Kyron Horman Missing: Kaine And Terri Horman Face Off In Family Court

Portland, Or– Following one of the largest organized search weekends on Sauvie Island since Kyron Horman, 8,was abducted from Skyline School on June 4, his step-mother and father squared off in family court. Kaine Horman, Kyron’s father, arrived with his attorney, Laura Rackner.

Kaine’s estranged wife Terri Horman, arrived with her criminal defense attorney; Stephen Houze and her family law attorney Peter Bunch.

Mr. Horman appeared in a crisp-white dress shirt and tie, and Ms. Moulton-Horman wore an eggplant hued suit with a long skirt.

Cameras were banned in the downtown Multnomah County courtroom; however, there were apparently several hidden “nests” as the tweets were flying real-time.

Peter Bunch, counsel to Terri Horman, is adamant his client is the subject of more than one criminal investigation:

“The state has the ability to obtain every single bit of information that is produced in this case and that is outside the bounds of what it could do were this proceeding not occurring,” Bunch said in court.

“It is fundamentally unfair for Kitty (Kiara) and for Miss Horman for me to be hamstrung in the divorce case for the information I have compared to what they have.” “The publicity that’s going on is not being driven by Ms. Horman, it’s being driven by Mr. Horman, when he tells national media there’s no doubt Ms. Horman is involved.” “If Mr. Horman is really interested in what‘s best for the child, then Mr. Horman wouldn’t object to any visitation by this child’s mother.” “We’ll concede, Mr. Horman can have the house, right now. Mrs. Horman is going to lose money…”

Terri Horman has not been declared a suspect in either Kyron Horman’s disappearance or the alleged murder for hire plot against Kaine Horman. She is however, seeking access to all of her 911 calls dating back to the DAY AFTER CHRISTMAS.

While this timeline coincides with accusations by Kaine Horman in his filings that Terri attempted to arrange to have him murdered, this is the first public revelation of that call. Bunch went on to say that Rackner and Kaine Horman, who are parties to case sensitive criminal investigation materials involving Terri, are at a supreme advantage to his client who should only be expected to plead her protections under the 5th amendment as a result.

After heated debate by those sides, we learned: Rudy Sanchez, the infamous landscaper/hitman for hire, has an alias, and has eluded service in the civil matter to date, although he appears to have cooperated. Bunch proclaims Sanchez is unlocatable as a result of MCSO unwillingness to share discovery of a witness in the civil case ( blink holds hands over eyes).

Michael Cook, a/k/a sexter king, waited all afternoon via subpoena by Rackner, but was only interviewed by the press. He states he cut ties with both Terri and Kaine days before he was outed for invasive scapular intrusions. No word on that healing process.

Terri Horman had her own personal black Friday this year.

She called 911 THE DAY AFTER CHRISTMAS. Regular contributors and readers of blinkoncrime.com doubt she had sale flyer questions.

Judge Keith Meisenheimer, was sensitive to Kaine and Kyron’s ‘round the clock nightmare, but feels some time may allow things to shake out. January 6, 2011 to be exact.

Following this afternoon’s legal melee, blinkoncrime.com Editor In Chief asked prominent Washington State Family Law Attorney, Lea Conner, to weigh in:

Although I preface my comments with the fact that I practice family law in Washington State and not in Oregon, I am an Oregon native that has followed this case closely.

I’m a bit perplexed by Peter Bunch’s reasoning that if the court were to abate the dissolution, he would respond by filing a motion to modify the restraining order so that Terri Horman could have visitation with the parties’ daughter. Essentially, Mr. Bunch is arguing that the abatement would prejudice his client’s ability to parent her child. My understanding of the Multnomah County local rules is that an abatement means that the entire case is halted. Neither party can bring a motion before the court, nor can the court hear argument or make any ruling on motions.

It was also interesting to hear Mr. Bunch argue that proceeding with the divorce would violate Ms. Horman’s right against self-incrimination in the disappearance of her stepson. This is the first time that Terri Horman has publicly acknowledged any self-incrimination issues. In her motion for abatement, Ms. Horman, through counsel, argued that the ongoing investigation into Kyron Horman’s disappearance had made it “virtually impossible…to proceed with divorce-related issues in an effective an[d] orderly fashion[.]” Were Mr. Bunch to bring a motion to allow visitation, Mr. Horman would no doubt argue that Ms. Horman’s actions demonstrate that Ms Horman or someone she knew was responsible for Kyron Horman’s disappearance, and that her behavior since Kyron’s disappearance shows that she is unstable and poses a threat to their daughter’s safety.

