Kyron Horman Missing: Kaine And Terri Horman Face Off In Family Court

Portland, Or– Following one of the largest organized search weekends on Sauvie Island since Kyron Horman, 8,was abducted from Skyline School on June 4, his step-mother and father squared off in family court. Kaine Horman, Kyron’s father, arrived with his attorney, Laura Rackner.

Kaine’s estranged wife Terri Horman, arrived with her criminal defense attorney; Stephen Houze and her family law attorney Peter Bunch.

Mr. Horman appeared in a crisp-white dress shirt and tie, and Ms. Moulton-Horman wore an eggplant hued suit with a long skirt.

Cameras were banned in the downtown Multnomah County courtroom; however, there were apparently several hidden “nests” as the tweets were flying real-time.

Peter Bunch, counsel to Terri Horman, is adamant his client is the subject of more than one criminal investigation:

“The state has the ability to obtain every single bit of information that is produced in this case and that is outside the bounds of what it could do were this proceeding not occurring,” Bunch said in court.

“It is fundamentally unfair for Kitty (Kiara) and for Miss Horman for me to be hamstrung in the divorce case for the information I have compared to what they have.” “The publicity that’s going on is not being driven by Ms. Horman, it’s being driven by Mr. Horman, when he tells national media there’s no doubt Ms. Horman is involved.” “If Mr. Horman is really interested in what‘s best for the child, then Mr. Horman wouldn’t object to any visitation by this child’s mother.” “We’ll concede, Mr. Horman can have the house, right now. Mrs. Horman is going to lose money…”

Terri Horman has not been declared a suspect in either Kyron Horman’s disappearance or the alleged murder for hire plot against Kaine Horman. She is however, seeking access to all of her 911 calls dating back to the DAY AFTER CHRISTMAS.

While this timeline coincides with accusations by Kaine Horman in his filings that Terri attempted to arrange to have him murdered, this is the first public revelation of that call. Bunch went on to say that Rackner and Kaine Horman, who are parties to case sensitive criminal investigation materials involving Terri, are at a supreme advantage to his client who should only be expected to plead her protections under the 5th amendment as a result.

After heated debate by those sides, we learned: Rudy Sanchez, the infamous landscaper/hitman for hire, has an alias, and has eluded service in the civil matter to date, although he appears to have cooperated. Bunch proclaims Sanchez is unlocatable as a result of MCSO unwillingness to share discovery of a witness in the civil case ( blink holds hands over eyes).

Michael Cook, a/k/a sexter king, waited all afternoon via subpoena by Rackner, but was only interviewed by the press. He states he cut ties with both Terri and Kaine days before he was outed for invasive scapular intrusions. No word on that healing process.

Terri Horman had her own personal black Friday this year.

She called 911 THE DAY AFTER CHRISTMAS. Regular contributors and readers of blinkoncrime.com doubt she had sale flyer questions.

Judge Keith Meisenheimer, was sensitive to Kaine and Kyron’s ‘round the clock nightmare, but feels some time may allow things to shake out. January 6, 2011 to be exact.

Following this afternoon’s legal melee, blinkoncrime.com Editor In Chief asked prominent Washington State Family Law Attorney, Lea Conner, to weigh in:

Although I preface my comments with the fact that I practice family law in Washington State and not in Oregon, I am an Oregon native that has followed this case closely.

I’m a bit perplexed by Peter Bunch’s reasoning that if the court were to abate the dissolution, he would respond by filing a motion to modify the restraining order so that Terri Horman could have visitation with the parties’ daughter. Essentially, Mr. Bunch is arguing that the abatement would prejudice his client’s ability to parent her child. My understanding of the Multnomah County local rules is that an abatement means that the entire case is halted. Neither party can bring a motion before the court, nor can the court hear argument or make any ruling on motions.

It was also interesting to hear Mr. Bunch argue that proceeding with the divorce would violate Ms. Horman’s right against self-incrimination in the disappearance of her stepson. This is the first time that Terri Horman has publicly acknowledged any self-incrimination issues. In her motion for abatement, Ms. Horman, through counsel, argued that the ongoing investigation into Kyron Horman’s disappearance had made it “virtually impossible…to proceed with divorce-related issues in an effective an[d] orderly fashion[.]” Were Mr. Bunch to bring a motion to allow visitation, Mr. Horman would no doubt argue that Ms. Horman’s actions demonstrate that Ms Horman or someone she knew was responsible for Kyron Horman’s disappearance, and that her behavior since Kyron’s disappearance shows that she is unstable and poses a threat to their daughter’s safety.

