The Nittany Nightmare Continues: More Financial Incest At PSU- Accused Perjuror Gary Schultz Head of Nittany Insurance Pays First Victim Payout AND His Lawyers

State College,  PA & Burlington, VT-  In the latest example of financial incest involving PSU, The Second Mile, and a bevy of double-dipping board members and executives, we arrive at the first discovery between an accused suspect in the case and his principal interest in an insurance company that recently paid out a settlement to an alleged victim of Jerry Sandusky.  As the filing has likely been sealed as a condition of it’s settlement, it is unknown if Schultz or anyone else within PSU in addition to Sandusky was named in the civil action.

Gary C. Schultz, interim Sr. VP for Finance and Business returned  following  previous retirement from PSU this past July.

 

His return to the PSU payroll  around the time that a grand jury was meeting about his possible complicity, FOLLOWING his own alleged perjurious testimony begs the question-As Schultz knew he was under investigation as well as Sandusky and Curley-

Did Schultz come out of retirement in anticipation of  incurring significant legal fees he did not want coming out of his own pocket?

You read that correctly.

Mr. Schultz, who along with Tim Curley were bound over for trial at their preliminary hearing on perjury charges and a misdemeanor failure to report summons last month,  is being provided legal representation costs through Nittany Insurance Company, where he is a paid Director.  According to Acting President Erickson,  it will also be used to cover any civil settlements and judgements in the Sandusky debacle et al.

This would seem to be in violation of the Vermont Captive Insurance Regulations Section 12, or conflict of interest.

In a letter sent to Penn State Interim President Rodney Erickson,  Senator Michael Stack (D) Philadelphia,  expressed his concern that taxpayers and donors should not be footing the bill for the Universities necessary legal representation for the various civil and criminal issues  and potential settlements.

In a response to Senator Stack,  President Erickson assured him that such costs would be accommodated by it’s liability insurance.  Nittany Insurance Company  is listed as the professional liability insurance company of record on the PSU site as well as the provider for PSU students in programs including the Hershey Medical Center.

President Erickson did not reference Mr. Schultz’s directorship position within Nittany Insurance Company although www.blinkoncrime.com was able to confirm with the Vermont Secretary of State that as of this afternoon, there are no pending changes to its registration.

Gary Schultz’s co-director at Nittany Insurance Company, is Allan Anderson,  Former VP and Chief Executive Officer for Hershey Medical Center.

While the captive insurance firm is self-administered, as Director,  Schultz would be in a position to review,  award, accept, negotiate or reject settlements within the framework of their contract with PSU and appropriate regulatory requirements.   Captive insurance companies are often developed as part of a risk mitigation strategy and as an entree to the reinsurance market for payouts exceeding a fixed amount.  Registered in Vermont, Nittany Insurance Company was formed in 1993.

It would seem a good starting point for questions on the regulatory  and compliance matter might be how the bid is/was awarded for initial self-administered liability coverage directed by a potential party and what the premiums, which are deductible to PSU,  were and  are?

What adjustments to same have been made in relation to the known incidents and corresponding dates alleged against Sandusky, Curley and Schultz?

What else is Nittany Insurance funding it may have had ample heads up about?

Does Schultz have a poster of Ken Lay in the top of his humidor?  Bernie Madoff?

    Amendola wrote that the alleged victims had contact with one another outside of The Second Mile, where they may have met. Records could show that the individuals together conspired against Sandusky, who has maintained his innocence.

    The defense stands by its request for dismissal of all the criminal charges against Sandusky, who is facing 52 counts of child sex abuse. Amendola wrote that the alleged contact between Sandusky and Victims 1-10 are too general and non-specific to build any reasonable defense against.

    Amendola maintains testimony from Tim Curley and Gary Schultz is imperative, but because the former Penn State administrators are pursuing the dismissal of the perjury charges against them, they plan to invoke their fifth amendment rights in the event that they are called to the stand during Sandusky’s trial.

    1 – credibility issues, such as the year of the event he witnessed.

    3 – shrinks (that I know of)
    a – thinks Sandusky is a pedophile

    c – not on the public record as of yet that I know of

    10 – Victims
    a – no one has ID’d
    b – defense has ID’d, prosecution has not
    c-j – some have witnessed assaults against eachother and the defense is preparing a case that they conspired against Sandusky

    This is all I know about from the limited material available. Maybe the case will be made by LEO’s, social workers and parents of the victims. There is hope, but I really hope there is more. Seems from the outside looking in, that Amendola has systematically knocked a couple of legs out from under them already, IMO. Part of me wants to wait for a trial ’til the rest of the GJ 34th info comes out, and part of me wants the trial ASAP just so more info is made public. Thinking JKA will be called and we will finally here her side of this, which will be defining for me.