I do not believe Mr. Horman would raise Ms. Horman’s 2005 convictions for DUI and reckless endangerment, as not only later chose to have a child with Ms. Horman since that time, he also left both of his children in her care for extended periods while he was at work. Under those facts, it would be hard to conclude that Mr. Horman believed Ms. Horman posed a threat to their daughter. The judge’s comment that “[e]ventually, Terri will have to decide whether or not to plead the fifth, regardless of the timing of the proceedings,” seems to indicate that the judge may not be willing to hold the action in abatement past the January 6, 2011, hearing.

I’m also interested in Mr. Bunch’s comment that “Rudy Sanchez” is an alias. If that’s true, then what is Rudy Sanchez’ real name, and how exactly did he first come in contact with Terri Horman?

It was also strange to learn that Michael Cook was subpoenaed to testify at the hearing. I’m curious if there were others scheduled to testify as well. I cannot speak to how the Oregon court operates in practice. However, I note that each party provided written affidavits in support of their respective motions.

Is there some reason that Mr. Cook’s statement could only be presented in oral testimony?

I’m not sure I understand Mr. Bunch’s logic in saying “If this is not abated we will not get reciprocal discovery.”

The state is not a party to a dissolution action. In a dissolution action, the parties can seek discovery from each other, and depending on the court rules, from third parties as well.

I’m not sure why Mr. Bunch would have the impression that there would be reciprocal discovery with a third party in a dissolution action, especially when that third party is law enforcement.

There’s a disconnect between Mr. Bunch’s argument that Ms. Horman cannot defend herself because she would incriminate herself in the disappearance of her stepson, and his statement that “If Mr. Horman is really interested in what‘s best for the child, then Mr. Horman wouldn’t object to any visitation by this child’s mother.”

The apparent logic is that Ms. Horman admits that if she speaks, she will incriminate herself in some as-yet-to-be-named crime related to Kyron’s disappearance, yet Mr. Horman is now supposed to trust her to care for his other child, because that’s so obviously in their daughter’s best interest.

    KH has always stated LE updates him often, so if LE focus had changed, don’t you think he would have worded this differently…or less severely?

    His coat and backpack were still at school. I left the school at 9 and he was seen with a man ‘chaperone’ and 2 girls after I left. There were no men on the chaperone list. That and it was highly chaotic – had to been 300 people running around – no coordination …”

    This is an email we’ve talked about before. I believe for the most part we came to the conclusion by the way this is worded that TH received that bit of information from someone, as she did NOT say I saw him with a chaperone, or I left him with a chaperone, etc. Hope this helps!

    As first reported by The Oregonian, Kaine Horman on Monday asserted Terri is seriously emotionally disturbed, and “unfit” to parent their daughter.

    KGW.com first reported on Friday that Kaine Horman filed papers opposing his estranged wife’s visitation request, stating that he believedTerri Moulton Horman “abducted and may have caused unimaginable harm” to his son Kyron. More: Kaine suspects “unimaginable harm”

    The Friday filing was in response to efforts by Terri Moulton Horman to gain visitation to her young daughter.

    KGW independently obtained a copy of Monday’s court filing. In it, Kaine suggests their daughter may have witnessed “some unimaginable act of horror” on June 4, the day Kyron disappeared from Skyline Elementary.

    Monday’s filing also included more explicit texts between Terri and Michael Cook, including photos she sent of her breasts and of her masturbating, and a text in which she wonders if she’s “going to get any ever again.”

    Kaine also stated in the filing that it was common for Terri to be visibly impaired from alcohol, including slurred speech and a staggering gait.

    Kaine disputed Terri’s claims that she was their child’s primary caregiver, noting that he worked from home many days of the week, and that Terri spent more time on the computer than on parenting.

    “I believe that any contact that Respondent (Terri) has with our daughter will be detrimental and will jeopardize her physical safety and emotional well-being,” states Kaine Horman in the filing.

