Nittany Nightmare Continues Past Sandusky: Former President Spanier Charged- NEW Charges for Curley and Schultz Filed

Happy Valley- PA On the heels of convicted child molester Jerry Sandusky’s transfer to his new home,  what most predicted would follow- has.

 

 

 

Former Penn State President Graham Spanier,  fired by the Penn State Board of Trust the same day as legendary late-Nittany Lions Coach Joe Paterno, is facing serious charges today filed by Sandusky’s prosecutors.

Spanier is facing counts of obstruction of justice,  perjury, conspiracy, endangering the welfare of children and failure to report allegations of child abuse.

Tim Curley and Gary Schultz,  who were facing perjury and charges based on “non-reporting”,  are now facing all five similar charges as Spanier-  additional filings occurred simultaneously.

Linda L. Kelly stated the men “used their positions to conceal and cover up for years the activities of a known child predator,” on Thursday following the announcement.

    GJ report.
    My conclusion is that SPM has better judgment than her predecessors (ie not letting Albro loose,
    inviting his atty to the signing) and is very detailed oriented. She also exhibited forethought by giving a
    subordinate running for office a cy of “the rules.” Imo L Glantz should be fired. The Commissioners
    and local PD are a hot mess. Many private attys are seeking to profit on that. imo Shutt was determined, whether
    talking to HR or others, to sink SPM’s ship after her departure, and she & Masorti deserve each other in an
    employment relationship for life. Or Shutt should just continue reading her romance books and aspiring to dress like
    a reality tv star.

    Across the board, the level of unprofessional-ism amongst sworn officer’s of the court is pretty startling. I am also pretty surprised Nathan Boob was not called to testify, but there would be no way to know for sure if he did or did not based on the report. I am flabbergasted that a Judge, signing (allegedly) 3 separate orders for what amounted to a criminal investigative sting ( I called this defense Rose, lol) to include amending true and correct records located within the clerk CANNOT REMEMBER the conversations leading up to, during or after, nor can she remember signing what I would presume to be the warrants for the pen register/trap/trace in the first place. I would have to check case law but I am pretty sure that would violate the four corners rule- and why would none of such interaction be confirmable via schedules/dockets and emails.

    Shutt committed professional suicide or you are correct, she has a life long employment gig with Masorti. SPM came out swinging and after I have read this report, while I do not agree with some of the tactics and those should be reviewed individually as it relates to proper criminal procedure- I do think in her role as the DA this was an organized smear campaign over some sort of balance of power. Disclosure: I have a relative in an investigative and supervisory role within the PA State Police in this jurisdiction- who has no involvement in this matter whatsoever.

    @Blink, in fairness to Judge Ruest, she said she could not recall that, but that she also could not recall signing a court order to wire a PSP Trooper going undercover in the case. She signs a lot of stuff and the judges in the county have been known to sign without reading.

    @Rose, Pipes has the situation “bad legal advice” and is planning to call for Glantz’s resignation at the next meeting.

    J.J.- I don’t doubt that- but I should tell you that they are required to substantiate such actions and keep such scheduling appointments on their calendar. Additionally, the investigator is required to keep a detailed journal on the chain of evidence. Was Richard ever charged? Can you imagine a defense attorney quashing these warrants and effectively suppressing all the evidence? There is a very high probability that could happen- there is case law on both sides.

    @JJinPhila. Recently on coic someone linked the Cty Comm mtg video in June when mary lou whoever, ins atty, gave a full report on case postures. iirc Pipes was not only passive but silent.

    If Pipes takes that tack with Glantz, he’s not only engaging in political grandstanding for what ultimately were his votes & participation. Client County needn’t have followed its contract Solicitor’s advice, he’s also inviting 2 more suits from Glantz on the County–defamation & wrongful termination.

    Glantz has always had a year to year contract, regardless of performance.
    The CC need to give him notice of nonrenewal, advertise the position, & let the new Soliciter recommend what’s next–and keep their mouths shut on personnel performancepublically til that occurs. I get Pipes wants to be reelected, but thinking folks need to bullet vite for the credible new Dem on the block.

    Eventually the CC can evaluate its malpractice options with the new Solicitor.
    But, the Cty’s current problem is the CC’s and Boyde said in open mtg the County needed to indemnify Glantz wrt suits by SPM and hired Abom for him. Can’t back out niw…

    It really is bizarre Glantz’ job performance was criticized the very first year his contract was renewed, in public mtg,
    as I recall in the late 80s, for defects still apparent, yet Chris & Steve have rubberstamped him year after year. And JJ, so did Michael…..
    Never questioned him.
    Chris of course has the grudge wrt his son’s public outing for peripheral participation in a drug murder. Steve is imo just thick as a plank. Her disdain when she said “these men” whose job is the County budget was well earned.