I do not believe Mr. Horman would raise Ms. Horman’s 2005 convictions for DUI and reckless endangerment, as not only later chose to have a child with Ms. Horman since that time, he also left both of his children in her care for extended periods while he was at work. Under those facts, it would be hard to conclude that Mr. Horman believed Ms. Horman posed a threat to their daughter. The judge’s comment that “[e]ventually, Terri will have to decide whether or not to plead the fifth, regardless of the timing of the proceedings,” seems to indicate that the judge may not be willing to hold the action in abatement past the January 6, 2011, hearing.

I’m also interested in Mr. Bunch’s comment that “Rudy Sanchez” is an alias. If that’s true, then what is Rudy Sanchez’ real name, and how exactly did he first come in contact with Terri Horman?

It was also strange to learn that Michael Cook was subpoenaed to testify at the hearing. I’m curious if there were others scheduled to testify as well. I cannot speak to how the Oregon court operates in practice. However, I note that each party provided written affidavits in support of their respective motions.

Is there some reason that Mr. Cook’s statement could only be presented in oral testimony?

I’m not sure I understand Mr. Bunch’s logic in saying “If this is not abated we will not get reciprocal discovery.”

The state is not a party to a dissolution action. In a dissolution action, the parties can seek discovery from each other, and depending on the court rules, from third parties as well.

I’m not sure why Mr. Bunch would have the impression that there would be reciprocal discovery with a third party in a dissolution action, especially when that third party is law enforcement.

There’s a disconnect between Mr. Bunch’s argument that Ms. Horman cannot defend herself because she would incriminate herself in the disappearance of her stepson, and his statement that “If Mr. Horman is really interested in what‘s best for the child, then Mr. Horman wouldn’t object to any visitation by this child’s mother.”

The apparent logic is that Ms. Horman admits that if she speaks, she will incriminate herself in some as-yet-to-be-named crime related to Kyron’s disappearance, yet Mr. Horman is now supposed to trust her to care for his other child, because that’s so obviously in their daughter’s best interest.

    Nothing noteworthy to report from that post. I simply was relaying to Beejay that the tone around the Skyline area was gloomy on Sunday. I am out on the “Ridge” as locals call it (on Skyline Rd) a few times a week and I have to travel very near to the school to get there. I did not see any activity at the school that day that would have indicated a search of that area again.

    Well said neighbor. I’ve only talked to them a couple of times, but I know many in the community are on a first name basis with the FBI.
    It doesn’t seem to me like they are trying to solve the mystery now. They are building a case. Naturally they want to make sure they understand the GK story completely – they don’t want to get surprised in a trial. MOO.

    Since we are talking about the GK again, something has always bothered me about him.

    1. August 11 – LE goes on television asking about a very specific sighting (the white truck) at a very specific time (8:15 – 8:45 morning of Kyron’s disappearance). They ask that anyone with information contact them.

    2. August 12 – the very next day. GK fits that request EXACTLY. White truck – check. Time of day – check. Hmm.. GK doesn’t contact LE apparently – he goes straight to a local news station? Who would do that? There is a child’s life at stake here!

    3. I do not believe that LE didn’t interview him in the early days of the investigation. That would be such a huge oversight IMO. I don’t think that LE is incompetent. Maybe neighbor can chime in and let us know if she had conversations with LE about the blocked off parking spaces BEFORE GK went on the local news.

    4. So assuming that LE DID interview him earlier and assuming he was asked like everyone else to keep quiet, what was the purpose of his interview with the local news? Again sending a message to someone per LE request? The information he released: No white truck blocking the access road between 8:15 – 8:30 , kids out front looking at a garden.

    5. The other option is that HE was the sighting and he knows it, LE knows it (could he be the fat guy in the plaid shirt?). Going to the local news would seem to be a strange choice in that case.

    I don’t really have a point – but this scenario has always seemed so off to me.

    @Jeff D, I, too, loved your thoughtful post from the other day. You also bring up a good point about TH’s appearance. I don’t care if she loses 50 more pounds and dyes her red mane blonde, she has a coldness about her face, her eyes, that can’t be hidden. There’s no soul in those eyes. IMO.

    to me, Kaine just looks…stricken is the best word. He and Desiree are cloaked in grief. It’s terrible to see. I feel for everyone and hope there are answers soon. Wonderful posts by all.

    I know on the last thread there were several questions regarding how RS was able to be part of the landscaping and etc and the school.
    I came across this post that I found informative. Link is below.

    Skyline Elementary, Northwest Portland: Under Jill Inahara’s leadership, the cafeteria replaced disposable trays with reusable trays that parent and student volunteers wash. Instead of throwaway “sporks,” kids use metal utensils that Skyline families donated.

    Students also sort lunch leftovers: Meat and cheese go into a bucket for a neighbor’s pigs, while other table scraps go into a bucket that feeds a teacher’s chickens. Cafeteria trash decreased enough for the school to eliminate a Dumpster, saving Portland Public Schools about $1,700 a year, Inahara said.