    IDK .. looks like Kaines losing control. He can’t be too concern about the future emotional welfare of his child if he’s willing to make public this kind of stuff. If any of it is true, let it come out in court .. not a public dump. Much of this is stuff the bloggers have been speculating about for months. Has Kaine just learned this about the woman he’s lived with for 8 years by reading the internet? Sorry to say, but this doesn’t pass the smell test for me. Waiting for the other shoe to drop.

    Probably several others have posted this – oh my, depression, alcoholism, personality disorder, passed out on couch,severely emotionally disturbed, more details about the photos – all being mentioned by Kaine. I didn’t know she had 2 Driving without a license charges. She is looking worse and worse as a mother. I know people think Baby K should see her mother and I have held to the idea that ONLY after she gets her psych eval and based on those recommendations, which are common practices in OR, with or without Child Services involvement. By now, Baby K has stabilized to a certain point, I don’t know more than that as I haven’t seen her. She would get disturbed to have Mom brought in and out again. It just ain’t gonna happen without that evaluation folks, especially after these comments by KH. And tomorrow I am off to testify on another case involving: “Is this parent fit?”. Later on in my life, I would like to help talk about family planning for people because too many people just are not fit to produce offspring and they need to use heavy birth control methods.
    I have a lot of empathy for Skyline parents trying to explain this to younger kids when they also may feel uncertain about what to say and how to say it. Some of the sensitive types could be quite impacted by this.

    Well, Kaine’s motion to disallow supervised visitation is certainly telling. It’s almost like everything unkind which was said about TH is most likely true. I can’t see Kaine as lying about these things. I do realize that people involved in a custody/divorce are going to stress anything which seems unsavory about the opposing party and we could ask why he let this woman mother his children.

    Now, I’m back to the thoughts I had on June 5th, that TH hurt Kyron in a fit of rage, then had to get rid of the evidence which would incriminate her, namely Kyron.

    What happened next we will probably never know. I think she is sick enough that she will never tell, if she remembers. Just the sexting at that particular time leads me to believe she is “severally emotionally disturbed” and I certainly hope that Kyron was not victimized for his entire life.

    Well, actually, despite Kaine’s knowledge of TH’s prior driving record and reckless endangerment offenses, he bought her a candy apple red mustang in spring, 2007. (Rather than an 1978 4-cylinder Chevy, which would’ve been my choice.)

    And, although he now claims he worked at home 3-5 days a week and was, therefore, Kiara’s primary caregiver, it seems that he knew little about the kids’ schedules and allowed TH to routinely drive them all around.

    Skyline — are you the local who mentioned that one set of dogs the LE brought to the school was supposed to sense extreme emotion? – yes that was me. I didn’t explain that very well. Those dogs were there the very first night and I believe were there to determine if Kyron was hiding away within the school. I don’t believe its possible for them to sense something after the fact, the way a bloodhound does. Sometimes we forget that in the first few hours Kyron was missing, there was still the possibility that he had holed himself up somewhere close by.

    And there are witnesses who saw Kiara in the school that day.

    Sort of strange that MC texts TH that he is writing to Kaine. Makes me wonder if she was attempting to have Kaine informed of her improprieties so he would be jealous or something. Or, was MC so grossed out that he was trying to get her to quit.

    And, to think these texts were very much like the texts she sent to RS per LE. Definitely things I wish I did not know.

    I’m so glad that Kiara is too young to read or understand any of this. I’m kind of pissed that the texts were published because of the crap James is bound to have to put up with at school now.

    Since this is a divorce, I fear this is only the beginning. The next motion from TH’s attorneys will probably have dirt about Kaine. And, I have to agree that it seems unlikely that he did much parenting since he did not know what the kid’s schedules were.

    Some comments state that all that has been released to the media is Kaine’s doings. My guess is that everything that comes out to the public is carefully orchestrated by LE and KH attorney. I doubt that KH is unilaterally releasing these docs on his own.

    What Kaine is implying is so disturbing. Very hard to read. What could Kitty have done or said to make such statements? Clearly, Kaine is no longer implying that Kyron is alive.