    I have brief access to my electronics and to Touched, the book. Want to post something. Since JS has had both an atty and one or more PIs working for him before his house was searched in June, 2011, would we think that all incriminating evidence would’ve been removed prior to that search? Well, in the rational world–yes. And, that exculpatory, or neutral items would’ve been left in place. So the place didn’t look suspiciously “wiped”.

    OK. So, Ganim told us, and I read elsewhere, that among those items on the “inadvertently” posted addendum, were this:

    “It shows that a “contract” between Victim Four and Sandusky was obtained.”

    Sometimes a “contract”, especially one denoted as such in quote marks, isn’t a legal contract. In the social services/behavioral health arena, “behavioral contracts” have long been used (at least since the 1970s). I’m wondering how many contracts there were.

    But on to other contracts. Just confirming what we might already know; can’t remember if we do. In Touched, JS says that when Matt was entering eighth grade JS convinced Matt’s mother to an agreement whereby Matt would study and spend time with the Sanduskys. In exchange for which he would be rewarded with money, part of which was to go into a college fund for him, and part of which was to be cash in hand. Matt would have to sign a contract. (see pg 101 of Touched)

    Matt held up his end of that “contract” for awhile, with improved grades in school. But things went downhill again, JS noting this was after a trip to the Citrus Bowl in Orlando with “us”. After which, Matt began missing his reponsibilities with JS, and JS said he had to “try and track him down.” At a baseball game JS said Matt’s mother and her boyfriend ended the contract. And JS had a hard time seeing Matt again.

    So, JS went thru various channels to relieve Matt of the difficult living circumstances he was in with his mom: “children and youth organizations” and “probation systems”. (all pg 101)

    In short, JS relieved Matt from his unhappy home situation, as I think we know, thru his phone calls from Calif. With the assistance of Tim Janocko, who visited Matt in detention and Matt said he wanted to live with the Sanduskys. (Tim played football under Jer at PSU; founded/headed up a chapter of TSM/was on Bd of Dir as of Nov 2011. Longtime coach at Clearfield Area HS; online rumors describe him as close friend of JS; lots wrt TJ is online) (see pg 102 of Touched)

    Oh, JS said he also talked with Matt while he was in detention.

    JS said he thought things would go well with Matt in foster care with them, but Matt still had behavioral troubles. On pg 102 of Touched, JS said that they sought counseling because of it. But, that also confused them because “none of us really understood what the people were saying, and there were many differences of opinion”

    JS said he thought Matt was going to be taken away, but 2 people prevented that:

    (1) a judge (not named, but we know to be the now-retired/elder Judge Grine);

    (2) Dr. Fox (no first name given), said to be a psychiatrist who wrote an assessment recommending Matt be placed back with the Sanduskys “because that was what Matt wanted”

    Um. OK. That’s the author’s version of events. IMO, Matt is extremely important in understanding Jer.

    I was up almost all night reading the book. Then couldn’t sleep. An interesting aside: in the copy i read, there were only 2 marks in the entire book. In front, the note “p. 54″ with a check by it. And on pg 54 a check beside the para where an anecdote about a man known as Jingles appears. In 2001, IIRC, the Pitt Post Gazette ran a story about the book and referred to Jingles. So, perhaps that’s what the notations in this copy referenced–research into who that person is.

    JS tells of a football recruiting trip he made solo. Stayed at the Brownson House, as was his habit when in the area. Took the young caretaker/janitor “Jingles” on the drive 35 mis to a school in Uniontown, at Jingles’ request. Nothing of interest in the actual anecdote. Dottie also knew Jingles; they were both country music fans. JS once took the 2 of them to a country music jamboree in Wheeling, WVA.

    Also noted, confirmation that Jer’s dad, Art, spent time himself at the facilities that were/or became the Brownson House when Art was a child. An interesting place, that facility.

    Maybe something will be helpful here to someone.

    Anybody know what Hank Lesch (Henry R. Lesch) was doing in the early years after he graduated from college (1971)?

    My info is sketchy, because his own bio shows nothing but TSM, starting @ 1988.

    Before that, I’ve only confirmed 1984-1987 at the Wiley House.
    Was Public Info person. (Hosted Virginia Satir once–very big doings) Might be more years than that. If so, I’d like to know.

    Before that, the business with his wife (Karen M. Lesch, now and earlier at PSU). Wonder how he got involved with the Wiley House. (Emmaus campus. Wiley is now KidsPeace. O’Donnell resigned as CEO of it @2007-2008; don’t know when he started. O’D very involved with many charities and assns for charities. Is now at Susan P Byrnes Health Ed Ctr, based in York, PA. Don’t think he overlapped with Hank at Wiley Hs)

    It’s the time back before that to his college graduation I need. Had a B.S. in Education. Did he ever teach? Coach football? Or other sports?

