Kyron Horman Missing: New Years Eve Settlement Ends Horman Marriage

Portland, OR- In a surprise court hearing,  Judge Henry Kantor signed off on the agreement between Kaine Horman and Terri Moulton Horman to end their marriage this afternoon.

Details of the agreement have not been released publicly, but according to KGW,  a financial settlement to include child support and a lump payment to Terri Horman has been reached.

In what can only be described as a bitter family court feud-  the divorce matter was last in court on December 16th to decide if the Horman landscaper,  Rodolfo Sanchez Estrada -who alleges Terri Horman tried to hire him to murder Kaine Horman at a lunch meeting – would testify.

Judge Kantor has not yet filed an order from that hearing but Attorneys for Terri Horman were granted a continuance from the pending temporary custody motion scheduled for December 19th and 20th.

Sorry, I ramble on, old age of frontal lobes, prior Blink’s answer re Door 1 or 2.
So, imo the Door 1 (Lone Wolf, driven), options:
    1) he drove by Skyline and saw the SF sign,
or was a weekly rental space team member (ie that gay basketball league)
& sawSF sign, then he did online research, ie rooms & layout, maybe
previsited, & went for it, no specific kid in mind. Imo this crime was more precise, planful & intimate.
    or
    2) a Skyline contractor, sub, or bidder visiting or working in
the school, or an adjunct employee ie day care who knew the bldg
    and maybe knew some kids, who targeted him based on a casual sighting, or it was random;
    3) a highly planful predator to the nth, familiar with school & neighborhood. well planned.
in tbis group ate at least 2 options: within the plan he went for an age/look.
or he was previously exposed to Kyron and his lust goal was specifically for Kyron, the target.
While both options make sense, I lean to targeting.

if targeting, the question is, how did Kyron come
to SZ’s attention, motivating SZ to take a great risk
    and to plan very carefully?

    choices:
in the school setting (ie a Subcontractor),
or through a community organization (soccer)
    or event (bowling),
    or a family member ( to include T, K, J,D,T),
    or a neighbor.

Of these, exposure by either fulltime caregiver makes
    the most sense.

Between them, was Terri or Kaine most likely to have an
aggressive sexual deviant in their circle of acquaintances?

Blink, I know you think Kyron met his passing early on… but my most palpable theory is that we will see another young boy go missing in the next year, a replacement for the 7 year old who is now hitting puberty and is not the desired hostage… like Hornbeck. And like that case, there is no evidence of the abduction, and even tho Shawn had contacted his parents missing child website, LE didn’t have a clue… we don’t know if Kyron has reached out either… or if he may have accepted his fate, like Shawn did… I guess I am just not ready to accept that he has passed – simply because there should be SOME trace of it… bodies have ways of getting themselves found. I don’t think LE will ever find Kyron – it will take Kyron ‘finding himself’ or an alert citizen looking for a ‘Quinn lookalike’ that finds him.

I can’t imagine the mess he has to look forward to by ‘coming home’.

I just have not given up hope. And am still focused on Find Kyron First mentality.

The DA took it from there Are they just blaming one man for show Using people who call Terri just a egg donor And ask other dumb questions why the new year invite to join the fold with the Soldier saying she won’t hold a grudge as she understands we have been used by a sociopath and knows we are good people
Never does she admit the unknown man When asked recently she says it is some ones opinion she knows nothing about it
Question is there a unknown man or not
I get confused here Sometimes. Why can’t that be verified by some one in the sheriff office and end this Terri Dede stuff. Blink? Then if the Soldier gets in that fold. I won’t hold a grudge. LOL

    Thank you.
I wondered if you were still mostly
on Lone Wolf, sexually driven, given the steroids thing.

SZ might have sighted K and the other child at the bowling
alley the preceding Sunday, heard the SF talk, & done his research.

If targeted though, I suggest SZ was someone in either fulltime
caregiver’s circles of acquaintance. Perhaps he was a steroid
user and therefore more likely to take aggressive risks. maybe the
gym dealor DDS said was an “afternoon” attender, which suggests
flexibility about his appearances daily at a job. Maybe his final trigger was
Kaine’s early mornong trip to the gym to deal with the steroids issue, so
SZ then went straight to the school.

