Kyron Horman Case: Terri Horman Attorneys Call Her A Suspect

In court papers filed Wednesday, Bunch went further, noting that Terri Horman is a “de facto suspect” in the second-grader’s disappearance…”
Portland, OR- In a voluntary appearance in court yesterday for matters relating to the pending divorce motion by estranged husband Kaine; Terri Horman showed her face for the first time since the week after her stepson, Kyron, vanished from Skyline School.
Although Kaine Horman opted to be represented by his counsel Laura Rackner and not appear personally to protect himself emotionally, according to Rackner, Terri Horman braved the fray.
Arriving with attorneys Peter Bunch and Stephen Houze, the trio was immediately met and escorted by MCSO deputies in “the box” formation to the 5th floor courtroom where local media scurried in from behind. Within 45 minutes, Judge Meisenheimer ruled in Kaine Horman’s favor and granted his request that the issues of the mortgage-sized retainer, allegedly furnished by Terri to Houze and other distribution and custody issues will be heard in a hearing on October 7, denying her request to have the issues bifurcated.
During the proceeding, Bunch argued that his Client cannot properly litigate the divorce and custody actions currently because she is.”..unable to proceed in the ordinary course to protect her rights as to discovery, property division, support and, particularly, custody and parenting time issues.”
In fact, for the first time publicly, we learn a very important detail about the criminal investigation into Kyron Horman’s disappearance.
According to her counsel, who would certainly be “in the know”, Terri Horman has NOT been named a suspect by MCSO in Kyron’s case, but she is painfully aware she is one.
Loosely translated, a defacto suspect is an unofficially declared suspect, but for all intents and purposes is definitely the target of the investigative crosshairs.
The Microsaccade Moment
Microsaccades are tiny involuntary movements of the eye generally caused by visual fixation. The result on visual perception can cause the beholder to question if they are “really seeing what they are seeing.”
I had a few of those yesterday while analyzing footage of the day’s events in conjunction with known facts of this case.
They Are:
The MCSO guard detail dispatched at the courthouse assigned to Terri and counsel et al for a family court appearance. I have spoken with a few local family lawyers who do not wish to be identified, with a combined 26 years of practice. None have ever seen this practice in a similar matter in Multnomah County. Specifically, the deputies went inside the actual hearing and waited to escort the trio out the back.
During the hearing, there was not a syllable mentioned about the driving force behind the request for expedition of the case in the first place. The very substantive weight that was used to secure an emergency custody and restraining order, which remains uncontested to date: The Alleged Murder for Hire Plot. Why wouldn’t a family lawyer looking to abate the divorce case strike at the very merits on which the plaintiff’s arguments are based? The plaintiff in this case uses an almost one year old mfh plot allegation, which was not carried out, and no person has been declared a suspect or arrested, to control every filing to date and counsel does not refute the claims therein? What possible reason could that be?
A recent interview with Terri Horman’s son James, in which he states that his Mother cannot have a computer, cell phone, or leave her parents home in Roseburg.
Blink Analysis Editorial: Sealed Criminal Indictment OR Civil Commitment?
A Civil commitment, which would have had to been voluntary, such as a concern for Ms. Horman injuring herself, or some sort of dependency is a possibility, but a highly unlikely one considering she appeared in court yesterday.
Strictly my opinion of course, but based on my microsaccades, I think it is entirely possible that Terri Horman is under a pre-arrest indictment in the matter of the alleged murder for hire plot, or some derivative thereof.
It would certainly be unlikely that she could have been booked and granted bail without a leak, but a sealed indictment, which may or may not include a sealed arrest warrant, would follow Oregon’s propensity to use the grand jury as a form of “preliminary hearing.” In light of the fact that there is an ongoing criminal investigation into Kyron’s disappearance involving Federal, county and State investigative assets, it would be entirely appropriate.
The public would not know until such time as the indictment and any potentially attached writs are unsealed. Throw in the possibility there is always the chance that Clackamas County may be the charging county for such an offense and not Multnomah.
In which case, this is about to get very interesting. Recall MCSO chief Dan Staton saying Clackamas County Major Crimes Team is involved in the case? That would suggest at least part of a crime has been established in their jurisdiction. Rudy Sanchez resides in Clackamas County.
Clackamas County District Attorney John Foote and Criminal defense attorney Stephen Houze are well acquainted. You might say that Foote owes his very job to Houze in a way-
John Foote lost as the incumbent DA in 1996 to his own deputy district attorney Terese “Terry” Gustafson. Terry was in the middle of fighting an Oregon Bar complaint at the time which cleared her name just days before the inauguration.
The embattled DA did not take long to be the subject of more ethics violations including felony perjury charges for lying to a circuit judge about releasing the file of a juvenile that was ordered to be destroyed. Gustafson was disbarred.
Who filed the Bar complaint who also represented the accused boy who was subsequently acquitted?
Who was the prosecuting attorney for the Oregon Bar?

