Caylee/Casey Anthony Case: All Rise- Judge Perry Takes The Stand

Orlando, FL– This morning, The Honorable Chief Judge Belvin Perry, Jr, has his first hearing presiding over the case against Casey Anthony.

At 9:30am, Jose Baez, J. Cheney Mason and team will appear with the prosecution led by Linda Drane Burdick and Jeff Ashton for a case management meeting called by Judge Perry.

In the week since the scheduling of this hearing by his Honor, the prosecution has released an additional 300 pages of discovery and filed a motion of supplemental discovery.

Camp Casey has resubmitted correctly filed motions already heard by the court under Judge Strickland, notified the court of impending vacations, filed a motion to withdraw an attorney no longer licensed to practice law, and filed a motion to seal the visitor logs of the Orange County jail.

Casey Anthony is serving time in the OC jail for her convictions in the economic charges, and while she awaits trial for the murder of her 34 month old daughter, Caylee Marie.

    I think that the gag order is for when the judge tells the attorneys the location where the jurors will be pulled from….not an immediate order. That is disappointing!

    Rest in peace caylee. I see Justice ahead with this new judge he seems fair and will do what is right within the law. I seen baez more subdued not too much arrogance. But it does bother me that he is allowing her to read thru his blackberry phone. I see george more defeated as in session mentioned!

    I know I’ve said it before, but Casey’s smug smile, primping, fluffing and looking indifferent to the charges against her will not help her case.

    I can’t believe her behaviour….and has it been addressed by her defense? I’m not legal beagle but I would INSIST that my client show humility and respect. Obviously, by the smile on Bozo’s face, the ‘plea’ thing has not been discussed. I sense a trail will take place AND if it does, Casey could be considered the most bizarre case of personality disorder. No touch with reality, just living in the moment. That’s all she can perceive.

    Joan(Canada), no, but then I didn’t watch the pre-trial video and didn’t see the hearing live. However, take a look at WFTV’s slideshow from this morning, look at pic #10. Is that a sherriff seated behind George and Cindy instead of Holly Bristow or other press?

    Cindy is looking at something, or just looking down, can’t tell. But if she was using a phone to communicate with the accused, who is in the custody and care of the Orange County Jail, they might have been interested in observing. Unless that officer was in the courtroom on other official business, a witness perhaps.

    Last hearing, there was a phone incident too that I did not see, someone commented that during the time Baez and Mason were at the sidebar or otherwise away from the defense table, Baez left his phone on the table and it rang. Ms. Michelle Padilla (can’t see her listed as a FLA bar lawyer, maybe a para-legal or ?) apparently picked it off and shut it down.

    I wish the Judge would confiscate Baez’s blackberry to see if he is helpiong Casey communicate with her family against rules just like passing letters back and forth from the jail. It’s illegal and he should be charged.

    Well, if George lied that early in the case, it proves to me that the Anthonys knew Casey had done something awful. Ugh, why haven’t these people been arrested??? So what if they plead the 5th? If I was a juror, hearing the parents plead the 5th would be a red flag, for sure!

    I’ve believed this all along, Casey & Caylee never spent the night at the Anthony house on the evening of June 15th/early morning of June 16th. George never even saw sights of Caylee that morning. George made up that entire story because he knew, “deep in his heart” as he told the FBI agent, “Casey is going to be going away for a very long time.”

    And if people have their way “in the works” – George & Cindy will have charges filed against them as well. Casey first, then her liar ‘rents.
    Priorities, you know. Take them down one-by-one.

    Kleat, yes, I noticed that too. I was just over reading at websleuths and someone was saying that the new lawyer for the defense passed a note to one of the femals baliffs who put it in her pocket. There are pictures and you can see the other bailiff’s looking at her and his hands are saying “what the heck”. The first bailiff still had it in her pocked when the motion hearing was finished. Interesting read and comments.