  7. Rose says:

One SZ scenario is SZ is the afternoon gym drug dealor, who is not accountable to show up at an 8-5 job. He could be a steroid-using LE on evening – nite patrol, therefore free also to meet K for business at the gym at 4-5 am on June 4 after those arrests. The mtg time suggests K was summoned. Might know the school – surrounding roads & territory – layout from his job. Angry at K for Terri’s role in reporting him, he goes on to the school. Steroids have heightened his aggression and risktaking, but as LE in the neighborhood, or a fireman on evening shift, he has the personal skills to pass in the school & persuade thru demeanor in Mathews’ room.

I don’t see how kiara’s afterschool plan can be squared unless Kaine is responsible for daycare until 6 pm somewhere. Then there’s the issue of what happens when he travels. If in loco parentis works until 6 and leaves 8th grader alone, she’ll leave k too including for quick weekend errands. The concern to me will be that 55 lb one year old dog, as any dog can flip to dominance with a little person. And the person Kaine does his target practice for.

Bunch needed to ask the Court to require a documented caregiving plan after school and for when he travels. Personally, I felt Bunch was a pushover. New mommie’s engaging in work until 6 in the last year, new 8th grade sister’s newly diagnosed continuous grand mal seizures and the doctor’s proscriptions re “left alone,” and new 55 lb dog as afterschool caregiver are material changes of circumstances meriting a new hearing on physical custody (where K’s travel frequency is factored in).
from the fundraising site of in loco parentis new mommie:
“While we were at OHSU for the most recent EEG, her team of doctor’s stated that she has enough seizure activity daily that she should never be left unattended. ……I explained to her doctor that having her attended at all times is an impossible task, as I am a single parent and I work until 6pm at night. She will be alone after school until I get home from work. This is when her doctor brought up the possibility of a service dog. They all thought it would be a great idea as it would give xxxx that independence back.”

If Kaine’s afternoon gym dealor had his supply cut off by the arrests, it not only cut his income, if addicted he’d be rageful and frantic if meeting with K at 4 am.
It seems Beaverton folks went to a Ballys on NW Cornell Rd in Hillsboro: http://blog.oregonlive.com/complaintdesk/2011/12/switch_from_bally_to_la_fitnes.html

While some OR Bally’s became LA Fitness, Gold’s Gym, on Briede’s resume, became Bally’s too, and earlier:
“In the Oregon attorney general’s complaint database, which goes back to 2008, L.A. Fitness, which had six local gyms before the purchase, has collected 27 complaints, and Bally Total Fitness, which had operated 10 gyms locally, had 71. Competitors 24 Hour Fitness, which has 14 gyms in the Portland area, has 28 complaints and Gold’s Gym, which operates two locations in Lane County, has 43. Complaints typically center on claims of misleading offers, inaccurately calculated bills or failure to fulfill contracts.
In 2000, the Department of Justice cracked down on a number of gym operators it said were not following consumer laws regarding contracts, including
**Gold’s Gym and Nautilus Plus of Oregon Inc., which did business as Gold’s Gym of Beaverton and later, Bally Total Fitness.•••
The investigation was triggered after complaints continued to surface in 2000 about 24 Hour Fitness, which had reached two separate settlement agreements with the state concerning contract issues in December 1998 and in September 1999.” http://blog.oregonlive.com/complaintdesk/2011/12/switch_from_bally_to_la_fitnes.html

Was he physically in jail until arraignment? If hecwas booked & posted bail, maybe he got out of that process at 3 am or so, met Kaine, and went on to school.
He was Traverso’s supplier & had spent 30 days previously for supplying Deason. So he was looking at a lot more time for selling to others. Maybe Terri recognized his name in the paper from 2008 as a check name and chimed in to detectives in Canby.

    From your link:
“We had two odd sightings of a vehicle on our road Friday,” Kelley said. Around 3 p.m., he and a neighbor reported seeing a white pick-up truck with a female driver pull to the end of the long road, idle and then turn around. Then again at 2 a.m. Saturday morning, a similar white pickup truck appeared, idled and when a neighbor loosed her dogs, eased away.

“A, it was strange to have a car there, any car there, that we didn’t know, and B, it was strange to have a vehicle come down our dead-end road twice in the same day, hours after a little boy goes missing,” said Kelley. “That’s beyond rare.”

    http://www.oregonlive.com/portland/index.ssf/2010/06/day_three_search_continues_hun.html

JK lived near the Holms family. IIRC, he is a hypnotist. I don’t know any more about him and I do recall wondering if he was any relation to the notorious Ned Kelly, but never found a connection.

