Casey Anthony Bankruptcy Bust: Trustee Wants To Auction Her Rights, Has Buyers

Orlando- Fl,  In a fitting twist to the latest saga that is Casey Anthony since she was acquitted in 2010 of the murder of her 34 month old daughter Caylee,   Miss Anthony is not getting off the hook for her financial obligations as easily.

Anthony was seen for the first time publicly on March 4, 2013 at the meeting of the creditors, referred to as a 341 meeting- she is required to attend.

Since that time the attorney for Zenaida Gonzalez,  John Morgan, has filed a motion to evaluate Anthony’s estate and financial affairs after hearing that she received financial support for living expenses from her attorneys ( gee, wonder if that is from any she is claiming as creditors in the petition- that would be a bar no no.) and also from undisclosed “friends.”

Not to be outdone,  last week the trustee HIMSELF filed a motion to auction and sell the “asset of the estate”:

  1. Among the assets of the Estate are the exclusive worldwide rights in perpetuity to the commercialization of Anthony’s life story including her version of the facts, her thoughts and impressions of whatever nature, in so far as these pertain to her childhood, the disappearance and death of her daughter, Caylee Anthony, her subsequent arrest, incarceration, trial, acquittal and withdrawal from society, including the rights to motion pictures, documentaries, live stage performances and any other form of performance art, any transmission of video and /or audio content, by any means of technology, whether presently existing or hereafter developed, including, withoutlimitation, standard free over-the-air television, non-standard television distribution including, without limitation, basic, tier and/or premium cable distribution; direct broadcast satellite television, subscription television; multi-point distribution systems, multiple multi-point distribution systems, local multi-point distribution systems, satellite master antenna television systems, open video system, television receive-only, closed circuit television, and radio; online including, without limitation, Internet, world-wide- web, all forms of social media, including Facebook, YouTube, Instagram, and Twitter now known or hereinafter developed; cable modem and all other forms of online distribution now known and hereinafter developed; internet protocol television, mobile/wireless, all portable devices including tablets and /or mobile phones; all interactive forms of distribution now known or hereinafter developed; airline, theater, restaurant and hotel/motel distribution, narrow and broadband services, video dial tone, paper-per-view, high-definition format, video-on-demand, and subscription video-on- demand; literary rights including publication(s) in print and /or electronic means, including but not limited to electronic books, audio books, online magazines, and internet articles; and merchandise tie-ins (the “Property”).

Among the critical thinking Orlando environs:  James M. Schober.

  1. The Trustee has received a written offer from James M. Schober in the amount of $10,000 for the Property. Mr. Schober’s stated intention is to acquire the Property in order to prevent Ms. Anthony or others from publishing or profiting from her story in the future, and therefore his offer is not subject to any contingency based upon the cooperation or promise of cooperation from Ms. Anthony.
  2. Due to the intense public interest in the Debtor and the Property, the Trustee believes that there will be interest from others in purchasing the Property.

Could the cash cow finally be going out to pasture?

Where legal, taking bets on how quickly the bankruptcy gets withdrawn or converted to a Chapter 13.

Caylee/Casey Anthony Case: Will Plumbing Emergency At The Anthony Home While Caylee Was Missing Produce New Evidence For The State?

When you have a family that both refuses to cooperate with Law Enforcement in a productive way, and in this editor’s opinion, outright obfuscates efforts to investigate the location of a victim and the circumstances to which Caylee Anthony became same,  we are forced to look at what I will term, available objective  data .

Analyzing data in conjunction with the verifiable evidence in this case, allows us, and eventually jurors, to better sift through the ever-changing accounts of those closest to Casey Anthony, without adding metaphorical dryer sheets to cover the smell.
As all www.blinkoncrime readers have known since my earliest coverage of this case, I have long stated it is my belief that the concern for Caylee’s welfare and whereabouts started with the Anthony’s backyard renovations the week of Cindy Anthony’s vacation over the fourth of July.

In fact, one might interpret Cindy Anthony hits her panic button during this time.

I have also written extensively that I believe that the defense team is going to intimate, if not outright accuse, George Anthony of culpability in the death of his own beloved granddaughter.
On Friday afternoon, following the conclusion of the last defense motions presumably prior to trial (insert laugh track) the state released additional video evidence to the defense.   As we brace ourselves to see video of Caylee with her Mother and Tony Lazarro having lunch, should we also prepare to see Cindy and George shopping for those backyard improvement supplies?

Or… Other?

Cindy Anthony’s bank records show 3 separate charges to The Home Depot posted June 30th.  As the purchases were made on Cindy’s check card, we can’t be sure if the purchases are made on June 29, June 30th or a combination of both.