    Skyline also made its landscaping more sustainable by ripping out English ivy and replacing it with native plants.

    Inahara, who’s also co-chairwoman of the Eco-School Network, shared these secrets to her success, which included spending hardly any money:

    Grants. Inahara wrote grant proposals that brought in not only an AmeriCorps volunteer who focuses on reducing solid waste at the school but also money from Metro, the Oregon Watershed Enhancement Board and the West Multnomah Soil and Water Conservation District for the landscape work.

    Community help. Inahara got volunteers for the landscaping project from a nearby church, Hands On Greater Portland and two Boy Scout troops.

    School custodians. “They’ve been saving garbage for us so we can do waste audits,” Inahara says. The school also has competitions to see which classroom can generate the least trash; custodians help track the trash

    Thank you Melissa for explaining about the lunch “code.” Yes, my children use the same system in Kyron’s neighboring school district. So much easier to just remember the number for lunch, the kids love having their “own” code word/number. Backpacks and coats are all over school and for the most part ignored, sometimes they don’t make it home for days at a time. Location of a backpack, coat, means little normally. Weather or not there is a lunch, or money in pack means nothing also, they use their code. Kids in Oregon go outside without coats all the time if it’s raining, that also doesn’t mean a whole lot. Many actually go to school in flip flops year round, go figure. Boot prints mean nothing if it really was “chaos” the morning of the science fair. That school goes through eighth grade, those boys have huge feet. If it was “quiet” when all this took place, at odd normally locked door, foot prints could be something. Just some basic thoughts.

    The topic of the “boot Print (s) has come up recently
    and I’ve been pondering this.
    I live in Oregon in one of Portlands suburbs about 20min from the school.
    Some of us here wear hiking type gym shoes when the weather is yucky
    and especially if we are going to be outside. The dress here is
    different from other places in the country, kind of a northwest look.
    Having said that if we take into consideration the person/people who could have worn boots that day we would have to include people who wear the hiking type gym shoe, as the are also considered boot type shoes. Women included wear these, However: they are most definately a favorite among landscapers here. Yes I checked em out, lol! the landscapers that take care of our yards in my housing area all wear a form of these.
    The other type boot is a work type boot, mostly men wear these and the people I know of to be POI in this case are the Groundskeeper, and possibly a dad or two. Usually required for certain jobs as most have steel toes to protect from their work environment.
    That said, I don’t believe many parents went out that door and that eliminates my thinking as to who would have had a need to go out that door that was wearing boots?

    I have spent quite a bit of time last few days doing name searches for the various mutations of all of the LS related names in this case. I’m just using the freebie searches and didn’t really turn up too much that hasn’t already been out there. One thing I did see that I thought was kind of interesting was in regards to Anselmo. Doing a search for the name “Anselmo Sanchez” in Oregon on PeopleSmart, the first name that pops up is Yolanda E Anselmo of Woodburn, OR. It shows other variations of that name being Anselmo Satay Sanchez and Anselmo Yolanda ESTRADA.

    When I enter the name Yolanda Estrada in Intelius I get even more variations. I get a relative named “Estrada Alredo Anselmo.” “Freddy” could maybe be seen as a variation of Alfredo. I think Yolanda is a female name, but if there is one thing I have learned in researching these names, is that I have seen multiple variations mixing up multiple names.

    These names may be totally unrelated to the case. One thing I did notice is that the last reported address for this person ends in Nov 2009. According to Blink’s “Kyron Horman Missing: Case Review and Birthday Wishes to the Frog Prince” article he was “found and apprehended in August 2009.”

I can no longer find the spokesperson’s exact quote, but it was something like “to my knowledge” they found nothing. Makes me think of all the times the white house purposely keeps the press sec. in the dark so he or she can honestly deny something, when its actually true. So, possibly they don’t tell her what they find so she doesn’t spill it to the press. Maybe this is all just wishful thinking on my part, but its seems like they are awfully fixated on Sauvie Island. I have trouble thinking a cell phone ping is all that’s leading them. I’m sure if they found an actually body, they would announce it, but maybe they would not share it if they found other physical evidence. I can hope, right?

    Since that is a deviation from the amazingly consistent comment she made to every news reporter (for 2 weeks running) it definitely stood out. Have to accept that it could be creative editing.

    But, I have been musing on the SI search and debating what I can post here as (MOO) ruminations…
    IIRC, they found animal bones last weekend too. No big surprise; my friend ubrmel (who has been posting the awesome photo albums quoted here many times) added one of a (?) cow leg bone she stumbled across this w/e.
    While on the one hand LE is saying, oh, nothing new/specific, we are just being thorough, anyone who lives here and stops to think about it must be noticing that the search area is actually pretty small, all things considered. Specific.