To this day, I wonder whether or not his (and alleged neighbor’s) sighting of a white pick up had anything at all to do with Kyron’s disappearance. I don’t think anyone knows for sure, including LE.

The earlier timing was interesting to me, because that’s about the time some staff would probably have been leaving school that day (for instance, kitchen help), and the talent show also ended at 2:45. I always wondered if whomever abducted Kyron, earlier that morning, could perhaps have had something to do with the talent show (sound tech maybe, or another child’s parent/relative bringing something in for his/her child to assist in the talent show program)? Maybe Kyron went to help them and accidentally got fatally injured, (some have thought, perhaps run-over by a vehicle, but since there was no blood found, or even a scent thereof, I’d lean more to electrical shock) and a panicked perp puts his body into truck covered with whatever, trying to act normally until after talent show ends @ 2:45 and then drives around trying to find a place to dispose of him, thus a sighting at 3:00 by JK and his neighbor. But I’m not exactly sure where the talent show was even held? Cafeteria? If it was there, and it is a separate place from the gym, then, most likely at the time Kyron was asked to help, (9ish) there may not have been anyone in there.

IDK, far-fetched and far-reaching, but it was a thought I had once.

I absolutely agree from what I’ve seen so far. Wondering, do you think even a smidgen of that result is intentional? If so, who (from a cast of characters including DY, TY, Kaine, posters, followers, those who feed info, those who withhold info) gets a benefit from that, and why? It has gone on so long it hardly seems accidental or unnoticeable – I suppose it could be entirely subconscious, but I just can’t see that being the case either.

I am not sure I would categorize my “opinion” as early in Kyron’s case- because if I did I don’t think it will be a respected response from BOC’rs. I think it is fair to say like many, my suspicions were focused on family exclusion early, the possibility that he simply wandered off, etc. I NEVER rely on instinct to form theory, in fact if I end up feeling pretty strongly in a specific direction that is not widely supported by evidence- I take steps to disprove myself to keep balance. At the end of the day my training and education since June 2010 has only served to form my working opinion.

The exclusion is always the rule, but I have presented Kyron’s case to include verified facts and some non-public intel to professionals who have worked in a related investigative area their entire careers- upwards of 15x in the last 4 years. I have to believe having done so, and the reaction, that MCSO has never done same.

wrt “you think even a smidgen of that result is intentional?”
No. I think in the case of bio mom there are human frailties that are not out of the ordinary, but character features that may be; and in the case of custodial bio dad, which dictated greater care and responsibility, some sort of character failings that left kyron vulnerable and unprotected, if not a target. And, in loco parentis mom had too much on her plate to cover it all.

(OT disclaimer, awake, qualing the night before a 10 hr drive with a predicted

What was intentional in June – Aug 2010?

First, Kaine – intentionally – left with their child, filed for divorce, and took out an RO..
Second, Underhill in mid August, standing beside O’Donnell, effectively accused

Looks to me like enough to remove any prosecution from this County’s DA to another County.
    ————–
Since Multomah county is a very liberal county and not likely to to be as prejudiced about Terri’s sex life and multiple marriages I would think Mutnomah county would be Houze’s first choice for a trial most of the rest of Oregon would be conservative and not likely to see Terri’s lifestyle as OK.

i also think that the conservative parts of Oregon would have way more sympathy for Desiree. I believe that all of this jury poisoning talk is an attempt by the prosecution to get the trial moved to a more conservative county in Oregon ( and is not working). You can also be sure that in a jury selection Houze will have a list of the HC posters who reside in Multnomah Oregon and they would not be allowed on any jury in a a trial of Terri. In fact if after the verdict someone was found to be one of those posters a mistrial would probably be the result.

So i don’t see Houze ( if this ever came too trial) wanting to move the trial to another county other then Multnomah.

I think a lot also about SZ or the unknown man what we hear is often these men are the last people anyone would suspect So that rules out drugs or harden known no good types Often some one close to family or family member. That interests me First look at Terri she was not the last person anyone would suspect she isn’t even all that like able. A only child who has had parents dote on her and help out into adult years She is educated
But not a lot of common sense In personal relationships So with no real motive Forget her. Dede a good hearted
Care taker type no real motive Not real close friends with Terri Forget her
That leaves a sick minded male family, friend or a family member or a stranger just passing by thinking the SF with kids would be interesting cause he likes kids a lot And maybe they have coffee and cookies And a kid who needs a friend a kid all alone No family watching

Why was he alone No bio family could arrange to drive up on the 3rd and spend the day on the 4th with him and
drive him back to Medford to visit mom. Not retired grandparents Rich and Kathy not Aunt Kelly No one
In a lot of families that would be done with out question Step mom had a fussy baby Lets go show Kyron we care and give Terri a break take Kyron out to eat and show him a fun day No one
I find this unbelievable in a big family Even Tony should have tried to be there They all claim to love Kyron so much now So fast to blame Terri Why because she left early, and Kyron was alone.

