    I retract everything I said about Arias not speaking. She has an Invaluable opportunity to speak not only to her jury but to the world. To waste it would be a crime and as she’s said she is no criminal.

    Have not posted since the CA mess of a trial, i.e. total misjustice. Said I would never get sucked in to obsessing over another trial and here I am. And I am in so deep! Uggg!

    My question is….Can’t the DT be charged with some sort of misconduct? Why would they be allowed to purposely “throw” part of a trial so an appeal could be granted? Ya can’t do that in baseball!

    I am puzzled. Why was court recessed? If there were no witnesses to call why didn’t Jodi say her piece..why wait until Tuesday?

    ***********
    Isn’t that what she was to have testified to? Her past experience with the defendant? I’m lost-lol.

    I doubt that she was going to discuss drug use that included the defendant, or income tax evasion of same. And if that was Martinez intention, why show that hand in the penalty phase?

    B

    I am all for murderers being tried, convicted, and held accountable for their crimes. I have no love for Jodi Arias. I do understand some of her issues, but do not accept them as excuses. But…this…it does sound like witness tampering/intimidation. Blink, you’ve pointed out so many obvious holes in the prosecution, that I was surprised at the M1 conviction. That and the defense. Jayzus, if ever a trial was likely to get an appeal, this’d be it, methinx.

    I have thought from the beginning that there must have been someone else there, based on Travis’ size, Jodi’s size, and all of the moving around of the …pardon me… dead weight of a person so much larger.

    The photos, think…why would Jodi put those pictures on his cam? Maybe for his new girlfriend to find? Just to think, if she had taken that cam or mem card with her, conviction probably would have been MUCH less likely, especially with the poor forensics.

  5. MackiezMom says:

    If it was Martinez’ intent to discredit the witness, he would have let her testify, then discredited her. Instead, he let her know he would trash her in open court, which served to intimidate her, and keep her from testifying. I’m dubious as to the propriety of his questions during the course of discrediting the witness, much less during the course of interviewing her pre-testimony. I suppose he could bring up things that would depict the witness as less than credible, but he best have evidence.

  6. MackiezMom says:

    WRT my comment concerning CA being borderline. My opion, of course, a layperson’s, not a doctor’s, but a familiar/somewhat educated layperson’s. As Blink has said, I think these women have several issues/diagnoses. They don’t fit into one box. Most of this type do not end in dead kids/parters, most end in drugged out old ladies whose families have bailed on them, once the kids grow up and the young women lose their looks and drive everyone away.

    Hello Blink,

    The judge ruled that the reason for the witness’s refusal to testify are speculative and denied the defense motion. Is it speculative because there’s no way of truly finding whether it’s 5th issues as the prosecution claims or intimidation as the defense does?

    Thanks,
    Dilberto

  10. jr says:

    I’d have to say that today I sided more with the defense…not Arias but her defense team’s reasoning behind their motions.

    As much as they benefit us, I don’t think these high publicity trials benefit the defendant in having equal rights to a fair trial. i don’t blame any witness being worried about about the personal repercussions of testifying on her behalf. look what the Anthony’s went through publicly dealing and trying to posture their crazy predicament of their grandaughter being victim to their daughter…one murdered, one facing the death penalty. im not saying they were the classiest people to begin with but imagine grieving, dealing with that whole situation and becoming blatantly nationally hated as their entire lives became a reality show.

    the arias trial isnt as bad, but its enough that its affected the course of events. i read a comment made by Jodi’s sister on a website that people have even been threatening her baby. while most of us our normal and can look at arias and the situation for what it is…there are those vengeful fanatics that get satisfaction out of doing things like bringing their kids along to scream “baby killer” all night on the Anthony’s front lawn….until they literally “get the hose”

    Does anyone have the video of Womack on the stand? (the bird flipping and laughing?)
    *********
    She was never on the stand-she was in the galley with the family- as well as on NG and other shows.

  12. Eloise says:

    I was going to mention- does any one think Mr Brewer was thrown out on the airways doing media in place of Jodi, speaking for her while her mouth is supposed to be under wraps? This is the man who previously went on the stand incognito- and now hr has jumped in front of the cameras to speak on her behalf at what a wonderful caregiver of children she once was? I say scam! This way she gets her points made- hoping the jury is watching TV, yet preserves her right to call unfair play-
    I’ll tell you- she really must be running this train- bc none of us have gone to law school and we can see this train coming miles away- she thinks she’s such a smarty pants- she really needs a good butt whipping.

