Caylee/Casey Anthony Case: All Rise- Judge Perry Takes The Stand

Orlando, FL– This morning, The Honorable Chief Judge Belvin Perry, Jr, has his first hearing presiding over the case against Casey Anthony.

At 9:30am, Jose Baez, J. Cheney Mason and team will appear with the prosecution led by Linda Drane Burdick and Jeff Ashton for a case management meeting called by Judge Perry.

In the week since the scheduling of this hearing by his Honor, the prosecution has released an additional 300 pages of discovery and filed a motion of supplemental discovery.

Camp Casey has resubmitted correctly filed motions already heard by the court under Judge Strickland, notified the court of impending vacations, filed a motion to withdraw an attorney no longer licensed to practice law, and filed a motion to seal the visitor logs of the Orange County jail.

Casey Anthony is serving time in the OC jail for her convictions in the economic charges, and while she awaits trial for the murder of her 34 month old daughter, Caylee Marie.

    I’m still stunned that Casey won’t look in her parents direction. I feel that shows more than anything else, what the defense is going to use.
    It’s a shame, cause I think now they will just let the bus roll right over them, and further ruin their lives. Just to save a child who will never appreciate their sacrifice, or admit to her responsibility in the death of her daughter. It will ruin Lee also, if he allows Casey’s drivel to drive the bus over him. Poor Mallory, what can she be thinking?
    Anyone Casey has ever touched with her life it worse for the wear, and tarnished.

    I have not found a clip that shows Casey AS Cindy makes this gesture. I’m not sure if Casey saw her or not. It would not shock me AT ALL if Cindy did this JUST for the camera. IMO.

    ArtGal, yeah. But there was a couple of good points by Bill Shaeffer on today’s court hearing, he noted that Judge Strickland was working on a full case load, the Anthony case, just one of them added to what he had when it was a child neglect case, lying to police.

    Chief Judge Perry has not got a full case load, he has his administrative duties but no other cases being juggled on his plate.

    wow what a difference a judge can make
    kc primped just a little in the beginning, but was stock still the majority of the time, no fake crying, no tissues, no squirming, reachcing for the microphone, nothing . . . cm & baez obviously discussed Judge Perry’s rules with her!
    cm said nothing, yup, nothing, can anyone believe it??? He had such a boisterous loud personality last time we saw him, what a difference!baez had a few moments where I was like, how can anyone take him seriously, with his sideways smile, and his big gaffaw laugh when Judge Perry excused Linda DB’s jury duty! how does this guy behave at funerals?
    Ah and ca, in her nice pressed new dress, so sullen and serious

    now this is how i always pervcieved a courtroom to be.

    i was wondering as well why is Conway there, and is he being paid? does he really need to be there? I would think they could pay their mortgage instead of paying Conway to be there when he’s really not needed.

    I’m starting to think I might need a break from this, I’ve never ever felt the need to punch someone as much as I wanted to punch miss anthony today and ruin my tv.

    I heard it! As I was watching the hearing this morning on television and thinking to me how appropriate, this case, the train is back on track. There are train tracks not to far from the courthouse it was the 10 AM train that runs through Orlando.

    I like the new Judge. Wow, it’s such a different courtroom.

    I read this interesting tidbit today regarding the chloroform in the trunk of her car-

    “That method of air-particle analysis has never before been used in court, and Baez said Friday he’ll challenge its scientific validity at a pre-trial hearing.”

    Hmmm, does it meet the Frye standard? If this isn’t allowed in what will that mean for the states she-knocked-her-out-with-chloroform theory?

    I think the Judge will have no choice but to sequester the jury–I wonder if he’ll take their cell phones? Remember the case not too long ago(in Florida) that the Judge had to declare a mistrial b/c jurors used their cell phones to either discuss the case or receive information regarding the case. And it wasn’t just one or two jurors-if I’m remembering correctly it was SIX jurors.

    Blink, I bet you are happy to hear Baez using Sir and not so much “Judge”- Much more respect given to Judge Perry.

    I felt as if Judge Perry was the teacher coming back after a long absence, and giving extra Homework because of the way the class behaved with the seasoned hardworking well-intentioned substitute.

    Judge Strickland is an excellent judge, but some people demand respect with out even having to say a word. This is obviously true with Judge Perry.

    I consider today the first day in the final chapter of justice for Caylee Marie.

    I think Cheney Mason is going to blow a 40 year career because he got trumped.

