family: 'Verdana','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: 'Times New Roman';"><strong>Offenders can change their phone list every six months</strong>. There are two exceptions to this policy: &lt; ?xml:namespace prefix =&#8221;" o /&gt;</span></p>

I have news for you Mr. Baez, the State has already listened to it. This would be how it is DISCOVERABLE, or subject to discovery in the first place.</span></p>
<p class="MsoNormal" style="margin: 0in 0in 10pt; line-height: normal; mso-margin-top-alt: auto; mso-margin-bottom-alt: auto;"><span style="font-size: 10pt; font-family: 'Verdana','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: 'Times New Roman';">Now, <strong>you know</strong> Jose copied and pasted some of the States own verbiage from the motion regarding Joe Jordan’s snafu. A surreptitious recording in a two way notification state is not even in the same zip code as a collect call from jail with NO EXPECTATION OF PRIVACY. </span></p>
<p class="MsoNormal" style="margin: 0in 0in 10pt; line-height: normal; mso-margin-top-alt: auto; mso-margin-bottom-alt: auto;"><span style="font-size: 10pt; font-family: 'Verdana','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: 'Times New Roman';">Is it me or does anyone else think this was an attempt at circumventing rules at the Pokey Mr. Baez is so famous for?</span></p>
<p class="MsoNormal" style="margin: 0in 0in 10pt; line-height: normal; mso-margin-top-alt: auto; mso-margin-bottom-alt: auto;"><span style="font-size: 10pt; font-family: 'Verdana','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: 'Times New Roman';">You know, the ole “Im willing to have her call me collect, bein’ that I’m on the list.. I will transfer the call to you-</span></p>
<p class="MsoNormal" style="margin: 0in 0in 10pt; line-height: normal; mso-margin-top-alt: auto; mso-margin-bottom-alt: auto;"><span style="font-size: 10pt; font-family: 'Verdana','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: 'Times New Roman';">-signed, unknown caller to unknown number sometime in early May. </span></p>
<p class="MsoNormal" style="margin: 0in 0in 10pt; line-height: normal; mso-margin-top-alt: auto; mso-margin-bottom-alt: auto;"><span style="font-size: 10pt; font-family: 'Verdana','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: 'Times New Roman';">HINT: If you want to claim something is work product you might not want to disclose portions of it in your motion. It just *Might* give the appearance you don’t want the recording out but want to make an accusation publicly that favors your client. </span></p>
<p class="MsoNormal" style="margin: 0in 0in 10pt; line-height: normal; mso-margin-top-alt: auto; mso-margin-bottom-alt: auto;">Bottom Line: An inmate placed a collect call, subject to the rules of the facility in which she is incarcerated. As dictated by protocol, the call was monitored and is therefore subject to public release. I for one, look forward to hearing it.</p>
<p class="MsoNormal" style="margin: 0in 0in 10pt; line-height: normal; mso-margin-top-alt: auto; mso-margin-bottom-alt: auto;">After all, it did earn a Blarwin, and I was saving that all year.</p>

<p>Orlando, FL– Yesterday, the defense team of Jose Baez, J. Cheney Mason and Andrea Lyon filed a <a href="http://www.wftv.com/pdf/23621475/detail.html">motion to strike </a>the Statement of Particulars including aggravating factors claiming that is does not list the States “facts” to support them. Team Baez is claiming that “may rely” does not meet the burden of the Steele citation used to compel the order from Judge Perry in the last hearing.</p>

<p>In essence they would like state to kindly hand over their theories and work product, if you please-</p>
<p>Also filed by the defense, this time including Linda Kenney Baden, is a 49 page <a href="http://www.wftv.com/pdf/23621537/detail.html">motion with exhibits for discovery </a>from the Oak Ridge Laboratory otherwise known as The Body Farm.</p>
<p>It is within this motion, we learn something very new, and very critical to this case.</p>
<p><strong><span style="color: #0000ff; font-size: medium;">THERE IS A FRAGMENT OF A LATENT PRINT ON THE EXTERIOR TRUNK OF CASEY’S CAR. </span></strong></p>
<p>According to Baden’s supplemental request, there are 18 latent fingerprint lifts, 8 areas of latent lifts developed via dye stain and one fragmented lift from the trunk. Wonder who they will belong to?</p>
<p>This morning, the State is releasing an additional 500 pages of discovery in the murder case against Casey Anthony.</p>