    So, we will see Ms. Lyon without an ‘s’ in action tomorrow morning. Will she or will she not, use the previous media statement in her arguments to have the dp thrown out, that “she didn’t… uh… kill her kid.’

    Baez rants against the media and the circus that was the early days while Caylee was missing, yet he and the family encouraged and fed it. Baez also talked about the unfairness of things being taken out of context, or not taken in context. Then in today’s 2 minute collage of media imagery and audio, Baez juxtaposed clips to create his own context, not one clip after the other, but integrated with unrelated clips and visuals, again he’s hypocritical– an example was the scenes of the divers, people waiting to hear the results, and then switching to a clip of Tim Miller speaking in a tent to searchers to thank them for coming. As if the water search was his own– I may be corrected, but it seems that the search in Blanchard that drew so much attention, was Leonard Padilla and his divers. That little video/audio montage is now part of the permanent court records for this case. I wonder why Judge Perry did not shut that down for it’s drama, and advise Baez to make a set of clips, independent of each other for their individual content. Almost as if it was ok to create a little drama from existing clips.

    chica, I’m sure nothing gets past Judge Perry. That little ‘huddle’ the A’s and team pulled to cover Cindy using the phone, especially the male friend who attends with his wife– he was looking right down at the phone, now who does that when someone is making a private call. He may have known about the call and the plan to communicate with Casey right under Judge Perry’s glasses.

    Coincidence about the officer right behind G and C– when all those seats were empty.

    I am so sick and tired of Baez and the Anthonys behaving as if they are “above the law”. The passing of family letters via Baez and now the possible sneaky phone texting. It really makes me wonder what else has been going on behind the scenes that violates jail policy?? Emails? Skype? Video chat/conferencing? WTH???!! I really hopes this behavior is exposed! Enough of the darn “special treatment”!!!

    Can not wait to hear Ms. Lyon’s arguement today, what is Nancy Grace’s funny saying “second verse same as the first” love when she says that…lets hope Judge Perry continues with his rulings and smacks the hammer down once and for all on this issue.

    Still don’t want to see Casey put to Death, but I don’t mind that this option is on the table it is a toss up for me…

    I just want to say up front and out loud, I could care less about what Casey ever wore (other than the stolen clothes, but that has been dealt with, so over that) I could care less that Casey had multiple boyfirends, what I care about is her daughter went missing and 31 days passed and during that time she did “nothing” to find her daughter, what she did do was lie and hide, and Grandma was the one that finally called the police to boot…that is the issue that is what makes me sick..

    Kleat, goes to show how ill prepared Baez is in representing Casey. I believe he is absolutely unfamiliar with the evidence. His presentation and ramdom montage of clips wasn’t relevant either. It’s the same thing he’s been going on and on and on about….the unfair treatment of Casey. He just found a loophole for his useless banter. Unless he brushes up on lawyering 101 and advanced defense, Casey hasn’t a hope or a prayer….imo.

    wow JP Denied the Motion to Remove DP. I am not sure how I feel about that, I am not for the death penalty in this case, I believe if you are going to have it you better be prepared to use it, or loose it.

    Now that that has been determined, what stall tatic is next for the Defense?

I was sitting here at work in tears, how can one contain themselves when their own life is on the line…how can one stay calm if they are innocent of killing the child they loved so much when the finger of posible death is pointing them straight in the face… Casey is either the bravest woman on earth or the coldest, time will answer that as will the jury.

    quick post, that may be in direct response to this story, which was titled “Judge Perry Takes the Stand”.

    Andrea Lyon’s comment in her last motion, re: ‘Impermissible prosecutorial motives’ alluded to some comments that she could not make, that ‘we are not allowed to make’ in open court, for which there was a pre-arranged side bar with Judge Perry at that point in Ms. Lyon’s argument.