    I do not understand this kind of ego and never will.

    all who responded to my question about Casey turning to see her parents, thank you. Bam from Mississippi, I have a feel for the same. I think Cindy may have done that one for the camera too. She tries to put on such a show.. I really think Cindy is somewhat confused as to what Casey is up too. She wants to get KC’s attention to see what kind of reaction will come out. I don’t think she turned around either. Cindy blurted out those words maybe because of a gesture Casey made as if she was going to turn around.

    I heard today on True TV someone say that the defense does not want to have any part of the decision with the jury being sequestered because they don’t want to start off on the jury’s bad side. They would rather the judge be the decision maker. That is maybe the reason for Jose studering.

    If this girl does not plea after a day like today then I do not think she ever will. I just love this judge. Just think where this case would be if we would have had him from the start. It is like we graduated from High School and off to College with him and by the end of this trial we will all have some degrees don’t ya’ll think.

    Perhaps Casey can’t summon up the will to look at her parents. She accused her father and brother of sexual abuse. Also, enough time has passed without real communication between Casey and her parents. She’s had enough time to close herself off from friends and family. Her new family is her defense team. They tell her what she wants to hear.

    Cindy and George are now having to face emotions that have been repressed and ignored since Caylee’s death. JP made it so today. They never properly grieved or mourned for Caylee. Feelings do not go away. They manifest themselves into fear, anger, hate, depression, disease….etc. I believe Cindy et all have bought into the lies because they were comforting. They’ve never been accountable. They’ve freely placed blame on everyone except themselves. No more delays. It’s time to move forward. Stalling tactics are frozen.

    Today’s session was a complete reality check for Cindy and George. As for Casey, she’s in her own little world where she’s always going to be the princess. She won’t plea because she’s the victim. The truth eludes Casey. She creates it as it suits her purpose. She doesn’t know consequences nor has she had to deal with them. Why would she now????? Jail time is a mere interruption in the life she embraced for 31 days. If we take her jail letters literally, her aspirations of a free life are not just fantasy. Casey believes she will walk out of prison and continue where she left off.

    How a mother of a beautiful little girl can sit stoically with words like decomposing, remains and duct tape being tossed about without so much as a REAL tear is mortifying to me.

    A life behind bars won’t change her. She’ll adapt to prison and roll with it. I do not believe for a na no second Casey will ever be haunted by the images of Caylee as she expired before her eyes. She is completely disconnected from that time in her life now. It’s like Caylee never existed.

    I am hoping for the death penalty, God forgive me. She deserves to look into the eyes of death and panic and fight for her last breath precisely as Caylee had.

    Blink, truer words were never spoken. It was on Mason’s face. He didn’t have his cocky, arrogant foghorn leghorn face on today. He’s stuck and he knows it. Perhaps we’ll be seeing less of an ego and more desperation to fight for that 40 year reputation. :D

That’s their real objection to it.

    First comment. Seems like the 2 big buffoon moves were Cheany’s idea. #1: Get a new judge #2: write a scathing motion about Judge Stricktland. Chaney is a big stick stiring up a pot of trouble. His sneaky plan was an “epic fail”.He has only to blame but himself. He is not shooting his mouth off now, actually I asw him slink away with his tails behind his legs.he mananges to get rid of a judge and now in his place is a no nonsece judge, then wright an inapproproiate mmoition that severs no papers. except he might get his wrist slapped and hopefullu a heafy fine for the disrepect he showd the court system. Chaney is no knight in shinney armor for them, just the opposite , he mucked up the case very badly today. I dont think casey is that smart to run her oun trial, I think the lawyers tell her how it’s going to be. Will a goverening body place sanctions or illegal conduct penalities on them.     Thank you for bringing to the courtroom exactly what was lacking in the form of organization and decorum. Today’s proceedings actually reflected the seriousness of this crime.
    I think there will be “no nonsense” in his court.
    Did anyone else notice how the back of his chair was shaking? He didn’t appear to be the least bit nervous so what was that about?

    George looked somewhat despondent, not connected to what was going on at some level. In the past hearing when he sat in camera line behind the defense, his face was making gestures and cabobbles and contortions– maybe he was just holding it in today to respect Judge Perry’s rules.

    Say, Blink– do you think that this new defense position as it seems they want to portray, that this is the judge they wanted, are happy, etc, was what they told Casey when the new judge was announced? Or do you think they laid it on the line for her about their feelings about this judge for her case. Maybe they’ve told her this is great, we love the result of our motion?

    Casey is in for a rude awakening if her lawyers are keeping things from her about what Judge Perry will mean for her.

