Jodi Arias Trial: New Witnesses May Reveal Defense Strategy- Prosecution Omissions

Phoenix, AZ- In a terse exchange prior to the hiatus in the Arias trial, the defense repeated their contention that they want The Honorable Sherry Stephens to order a directed verdict or a mistrial in the State’s case against Jodi Arias.
As reported exclusively by BOC it does seem the prosecution missed quite a bit of potential evidence including a possible motive- the duct tape around Travis’s right arm. Was it the final straw that made Jodi Arias snap as she was allegedly taking photos of Travis in the shower without his knowledge?
There was also an exparte hearing held in Judge Stephen’s chambers, however, the contents of those minutes have not yet been filed- although the docket suggests they have. The defense is now testing Jodi Arias’s canon camera for some undisclosed reason.
With the defense preparing to start its case next week in spite of the outstanding motions before the court- have the prosecution’s actions harmed their case?
The issue at the forefront seems to hinge on something that the prosecution never introduced- On Purpose, says Prosecutor Juan Martinez.
The prosecution’s very first witness, Maria Hall, who was the female friend attending the Cancun trip with Alexander on June 10th, told the court that Travis told her he had been stalked while on a date with another girl and had his tires slashed. The intimation before the court was clear regardless of the defense attempts to point out that Travis never said it was Jodi who was responsible.
Nancy Grace and Jane Velez Mitchell lit up their HLN evening roster discussing Arias’s stalker behavior with several associates of Alexander. Dr. Karl Hiatt said one Sunday he was told that he had his tires slashed and that it was possible that something might escalate and he may not show up for dinner as a result.
Outside the presence of the jury Juan Martinez argued that they did not call the witness who Travis was on that particular date with because he did not want to create “an inflammatory” situation for the jury causing an appellate issue.
However, Martinez also lets it slip that Lisa Andrews Daidone does not want to testify and the defense tells the judge the prosecution has withheld her contact information from them and THEY intend to call her. Daidone recently deleted her FB profile and other social media sites in her name.
Does it make any sense to anyone why a prosecutor would not call a witness who could place a dangerous weapon in the hands of a person committing a destructive and openly violent act who they allege is guilty of doing exactly that for exactly the same reasons in the instant case?
From Daidone’s bog entry in 2008:

While if you asked me a few months from now if I could go back would I change it, I would say “Absolutely,” I’m not sure how much I would actually change about it. Of course I wouldn’t want Travis to be taken. I might even opt for Jodi to be popped instead. But who am I to decide the fate of the hundreds of people that have been effected by this? It’s hard
to say which way is better. Travis always talked about Opportunity Cost. He spoke of how his time could be used best, to benefit the maximum amount of people. I’m sure he wishes he could have done more while he was here, but I don’t think he regrets leaving. He is doing something amazing up in the Spirit World. I know it. I can feel it. He is continuing to learn and progress. He’s helping others to do the same. He is the same wonderful, creative, spontaneous, caring, gentle, driven, foe- paint-loving, show-tune-singing man that I fell in love with…”
Is it because in the 48 Hours Mystery program so frequently noted by the defense Detective Flores openly states there was no evidence whatsoever that Jodi was involved in that incident after he repeats his theory that Travis was shot first? Both these statements made by the lead detective in the case on national television directly conflict with the prosecution’s case as testified by Esteban Flores.