FWIW, here is a photo link of their Hawaii wedding, she has the dark wedding band on her finger, definitely not the one she wore to court. I just had to be sure she didn’t switch wedding rings frequently.

I remembered a case in Vancouver that was rumored to be tied to the Russian mob but I didn’t realize until I found the story how long ago it happened. Oleg Babichenko was murdered when his car exploded and when the crime was investigated, they found that he was possibly involved in a stolen car/chop shop ring. It’s from 1997, but still the same kind of “business” is going on in the Portland/Vancouver area. That’s why you have to be careful when buying a used car in PDX to steer away from reconstructed or salvage titles. We are in the market for a used car for our teenagers, so we have a lot of recent experience with this problem.

Through my school district, I took a Russian/Ukraine culture inservice. Many or most of the new immigrants are from the Ukraine but speak Russian as well as Ukrainian. Most of the slavs here now are quite religious (which brings to mind Beejay’s Onion religious criminal link LOL). They were sponsored for immigration by area churches after claiming religious intolerance in their home country. Slavic Baptist and Evangelical churches are sprouting up all over Clark County and are well attended. The criminal behaviors and behaviors we see as rude and abrupt were developed to survive in the old country. I have worked with a lot of the kids.
AS was somewhere else on June 4th, verifiable, must be. Related somehow to this crime?
I would go as far as to say relative the overall investigative efforts of Kyron’s disappearance.

Seamus (and I’m paraphrasing) often states how there’s usually some part of the truth in the liar’s statement. Maybe TH was telling part of the truth–Ky was last seen with 2 girls (TH? DDS? Kiara, though hard to believe she was there) and an unidentified male (a LS perhaps?) Just a thought. Maybe that was THs way of telling something resembling the truth.

Blink – you can delete this is need be – I am trying to sort out the information you have provided and make some sense of it. Forgive me if I am missing any pertinent points – my son brought his recorder home and hasn’t stopped “practicing” since yesterday afternoon. If I hear Twinkle Twinkle one more time I may impale myself with the darned thing- or accidentally back over it with the car!
If I understand correctly: TMH did not (likely) orchestrate the disappearance of Kyron, but did “bring the vampire into the house”, and either TMH or an associate that became known to LE fairly quickly was already under investigation. I think I can digest all that – but am still incredibly confused by what went down on the morning of June 4th. I think I am getting hung up on the “didn’t orchestrate it” – do you think she got him out of the school for whomever DID orchestrate it?
I pray one day Ky’s parents can move on. I know Ky would want them to.

The only thing that would make sense if you were trying to inherit everything would be to hire someone to kill them both at once – perhaps with the 2 of them out in the truck together – and to make it look like an accident or a random act of violence, mistaken identity, etc. Somebody proficient enough to do that and not get caught or testify against you would be a pro and charge pro fees. They also are smart enough not to risk their “careers” getting even with someone who didn’t pay a deposit when they didn’t even do the job.
I am now of the opinion that I (we?) should stop trying to think like Terri and her friends, or even LE, and start thinking like the “regular” criminals who may or may not be connected. More to come on that.