    This has been at its heart an attack on the County judiciary by defense attorneys with personal grudges (Cantorna, McGraw, Masorti).

    The nonleader who should have rather lead who I blame for the success of this attack is Kistler who as Pres Judge could’ve breathed fire wrt attacks on both Lunsford & Miller, as Judge Kurz did.

    But, he’s a political bedfellow of Chris & Steve and wanted appointment to the State Supreme from Corman.

    Glantz did not disclose this when advising the Commissioners what to do when the Shutt complaint was offered. Further, it was legally permissible to discuss this in executive session, as it was technically a personnel matter and a legal one. Yet Glantz did not recommend that.

    I expect even more to be discussed at the meeting. I would not be overly surprised if Glantz would resign.

    The stumbling block is Kistler, an ally of Steve and Chris, and taking his guidance from
    Corman imo just like Corbett once had informal and formal political power.
    I have stuck around because Steve & Chris had these same roles when Gricar was DA; when Chris Lee
    was protected (don’t care they’re diff parties, there’s other kinds of connections; when Sandusky strutted about invulnerable. And I would love to see SPM go spelunking. Imo the CCs made a disabling move on her, and Lunsford who would succeed Kistler, just after Gricar case was sent to State police. Otherwise, Lunaford coukd’ve chaired the County criminal grand jury. Now who, Ruest? I bet Kunsford us on the verge of Judicial body investigation clearance.

    There were 3 GJ’s before Sandusky was indicted- I know Gricar did not feel he had a successfully prosecutable case and given the investigation I am aware of, and timeframe ( reluctant witness, probable entrapment) he was right . However, I fervently believe there is so much we don’t know about his activities as a prosecutor- AS EVIDENCED by the fact that I have FOIA most of it to no avail-

    All it took was “volume” from Cantorna–the one complaining at the time– alleging Lunsford was “unfair.” Kistler didn’t even read trial transcripts to evaluate bench rulings. Cantorna probably had his business partner Solicitor Glantz put in a call to Kistler, and Corman and the 2 stooges probably called as well. It was political. Kistler is a wimp, and imo his potential deposition in a Miller civil suit against Cantorna and Glantz will be deservedly made public by her.

    There are many ways to skin a cat JJinPhila. She has likely looked at his many appearances representing townsfolk including his son before the Cty Planning Commission (zoning, variances, permits), his own tract development (another repped him), and his frequent attendance at that County Natural Gas Board that has all those frackers & gas cos. on it. Showed up there more often than Commissioner mtgs. she claimed Sunshine Act violations and coverup of a potential jail-related crime. I seem to remember the Comm’s budget relied on pay from other Counties to house criminals while they put pressure on Kistler successfully to stop housing so many criminals and for so long. Imo Lundsford’s high bail reqmts and stiff sentences which bucked Kistler’s policy requests to give the jail relief was the real reason Kistler took him off criminal cases. She can probably tie something together that involves money, the twins, & Kistler and relates to the jail. Wrt Gricar, subpoena power, testimony under oath, & immunity may progress the Task Force’s work.

    @Rose, none of these guys were commissioner in 1998. The Commissioners then were Vickie Wedler (R), Sue Mascolo (R), and Keith Bierly (D). The only county officeholder from that period is Sheriff Nau, and he’s retiring this year.

    Wedler often sparred with Gricar over making the DA’s position full time.

    Pipes is self-immolating if he files a formal request to resign to avert Castor’s personal threats. Glantz’ contract is up yearly; he is old.
    Wiser to find a willing highly qualified local replacement, get tentative interest shown and a resume, and present the recommendation to interview others to the BOC two months before his contract is up.

    He also has to get with the other Dem running and form a team that lobbies fiercely for bullet voting in the two of them. Right now he should be talking to voters, not the Commissioners. Without a Board majority Pipes just continues to be a widget office manager trying to keep things quiet by cooperating.

    Such like small town attorney ripped off my spouse’s small town parents with estate
    mgmt-related fees. It’s a rural industry esp affecting simple farmers.
    My guess is the Glantz has the loyalty of many an elderly client.
    And fealty of many a small town banker.

    If I were the ever anti legal secr Ellen’s prominent law firm employer, I’d find some reason to give notice. It is extraordinary Glantz failed to disclose his several conflicts of interest, merely opined what he felt was legally permissible to facilitate a political agenda rather than what was legally wise, and did not obtain outside legal opinion before the BOC action–saved that for his & their defensive game.

    Remembering Steve and Chris were on deck in 2004, with Glantz.

    That legal advice was debunked when Bellefonte PD was required by some mechanism, probably a judicial order coming out of the investigating Grand Jury to turn over search warrant proceeds to the OAG’s first-in-time investigation, who promptly returned the hardware to the DA.

    Compared to the DA’s and ADA’s in Centre County we normally discuss, she has substantially less experience.