Is it because they already know who was responsible for the multiple tire slashing incidents and presenting that information might corroborate a story told to them by Arias in the past?
In her own words, Lisa Andrews Daidone began dating Travis Alexander in July 2007. According to the minutes filed from trial January 16th, the tire slashing incident was in December 2007, both Alexander and Andrew’s tires were slashed and the individual came to the front door . Martinez states Andrews will testify to these facts. Prior to dating Alexander, Daidone was dating a common friend and member of their Mormon ward- Steve Bell. Arias claims she and Travis began dating February 2, 2007.
Daidone will not go into how she and Travis began dating, or why, but there is a Steve Bell connected to this group that has had some serious troubles with the law immediately preceding the break up, and many following.
Could the mystery stalker have been on her end and NOT Arias? If so, you can bet the defense will be bringing that issue into court next week and providing the jury with this eye opening gem- expected to cause further problems with the State’s theory.
That’s not all, unfortunately.
Thomas Brown, a former roommate of Travis Alexander in the home of his murder, was interviewed up to three times by Detective Flores whereby he told them that Jodi had open access to the home when he was around and the Arias he knew was completely shy and somewhat awkwardly withdrawn. He was having a hard time picturing her do this without help and he told cops that.
He also told them something about Travis being shocked to get the call that Jodi Arias was standing outside the home the early morning hours of June 4, 2008 and that he had been up all night performing some sort of protection rite. Brown’s information was not included in any information given to the defense and he was not even aware his name came up in the investigation by Jodi Arias herself. I would expect that issue to surface promptly as well.
Gus Searcy, $100K ring earner for Prepaid Legal Services and now Legal Shield was noticed to be available this week for interview. Travis was scheduled to be on the conference call with Searcy at 6:45PM the evening of his murder.
Artful Dodging
While the trial is in hiatus, one are of Jodi Arias’s life is quite active and well, pecuniary.
Arias, through her family, has taken to EBay to sell her personally rendered offerings the macabre set is snatching up for a few hundred clams a piece during the trial.
It is believed to be managed by Arias’s mother Sandy, who uploaded images to Arias’s MySpace after her incarceration to include one of Gary Alexander- Travis’s older brother.
The defense portion of the Jodi Arias trial for the murder of Travis Alexander led by Kirk Nurmi and Jennifer Willmott will begin its case January 29th.

JEEZ- it may help you to know that i read, & it is my understanding that Travis family wanted the tape played in court and it is my understanding that the prosecution wanted it allowed in its entirety- that way Nurmi couldnt just pick little tidbits.
I think these last days ofof her on the stand Jodi has succeeded in losing alot of the compassion any juror may have been feeling during her first days of testimony..

Arias’ memory for details is noticeably waning. How many times today did we hear, I can’t remember that at this point in time. Her demeanor has shifted from woe is me to deer in headlights.
So, she borrowed the gas cans because gas is higher priced in California. Really? As I understand it, she would have to buy gas to get out of California… and she lives in California… So if we rely on her Calif gas price theory, then she brought them along to fill before entering back into California. Who carries 2 gas cans across the states to save a few bucks returning? Brewer testified on cross that Arias called him in May 2008 to ask to borrow the gas cans, called two more times and arrived at his house in June 2008 to borrow the cans but would not explain why.
So, Arias is saving pennies at the pump yet waits in line to get her nails done in a strange town. I’d love to see that receipt and bet it was It was a Brazilian wax. I haven’t noticed salon manicured nails in any of her photos.
She pulls into the center of the driveway (where she always parks) and cannot remember if there was another car parked there? With all those roommates and people coming and going, why would she always park in the center of the driveway? He has a split 2-car garage.
And, she arrives and stands behind Travis, watching YouTube. Neither Travis nor Napoleon notice her right away. Really? Is the dog deaf?
These are the responses we pray she elaborates. Her “facts” will change, statements will not make sense, she will try to confuse but will be cut off by objection, all the while unfortunately Travis will be made out to be a larger than life monster.
I am anxious for cross for many reasons but mostly now to see how the prosecution lays it out. I wonder how many college law classes are studying this trial.
Blink was in her office solely concentrating on another case today so I sincerely hope to get caught up.

Those gas cans imo were for the express purpose of driving into the desert to dispose of the knife, gun and bloody clothing so that the tickets at the gas stations would indicate that highway mileage matched the gas used. Just another step in premeditation.
She had this planned out for some time. The problem is to get evidence in front of the jury that points it out.

They are just trying to explain away any question of premeditation (how did a gun happened to be conveniently lying around the bathroom? not yet explained, but they conveniently placed the knife in the bath when she and Travis measured out and cut the soft rope with a knife in the bathroom).
I was surprised that Cancun was introduced into this scenario. They are second guessing the supposition that she killed him because she was enraged that he was taking Mimi to Cancun with him. Her explanation that Travis took the babysitter because he owed the friends money? What??? That ranks right up there with sex under water doesn’t count. Her nonchalant response to his NOT taking HER was very telling. The lady doth protest too much, methinks. It makes me think Cancun was very much a central driving force in directing her to Travis that day and his ultimate annihilation at her hands before she left on June 4. She, at one point, mentioned discussing Travis and Mimi’s relationship and commented that someone in the church informed her Mimi had rejected Travis. Aw crap, maybe I shouldn’t have butchered him after all.
I am so looking forward to Juan Martinez’ cross of this lying succubus. He had that lean and hungry look today. I have great hopes he will shred her lies and bring the truth to light for the jury. I am getting so sick and tired of hearing her, watching her histrionics on the witness stand. Equally weary listening to Nurmi’s thinly veiled attempts to lay out a vision of Jodi as the poor, maligned innocent who was victimized by Travis. Not buying it, not one little bit of it.

