Kyron Horman Missing: Kaine And Terri Horman Face Off In Family Court

Portland, Or– Following one of the largest organized search weekends on Sauvie Island since Kyron Horman, 8,was abducted from Skyline School on June 4, his step-mother and father squared off in family court. Kaine Horman, Kyron’s father, arrived with his attorney, Laura Rackner.

Kaine’s estranged wife Terri Horman, arrived with her criminal defense attorney; Stephen Houze and her family law attorney Peter Bunch.

Mr. Horman appeared in a crisp-white dress shirt and tie, and Ms. Moulton-Horman wore an eggplant hued suit with a long skirt.

Cameras were banned in the downtown Multnomah County courtroom; however, there were apparently several hidden “nests” as the tweets were flying real-time.

Peter Bunch, counsel to Terri Horman, is adamant his client is the subject of more than one criminal investigation:

“The state has the ability to obtain every single bit of information that is produced in this case and that is outside the bounds of what it could do were this proceeding not occurring,” Bunch said in court.

“It is fundamentally unfair for Kitty (Kiara) and for Miss Horman for me to be hamstrung in the divorce case for the information I have compared to what they have.” “The publicity that’s going on is not being driven by Ms. Horman, it’s being driven by Mr. Horman, when he tells national media there’s no doubt Ms. Horman is involved.” “If Mr. Horman is really interested in what‘s best for the child, then Mr. Horman wouldn’t object to any visitation by this child’s mother.” “We’ll concede, Mr. Horman can have the house, right now. Mrs. Horman is going to lose money…”

Terri Horman has not been declared a suspect in either Kyron Horman’s disappearance or the alleged murder for hire plot against Kaine Horman. She is however, seeking access to all of her 911 calls dating back to the DAY AFTER CHRISTMAS.

While this timeline coincides with accusations by Kaine Horman in his filings that Terri attempted to arrange to have him murdered, this is the first public revelation of that call. Bunch went on to say that Rackner and Kaine Horman, who are parties to case sensitive criminal investigation materials involving Terri, are at a supreme advantage to his client who should only be expected to plead her protections under the 5th amendment as a result.

After heated debate by those sides, we learned: Rudy Sanchez, the infamous landscaper/hitman for hire, has an alias, and has eluded service in the civil matter to date, although he appears to have cooperated. Bunch proclaims Sanchez is unlocatable as a result of MCSO unwillingness to share discovery of a witness in the civil case ( blink holds hands over eyes).

Michael Cook, a/k/a sexter king, waited all afternoon via subpoena by Rackner, but was only interviewed by the press. He states he cut ties with both Terri and Kaine days before he was outed for invasive scapular intrusions. No word on that healing process.

Terri Horman had her own personal black Friday this year.

She called 911 THE DAY AFTER CHRISTMAS. Regular contributors and readers of blinkoncrime.com doubt she had sale flyer questions.

Judge Keith Meisenheimer, was sensitive to Kaine and Kyron’s ‘round the clock nightmare, but feels some time may allow things to shake out. January 6, 2011 to be exact.

Following this afternoon’s legal melee, blinkoncrime.com Editor In Chief asked prominent Washington State Family Law Attorney, Lea Conner, to weigh in:

Although I preface my comments with the fact that I practice family law in Washington State and not in Oregon, I am an Oregon native that has followed this case closely.

I’m a bit perplexed by Peter Bunch’s reasoning that if the court were to abate the dissolution, he would respond by filing a motion to modify the restraining order so that Terri Horman could have visitation with the parties’ daughter. Essentially, Mr. Bunch is arguing that the abatement would prejudice his client’s ability to parent her child. My understanding of the Multnomah County local rules is that an abatement means that the entire case is halted. Neither party can bring a motion before the court, nor can the court hear argument or make any ruling on motions.