Will we see the purchase of new gas cans, concrete mix, weed barrier, or something else?
Cindy or George Anthony began furiously calling her daughter’s cell phone, in the wee hours of July 1 at 1:43am.
Calls to Casey from the Anthony landline are made to her at 1:43, 1:51, 1:52, 2:02, 6:56, 7:33, and 7:50 AM.

Casey does not answer her cell phone, but she DOES check her voice mail after every one of them, and attempts unsuccessfully to reach someone at the Anthony home at 7:54 AM, possibly due to a busy signal.  This pattern of calls suggests an emergency of some kind, not Cindy checking if Casey was going to finally bring Caylee over as Cindy had requested.  In fact, there is a small break in the action, pun intended, when a different number is dialed from the Anthony home:

In no interview, in no deposition, will you find either Anthony disclosing the obvious plumbing nightmare necessitating 2 calls to Rainaldi Plumbing 4 minutes after their listed hours of operation in the yellow pages, and the subsequent service call resulting in a $283.96 bill.  Ironically, the check number, out of sequence, follows one Casey Anthony wrote on her Mom’s account in December

Spoiler Alert: The only reference to any plumbing emergency appears in one of Cindy’s letters to Casey, but two years after the July 1, 2008 incident.

..” I don’t know if Jeanene told you, about the water pipe we had broke on Friday, we had water from the pipe outside of Caylee’s room, leek into her room, mostly in her play corner- carpet was soaked and walls were damp.  Everything is drying out but the carpet smells bad. (I better watch how I describe it they may take it for discovery). It’s amazing how even clean water can smell rancid after it sits for a while.  Fortunately one of our church friends was able to come out and fix the pipe…”

Facing a capital murder charge, and already convicted of economic felony, it begs the question:

Why would a member of Jose Baez defense team, Jeanene Barrett, need to relay information to Casey about a broken pipe leaking into her deceased child’s room?

If you are thinking this is more “Anthony Code Speak”, you are not alone.  According to a blue print of the Anthony home, there is no plumbing on the outside wall of Caylee’s bedroom that would leak into the corner, the right lower corner or her “play corner” which abuts the outside wall.

As the bulk of “pipe bursts” or “breaks” go in Florida temperatures, in general they occur only through freezing, extreme temperatures, or water pressure stress (build up) of some kind. The source of the emergency plumbing call to Rainaldi on July 1st, 2008 is not known, but what is known, is that it gives new meaning to the signature of Casey’s inmate correspondence “FLUSH”.

What has always bothered me was what could have been found in either the backyard or now as we know, in the plumbing that would send Cindy Anthony into a clear and obvious panic, mobilizing Lee to track down his sister, and attempt to track down Caylee through her friends AFTER speaking with Casey.

George and Cindy Anthony’s versions of June 15th and June 16th 2008 have evolved it seems, after every new release of discovery.  Specifically, George’s account of the last time he saw Caylee and what she was wearing.  They have gone to painstaking lengths to establish that at least Caylee was home the evening of the 15th, and very much alive the morning of the 16th.

So where is the blue “dress” she wore to the Mount Dora Nursing home on Father’s Day, June 15th, 2008? It would seem to me if I wanted to establish an alibis, or timeline, that clothing would be critically important.

Is that what Casey meant when she uttered to Tracy Mclaughlin and Rob Dick that OCSO had no idea what they were doing and they had not even found her clothes yet?  Was she talking about Caylee’s clothes, or Mama’s?

Orlando, FL– With the public still reeling from last weeks indigency hearing, the State Attorneys office is set to release the latest round of discovery documents this morning.

Speaking on the condition of anonymity to blinkoncrime.com, a source inside the investigation has confirmed within the release is the latest interview by OCSO of Joy Wray.

Ms. Wray is said to have told investigators that she was in the woods on July 18, 2008 searching for Caylee Marie Anthony and has the photos to prove it.

When OCSO investigators requested Ms. Wray surrender her laptop computer to retrieve the original image raw files, among other source information Ms. Wray revealed, she headed to BestBuy to have the hard drive erased prior to her interview, which would reveal the dates on the photos had been added by her.

Detectives were tipped off by a savvy Geek Squadder and when Joy arrived to retrieve her blank computer and copy of it’s former contents, they were waiting for her.  Joy sniffed out the Five O, and turned on her heels out the door without the computer; only to be interviewed by Detective John Allen in her lawyers office about the incident, shortly thereafter.

Ms. Wray has been baker acted 6 times, and claims to be friends with and corresponding with former President George W Bush on the Caylee Anthony case.

The discovery is also expected to include interviews with members of Texas Equusearch, as a follow up to statements by Laura Buchanan and Joseph Jordan.

Who raised their hand at the weekly status update and said:

That is nothing compared to the caught-on-camera cluster that took place during yesterdays  hearing to declare accused murderer Casey Anthony indigent for costs.