    The last page of Mason’s Objection to JS Order on Defendents Motion to Disqualify Trial Judge is an Affidavit from K Diana Marku. She states that she hand delivered the motion to JS Chambers etc. on April 16, 2010 and it is notorized by Mason. Is it normal procedure to have the person/persons that deliver motions complete a notorized affidavit? It was notorized on April 16, 2010.

    If it is confirmation of service, than yes.

    I don’t know if I liked the way that Judge Perry came into court today and gave off this *new sheriff in town* persona and wanting to have hearings *like yesterday* I think if anything this new judge needs to slow it down and come up to speed on all of the discovery so far in this case and even discovery that he does not yet know of before he starts making outrageous statements like *I would like to make it sooner* concerning Casey’s May 9, 2011 trial date. if anythng, it should start later in 2011 than May 9th or even pushed to early 2012 not moved earlier for pete’s sake! I almost lost my lunch when he said that. Also concerning the junk science *air test*, even Attorney Bill Sheaffer from wftv stated himself today, *again that type of evidence HAS NEVER BEEN evidence entered into ANY CRIMINAL PROCEEDING, in the whole country, much less florida* I would think that any air tests or any other forensic tests fromt he Oak Haven Lab will not be allowed to debut in a high profile capital murder case, where the death penalty is being sought by the state. that one is a no-brainer if you ask me.
    I think if this judge admits into evidence any supposed forensic tests from the Oak Haven Lab, in Tennessee, at all or tries to move Casey’s trial sooner, (rather than later) than its current May 9, 2011 trial date then he’s going to muscle his way into a verdict and possible death sentence being overturned on appeal and delaying *Caylee’s justice* even further for another 2 to 3 years. I think his honor needs to be warned to put the brakes on Judge Perry, not slam your foot on the gas.

    Item #3: “Counsel shall provide courtesy copies of all future Motions to the Court.”

    Did Mr. Mason provide a courtesy copy his Objection to Court’s “Order on Defendant’s Motion to Disqualify Trial Judge”?

    I think we all noticed that Mr. Mason fired in his “Motion” at 8:27 am, barely one hour before yesterdays hearing.

    During the hearing Chief Justice Perry asked the defense, multiple times, which motions were “ripe to be heard.” Did Baez and Mason, in their brief whispered conference, choose to NOT refer to the above motion for a reason? (Like they were hoping that Chief Justice Perry maybe hadn’t received his copy yet?)

    Yet, within an hour or so after the hearing, the media has a copy of defense’s freshly filed motion.

    Did Mr. Mason mistake the fax number for the Chief Justice with their media contact and “oop’s, sorry man, my legal secretary accidentally sent the motion to the media!” ?

    I am so hoping that at next weeks hearing the train we heard during the proceedings, hit’s the defense full force!

    I am with you and wondering if he did not repeat the “all pending motions question” to snag Cheney Mason.
    Being underhanded with Judge Perry is a bad idea.

It seems to me they want Judge Strickland to say “so sorry” but would a motion normally be filed for an apology? I am so confused. Would someone who is in the know please fill me in on what the purpose of this motion is. The only thing I can figure is it is just one more platform the defense is using as a place to whine.

    Regarding the air samples….Let us NOT forget that we have 2 people who said they smelled decompostion. These two people are trained and have worked in such areas where they know the smell. How will they explain this away from CA and GA and oh yes,,,,Lee made a comment about the foul smell. One said it smelled like something died and the other said the know the smell of decomp. and has smelled it before

    I agree with you about the cell phone issue with Jose and Casey. I wouldn’t think that would be allowed in a courtroom and especially with a murder defendent! But while it was happening I thought that Casey was probably so hot to grab that phone right out of his hand and start texting and dialing for dollars. She had to use every bit of self-control. Poor thing … she hasn’t been able to make a call or send a text in a very long time.

    Re Cindy’s “I love you” at the end… It looked to me like at the end of the hearing, when everyone was standing up to leave, Jose asked Casey if she wanted to turn around and see her folks and she said “no”. That’s what it looked like to me.

    Another thing I found very amusing during the hearing was when they were talking about a specific subject (of course I can’t remember now what it was!) and they were going to have to schedule a new hearing date. Judge P says something like “how about next week” and I thought Jose was going to keel over. Judge S usually gave them a month or so to come back with their stuff in order. Not so for Judge P! Love that!

    It’s just ironic that the A team never really gets it. It’s all about respect when we consider civilized living. That’s why we don’t allow our children to lie, cheat, or steal. We teach them to sit and stand up straight, pay attention, obey laws, respect authority.