It was also interesting to hear Mr. Bunch argue that proceeding with the divorce would violate Ms. Horman’s right against self-incrimination in the disappearance of her stepson. This is the first time that Terri Horman has publicly acknowledged any self-incrimination issues. In her motion for abatement, Ms. Horman, through counsel, argued that the ongoing investigation into Kyron Horman’s disappearance had made it “virtually impossible…to proceed with divorce-related issues in an effective an[d] orderly fashion[.]” Were Mr. Bunch to bring a motion to allow visitation, Mr. Horman would no doubt argue that Ms. Horman’s actions demonstrate that Ms Horman or someone she knew was responsible for Kyron Horman’s disappearance, and that her behavior since Kyron’s disappearance shows that she is unstable and poses a threat to their daughter’s safety.

I do not believe Mr. Horman would raise Ms. Horman’s 2005 convictions for DUI and reckless endangerment, as not only later chose to have a child with Ms. Horman since that time, he also left both of his children in her care for extended periods while he was at work. Under those facts, it would be hard to conclude that Mr. Horman believed Ms. Horman posed a threat to their daughter. The judge’s comment that “[e]ventually, Terri will have to decide whether or not to plead the fifth, regardless of the timing of the proceedings,” seems to indicate that the judge may not be willing to hold the action in abatement past the January 6, 2011, hearing.

I’m also interested in Mr. Bunch’s comment that “Rudy Sanchez” is an alias. If that’s true, then what is Rudy Sanchez’ real name, and how exactly did he first come in contact with Terri Horman?

It was also strange to learn that Michael Cook was subpoenaed to testify at the hearing. I’m curious if there were others scheduled to testify as well. I cannot speak to how the Oregon court operates in practice. However, I note that each party provided written affidavits in support of their respective motions.

Is there some reason that Mr. Cook’s statement could only be presented in oral testimony?

I’m not sure I understand Mr. Bunch’s logic in saying “If this is not abated we will not get reciprocal discovery.”

The state is not a party to a dissolution action. In a dissolution action, the parties can seek discovery from each other, and depending on the court rules, from third parties as well.

I’m not sure why Mr. Bunch would have the impression that there would be reciprocal discovery with a third party in a dissolution action, especially when that third party is law enforcement.

There’s a disconnect between Mr. Bunch’s argument that Ms. Horman cannot defend herself because she would incriminate herself in the disappearance of her stepson, and his statement that “If Mr. Horman is really interested in what‘s best for the child, then Mr. Horman wouldn’t object to any visitation by this child’s mother.”

The apparent logic is that Ms. Horman admits that if she speaks, she will incriminate herself in some as-yet-to-be-named crime related to Kyron’s disappearance, yet Mr. Horman is now supposed to trust her to care for his other child, because that’s so obviously in their daughter’s best interest.

    It’s pretty easy if you’re close with someone in LE to get things like a traffic ticket or even a DUI arrest expunged from the record–either before or after you pay for it (in the case of a traffic ticket, ex). At least it is here. I’ve had my contacts call me and volunteer to pull a traffic offense; which I would never do just in case I ever decided to run for political office (just joking). It’s no big secret that this is often done.

    If Twinkletoes would pop in, she could tell you about the Russian “upstanding businessman” who has managed to get some pretty serious charges obliterated from his record. He has connections to someone pretty high up.

    TH’s lawyers possibly mentioned “supervised” visitation with Kitty for several reasons, including: that is all they know they could get right now; it makes TH and her attys seem very reasonable in their requests; and also for TH’s own protection. Remember that the evangelist Billy Graham (a nice looking man in his youth) would NEVER be alone in a room with a woman not his wife? That was so he could never be accused of something inappropriate. I thought that was very smart of him. Same goes for TH at this juncture.

    All the attorneys right now are at the point of testing the waters with each other and setting the groundrules for how evidence will be heard. They’re not really yet at the point of wanting to deal with the content/the meat of the matter. I thought Bunch (with the hand of Houze in the background) did a good job of drawing some lines in the sand.

    Bunch called a spade a spade: TH will agree to a divorce right now if KH wants a divorce, reserving custody & some other issues till later. But it’s clear, Bunch said, that KH is using the divorce to help LE investigate a criminal case in which TH is a de facto suspect. So, cut the crap guys. The jig is up on that.