  13. Survivor says:

    I saw on HLN last night that the jurors were irritated/angry when leaving court yesterday. No defense witnesses and JA potentially not speaking at all. I would be furious as a juror. This could have been over on Thursday. If she doesn’t speak, she very well may have ticked the jury off so badly that it will be a record DP vote. Of course if she does speak, they could be headed into a record DP vote just because they have to listen to her again.

    All along I didn’t think JA and to a lesser degree, Wilma, were taking this trial seriously because of appeals. It feels like this trial has been nothing but an appellate stepping stone since it started, especially once the DT had to put her on the stand. For Travis’ sake, I’m glad she never stopped talking.

    Saw the motion argued and I think I can answer my question Blink: The court found that a sealed proceeding would prevent fear of intimidation and that Womack’s reason for refusal is speculative w/o more information–which would require her cooperation/oath which she is not going to volunteer.

    Dilberto says, “Nurmi took his ball and went home and is hoping for a mistrial? But a mistrial here would only reset the penalty phase I think.”
    ~~~~~~~~~~~~~~~~~~~~
    @Dilberto: Correct, and think about how difficult it would be to find an unbiased new jury for this penalty phase. If this is DT strategy, it is clearly flawed. I believe the Court recessed to give the defense attorneys some time to think on this before going forward. JMO.
    Thinking about Travis and his family today, and the hell this monstrous entity has put them through. In order to completely possess Travis, she brought such evil and horror into their lives and the lives of his friends. Yesterday, I saw Sky Hughes on television being interviewed and she said that JA never stopped believing that Travis was going to marry her, even as he desperately tried to cut off contact with her at the end. The more he pulled away, the more determined and aggressive she became.
    My hope is that Travis’ name will live on through his writings and innate goodness and positive effect on others, while JA sits in a claustrophobic cell staring at it’s four walls for 23 hours a day. If the jury votes for death, so be it. She is the only one responsible for putting herself there. She sickens me.
  17. PamSpaz says:
    What is the relevance to her association with the defendant?
    B
    ————————————————————
    To me it goes to her character and proves she is making bad choices and can go to making bad choices in choosing friends or even in evaluating a person. Who would take the word of someone that has drug problems?
    I do not think there was intimidation. Regarding the threats, the judge already addressed and offered the solution in that her testimony would be sealed. That to me speaks to fairness. All things considered, I am sticking with my first gut reaction to what happened Thursday and that is simply that this so called friend does not want to testify. She has been on NG and other programs so she is not scared of being seen or heard. What can she really offer anyway? What kind of friend Jodi was in highschool? They did not remain in touch. I also heard one of the talking heads say that the witness did not think Jodi was abused as a child and could not testify to that.
    My prediction on Jodi speaking today. IMO it will be much like her TV interviews pre and post trial/verdict. She will be emotionless and come across as though she is just telling a story. No feelings whatsoever. To clarify she will say she feels but no one will be able to see the feelings. She will talk and talk and talk about herself. How others see her is sooooo important to her. I even can see her making digs on Travis like she did in the post verdict interview. I hope she does not do this but would not put it past her.
    I respectfully disagree that she was not intimidated by the prosecution but I don’t know that I think it rose to the degree of misconduct in that the jury has the right to evaluate the witness on their own merit. She could also simply refuse to answer questions she objected to and let her answer stand on it’s own. I suspect the counsel that was appointed for her advised her not to, and that is what was heard ex parte yesterday.
    As far as Mr. Brewer, I would not doubt whatsoever that JM was planning to ask him about the remote to the DVD player and how it got in Arias’s car in the first place. Maybe something about receiving or fencing stolen property, lol?
    I wonder if she will take the opportunity to implicate MM?
    Yes Grace, this is what I was talking about re: the stalking and this same outcome if he had pulled away sooner from our prior stalking conversations.
    Also, I can tell by some comments here that I missed at least one of your posts. So I will take this opportunity to give you my heartfelt sympothy wrt your uncle. So very sorry for your loss. Prayers to you and your family.
    ——————————————————————-
    At blink, to clarify I do not think there was intimidation to the point that she was no longer willing to testify. I think JM aggressive style is intimidating to a lot of people. May be she was more intimidated by the questions themselves. I do still think that she just plain did not want to testify anymore because of her other issues and of course they have to blame someone so why not the prosecutor. JMO and of course respect your opinion and others.