    The problem is their is an inherent need for this community to want to clear this scandal like it never happened. These victims have some of the most unfair disadvantages today just like they did when they were children that resulted in their victimization in the first place and it makes me hopping mad.

    The Second Mile sends out a letter to counselors in Pennsylvania asking for participants in the “Nittany Lion Tips.” Those who want the cards fill out a request form and an evaluation form.

    “The project is growing in popularity,” Lesch said. Currently more than 550 counselors are involved.

    The players who are pictured on the NCAA sanctioned cards were chosen by Sandusky, Coach Joe Paterno and his staff, Lesch said.

    The idea for the football cards came from the group’s executive director, Jack Raykovitz. Raykovitz, who collects cards himself, saw a magazine article where law enforcement officers were using similar cards to make contact with children.

    “A foster home was started in 1982 for six boys with special needs,” he said. “It just evolved, we joined ‘A Better Chance’, (another group for children), and now there are six boys and girls from the inner city at the home.”

    A Better Chance began sending students to a residence run by The Second Mile in 1988. Palusek said none of the A Better Chance kids lived with the Sadusky family.

    However, one A Better Chance student was quoted in a news article as saying he attended a went to a Penn State event that Sandusky was at in 1997.

    The relationship between the two charities continued for about 13 years. Bright young teenagers, many from inner cities, moved from as far away as Philadelphia and New York City to the Second Mile residence near Penn State. They attended local schools in the State College area and received tutoring. Many stayed multiple years.

    Thanks, guys, for your work. Lesch’s Linked-In only shows the last 23 yrs of his resume–all with TSM. So, naturally, I wonder what he did before and how he got into this line of work. I’ve got all that stuff, college, high school, wife and kids.

    Here’s a third nonprofit he worked for (TSM, and Wiley House the other, more recent ones)–I think. It’s hard to work with these newspaper archives. Looks like this was much closer to his 1971 college graduation date. 1979.

    Um, yes, sort of. It’s one of Oprah’s favs. I’m cautious about posting. Not because of anything on their part, but because I think they want no untoward publicity–either as a group or individuals. Some real movers and shakers have comes out of that program and/or are supporters of it. They placed urban children “of color” all over the country so that they could attend better schools, both private and public, than they otherwise could. A lot of $$ is likely why TSM hooked up with them. I suspect nothing more.

    (See pg 107 in Touched) Jim Martin was described, along with his then-fiance Becky, as “good friends” to both the Sanduskys and TSM. There was an anecdote when they came as dinner guests. Martin was a championship wrestler (85-86ish) at PSU. Wrestling Club there. As usual, Jer’s anecdotes had little to do with anything except himself acting childish.     I don’t see if erose posted it, but in Dec 2011 the Leschs also set up a revocable trust (meaning they can take it back later) to Condon (sp) persons. Might be same property. The one erose listed is the developer/builder of new townhouses transferring title to the Leschs (TOA PA IV LP to Henry R. Lesch and Karen M. Lesch,). I believe that’s the new development in Boalsburg–an over 55 active-living type development. If it’s NOT the same property, then the Leschs put other real estate in trust for the Condons. If I have time I’ll go see.

    …is the Lesch couple transferring title to their former home, on Seaton Drive, and putting it in a revocable living trust for use by the Condon folks. I see that the former house is the pricier one currently.

    I have to say, though, that if you can buy real estate, now is a good time to do it. And Dec is the last month to do that sort of thing for last year’s tax purposes. So, we have to temper any assumptions with that fact. It’s tricky, too, so I’m told, to try to shelter assets from civil liability. Where I live the spouse who has no Judgment against them may find their assets seized nonetheless if errant spouse gets a Judgment against joint assets. But, it does slow things down. As always, he who prevails might just be he who has the money for the legal pursuit/defense.

    Posting for anyone who might be researching, or looking for someone to take to lunch. History of KidsPeace goes back to some of the “children’s homes” a/k/a “orphanages”. Many–if not most–of our current child & adolescent residential treatment centers and psychiatric hospitals have cannibalized those old “children’s homes”.

    For those who don’t know the history (and care to) even back in the mid-1950s there were very few orphans in those homes. Most were kids whose parents couldn’t take care of them or whose behavior was unmanageable in a home setting.

    KidsPeace in PA did consume Alternative House with Wiley House as an interim merger. Might be some helpful things found thru this. Or, maybe not. Their prior organizations in Bethlehem PA has/had a longtime history in this area.

    Just throwing out some random thoughts here, some of the details coming from Touched, the book:

    Jer seemed to visit his parents as often as he could, and stayed with them overnight till they left Brownson House (1986ish). Art was said to have provided “consulting” services to Jer at TSM. One anecdote in Touched was the one with Jingles, where Jer used BH as a hotel, driving 35 miles from there to a high schl for PSU recruiting purposes. (I’m sure he wanted to visit with his folks whenever possible.)