    And I thought Bunch’s last point was a real whammy: the state (LE, prosecution) doesn’t really want us to have the evidence we could have brought out in the divorce matters brought to light just now–so back off.

    In other words, it’s not about the suit money, or other divorce matters yet. It’s about what venue the state’s evidence will come out in. Yes, the state, if KH’s attys push it, will become a DE FACTO party to this divorce proceeding. And if that happens, state employees will be subject to subpoena as witnesses in the divorce (records custodian for 911 calls, etc.) So, the state needs to rethink that. The State can’t have it both ways.

    Bunch also laid the groundwork/subtly warned that they can easily cast doubt on the state’s star witness (in both civil and criminal matters for the Hormans): because RS is an alias. And they know all about his INS/ICE problems, of course (it wasn’t necessary to even say that in the memorandum). So, the MFH will go away in the divorce matter, with no evidence probably except the word of an illegal, who uses an alias for possibly some shady reason, and might make up anything to cut a deal to stay in the USA. And once RS has been completely discredited as a witness by TH’s divorce atty, how will he play in the state’s criminal case–about any MFH or anything else??

    Unfortunately, I think LE has screwed up this case. LE’s trying to take some investigative short cuts, however well intended, has backfired. And I think so has KH’s legal maneuvering to accomplish the same in the divorce filing. MOO.

    Thanks to all who sent me hugs and such about my mood yesterday. I’m in Georgia and the weather here has been beautiful, so it wasn’t rain here that was affecting me. I’m just really depleted.

    I watched that video again. I think KH seems contemplative. Maybe he was trying to decide if he saw this coming in preceding months and suspecting his wife might be involved? There does seem to be distance, if not tension, between TH & KH. It seems odd she would look to DY for comfort when standing right next to her husband. But, I think she was looking for someone to latch onto. As another poster suggested, it wasn’t so much that TH was comforting DY, as she was seeking comfort. When DY didn’t reciprocate, TH tried to comfort herself by rubbing her arm.

    I hope the searches on SI will bring a break in the case this week. I think the suspense is getting to be too much for all of us!

    Regarding RS’s alleged alias … this is interesting. When you do a search on JE (his brother I believe from previous research), this comes up. Interesting how RS’s name comes up as relatives of two different Jaime’s (different cities, different ages) but with two different names (aliases?). Look at entry #2 (Canby, OR) and the associated relatives and then down below entry #8 under Portland and associated relatives. Appears to be same JE but different names for RS in each.

    From experience, as far as I know, the only people who seem to feel they need to use aliases of any sort are those who are trying to evade someone or something or are trying to make something look one way when it’s in fact another. What other reason is there for using one otherwise and why would RS potentially need one? Just something interesting I came across …

    Thinking out loud here…Isn’t it possible that LE finally got their hands on one or more of the bat phones and successfully subpoenaed the cell records? Or perhaps, IF there is a third party involved in Ky’s disappearance that we are not aware of, LE finally caught up with this person and received information from them? Perhaps one of these scenarios is what has caused LE to search particular areas of SI these past two weekends.
    I have to say, I haven’t thought about DS much lately. I’m still on the fence with her being involved or just collateral damage, kind of like MC. Just wonder WTH they were thinking!
    I’ve been wondering about any possible ties here to BP, WF or LF; and about the possibility that certain persons may have been selling pot for extra cash on the side. It can be quite lucrative from what I’ve been reading. All just MOO.

    @S- I don’t think TH’s legal team tried very hard to find RS. That said, it is possible for a person to avoid a subpoena server if they suspect one may be looking for them, it’s called hiding, lol.

She is one woman hell bent on destroying anyone who gets in her way and so far she has succeeded. I hope all those involved get “due process”.

    It is interesting to watch the first presser with the sound off. It looks to me like toward the end of the press release that Kaine forcefully grabs Terri’s arm and says something to her. It would be interesting to know what he said. Also the body language of Kaine and Terri seems very different from the body language of Tony and Desiree.