And so the story changes again ??? If i remember correctly, didn’t Arias tell Detective Flores in one of her interviews that she and Travis tried to look at the photos she brought on the discs the night SHE ARRIVED at Travis’ house, but he had a virus on his computer and they couldn’t view them…..on the stand today, didn’t she say that it wasn’t until she was getting ready TO LEAVE Travis’ house that they tried to view the discs (and now adds that he throws the discs because he couldn’t view them). Also, i swear her account to Flores also included her ringing the bell when she arrived and she could hear Napolean barking in the house, but now she says she just walked in….don’t quote me on any of this, i’ll have to go back and take a listen to the tapes when i have a chance, but this is what I’m recalling at the moment.
Why do i have the feeling that Travis had no idea she was coming to the house that night (if it was at night/early a.m.). Why do i have the feeling that he was not downstairs or awake when she arrived, allowing her time to go through his computer to see what he’s been “up to”. For all we know, she may have hidden herself in or near the house until she revealed her presence in the morning or later that day. I find it hard to believe that she arrived at 4:30am-ish, but she did not begin her ‘seductress routine’ for some 8 hours after her arrival. It just doesn’t make sense to me. So far, i’ve been taking the timeline SHE has proposed at face value, but she has proven herself to be a liar, so why should her timeline be taken as truth?

@ Mom3.0……NO, you did not come across as defensive. These are difficult conversations to have, to being with. Participating on a blog is a lot trickier. I just pray that when I lay something down like that, the person sees a perspective of faith they’ve never considered before. I realize that not everyone will agree with me. I did state that my posts were not to condemn or judge. I simply express myself through the good book, try to express myself from God’s point of view, how I’ve grown in Him AND as He reveals Himself to me. My desire is to align my will with His. This is why I respect that other people will be at different places in their journey than me, HENCE, God will talk to us according to where we are. If you’re listening to Him with all your heart, all your mind and all your being, He will reveal His truth through you. IF God is for you, who can be against you? I’ve never known a dog that didn’t react when someone drives up, never mind comes into the house and into the room the dog is in. Well, only once that I can think of, but that dog wasn’t feeling well. Napoleon was feeling fine according to anyone who’s mentioned him. Isn’t it funny how dogs can be such excellent witnesses? Remember in the OJ case, Nicole’s Akita established the time of the murder.

I agree my friend! Interesting, because Jodi was able to flip that around and testifies it was Travis who was deviant, unfaithful to her, manipulative, controlling and abusive. There is a degree of truth in this.
She’s been able to twist the truth quite easily, since she’s describing herself. This is where it just SUCKS that she did what she did and Travis can’t be here to call her out on her bullshevik.
She’s not looking so confident, but sometimes, she cracks at smile at the most inappropriate parts of her testimony. If only we could determine how the jury is observing her demeanor, if at all. The eye contact with the jury could have worked, but the rest of the body needs to be agree with this gesture. She’s a sitting controversial body of work, literally.

I have checked hln & trutv, all I see is pretty much replays, Nancy Grace
replaying entire sex tape for all that’s worth. I can’t see the dimmest of
viewers sticking with it twice. I did catch JVM yelling at someone about
something last nite. I recommend fresh blonde streaks and a new edgy haircut
as an infrequent tv viewer.

I am convinced Nurmi banked on a prosecutorial error or talking sense into his client to not take the stand.
I could see his rationale, but he did nothing to amp his defense strategy.

The defense is letting her talk herself into “premeditated” murder. So many victims….my heart goes out to those suffering the loss of their family members including Jodi…her free will allowed her to enter the kingdom of hell forever.