    In one of Art’s obits, as well as in Touched, it was stated that Art really loved the TSM kids. Jer said some of them stayed with Art and Evie in their State College home.

    In Touched, Jer stressed how extremely financially pressed TSM was in the early years. Why did TSM spend $64K in 1981 to buy 20 acres of land? They did build a house for the handful of foster kids; I assume it was on that land. But they didn’t NEED 20 acres. IMO JS was already planning to add many more kids to a residential program. And it sounded like the additional land purchased from PSU was adjacent to the original 20 acres.

    All of it fits together as a continuation plan from Brownson House to TSM, IMO. Generation to generation.

    In a study conducted of both Federal and State convicted pedophiles with similar grooming habits and “lure” techniques, it was found that 100% of similar offenders were abused similarly as children.

    100%. If the allegations against Jerry Sandusky are proven true ( and imo, for me, they already are) I will not stop researching and digging until the “root” cause, or lineage of this heinous pastime is uncovered. We can’t break cycles until we know where they are.

    As to the staying with part, it’s in Touched, top of pg 193. It’s unclear, but that passage appears to be referring to TSM kids staying with either Jer or at Art and Evie’s on visits to State College AFTER the kids were grown. I think. Frankly, I wouldn’t be surprised to learn it was when they were younger also. Or at least for unsupervised day visits. Which are risky enough.

    Sorry if I misled you. (And I hope if TSM kids, as adults, stayed with ANY of the Sanduskys I hope to hell they didn’t bring their own children.)

    Seriously, you’re working on this? And expect to finish within your lifetime? and may it be long. Well, acc. to Touched, Art spent a lot of his OWN youth at the Brownson House, or whatever it was called back then.

    Some of those earlier generations victims (or perps, we should be so lucky) need to come forward and help. Art’s generation were big secret-keepers, as are most towns the size of little Washington, PA.

Since there is reason to believe that Sandusky and his father preyed together, I wonder is that the norm between a groomer and his grown up victim? The United Way keeps popping up with ties all the way back to The Brownson House and seems a common thread with TSM donors, as does PAWS, fwiw. BTW, it’s still spring, summer doesn’t start for another month you know…

    Anywho, I did manage to do a quick timeline of Brownson House wrt the childhood of Art, since Jer claims Art spent time there in his youth too. First, it looks to me like there wasn’t too much going on in that burg to keep kids occupied, so anything was an improvement.

    Then, too, Art was born in 1919; turned 18 in 1937; served in WWII in say early 1940s (home by 1942, IIRC). His childhood time and place was factory work if you could get it. A lot of women working, the Depression. Not a lot of folks at home looking after the kids; not much spending $.

    From 1928 to 1932 what became B.House was a Boy’s Club, run with the help of nearby Washington & Jefferson College volunteers. Does that mean staff or college students or both? IDK. I’m betting some students helped out with kids’ sports, at least. The “facility” was still just a couple of rented rooms in a house on Weirich Ave. So, that was it till Art was 13. (Up till 1927 it was mostly some local ladies teaching sewing and cooking classes. Let’s assume not many boys there.)

    In 1934 an entire house was acquired (Art was 15 then) and it was named Weirich Ave Settlement House. Settlement houses were originally considered a progressive way to help immigrants and other struggling families. They had live-in staff in the community they served. Some had families live there, which was the case as Jer described it even in the late 40s or later, at B.House. They hired their first live-in worker and estab’d a Bd of Directors.

    From late 30s to mid-40s a woman ran it. They offered sports, cooking, and sewing classes. So, that’s the setting Art would’ve been around.

    In 1937 the current facility was purchased when that factory closed down. From mid-40s to early 50s a man named Joseph Julian was its director. It was languishing. (Hark! a new name to play with)

    Art was hired in 1952 to try to regenerate interest in it.

    This is a summary for those who don’t want to go to that link. I am looking at some of the priest abusers out of the Pittsburg Diocese, because there could be some overlap somehow. There was a dreadful case in 1988–a coverup horror. There are a fair number of Catholic churches around the area, all i think under the Pittsburg Diocese. I ran across one obit where a catholic woman requested donations to B.House in lieu of flowers.

    B.House actually got a grant last yr or so from Wash County United Way; about $8K to run an after school program. It’s listed as a UW charity. I mean it’s legit; probably more so in actual services provided than some others (ahem).

    I’ll do what I can for as long as I can. I do a lot off-screen, just so you don’t think I’m idling my retirement years away!

    Judge Brownson graduated from Washington and Jefferson College in 1874, however, he received an honorary doctorate of law from them in 1935. As you read on you will see he was on the BOT for Washington and Jefferson College and President of the Washington Community Chest since it’s formation.