    That court filing is quite a read. Many of the behaviors described I think have been alluded to or suspected by many, but it was something to see KH put it all down on paper. One statement in the filing I found especially interesting is “Law enforcement officials have informed me that more than one circuit court judge has determined probable cause exists to implicate Respondent in Kyron’s disappearance and in the murder for hire plot. Respondent and her lawyers are also aware of this.”

    I am not very well informed on the intricacies of the legal system here and who sees what and when, but I am a little confused as to why circuit court judges would be looking at this already, and we have a grand jury going. I would really appreciate it if somebody that knows, would explain this process. TIA.

    This has been one of my primary reasons for suspecting that there is an indictment of some type out there.

    ***Puzzled: I know what you mean, BUT it *was* brought out in court thru this filing. It’s not like he told the story to People magazine or spilled it on Oprah. We are privy to it and reading it because it was available thru via this motion. So I have a totally different take on it. I’m guessing that Kaine’s attorney (and possibly the DA since they are guiding this case) thought that now was time for Bombshell Number Whatever (I’ve lost count in this case). This info about TH was going to come out eventually (maybe January), but perhaps KH was advised to do it now. With TH refusing to talk, it’s maybe a way to prompt something from her or at least keep her the hell away from Kiara. I don’t know. I can’t imagine that this will hurt Kiara any more now than in a few months, and that poor little child is already going to have so much to deal with growing up. I just hope that she was NOT in the truck if/when TH hurt Kyron. JMoooooo

    Just finished reading KH’s Affidavit attached to his Response to TH’s request to modify the Restraining Order, as well as the redacted texts between MC and TH (thankfully THANKFULLY the sexting photos were not included!). Even if you were to discount the multiple allegations contained in the Affidavit, which KH signed under penalty of perjury, the content and timing of the text messages cannot be ignored. The texts are worse than I even imagined. While KH and DY are pleading emotionally for any information about their missing son, TH is sending text messages about drinking, masturbating, how expensive her attorney was to retain, and requesting MC to lie for her. How anyone can read these text messages in context with the investigation of a missing boy and not question her fitness as mother and involvement in Kyron’s disappearance is simply beyond me.

    Question, if TH was passed out on the couch most nights how could she be keeping Kiara up at night? Ok, drink early and pass out around 9 then wake up around 2 or 3. If KH was asleep, how would he know what TH was doing? Is he making assumptions? Maybe he woke up once or twice and caught her awake with Kiara at 2 or 3 AM? There has been a distancing between KH and DY, is this it? KH turned a blind eye and allowed this behavoir to occur under his watch. I am by no means a TH supporter but when this kind of info emerges you have to wonder what “petitioner” did to stop it. She had a DUI with her son in the car??? Did KH just dismiss it?

    First, Terri is clearly sick. Mike Cook was clearly setting her up.

    Kaine was an enabler who wants to claim he didn’t know anything his wife did in her spare time or when he was at work, didn’t even know his son was to be in a talent show, nor did he know Ky was to spend the weekend with Desiree, but he wants to claim he was the primary caregiver of Kiara?

    Big sigh.

    Their house was spotless for a woman who did nothing but work out and sit on the computer all day. She may be crazy, but she did go through the motion of caring for her kids and keeping a nice home.

    Regarding the texting… huge clues to her mentality in there. She’s a highly sexualized woman and uses it as a coping mechanism. She wants to be loved and adored but somewhere along the way felt that to be loved or adored she had to come on sexually aggressively to men. This appears to be a focus, even in light of her world crumbling around her. From confusing love with sex, Terri went on to using it as a tool of control which can be seen in the MFH plot.

    I do not believe Terri harmed Kyron with her own two hands. I believe that sweet baby wound up in the hands of someone else, then was passed along to another. She systematically was removing the people from her life who were interfering with her personal desires, and used her sexuality as a means to that end. She’s too wrapped up in it, though, to see when the other party has other intentions beyond what she is offering. Michael Cook’s responses to her texts are a good example, ie… he did not appear to be nearly as interested in the ‘sexting’ aspect and only playing along, but did appear to be fishing for information. Perhaps whomever she was dealing with in regards to Kyron pretended to want Terri when in fact they wanted Ky all along and Terri fell for it.

    A lady who lived on the edge and finally went over it while other adults in her life should have seen it coming but instead were happily going along with leaving all the responsibility of rearing the children and running them around and volunteering at school, etc… up to her.