    We’ve heard comments in open court, about the prosecutors (the state, the assistant attorneys for the state) and their change of tactics between early December before the body was found, through April with the DP was once again put on the table. So presumably, Ms. Lyon’s in camera side bar issues didn’t relate to those people, unless there’s unethical comments from one lawyer to the next under FLA bar rules, and that may not be allowed in Judge Perry’s court anyway, we can presume that Ms. Lyon was not attempting to toss mud at her collegues in that side bar and would bring up specific allegations and examples.

    Could this be why the need for removal of Judge Stan Strickland? That the ‘motives’ that are argued part of prosecutorial misconduct, were in fact motives via actions/statements/rulings of the prior judge? And was this motion last heard today, necessarily heard only once Judge Strickland was removed from the case so that another judge, whomever might have replaced Strickland, could hear the accusations against Strickland?

    Is accusing a sitting judge of something inappropriate, something ‘not allowed’ by a Florida Court? (besides the obvious can’t complain to the judge when it’s the judge you complain about).

    Could Judge Strickland’s comments, as one example only, about ‘the truth and Ms. Anthony are strangers’ (paraphrasing) show an early bias by Judge Strickland that goes to the misconduct of allowing the state to seek the death penalty after the state said that it would not seek the death penalty?

    I have used this example as the only one I’ve heard any reference to, re: Strickland’s views– the way I’ve written it might imply other and I did not intend that because I don’t know of any others. I ‘only’ used it as an example.

    Looks like George has had enough. He looked somewhat distant and perturbed yesterday and today he didn’t even show. Is he worried about the lies he has told or is he just mad at Casey for the allegations of sexual abuse?

    I think Burdick’s comment about the 15th was obvious even to him.

    In watching the past few days of trial, I am of the opinion that:

    1) There will be no plea in this case. I think Casey has decided to take her chances. If she pleas – all appeal opportunities are gone. If she is sentenced to death – she’ll spend many, many years appealing her sentence. I think her lawyers believe she may as well take the chance at a jury. Really…what does she have to lose?

    2) All attorneys on the defense side of this case will remain until the end of the trial. I do not believe any of them will be excusing themselves from the case. They’ll all been on the case going on 2 years, with the exception of Mason. I believe they will see it through to the end.

    Anyone else agree??

    I can’t believe I’m even going to say this, because the identity of Caylee’s father has been discussed so many times in the past. But I think we can put a new twist on it today. And if inappropriate or inflammatory, Blink please remove.

    George wasn’t in court today, and he has looked particularly unwell, angry, detached lately when he has been there with Cindy. Speculation is that he is upset about the molestation accusations in Casey’s letters. Today AL talked about mitigation and the assumption is that, if Casey is found guilty, the defense will bring up molestation by George and Lee during this phase. Is it possible that if it gets to that point, Casey could say she feared that Caylee’s father might have been George or Lee, and that the stress of living with this caused her to snap and harm Caylee? Could this be part of the reason George is so upset? Could be that the secret mitigation witness that the defense does not want anyone to know about is a specialist in dealing with the effects of incest and molestation.

    I just find it particularly interesting that, as George seems more upset and distant, Cindy and Casey seem to be making more efforts at reaching out to each other with their “I love you”‘s. I get the feeling that Cindy is being forced to choose, and she is choosing Casey. Is Cindy getting ready to throw George under the bus?

    Steadychick, I ‘m curious too about the area that the mitigation will focus on. It’s obvious that life in that house was a little left of “normal” (whatever that may be) but for maximum impact they’re going to have to probably narrow it down. Questions for me is: Do the A’s know, have they been told of the slant mitigation will take? will it require GA or LA to take a humiliating fall from grace?

    This new love fest between da girls may be simply the new spin or is it a little deeper like you ask? Big question, is roaming gnome George ready, willing and able to be a martyr?