Yes- and he is lying down according to the chronological timeline and then back sitting on the shower floor. This is before the “last pic of Travis” we all have come to know. Whats up with that?
I also think everything she was doing was carefully planned to shame his reputation/his religious standing/etc.
Also- I had to go back and listen last night due to missing live testimony. I am not understanding the Cancun trip was payment for a friends babysitter? Had there been further elaboration on that- or did that just pop out of no where?

Didn’t the Forensic camera guy for the Pros.indicate he didn’t see any indications that TA’s camera had been set to auto-timer? BC that is what I think a lot of ppl believed initially until it seemed he debunked that possibility.
I hope that is reviewed further- there are critical issues in this area, imo.
Travis Alexander used Jodi Arias as his own personal sex toy, bullied her and degraded her. She accepted this behaviour and allowed herself to be subjected to it time and time again, simply because she was in love with the man. She cannot deal with rejection and may have felt the only way to remain part of his life was to be his booty call whenever he felt the urge. He knew he could have her anytime he wanted to and there is no doubt he used her for his own sexual needs.

The man obviously knew he was playing with fire but still continued to have relations with her. It still doesn`t excuse murder but I for one would not be so quick to call this a nailed on conviction.
I think their is definitely room for a jury to have at least person see the patterns here, and I still say as I have said from day one, it is going to be very difficult to prove capital murder and I have yet to see evidence of the commission of a crime preceeding Travis’s murder. She is overcharged as to the limits of the prosecution’s case, period.

I hope Martinez will emphasize to the jury that because Jodi had Travis’ passwords, any communication that was supposedly from him should be taken with a grain of salt. As carefully as she plotted out the smallest detail in getting to Mesa (fully equipped w/gasoline, knives and gun), it wouldn’t surprise me at all if she sent herself incriminating email from Travis’ account. Wondering if Martinez will unleash “psycho Jodi” if he pushes her over the edge. That would be worth watching.
If Jodi really is a psycopath, and I honestly do not believe she is, sociopath, yes- Martinez would not be able to shake her. He should not even try. A sound strategy would be- in an even tempered way, to take her through the inconsistencies and flagrant lie patterns and then allow the jury to view how skilled she is at lying. Including but not limited to her ability to actually believe what she is saying, no matter how ridiculous it seems to everyone else.
That is really what is necessary. A true psycopath is entirely believable, sadly.
I would follow that with a psych expert who has evaluated Jodi ( I believe there is one on deck) and structure my rebuttal around addressing what Jodi displayed in front of the jury juxtaposed with her hours of interview, and yes, the last thing the jury would hear from me would be the “no jury will ever convict me”.

That won’t wash since the shower pics were taken after they supposedly put sheets in washer.
I am so convinced that she snuck back in after Travis thought she left to get copies of the nude pictures so she could send them to Mimi before the trip. When she found the camera the pictures were deleted so she thought she would sneak in and take new naked pictures of Travis This would however dismiss the idea that her initial plan was to slaughter Travis as she did, so I just do not know. I did find it interesting that she mentioned the timer on the camera. The idea of a little truth in a big lie could well be in play here. Who is to say that she did not take those pictures of herself while using the timer.
She was so busy playing drama queen and plotting that Travis had just about had enough of Jodi. She accidentally sent the email to Travis intended for another man , NOT.
Also how long does it take to zip and download 12 pictures and send to someone? Just another little form of manipulation by Jodi to get under Travis’ skin. If and I say if, Travis was punching away at the punching bag the night she arrived it was probably because she was baaaaack.
She filled the gas cans in Pasadena although stating the reason for taking them was to avoid California gas prices.
And drove across states although broke, unable to pay car payment, change oil or fix transmission.
She rented the car with a debit card. I don’t know of any car rental company that accepts debit card. But then, which website did she confirm? She can’t recall.
Travis’ sisters are taking copious notes now, probably in part to break Arias.
Her account of the arrival to his house is untrue by nature of Napolean’s reaction. After 45-60 seconds he barked. Arias just doesn’t know dogs. Her penchant for excessive details will be her undoing.
I believe she snuck in, unannounced. And started snooping on the laptop.
So, there was “someone else there” but she doesn’t think all of his roommates were there. Really? That’s quite a big difference in cars in the driveway and activity in bathrooms, doors closed, etc. Yet… her understanding is that nobody was home “during that part of the day”. What is “her understanding”, what does that mean?
Arias has been wiping her nose quite a bit today. I have not noted her wipe her eyes. In other words, tears are not streaming but the nose is running.