    @Blink, I knew what you meant, it’s just when I think of that little girl I see my own grandbaby…same age, how attached they are to the people in their lives, the routine of their day to day world…this little girl has been thru soooo much in her short little life that I can’t help but feel she is more than just a little confused. Not just one, but three people that had been there,if not every day, then routinely for her are now gone.

    We may not ever know to what degree, if any, TH played in this tragedy and that in and of itself somehow makes a bad situation even worse. If she did master mind this…(I don’t think she did, I think she got WAY in over head) then she shouldn’t be allowed non supervised visitation, but what if she didn’t? I still say her lifestyle is what made this whole thing possible, but I have no proof of that, what if LE doesn’t either?

    @Mom, I know you weren’t giving me a hard time! I was just so happy to catch the typo that I did catch that I didn’t take the time to look at the word closer! lolol

    Thoughts and prayers are with Kyron, his brothers and sister.

    And I was thinking that MC might have been subpoenaed just to loiter around for intimidation purposes–a little reminder for TH and her attys. For any hearing or trial, given MC’s background as we know it, surely you don’t want him on the stand for cross-examination. His cell phone evidence might be all they will ever use.

    So, my legally and factually uninformed answer to Ms. Conner would be, “No. They just don’t want to put him on the stand.”

    These last two week-end in P-town have been a mix of emotions. There are those that really, really want Kyron found on SI & those that really, really want him found some where else -BUT-all want him found yesterday/now, if that makes sense ?

    Because if the searchers (on SI) find him, he is “found” & if not, than alive ? -or- ? & where – there are no searchers any where else, which means no Kyron.

    It is simply a catch – 22.

    I read your post yesterday & found no words to express how much your words rang true.

    Everyday I think of Desiree, my words bring her no comfort but my heart breaks anyway for her -his “Momma”. Always in my head I hear her words of being @ the “Wall @ Skyline” : (paraphrase) “I like to be here…yes it is hard…but this is the last place he was… I feel close to him…”

    Normally, we spend time @ SI, since Kyron disappearance we have not gone, nor certain “places” in NW Pltd & we live in NW Pltd, it just does not “feel” right until Kyron comes home.

    While I cannot predict who will ultimately hold the responsibility for Kyron’s disappearance, I can predict one thing with a fair amount of confidence: We are going to see a continuing thinning down and glamming up of Terri’s appearance as the months go by.

    This statement has no value added to it, in other words, it is a non-issue. So why the heck am I bringing it up? Because it is predictable that a woman in Terri’s position would use everything she has to gain control of the situation (read: build up on the sex appeal). At *least* three men that she has interacted with in the past six months have turned on her. So how do I expect this woman to wield power? Through her physical appeal.

    Predictable.

    I was under the impression that James was in Kiara’s constant enviorment until he left to go live with his grand-parents, am I wrong in thinking that? I really don’t want to talk about this young man as he is a minor, just the way you put that in quotation marks makes me want to clarify that TH and KH were James’ primary care givers up until he moved or WAS moved in January.

    I kept thinking about this during my drive to work which is insanely long. I’m thinking possibly the reason some things have taken so long for LE to investigate is that this phone call TH got from someone who was on SI that day came from a disposable. Those can be traced, but it could be a real bugger.

    I will assume that from the call LE/technicians can tell the manufacturer (and possibly some type of identifier akin to the IP address of a computer??) of the phone. LE would need to contact the manufacture to determine where it went from the manufacturer. It could have been sold to a distributor anywhere in the US, then it went on to a retailer. Good news would have been if the retailer was a large chain in the US, but it could have just as well been distributed to a Mom and Pop in Mexico who have weapons behind the counter instead of video surveillance.

    Another way to look for the caller would be to track the cards purchased to add time to the phone. With luck, someone purchased time with a credit or debit card. But it doesn’t look like LE had any luck with that either. There are also Mom and Pops who cater to persons of Mexican descent in small towns throughout Oregon and Washington (and probably all states) who also do not have video surveillance and if additional time was purchased for the phone and paid for with cash you get a dead end again. If LE hit this dead end, then it possibly explains why they went back to SI. Maybe the information we heard they got the Wednesday before last was that they would not be getting any information.