    Today George wasn’t in attendance, maybe he was working the early shift, but this was the day that Andrea Lyon would mention the fact of two witnesses in the defense case as having attempted suicide, one was George of course. There was a lot to make a tough day for parents of the accused, ‘death’ is different, ‘death’ penalty, repeated over and over in these very real discussions of what may well come to pass. This was not a day for parents in court, George may not have stood up well and work may be the best choice for him during the death penalty discussions.

    Did anyone notice, how during the 10 minute recess, in the defense huddle….Casey CLASPED her hand over her mouth and started crying.

    Cindy was in tears also staring at Casey.

    Betcha they were discussing how the defense’s motion was denied and dp is on board and what it means to HER!

    Here’s an interesting point, a comment on the hinkymeter, but now the thread is closed so can’t respond. But it is something I noticed in the hearing, when the lawyers were at the sidebar, Andrea Lyon’s chair was filled by a woman wearing somewhat the same colour and neckline a blouse as Casey– reminded me of the seafoam teamwork of the past. Maybe a coincidence, maybe not, both were ‘open’ buttoned to a low degree, Casey’s blouse opening had an inset, so not revealing, just meant to appear that was somewhat. The woman who seated herself next to Casey, communicated with Casey in writing as Casey initiated, but it was a hug after court ended, that’s curious. At the time, I wondered if this was the defense mitigator, Jeaneane (spelling) Barrett? This would make sense, a hug from a lawyer or paralegal may not be allowed, but from the mitigator, probably something that is acceptable in jail visits and not considered unprofessional, likely essential in the bond that must be formed with a dp client.

    Blink, do you know if this was Ms. Barrett in court today? She may have been in attendance for Casey’s support as Ms. Lyon could not do both, support her client 100 percent, and argue such an important issue at the same time.

    The sherriff’s officer (blonde woman) who sat behind George and Cindy yesterday, was the same officer who is pictured at today’s hearing, just outside the courtroom door as Casey enters– photo no. 1 in the WFTV slideshow. So maybe she was looking to see what communications might be happening with ‘phones’ for their accused in custody.

    I really don’t think Casey’s dress is the issue it is the fact that she was club hopping and whoopin it up when her precious baby was missing (murdered and dumped)no way a GOOD MOTHER would go to a club and dirty dance, was that example an inticement to coax the kidnapper out of the crowd at of the club? was it a trial dance to bring forth the Gods to assist in the finding of her baby, maybe in the 1800′s or in some kind of tribal ritual but correct me if I am wrong Casey didn’t belong to any tribe or religiouos sect that practices Booty Shakin to find a killer. It is beyond Stupid to think that this was the case…..I could go on and on….

    DEE~ booty shakin (lol) is apparently an investigative technique that kc used extensively during that 31 days. It is not to be talked about negatively especially with any religious undertone because Mizz Lyon has already been trying to find a way to incorporate her Salem Witch Trial diatribe in any proceeding.

    So glad that Judge Perry moves things along and feels confident about ruling on the motions immediately. Quite frankly (hat tip to JB esq.) I’ll bet that team Casey wishes they had been a little less vindictive regarding Judge Strickland, but, well they followed their shark instincts so the waters are chummed for sure now but not so much in the way they wanted.     Blink — IIRC a life insurance policy on a baby is pretty cheap, and at least at one time they were sold as a good way to save for the child’s future. A whole life policy could be cashed in for college funds. I know it’s been said that there were no policies on Caylee, but any possibility some unknown person or family member purchased such a policy? Or is it possible the mystery deceased father may have had assets that were due to Caylee, but would pass to Casey upon Caylee’s death. Just trying to imagine a scenario where financial gain would be an aggravating factor, since the SA did not rule it out.

    re duct tape– “something was found close by”, Baez will argue that the duct tape was reported by someone, police, whatever, he won’t admit that the duct tape was around the skull also.

    Baez handled things 100% better for the defense in his presser, he’s learned from that recent botched ‘fit on the sidewalk’! He didn’t delegate questions too well, but still, he’s helped, not hurt his defense this time.