This report is very thorough and accurate – and discouraging because we know LE is not going to have the money and resources from the state that they need to really make a significant dent without a huge uphill struggle.
I think some of these activities and groups could be put way down on a rated list of who Terri might have connected with, if indeed she got mixed up in any of these.

I believe TH knew something was going down on June 4th PRIOR to June 4th. Her behaviour immediately after Ky’s disappearance was more than questionable…well y’all know what I’m talking about. She got in waaay over her head and she knows it. The “sting” effectively put her in lock-down mode…hope we have answers some day.

I think that was why DeDe wasa in the area “gardening” and why she got that phone call and rushed over to Terri. I think DeDe had Kiara and did the Kiara exchange so Terri could rush to Fred Meyer(s) and start her alibis so quickly.
Given the facts in an article contained in the link below, here is another reason that makes it hard for me to merely focus on TH. I am bothered that we have not heard much about the school in this case. As described in the article, it is not too much of a mystery why this may be happening. Whether there is something to look at or not, it should bother us all that protection is a possibility. At least it appears that way to me.
And if TMH was EVER PROTECTED BY ANY SCHOOL DISTRICT for reasons that parents should have been made aware of, then shame on those entities that covered it up. Certainly a possibility.

Okay, I am sorry if I am bringing up anything that has already been discussed here, but I just have not been able to keep up with reading all of the posts completely.
Here is my latest theory:
Could Kyron’s disappearance be related to gang initiation? Maybe TH got in too deep with the wrong crowd when she interacted with Sanchez. Maybe she didn’t really understand what the repercussions could be when she allegedly tried to hire the landscaper to murder KH. Maybe the reason she won’t come clean with LE is not because she did anything directly with Kyron. It could be that she kind of knows that when she started the whole MFH plot, that she was putting the rest of the family in imminent danger of the wrath of angry gang members. Maybe she really was trying to protect Kyron and Kiara on June 4, from Sanchez and his ilk, but it all went horribly wrong because the gang member(s) were hot on her trail and had somehow gained the upper hand and grabbed Kyron. And she knows on around June 4, that if she tries to go to LE to get protection from gang members threats, she will have to spill all of the beans about the MFH plot, which will land her in hot water with the law and with her husband.
Maybe the 3 hours that TH cannot honestly account for were when she was trying to reason with or deal with or escape from the gang member(s). And maybe she asked DD to help her with the baby in that time period. DD talks about death threats that they get in the People magazine article.

Thank you and I totally agree with the fact finding part. We seem to be having a shortage of facts however, so I’ve been looking for a way to eliminate things that can never become a fact, hoping to see what’s left. I hope that makes sense. I think we’ve twisted what we already know or think we know into so many pretzel shaped theories that it’s even more confusing – nobody’s fault, just a sign of how hard we are trying.
@Mockingbird – wow, is that discouraging (and that was 2006) re: the DOJ report on Oregon, prolly similar or worse for other Western States. Yes, I had been to some type of workshop on international drug smuggling and they admitted that the US gov. does not even begin to come near the budget (for fighting this I mean) of some of these cartels. Not a happy thought.
So it sounds as if AS may have an excuse. He might not have known Kyron enough to take him anyway. RS might have known him well enough as Blink said, with his presence at the house and likely school. The network he is in could be infinite. So he is sequestered somewhere, well, good for him if he is a witness. It is hard not to think TH was in on the planning of some of this, but in any case, she must speak now! Where is the caring, were is the role modeling for her children who are deprived of their brother?

If LE agencies have any interest at all in preserving the integrity of their evidence (and, believe me, they do), these agencies do not reveal to the public information they collect in the course of an ongoing investigation. That being said, leaks do happen from time to time.
By the way, one can certainly be a person of interest/suspect in a crime and not be publicly named by LE. In my experience, this is more often the case than not. Many LE agencies will not reveal or name suspects or POI unless they are very close to an arrest and/or require assistance from the public (e.g. BOLO situations).