    Cindy, who taught Casey to play fast and loose with the truth, coddled her thefts (she just did it one time, Jesse; I’ll pay you back, Mom), denied her pregnancy, and now, the murder of their grandchild

    Yes, I did notice that. I thought I might know what was causing the chair to shake, so I tested it out. I sat in my computer chair with my legs stretched out before me; very relaxed pose. I crossed my ankles, and was rhythmically shaking the foot that rested on top of the lower ankle. This did cause the top of my chair to shake in the same way Judge Perry’s chair did.
    Can anybody tell me who the woman sitting next to Cindy is? I think somebody referred to her as “Holly” but I don’t know who/what she is, such as personal friend, professional person, etc. ??

    Ragdoll, I completely agree with you about Casey’s life behind bars. She’d cope just fine. She often reminds me of Karla Holmolka who used her time in prison to educate herself and took advantage of all the classes that were available to the inmates. Well, you’ve likely heard it all before.

    But Casey will NOT be doing light time, as Holmolka did. I think the best she’ll see is LWOP or, I am hoping she will get the Death Penalty. Up until now I’ve been your typical Canadian pacifist but Casey has caused me to reconsider it in this case and imo it’s the closest we’ll ever come at balancing the scales and hoping she feels as much terror as Caylee did. Had she ever shown us any amount of genuine remorse or guilt I might feel differently. I’m likely not as evolved as some watching this case but the only problem I have with the DP IN THIS CASE is the huge price tag it would come with, that’s a valid concern.

    Mason, who almost cartwheeled into court at his first appearance about a month ago, has done a complete turn-around, and what a pissy-face! Doesn’t he look totally miserable? You’d think he would have noticed that, without fail, every single person who has tried to defend or help toxic Casey becomes contaminated. He thought himself immune. Ha! One more career down the tubes! Although the circumstances were regrettable, Strickland may have been fortunate to get out when he did.

    Dee, I wonder who will give the victim impact statement? Good question. I hadn’t thought of that. How could it be one of the Anthony’s when they’ve been doing everything in their power to protect her murderer? Hmmmmm . . . .

    I feel that Casey on the day of the “Casey Death Day” (that day should be a Caylee Marie Memorial day) will be a disapointment for us. On that day she will not show one smidget of remorse. It will be just another day in her life. It will be a day that she shows not a bother. She will walk her walk to that chamber with the same cold calculated face that she always has on. Most likely having thoughts of the lunch she will miss that day. It is like someone said in a post earlier, if she can sit in that court room with talk about her baby girl falling apart at the seams, then folks ,this girl will have no pain on the day that her life comes to an end. On that day I will feel as if she gets what she deserves, but I really do not think I will have the satisfaction that she feels bad for what she did .

    If there’s no reputable family member to give the victim impact statement, then maybe Kathi Belich could do it. Or Blink, or any number of us that love Caylee. We’re living proof that the victim impacted all of our lives in a huge and unforgettable way. So odd that a stranger might even be considered. Imagine if the task fell to Lee and he gave us another impassioned rendition of CMA!!! CMA!!!! I imagine that’s the direction it would take if any one of the Anthonys did it.

    I held back suggesting anything, but there is a photo of the Anthony team, Tennis and Brad having a tete a tete (I’m not coffee’d up enough to try adding accents) in front of Cindy, as she views a phone message.

    Sneaky– they can’t turn and say hi before the judge comes in, but they can share a phone message with each other?? (as long as the other person holds the phone and they just ‘view’, it’s ok????)

    Baez was not reading a text message about his next case or Friday Joke of the Day or about bringing a quart of milk home with him after work. Cindy wouldn’t be reading idle chat from someone’s phone.

    Here’s a quick link to the call on video– it’s the first raw video up on wftv and is only up to the point where the judge enters and everyone is called to rise, at which point Baez puts the phone down on the table. (it’s a convenient link for this topic).

    Note the microphones are on and catch Baez speaking, and ‘might’ be audible if someone can play with it. Note also that Casey’s reaction is consistent with her past reactions of a tear wipe and cry and she says something. Client wouldn’t be communicating with the lawyer and lawyer with client, if the phone call was not family, either behind her, or from Lee as support maybe? with a cc to parents? I don’t know if it would be a good idea to have the calls entre-court for the simple fact of reactions of the participants (oops, Casey reacted/talked). Could have been a photo too, sent with the message– is that a G3 iPhone Baez has?? ;)

    Now, I know I saw the photos or video section of Cindy watching a phone screen, her friend beside her. Anyone else see them and got a link?