Most debit cards operate via the VISA network, they can be used as a credit or debit but are still subject to available funds, which she made cash deposits to her account enroute. While I don’t think it prudent to use a debit card for what she claimed would be reimbursable business expenses, or to rent a car I was going to return without gas or damaged, sans mats, etc, but I am more concerned about how she interpreted :

Rose- because you are newer to the case, you may not know that interestingly under AZ criminal process and procedure- these jurors are permitted to ask their OWN questions after completed cross PRIOR to re-direct.
In addition, this panel is subject to a lottery as to who will actually deliberate once final arguments end so nobody knows for certain who will actually deliberate to verdict until just before the Judge charges the jury.
And.. she just literally effed herself by essentially admitting she knew exactly what doors are locked and when, and that she stalked him when he had a girl over by stating she knew there were “other people” but then needed to confront him about whether or not he was dating someone.

Ok…let’s think about some of the crud spewed forth yesterday.
Gas cans to avoid pricey gas purchase in CA? Yet gas was actually purchased in CA…….oops
Do we know where the gas cans ended up when she returned home? Were they left in the rental? Were they found at her g’rents house?
Did they even make It back to CA?
I was broke at the time of the trip, for example I couldn’t even afford my car payments or upkeep for said car.

agreed it can save $$, but I seriously doubt that she couldn’t have secured the same savings at a local rental office.

Rental car..yes it is a known fact you are far more likely to be pulled over in a red econo-box rental car than any other color econo-box rental….umm no, I really don’t think that theory applies to the compact ecoomy festiva and focus type cars….maybe if you had selected a mustang etc…You also have to put down an add’l deposit to use a debit card for a car rental, they have pretty strict policies on debit cards….even if she had already paid for the rental thru the online site she used (that also have policies around debit cards) You have to provide the card used for the online purchase and then either use that card or a different one to have on file for accidents, damage, etc no different than hotels.
Here’s a thought…if your so damn broke, why not keep your butt home…..oh wait, you can’t murder your ex-bf for rejecting you and then go evaluate your potential next victim from home…

If you were planning a trip to see your potential new piece of man meat and you wanted to get your nails done….you would have gotten
them done at your regular place at home….nail techs are like dentists..once you find one you like you stick with them unless it’s
an emergency….at least that’s how ppl who get their nails done regularly typically feel. You don’t just pop into some random place if
you already had your trip planned out, you would have planned to get them done before departing…DUH!!

I honestly do not think he knew she was taking pics of him in the shower, I think he thought or assumed she was gone.
in all the pics of him I the shower his eyes are either closed or he is facing the shower wall EXCEPT the one pic where he looks surprised
and confused. The other shower pics are also dim, meaning it would not appear she was using flash initially, so he may not have
noticed her taking pics. When he saw her…that’s when she attacked…which I think she did because he told her to get out and don’t
come back, don’t call, don’t text, just go away, I am done….which she knew would happen and is why she came prepared because
she knew she had lost and she was going to end him.

Seriously. We sat through 8 days of her droning on and on. She can remember what color her poop was on any given day, but now that it’s time for her to tell “her” story, she has a memory lapse and can’t remember anything. Un-freakin-believable!

Actually the fact that her family wanted the tapes played make all the difference in the world. I did not know that. Still have to wonder what would the prosecutor hope to gain by playing these tapes or bits of them.

I know we have our ideas about this but since she said she shot him first did she explain how the casing was on top of the blood?
I have always believed she shot him first, the gun jammed and didn’t kill him and that’s way she started stabbing him, then she picked up the casing in the clean up and didn’t realize she dropped it. Anyway, did she say anything about this?
No discussion on the casing, nor do I expect the defense to bring that up. Truthfully, the casing can transfer and travel a fair distance depending on the circumstances. An example would be the casing discharges onto her clothing, ends up in a fold or down her shirt, etc, and through additional movement it lands where it does. Without the weapon and even then, that casing is nothing more than secondary transfer evidence.

I watched JVM, NG, and Dr Drew last night. One of them was talking to Travis’s friend, Dan, with whom he went practice shooting. Dan said T didn’t own a gun; he always borrowed one of Dans.