    I’m thinking this is the information Desiree has implored TH to come forth with. Who called you that day, Terri? Why won’t you say? Are you afraid, stupid, evil or none of the above? Cooperate and tell police who called you that morning.

    @Idahogal – I am so sorry, I wasn’t referring to the guy(s) at the SF, but the link and guy you put up, Andy Bernal Rios at the MCSO. I said he looks somewhat like “RS” and has the right size and age, could have dyed hair black and sprouted a goatee. Usually I hate it when someone says someone looks like someone else and they haven’t checked the other particulars. I am not saying it is him, but possibly could be.

    Re: DHS in Oregon. They LOVE to have people take psych evals and also substance abuse assessments so I am thinking TH does not have a prayer of even getting supervised visitation until these things (and hopefully some treatment) are in place. This could happen mostly in Roseburg too. KH can just ask for it since obviously we aren’t gonna get a quick conviction here. What I see is when people begin to make progress on these issues, then they get supervised visitation. These evals have sub-scales to detect lying, trying to make a good impression, etc. I know they have psychologists who do these assessments with an eye to parenting. THere is some argument (though legal right probably trumps) that Kiara is doing fine without TH around now and to bring her back might upset her, especially when it isn’t know when the longer outcome would be.
    I also thought like someone else that TH wasn’t supposed to have contact with any of her children.
    Re: TH being preggers, usually there is a puffiness around female’s faces when they are pregnant, though I am not sure about the ones who are sick a lot in the beginning.

    Re:Expungement is the only word I have heard in OR (have no idea what happens in other states). People can get their legal records expunged on misdemeanors and arrests (that have no convictions) after 3 years, I think. For a fee of course. I think it is pretty hard to expunge felonies, unless the law changed in there, which it has on a rare occasion. Lucky dogs who got their traffic tickets wiped out! However, nothing goes off you DMV record, that is a different record.

We have commented on demeanor and appearance of TH, KH an DY as well; we have seen much more of KH and DY. What does it say and how does it influence us? And inversely what does it say about TH? It would change the views of many were we to see and hear sadness, regret and innocence.

    I would love to be the one selling tickets to that visitation hearing, don’t you know? Especially when Kaine presents evidence of WHY TMH may just not be a very suitable mother right now, and TMH slings mud back at him. Of course, there will be an ad litem for Kiara, and a child psychologist or two appointed who will try to decide what parenting arrangement is in the best interests of this child. This could get very tricky, IMO. Very tricky. God bless and protect that sweet, innocent child.

Kaine’s son is abducted by some thug(s) and LE tells Kaine that said damsel wanted her Latin lover/lawnmower man to kill Kaine.

    So, I think Bunch trying to second-guess Kaine’s motivations is pretty chickensh*t, but a lawyerly thing to do. But, can any one of us actually blame Kaine for trying ANYTHING to get his beloved son back???? I can’t.

    When I hear lawyers get uppity in court when it involves a missing and endangered (possibly deceased) child it makes me want to HURL all over their shiny Italian loafers.

    A couple of thoughts I’m having – I’m not 100% convinced that they didn’t find anything on Sauvie Island. I can no longer find the spokesperson’s exact quote, but it was something like “to my knowledge” they found nothing. Makes me think of all the times the white house purposely keeps the press sec. in the dark so he or she can honestly deny something, when its actually true. So, possibly they don’t tell her what they find so she doesn’t spill it to the press. Maybe this is all just wishful thinking on my part, but its seems like they are awfully fixated on Sauvie Island. I have trouble thinking a cell phone ping is all that’s leading them. I’m sure if they found an actually body, they would announce it, but maybe they would not share it if they found other physical evidence. I can hope, right?