    Bees, yes, to the victim and an advocate to speak for the victim– the family could do it, they could be the ‘victims’ and say the state is making us the victim, making our whole family ‘victims’, and then depending on the defense used at trial, add how the real perp(s) have made everyone in their family victims, especially Caylee, but equally their daughter too.

    They will give Casey, equal status with Caylee once again, like Casey said from jail, that she and Caylee are the same little person.

    Caylee is the ONLY victim in this mess who should be ever mentioned in court– the rest have culpability for what happened in Caylee’s life, one for her death and suffering, the others adult caregivers who were being selfish about the child and wanting her for their own selfish reasons. George’s statement to LE stands out, that he had hoped to do it [raise their little girl] better the next time, have a second chance (I’m paraphrasing, it’s in the first interview IIRC).

    There’s no way to extricate them from the lies they were all living before Caylee was murdered. Don’t get me wrong, Casey alone is responsible for Caylee’s murder imo, but George & Cindy are responsible for letting their adult daughter live in a dangerous and fabricated world with their flesh & blood granddaughter. But not one of them will own up to the tiniest bit of responsibility. Maybe they will once the trial is over.

    This takes place in the same ‘pre-Judge enters courtroom’ moments as the Baez/Casey/tear wipe/words spoken/phone screen watching discretely, moments as in the wftv 3:11 minutes raw video linked previously.

    The photo of Cindy with 1. phone in her hand, and 2. looking at the phone screen as if reading.

    (note the lead up photos, which seem to be in chronological order for the pre-hearing minutes.)

    Photo No. 16 of 101 is the first photo.
    Taken as Brad sits with his back to the court/camera each other, George is standing, Cindy has phone in her left hand.

    Photo No. 21 of 101, Cindy is watching the phone, George sits forward in his seat, the male friend, seems to watch what Cindy is doing.

    So, were the phone messages family with Casey or just coincidence that Cindy was expecting a call by having her phone in hand and at the ready in photo 16 as they entered? And is it coincidence that Casey wipes a tear and talks to her Baez as Baez talks to her as he scrolls the phone screen?

    They have all the angles, don’t they, to chat with each other. Could they be doing this same technique from jail too? With photos and or video?

    On the phone use– it was Cindy who used the phone to likely send the outgoing message, Baez picked up a call coincidentally. Cindy entered the court with phone in hand, as if to use it. In the photo, those seated behind the Anthony’s were not yet in their seats, the male friend leans forward and seems to watch Cindy’s phone, the woman friend sits slightly forward, as does George. The couple effectively blocks any view of Cindy’s hands from the women in the far seats. George blocks the view from his side but not enough to stop the camera.

    Holly Bristow was seated behind the Anthony’s, we can see in the photo, she hasn’t taken her seat yet.

    This could be one of the perks of having no jail monitoring of attorney visits (video only) as it would show any calls between the attorney and Casey’s family being used for communications between family and Casey. They will likely renew this motion??

    It seems like Baez is scrolling awfully fast through whatever is on the phone screen – maybe pictures?

    Is the phone use not even addressed in courtroom decorum rules? Could be cell-phone use was not such an issue in 2003 when Perry’s set of rules were written down as we encountered them recently. However it seems like a no-brainer. I think something needs to be added to the list.

    Is it just me or does Baez seem like that unruly kid in first grade who would never sit in his seat, who sent spit-balls across the room whenever the teacher turned his back. His predictable love-fest w/ KC each time they appear in court,whether it involves phone or whispered comments or whatever just seems so inappropriate to me. That sinister smile on KC’s face even for a few second makes me feel ill.

    Have nothing but respect for the way Judge Perry conducted the court yesterday. His “cut to the chase” and should have “been done yesterday” type attitude was refreshing. I never got the feeling that he was trying to put on a personal show at all but wanted the case to proceed in a timely, organized manner. I know nothing about legal processes other than having been a juror several times, but I felt the cell phone deal and the whispering was disrespectful of the court. What in crap (excuse me) can Baez find so giggly all of the time….not becoming at all….even seemed like Cheney wished he would be quiet. Also thought Baez could have been more respectful in correcting Judge Perry about Andrea Lyon’s name. One can offer to clarify that mistake without giggling imo. I was amazed that Cindy and George were able to stay so contrite as the reporter followed them out….but much more time and I think Cindy would have burst at the seams. Btw, what about Lee….is he still supportive in light of Casey’s letters to Robin?
    I pray that the train (as we all heard) is going to go full steam ahead to justice for Caylee and may godspeed.