<p>In the week since the scheduling of this hearing by his Honor, the prosecution has released an additional 300 pages of discovery and filed a motion of supplemental discovery.</p>
<p>Camp Casey has resubmitted correctly filed motions already heard by the court under Judge Strickland, notified the court of impending vacations, filed a motion to withdraw an attorney no longer licensed to practice law, and filed a motion to seal the visitor logs of the Orange County jail.</p>
<p>Casey Anthony is serving time in the OC jail for her convictions in the economic charges, and while she awaits trial for the murder of her 34 month old daughter, Caylee Marie.</p>

<p>Orlando, FL&ndash;&nbsp; The Honorable Stan Strickland&nbsp;has recused himself at the <a href="http://www.wftv.com/pdf/23176762/detail.html">request of the defense team</a>, anchored by THE BAEZ LAW FIRM and recent roster addition, J Cheney Mason. </p>

<p>The original request contained a notarization by Mr. Mason which was found to be expired and a corrected motion with a current seal was subsequently submitted. (insert Pavlov giggle)</p>
<p>In a motion filed&nbsp; last Friday at the usual witching hour the defense&nbsp;seems to prefer;&nbsp;Strickland was asked&nbsp;to disqualify himself due to his well wishes for a recently hospitalized blogger covering the Casey Anthony case.&nbsp;</p>

<p><a href="http://marinadedave.wordpress.com/">Marinade Dave </a>agreed to meet with the defense Private Investigator, Jeremiah Lyon, voluntarily on Sunday April 11, 2010.</p>
<p>During&nbsp;Mr. Marinade&rsquo;s interview, he revealed that Judge Strickland called him following a recent health issue to check on his well being.</p>
<p>His reply of &ldquo; Well if I were any better I would be&nbsp;cruising down the Hudson with a shirtless Geraldo..&rdquo; raised a flag apparently.&nbsp;</p>
<p>(<strong>editors note: That is what we call a dramatic license/ensuing mini-vomit combo. Sorry. Shirtless Geraldo deserves that. Dave said no such thing</strong>)</p>

<p><a href="http://blinkoncrime.com/wp-content/uploads/2010/04/rumplebaezcasey1.jpg"><img alt="RumpleBaezCasey" src="http://blinkoncrime.com/wp-content/uploads/2010/04/rumplebaezcasey-thumb.jpg" align="left" border="0" /></a>Mr. Baez can pass verbal/handwritten shanks back and forth for Casey Anthony and her family and think he can operate outside of the regulations of the Florida Bar; that&rsquo;s fine. </p>
<p>In defense of the FBA, they tried to wash their hands of him in the eight years preceding his admission.</p>
<p>Mr. Baez&nbsp;can&nbsp;task his client, Casey Anthony,&nbsp;with&nbsp;attempting to spin her duct tape into gold for endless days and nights until he runs out of <a href="http://www.vitalishair.com/">Vitalis</a>.</p>
<p>It will change nothing.</p>
<p>What he has never understood from the beginning of this case is that everyone already knows his name starts with Rump.</p>
<p>Personally, I would like a poll from the ENTIRE defense team, as to who thinks a *do-over* is a good idea in this case. </p>
<p>If ever there were a be-careful-what-you-wish-for scenario, this is it.</p>
<p>Let&rsquo;s start with Ms. Lyon, who is curiously absent from the motion.</p>
<p>Never mind.</p>
<p>In recalling her comments to the lunch crowd at the <a href="http://blinkoncrime.com/2009/11/25/cayleecasey-anthony-case-andrea-lyon-shows-her-thought-bubble/">seedy soiree </a>she refers to all judges as &ldquo;ugly in the room, &ldquo; I think that her exclusion was tactical.&nbsp;</p>
<p>That sentiment might be particularly offensive to <a href="http://articles.orlandosentinel.com/2007-02-23/news/BCOPPERRY23_1_belvin-perry-perry-family-finish-high-school">Belvin Perry, Sr</a>.</p>
<p>Mr. Perry is the high-school educated Father of the recently appointed judge to replace Strickland, The Honorable Belvin Perry, Jr.</p>
<p>Mr.&nbsp;Perry, Sr,&nbsp;retired from the Orlando Police Department after&nbsp;25 years of decorated service.</p>
<p>Mr and &nbsp;Mrs. Belvin raised 4 children who grew up to be a school principal, business owner, surgeon, and now, a judge that will preside over one&nbsp;of the most famous murder cases in recent history.&nbsp;</p>

<p>The Honorable Belvin&nbsp;Perry, Jr will preside over this case to it&rsquo;s conclusion.&nbsp;&nbsp;</p>

<p>I am feeling comfortable it is unlikely His Honor will be open to any attempts at police pulverizations that are undoubtedly part of the defense strategy; should this case every actually be scheduled for trial.&nbsp;&nbsp;</p>
<p>I am feeling if Judge Strickland wants to try his hand in the blogesphere, I am in full support. </p>