    The Albertsons – I don’t think I’ve ever heard anyone claim she was at Albertons on June 4. Only that they were asking for tapes. And if I recall correctly they asked for tapes for June 3 and 4. So maybe they aren’t looking for her movement AFTER Kyron went missing, but before? I heard a rumor early on that she bought something suspicious. And that would explain why she might be so far from home – making sure no one would recognize her.

    I didn’t realize TH & KH picked up Kyron’s backpack & coat from the school. There was discussion earlier in the investigation as to whether Kyron’s lunch or lunch money was in the backpack. If he had neither, we would have to suspect TH knew in advance that Kyron would not be at school the entire day; and would be gone before lunchtime. I’m very surprised LE did not take the backpack & coat. Those items would also have Kyron’s scent on them.

    TH might have had opportunity to remove things from the backpack (and possibly coat pockets) at home, unless KH took Kyron’s belongings into his possession from the beginning and looked through them himself. If so, he could confirm whether or not there was a lunch or lunch money in the backpack. How soon did LE begin camping out at the Horman home? If immediately, they would’ve been present while TH or KH went through the backpack & coat. How observant were they?

    I’m wondering if there were opportunities to collect evidence early in the case that were overlooked by LE, and also missed opportunities by LE & KH to observe TH’s actions. It’s so much easier to recognize those opportunities in retrospect, but now those opportunities are forever lost. It seems like so much has worked against our dear little Kyron before and after his disappearance. :( Let’s hope things are about to turn around in his favor.

    Your post prompted me to re-watch videos of Terri from the most recent hearing and I do see your observation. I also see a very “schooled” and “rehearsed” demeanor. If she is hiding behind a facade…can we really know what her body language is saying? I felt she showed more of a “practiced attempt to look nonchalant and their hopeful representation of ‘not guilty’ to obscure an actually very fearful woman”.

    Thank you again for your sentiments…they warmed my heart and soul.

    Prayers for Kyron and his family and all the wonderful people trying to find him and bring those involved to justice.

    About two weeks ago there was a woman mowing the grass. Getting “questioned” does not imply much. Many of us have been interviewed so often that it starts to feel as if MCSO/FBI is part of our social circle :-) .

    Could Suit Money be a big clue in the case? Follow the money Theory:
    Person who paid $350k suit $ could be a person who knows something, doesn’t want to get caught?
    How did it come about that TH employed House? Did TH find House or did House find TH?
    Maybe somebody could have made a call to House and said something like: “represent her, I’m paying for it.”

    SI Phone pinging: I wonder if Ky was set up that 6/4 day to call TH from a phone on SI, something like, “I’m here, come get me…?”

    Why repeated SI searches? Did the Horman’s ever have a dog die? Sad to say, one can google how to bury a beloved family pet, once buried, they say add lime, hard to track.

    Blink, please continue to help put the pieces together, the whole thing is so disturbing.

    Karey…I’m not sure if the absence of lunch money would mean anything. Most schools (Pre-K thru 6) are on a system where a child is to learn a number/code to remember when in lunch line with the cashier. Most parents I know of children that age prepay for lunches by sending a check in or online by debit so the child doesn’t have to carry aroud money. This has been in place a while and has cut down on stealing and bullying classmates for their money. But then again, Oregon may be different.

When I was growing up in the late 60′s you never heard about child abductions or missing children. Now it happens on a daily basis. Times sure have changed and not for the better. Very sad.     The message is, AGAIN?? The message from MCSO? The implicit “message” from all the intensified searching? Or does this simply mean nothing?

    Maybe the message is “look how hard we’re searching; all these volunteers giving up their weekends, in the rain; don’t be afraid to come forward with whatever tip you have because we really, really need it. We’re looking everywhere and finding nothing but bones and junk piles.”

    It’s obvious she’s not asking the perp to just confess. (unrealistic) There have to be innocent people who are afraid to get involved because they think it would be risky to themselves and their families–I sure would fear that. Or because they don’t want their privacy invaded by the media. Especially if they don’t know if their tip would have real value. That’s who I think she’s talking to. And that’s why I think she finally said what they’re (not) finding.