Who sees more cases and trust her to study all she can to be credible LE is not in a big hurry to give out info
    Or ask for info anymore
I feel that the Soldier could have been a he– of a lot nicer in her treatment of The DA But I have done some research on her. She just doesn’t have what it takes Education or otherwise She may have heart or not
That is not up to me to say
The right person maybe could get the bio parents to go and request what is going on Maybe not
At any rate I personally disapprove of this kind of treatment of the DA

Malty- just want to point out, even the best investigator can be wrong and I think in Kyron’s case I could not wish any harder that I am.

o/t: I can remember way back when.. I remember exactly on what stretch of 287 I was on when I heard that announcement.. Elizabeth Smart was recovered safely. I had a very small circle of true crime interested pals then and no training, but all will tell you I am the one person We knew that was adamant she was abducted relative to an insider and her faith and therefore alive. Let me be clear. I think hope and love plays the role it is supposed to and I do not want my personal opinion (however framed it is) to take that away from those who may disagree. To me, this new mission of Desiree’s and WS Admin is the best evidence Desiree’s briefing from mcso consisted of: “We have made a prosecutable case against Terri, but this DA won’t arrest and try her.” Tony, as he’s said, is fine with trials for murder which lack forensic evidence and have exculpatory evidence, so I expect he’s a corroborating voice to mcso in Desiree’s ear. What that means about mcso is the agency is not investigating with an eye to finding SZ and thus Kyron. As DY said they are “reinterviewing” and getting scads of new info (that suggests “leading” interviews imo). That’s gone on per Desiree for almost a year. So, what’s lone detective on the hamster wheel going to earn his pension with in 2016? Imo he wants, and mcso wants, the DA to arrest and try Terri already.
The only hope is Staton files for that Gresham Commissioner’s seat, and Wheeler & Underhill get a word in on the next appointed Sheriff who ought to be an outsider.

Here’s something I don’t understand. If, DY and cohorts are knowingly disseminating false information in regard to Kyron’s disappearance, then where is Kaine Horman on this issue? Why is he silent?

Why would the father of a missing child, knowingly let ANYONE try to mislead the public about the disappearance of his son? How on earth could such action be beneficial and productive to finding Kyron? Unless I was told specifically by LE to let this (DY&KR’s statements and actions) just “play out”, I’d be making my own statement to correct any false information that was being spread by whomever, particularly if it was being spread by someone I personally knew, like my ex, my child’s other parent.

If the statements DY are making are knowingly false, how on earth does LE think this will lead to productivity in this case as well?

I just don’t get it. If real tips are wanted in this case, then they can’t expect people to come forward if whatever information they may have is contradicting information one of the spouses are providing the public. Most people would simply assume that DY is giving out facts, since she is Kyron’s mother and would, I think, hesitate to offer any conflicting information that may be out there.

    Sad.

Another thought that old retired investigator who gets calls and tips from from all over may be like a lot of old retirees
All worn out and not up to full time work anymore Like me
    ———————————————–

@Malty – don’t sell yourself short. Don’t you feel, at least sometimes, like BOC is a fulltime effort? :)

  38. Rose says:

@TRuth. Imo DY and followers repeated avowals of guilt of Terri & DDS
and pressure tactics to promote that pov and ensure a prosecution, benefit Kaine more
than anyone or thing else in the universe. Vital to his preventing mother’s visitation. Imo
he likely figuratively prays nightly for charges resukting in trial, even with buckets of reasonable doubt and a
pretty sure not guilty verdict, because an arrest would ensure no mother visitation would be
possible til the trial’s conclusion in a couple years. Imo, he buys time.

  39. Rose says:

@cd. you point out a motivation for Desiree/Admin filling DA’s site with
such comments about Terri–perhaps laying the groundwork
to get trial moved to a more favorable, conservative venue like Lane Cty.

    you’re right, not Houze’ preference.