    It doesn’t look like I bit my tongue, but believe me, I did. There’s no room for any of this when little children are involved.

    Reminds me of the Andrea Yates case. It was said she would walk a circular path around the inside of the home over and over and would talk to herself while doing so. Yet her husband left her there with those babies all day long, day after day, continuously getting her pregnant. There were so many clues she was losing her mental grip.

    I had just had a baby at the time and was struggling with very mild postpartum depression but I told my husband if I start talking to myself or walking circles through the house don’t leave me alone with the kids!

    In Terri’s case IMO, it’s more pathological. She’s not crazy in the sense that Andrea Yates was, but the clues were there.

    After reading the recent court documents, we have lots of new information to ponder. Just off the top of my head:

    What does this all say about Kyron not being able to come out of his room in the mornings until someone came in and got him?

    We now know that James moved out by February 6th.

    KH was an enabler. It’s easy to do. It probably took him to be removed from the situation for a time to see how unhealthy it really was.

    KH was in denial about TH when he was trying to get her to talk. Normal, but not helpful. How do you wrap your head around that?

    TH was in to take three LD tests. Results were; failed, walked out, stalled for a week, then failed.

    In TH’s text messages to MC she states she has only had five men. She was married three times, then there is RS, so according to her there was only one other guy.

    MC made a comment that he was emailing KH. Did not want to lie for TH and told her not to lie or she would feel isolated. Pretty convincing for me that he was assisting LE or KH, however, if they had sex the night before I guess that is going above and beyond. I’m conflicted about MC.

    I know that accusations in custody cases get amplified and it is up to the other party to defend themselves, which I believe is KH’s motivation, in part, to get this woman to talk, as he has been trying to do for almost five months. If only half of the domestic picture his lawyer has allowed him to paint is true, it is not hard to believe that she simply wanted Ky gone.

    It does not make sense to me that she lost her temper, as they were at school and she would have to manipulate the situation to get Ky to leave with her. That is not spontaneous anger.

    I’m pretty sure, and this is MOO, that the plan with this action is to make TH talk. I’m thinkin’ KH and his attorney along with LE, think if they slam TH on her mothering skills, especially in regards to Kiara, she will have to speak up.

    As for the sexting…all I can say is this woman needs some serious help, if it’s true. Personally I don’t believe anything ANY of them say anymore.

    All I know is now everybody is going to be focused on TH’s va-jayjay instead of finding Kyron and that infuriates me.

    Thoughts and prayers are with Kyron, his brothers and sister.

    Thanks for detailing that for me. That’s quite interesting. As far as I know, background checks and fingerprinting for parent’s or ANY person who will be actually chaperoning for the kids at our schools must be checked/fingerprinted beforehand, just to make sure there is nothing in their background. They call a chaperone anyone who would potentially be able to have contact with a child alone, i.e. taking them to the bathroom, on a field trip, etc. If parent’s are simply attending an event, i.e. school play, classroom parties, science fair, volunteering in the classroom, etc … no checking/fingerprinting is needed because the teacher is there.

    I am very comfortable with the way our school system does this and believe it’s the right thing to do all things considered, because nowadays, you just never know. The problem I see with it, is nothing is foolproof. As one of the other Blinksters posted earlier (cbickel I think?), an SO on average offends 16 times before they are ever caught and convicted. So in my mind, that doesn’t necessarily mean our kids are 100% protected from harm in that respect, but at least it’s a step in the right direction. I think all school systems need some kind of “heads up” like this IMO but I realize not all do.

    Our schools too have the office ‘check in’ when you come to the school for any reason … an “honor system” of sorts I guess you could say. You have to press a button in the front foyerway (in between doors) to be able to even get into the school as it is locked during school hours for safety purposes. You state your purpose to the office staff and they buzz you in. The doors are only about 100 ft or less from the office itself and you’re supposed to go directly to the office and check in before going anywhere else around the school, but I’ve seen many people walk right by the big office windows and not once has anyone in the office even questioned them not stopping. That makes me a little uneasy to be honest w/you.

Do you think LE will consider this plea and try to move on this sooner, or do you think they have their plan in place and will only arrest when they’ve completed their secondary investigations?