Obviously TH was having multiple affairs throughout her marriage to Kaine. I think MC and RS could both be players leading to Ky’s disappearance for whatever reasons, jealously…I just find it difficult to believe that Kaine didn’t have a clue as to what was going on with his wife. The sexting revelation with MC after the disappearance gave me more cause to suspect TH’s involvement. jmo

I hear what you are saying and understand it. I have also seen the direct opposite happen. And just recently, I have seen the guilty walk….case dropped. My opinion? Connections with retired law enforcement. Some involved merely were friends with others involved having direct connections. Anyone else would have paid dearly. So much for the big deal about “it” being within 1,000 feet of a school. We know how much THAT really matters!

Kudos to you trying to teach your son -sounds like you got a lot out of the exchange too! They are important lessons -this coming from a gal who grew up in a family of 8 -I had nothing, truly NOTHING of my own -perhaps not even underwear (really!) As an adult, I share and give, even when I have little to give…I even let guests stay in my big bed, while I am on the couch! It’s good to put others before yourself…and yes, as you said, just as important to not to give away the farm either!

Toasty, I can tell you that the Mexican mob is alive and well in PDX, a lot of it in Beaverton and Aloha area -on the west side. Only makes sense, releasing it while perps are running free gives too much opportunity to undermine the case / plant conflicting evidence / influence witnesses, etc. Also, seems to me that it’s the norm these days to wait until moments before an arrest to name someone an official suspect.
Example ~ Casey Anthony, accused of murdering her 2 year old daughter here in Florida, Public comments were the same as in TH’s case, “Where’s the evidence? ~ she must be innocent”. Since her arrest, LE has released thousands of pages of phone conversations, letters, diaries, photos, witness statements, chemical analysis, FBI crime lab reports, computer files including searches for “neck breaking” and “how to make formaldehyde”, and it just keeps coming!

I really think that the phones, even if bought June 4, were to be used for friends of TH so that her cell didn’t miss a call because this was thought of as a kidnapping in the beginning. I’m sure she needed someone to talk to, she prolly had the evil eye(Maloika?) on her from moment one as the last person to see Ky.

You are very generous in thought, however, consider this: if this had been a true LE/FBI concern of kidnapping from the get-go, then, it would have originated on day 1 -not day 24, after which the prepaid phones were purchased. Additionally, if the primary concern was to not “miss a call from a kidnapper” -then, imo, it stands to reason that LE would certainly have provided access on another phone line “as not to miss a call from kidnapper.” -at the very least, Th could have loaned Tony’s phone. But I do agree with you that, after 23 days of Ky missing, that surely she, “needed someone to talk to.” I just wished that she chose to pick up her cell phone and phone LE.
I’m sorry I didnt’ finish my train of thought…I’m quite sure that when all went down with LE telling KH bad stuff about his wife plus the supposed texts with other men I bet his first reaction was to cut off her cell phone without even telling her!! After all, this is when the phones were bought, right?

My son was 13 years old and one of his teachers (he has ADHD but not sever enough to use medication as to the harm of the side effects) taped him to his desk to keep him from raising his hand to use the rest room and he is a wiggler.
Well anyway I guess this happened two days in a row and the ONLY reason I found out was, , my son was talking to his friend in our house and I over heard him telling his friend about it. THank God it was the weekend and time for me to cool down (slightly) as the minute the school was open, I asked to talk to principal of course and then a meeting with the board. well, it was put in her file, but no firing. and I was so mad, I asked them how she could teach and do that to a child, she was from a different country.
They said the only way another school would find out, would be for her to go to a different school and it would be in her file BUT if she stayed at the same school, no one else would know?
I am STILL mad about that and my son is 26 years old now…
It made my heart hurt that this could be done and hushed up.
OH and believe me, I got an attorney and GUESS what? he said it would be a conflict of interest for him to take my case as that is another story… I wouldn’t lie for the city and they would not help me out with the school because of it…..