 Andrea Lyon, lead counsel and chronic look-of-woehaver, feels approximately $70Geeze of her “charity’s” money has been spent on this case. (Edited to add, methinks she is subtracting $22Geeze, read on)

The Center For Justice In Capital Cases 

SHUT THE DOOR. This is no charity, except perhaps to Lyon as she is a paid staff member, serving as it’s director.

It is a certification study class at DePaul, run by Lyon and paid by the defense PI Morty. 

Furthermore, as the work product developed in this case supports the curriculum and subsequent GPA of it’s tuitionable students, why the hell would the expenses be allocated to the defense of the case against Casey Anthony instead of DePaul? 

There is no charity attributable to Andrea Lyon although she testifies to fund raising efforts through various charities and corporations, and that those charities are now, “in the hole.” $70Geeze, to be exact.

Is this the part where we here her use of the word charity was a charitable way to say she imposed on her budget as a professor? 

I will say, given her penchant for hardass reporting from her students, how is it possible she has no clue what her books and billable hour are?

There are 14 students working on a death penalty case that are not attorneys, and client attorney privilege would not extend to them as their is no established agency. If I were the National Enquirer I would be finding out which of those undergrads have fat student loans and what kind of access to information they have. Catch My drift?

Todd Macaluso, apparently so sure of Casey’s innocence he gassed up the whirlybird, packed his lucky smoking jacket and signed on to the case.  

Jose Baez testified that Todd Macaluso gifted $70 Geeze to the trust account of Casey Anthony. Operating pro hac vice (visitors pass) as representation with his own retainer agreement with Miss Anthony, Mac has violated the rules of the Florida Bar:

RULE 4-1.8 CONFLICT OF INTEREST; PROHIBITED AND OTHER TRANSACTIONS

(e) Financial Assistance to Client. A lawyer shall not provide financial assistance to a client in connection with pending or contemplated litigation, except that:

(1) a lawyer may advance court costs and expenses of litigation, the repayment of which may be contingent on the outcome of the matter; and

(2) a lawyer representing an indigent client may pay court costs and expenses of litigation on behalf of the client.

 As Casey had access to $275K and was not indigent 10 months ago when Todd Macaluso signed on and paid his apparent entry fee, it would be impossible to defend this “contribution” as legal under Florida law.

The Approving Bogs for Children company has paid out $200 Geeze.

“In August 2008, we licensed exclusive rights to an extensive library of photos and home videos for use by our broadcast platforms, affiliates and international partners. No use of the material was tied to any interview.”

..”The deal was done with an attorney representing several owners of copyrighted content,  ABC News spokeswoman Cathie Levine said. That attorney is Baez, she added..”

Really, not tied to any interview? When did those images and videos debut on GMA exactly? Who was on that program when they were shown?

I am quite certain I heard Jose Baez say in sworn testimony that he retained Tim Chinaris, former head of Florida Bar ethical committee to field such inquiries and all were turned down. He added that such agreements would not be ethical.  Maybe he thinks ethical is transposable with visible.

Several owners of content means multiple people were paid for this “extensive library”. If ABC is claiming that Baez brokered this transaction for all then we have an even bigger problem as he was simultaneously representing the interests of all parties at the time. The agreement that was reached between the parties is critical to understanding the income status of Casey Anthony and her attorneys. Judge Strickland may very well just deny the indigency application and alls well that ends well that these barristers will have to buck up on their own.

That is, until John Morgan gets wind. We will see a copy of the ABC contract in the civil case against Casey Anthony on behalf of Zenaida Gonzalez, fo shcizz.  He danced 2 jigs yesterday. There were witnesses.

Without question, Mr. Baez should be REQUIRED to produce this agreement in response to proof their is no recurring revenue or subsequent earnings to his client based on the structure of the agreement. It is not uncommon for such agreements to include royalty clauses, which would mean that someone is getting paid every time a photo or image from that collection is used. 

ABC newsroom laid off 1/3 of it’s news staff earlier this month. Nice.

Billable Hours

Perhaps the *thud* moment for me yesterday was when Mr. Baez admitted in open court that he does not track his billable hours on this case.

Apparently, the reaction is sticking with me.

Under the rules of the Florida Bar, there is a very stringent set of requirements when determining reasonable fees for clients.

Short Version:

RULE 4-1.5 FEES AND COSTS FOR LEGAL SERVICES

(b) Factors to Be Considered in Determining Reasonable Fees and Costs.

(1) Factors to be considered as guides in determining a reasonable fee include:

(A) the time and labor required, the novelty, complexity, and difficulty of the questions involved, and the skill requisite to perform the legal service properly.

How can you bill someone $90Geeze, and have no idea how you got there, or whether or not such activities are reasonable to the client and or case?

Judge Strickland ruled that by end of business today the defense team needed to provide a full accounting of requested trust account disbursements.

I am thinking they will take the rejection of her indigency status before another trip to the dunk tank, but that’s just me.