  40. Rose says:

What Malty you have is the capacity to empathize, deeply.
You put yourself in Kyron’s shoes at 8:45 with mom 1 leaving to find otc for kiara.
It’s been sleepless nites due fo her noises, and dad was wierdly out at 4 am. Other kids have relatives there. One suspects he felt lonely, so he chose to go downstairs alone. I suspect this was his lot, the pattern, since birth. Neither parent seems reliable from a little one’s eyes.

You are right, Malty, someone in the large Davidson family group should have been there, end of school, especially because he had to drive South, & right after school was best. If I were the family planner, the school would have excused him at 10 am, or after the talent show, to jump start the drive. On e I had a father daughter event where I was to get an award, probably middle school. (no father at hand) My mother ate humble pie and asked an uncle (who lorded it over his 3 sisters & was none too pleasant — or maybe it was his wife in mink wasn’t pleasant to we poor relations she was ashamed of) to come across the State, and he did. That sort of family behavior even when one os not close is what Kyron needed from birth from the Davidsons.

    ————–
Except you can’t try someone for murder unless you at least have someone that is believed to be dead.

Kaine does not think Kyron is deceased.
MCSO has said that they do not know that Kyron is deceased.
So there is no officially dead person to base a murder charge on let alone have a trial.

    IMO
There is no blood, no clothing (that I have ever heard of), no evidence that Kyron was harmed in any way. They can’t even prove if Kyron was murdered, wandered away and fell down a hole, was kidnapped or beamed up by aliens let alone who was responsible.

I think that Harassing the DA and trying to get him to arrest Terri is just plain stupid. They need to get MCSO to release some of their information about the case. Maybe it would trigger someones memory who saw or heard something relevant to Kyrons case and doesn’t know they did (although that happening is more doubtful as time goes on).

MCSO really needs to do more investigating in this case or no one will ever be charged with a crime against Kyron and we will never know what really happened to him. IMO It may already be to late.

    JMO
In the Caylee Anthony case they had the poor babies bones which they found in a garbage sack. So even if they did not know how Caylee died they knew she was deceased. They just could not determine the cause of death and there was not enough evidence to trace her death back to her Mom (whom I thought and still think was guilty of manslaughter at the very least).

    JMO
In the Ramsey case they had JonBenét body and DNA evidence and they still have never found the person who took JonBenét’s life. I think if LE in Colorado would have released some of the evidence that pointed away from JonBenét’s parents early in the case they may have gotten more leads. By the time LE in Colorado shared more of what they knew (that pointed to Patsy was not responsible) it was to late.

    Sounds hauntingly familiar to me

  42. Rose says:

imo Tony and many mcso employees would not think a body necessary but believe a circumstantial case would work
when it is righteously made. .

I suspect the advocacy de jour by Admin and defacto mcso & Desiree is to try her for a felony, child abduction, and plea bargain with estimable Houze to learn where kyron is to give the family closure and garner evudence against the
the more culpable & assured murdered, SZ.

  43. Malty says:

@CD it does seem like no evidence means tread water until the case fades away with years I only watched and read the Anthony case at the first then at the last of the trial. I thought the whole family acted like they had a hand in that baby’s fate The lies seemed to come from them all IMO poor little child So sweet looking

I don’t like what has happened to Terri and Dede But if evidence ever shows they did something to Kyron I will be the first to change sides As it is right now I agree no one knows if any thing happened He just isn’t here
Another sweet child just gone I still think the school has an answer some place Someone one knows
    IMO

  44. Malty says:

There is so much crime in Portland Every day I don’t know how anyone gets justice But when dealing with the DA or. MSCO j I think it takes a respectful attitude toward their jobs No matter what you think of the person holding the job Same with our President When they are no longer holding the job the you can call them names as a person This I believe.

  45. erose says:

After reviewing the August 2010 press conference, I’m starting to think Underhill and MCSO are in lock step, but Underhill can’t or won’t make a move without the support of a grand jury and that’s why team DY is upset. He is probably telling them he needs more evidence (hence their searches) because he can’t go back to the GJ without something new.

I think he needs any evidence, any evidence a crime has even occurred. I do believe for sure there certainly is a crime victim in Kyron’s case, but as a technicality absence of any evidence pursuant to a crime is not evidence of one under the law.

Not only was Kyron alone, but he must have been disappointed that his mother was supposed to come up, but then cancelled.
