Nittany Nightmare Continues Past Sandusky: Former President Spanier Charged- NEW Charges for Curley and Schultz Filed
Happy Valley- PA On the heels of convicted child molester Jerry
Former Penn State President Graham Spanier, fired by the Penn State Board of Trust the same day as legendary late-Nittany Lions Coach Joe Paterno, is facing serious charges today filed by Sandusky’s prosecutors.
Spanier is facing counts of obstruction of justice, perjury, conspiracy, endangering the welfare of children and failure to report allegations of child abuse.
Tim Curley and Gary Schultz, who were facing perjury and charges based on “non-reporting”, are now facing all five similar charges as Spanier- additional filings occurred simultaneously.
Linda L. Kelly stated the men “used their positions to conceal and cover up for years the activities of a known child predator,” on Thursday following the announcement.

Well, if they threaten or effect a crime, or contain porn denigrating specific genders, social class, and race…those constitutionally “higher scrutiny” factors in some trials.

Judge J Bowes is a darn good writer.
This decision seems inevitable (in fact I read Bowes to say Curley’s
attorney didn’t take it as far as he could have and Schultz’ did.)
Decision lays the foundation to sue Baldwin & disbar Fina.
The urgency (to say Fina, or some Dems supportive of Baldwin)
of Kane’s temporary suspension, if not removal from office,
becomes very clear. Beemer expectably would appeal this decision
(a fool’s errand unless the S Ct result is expectably politicized).
Kane would not. It is excellently reasoned and written, well substantiated,
and feels right. It was imperative to disable Kane as AG imo to protect Fina, Baldwin,
and charges against the 3 Penn State employees.
@Rose The court did not rule on the crime/fraud exemption, which would be a stronger argument. I’m expecting that there will be an appeal and Baldwin’s testimony will ultimately be let in on that ground.

This comes to light becauseSimon PFUR hired her to disable the CC DA’s ability to keep investigatory expenditures confidential. Don’t know where he git Pepper’s retainir. He had to drop a Court appeal in his real cause saying he lacked funds to pay for it. Since his sustained attack has been on the DA in CC, who is tough on drugs and sentencing, we need a foia on Simon for sources of his funds, & his expenditures.

You have to look at the footnotes in Bowes opinions. It notes that the appeal did not raise the crime/fraud exception. That is as close as a court can say, **Use this argument.**

The media minutes of the CC Commissioners are a joy each week. I skim and dip, but the 2 females who replaced Boyde and Glantz are like Day after Night. The 3rd full paragraph on p 8 url beliw (Shutt’s complained of notarizing of SPM election materials) explains a little attorney-Commissioners-Administrator back and forth that occurred in last Tues’ media minutes between these others and Dershem. Someone in that group of 4 was getting Dershem on record, not going back to see who. He was led tho to state on the record that County notary employees have always notarized anything requested, inckuding election materials, for any john q public who walked in requested a notary, and Dershem wanted to continue that practice, thus establishing Shutt’s complained of notarizing was the ordinary practice in the County, and Dershem knew it, and wants to preserve its continuance.

The PASC by a 6-0 margin, refused to reinstate Kane’s law license. The Senate is moving on to direct removal.
The OAG is asking the full Superior Court to reconsider, and so in Curley, who is still charged with perjury.
Thanks JJ. I guess in a word, Kane is toast. I will form my opinions at her trial, however.

While Kane can expect to be removed by Wolfe (everyone seems to want a man from MoCo
who is running for AG appointed to the job), my wish is Gansler gets thru those emails first

The House is still moving forward with impeachment. Kane’s criminal trial is set for early August.
The Senate also adopted a motion to Reconsider, which means that they can, technically, bring up direct removal again.
@JJ I don’t think saying she is not running again will save her bacon.
I think she’ll create enough reasonable doubt to avoid felony conviction, maintain bar membership,
but by the finale will likely resign a but early.
All I want is enough stall for Gansler to make progress.
@Rose, I disagree on that. Had Kane filed petitions, she might have had those challenged on the ground that she could not practice law. It would go to court, and the court could rule that she couldn’t hold office. It was a risk she couldn’t take.
I expect Kane to be convicted, but even if she isn’t, I expect her to be disbarred. Some of the problems will arise from her conduct after her suspension.

At some point Gansler’s investigation will reach a point of no return, thankfully.
If a Dem succeeds Kane, I expect the next AG to fully clean Corbett’s house,
including Beemer and others. The next election will be about infrastructure, with
Kane having played a transitional role. PA’s real problem is the Budget dysfunction.
If you skim, dip into the now short and sweet Centre Cty Commissioner’s minutes
video, one of them gave a nice spot on the CC impact last week. Imo even
Corman will be in trouble in that County at some point due to Statewide budget impasse.
With Exarchos, Boyde, & that attorney gone (name blank), replaced by current
personnel, these CC Comm mtgs are like Day vs Nite.
Here’s an example of a man (who may be bipolar, or have dementia, or alcoholic, or just demonstrate the ease of entering the PA Bar in his era) who shoukd be disbarred. Imo not fir the content of his unsolicited emails but for sending them to judges and prosecutors whilst they were handling his litigation. By their failure to rebuff his emails, he was really creating a hold over them.