    Would not surprise me if she does implicate MM, but if she does that would be a whole new story, and IMO would be viewed as another lie/story to save her own skin. I do not see her doing that. I think she going to stick with her self defense story, ie. making digs on Travis mentioned in my previous post and my prediction. Could be wrong though. I have been wrong before and will no doubt be wrong again.
  19. Ode says:
    I just heard a crowd member on HLN give a very plausible scenario that JA may use if she speaks today. She will admit to not wanting anyone else to suffer because of her so she was shielding her friends and family from testifying. She was the one that would not let Mr. B, Ms. W and Mom testify.
  29. PamSpaz says:
    Well she still wants to be perceived as a victim of domestic violence. Also she did not want any responsibility for his grandma dying. Of course she had to be sick and not knowing if she would survive before she killed Travis. To me she just called Samantha and Steven a liar smh.
    She reminded us she never meant to sling mud on Travis…
    Or expose the dark side of their relationship. Then,
    She threw Travis under the bus. Again.
    She painted herself as gifted, special – with so much to give.
    Locks of love…
    She talked about what losses she will suffer for the rest of her life.
    It was and always will be about her. Btw, I have seen more emotion expressed
    by lecturers at forensic seminars as they discuss particular homicides. Really.
    Did anyone hear her say she was sorry or that Travis never deserved this slaughter?
  33. Rose says:
    due to family obligations, I was in & out of The 19 Minutes. Came in just before her prison recycling program & had to be inattentive. However I heard enough to suggest, as a lay person, her not dual dx, but quadruple dx–
    PD-NOS
    Bipolar or Schizoaffective
    History Substance abuse
    but today qualities of Aspergers shone through.
    IIRC correctly I suggested during Dr D’s testimony it was suspicious she inly talked about the wais verbal scale & there had to be a statistically significant disparity with a much lower performance scale & uneven subtests. imo that’s the only reason she skipped it — verbal was significantly higher than full scale. Such testing predicted cognitive deficits seen in Aspergers or similar brain profile.
  34. Rose says:
    One of the worst of Willmot’s performance failures was lack of knowledge base fo question Dr D about wais subtests & performance scale and the implications
  35. Jane says:
    She made me sick-er. I’d hate to be sitting in that court room. I’d want to reach out and grab Jodi. I hope the jurors don’t fall for her pleas for LWOP. All I continue to see/hear are those graphic crime scene photos and the statements from Travis’s brother and sister. Gross…she wants to teach classes, implement a recycling program, book club and continue giving hair to LOL. A survivor of domestic abuse – no way. Then a slideshow of Jodi’s Life. Does anyone care. This is about Travis.
  36. jr says:
    I was actually impressed with Jodi’s “presentation” and seeming ability to focus on what her actions have cost OTHERS, she even made a good case for how someone like her could possibly benefit anyone spending the rest of her life in prison…until she pulled out the domestic violence t-shirt (HUGE MISTAKE) and then went on and on with the reprise tour of HER life.
    Unfortunately its been so long since Samantha and Steven spoke to the jury – hopefully not enough to compromise their impact.
  42. Twitch says:
    I have come to the conclusion that JA truly deserves the DP for 2 reasons:
    1.) The manner in which she killed Travis….the heinous slaughtering.
    2.) She does NOT deserve the ability to have any form of a social life, in prison or out. She forfeited that right when she crossed Mesa city limits on June 4th.
    JA is the type of person who will continue to manipulate and I don’t feel comfortable with the thought of her manipulating her fellow inmates to do her bidding and dirty work forthe rest of her natural life. Total and complete solitude from the outside world until death will be the ultimate price and worst form of punishment she can be handed. It is the equivalent of total banishment for which her crime deserves.
    May this jury have the strength to carry out what they signed on for.
Did she then contract and hire people to buy material and manufacture the t shirts? Did she set up an on line site to sell them and ship the t shirts? Did she then send the 100 percent of the profits to the ( nameless ) charity? is there full financial accreditation and transparency in this project?
  49. Twitch says:
  50. Rose says:
    @hervness, whatever POS means, I’ll endorse!
    @erose, no idea. A neuopsychologist once mentioned
    both anxiety & low self esteem can be byproducts of a number
    of mental disorders as folks like Jodi try to process the world
    & constantly get negative blowback they don’t understand. My
    point is that was the statement of someone whose brain function
    was like an adult aspergers’ & I bet there was data supporting that
    from her wais. I don’t think nurmi/willmott knew enough to hire the
    Imo the “survivor” tshirt finished her off, but an
    aspergers-like MO would never get that.