    FWIW, I learned via a post at WebS that there is free WiFi service at the RV park nearby to the Rentaaner Rd search area. Skyline parent, what if it was IP logins, not cell pings?

    Also, it’s quite a hike to the area they are searching; easily a (grr, do not want to put wrong estimate here, but ‘a while’) drive from the bridge, which takes another good while to reach. If *I* were going to make a quickie meet with someone, or a handoff or anything *planned*, I would not choose SI and especially that part of SI. Other locals have also commented about the close knit community there and how people know one another. A car mooching around near private property is bound to be noticed.
    Something just doesn’t fit quite right.

    Zahra seems like such a sweet child, just like Kyron. The abuse she suffered was much more overt, though. It’s heartbreaking to think what these kids must go through in life.

    Not sure how old this article is, but this has recently been determined to be a homicide investigation as dogs hit on human decomp in the family’s yard. Also, according to JVM show last night, LE could not find one person who had seen the “missing” 10-yr old NC girl in about a month, therefore igniting suspicion that her alleged “recent” disappearance was a lie. They arrested the stepmom on other charges but recently admitted she was the one who wrote the fake ransom note so I’m guessing this case has already been solved … again, the wicked stepmom did it. Not funny I know, but lately with these cases, it’s either laugh a little or cry and I’m sick of crying.

How does the initials GK relate to him or is this some other person? If another person, does this individual have a name?

    The step-mother admits to writing the ransom note. Really sad that all these people saw what was happening but no one stepped in.

    Oh, Blink, a hundred B’s couldn’t cover all the horrible things that are done by one human to another human or to animals.

    I live in NC. Look up “Susie’s Law and why it was passed; “Phoenix” at the GCAS (tied to a tree for 2 months no food or water). Or look up Firu the dog dragged behind a truck. And then when they realized the dog was still tied to the truck, they just dragged him the rest of the way home.

    Sorry to get off the subject. It just breaks my heart to see children and animals hurt :(

    To All, So something that struck me out of the blue as I was reading, is the subtle information Blink has given us About Rudy and his truck being registered/licensed in washington.
    It dawned on me that most of the posts I have read and the research I have done, has all been based on RS in oregon.
    So I googled RS in Washington, here is what i got.
    I think I choked on my Diet Coke when I seen the picture of Kyron on his pictures, (2nd page) of RS pictures.

    Skyline parent — your thoughts on SI have me going back to the thought that Ky was handed off in the area you mentioned. From what I’ve heard from the locals and LE it seems that it is TH who they think was on the island and that her account of her day isn’t holding up to the facts.

    I have said that I think the headless lumberjack in the June 4 photo is RS. What if TH somehow talked RS into helping her with the kidnapping. She takes a picture of RS in the room and leaves, setting him up to be caught. Then she goes off and establishes an alibi.

    RS takes Ky and meets up at FM — after going to the wrong one. TH is upset because this throws off her time line. TH then screams in and out of SI dropping Ky off at one of the RV parks or perhaps a boat.

    Whatever she told RS to get him involved would be a lie. Maybe something like getting back at KH for making James leave.

    @justice – well said, I’m sick of crying too. LOL at the GK post, we couldn’t use DS as that one is already taken. I don’t know how anyone new here knows what we are talking about, we have created our own little language with all the abbreviations.

    @ Karey – The North Carolina case appears to me to have more similarities to the Caylee Anthony and Haleigh Cummings cases more so than to Kyron’s.

    The Caylee Anthony case, in that apparently this little girl has been “missing” quite a bit longer than a few hours as first reported, and might be as long as a month. Seems like it took the Anthonys quite awhile to finally report that they hadn’t seen Caylee around after Casey supposedly left her with the “babysitter.”

    The Halieigh Cummings case in that the stepmother/caretaker was apparently supposed to be home alone “babysitting” the child, just as Misty Croslin was, and somehow this child just turned up missing out of the home during the middle of the night according to their story told to police.

    The only parallel I see to Kyron’s case is that the stepmother is under suspicion, however, in this case in North Carolina, the father appears to be under suspicion and culpable as well, while Kaine Horman has escaped this fate thus far.

    Just my opinion. Sadly, all of these cases do have one, common, universal thread: missing, innocent children who did not deserve their fates.

    Correct me of course if I’m wrong, but I read on this site that Blink referred to searchers or LE knowing something from the previous Wednesday prior to the first new weekend search on SI. That, combined with Desiree’s plea for more reward funds; then the search is re-started and highly visible. Then it is reported that donations came in to bump up funds already collected.

    Is it possible there’s a little game being played here involving financial demands from the person who might know where Kyron is? No matter what his fate was? Or some sort of set up by LE?

    I know that our NYS troopers and my county’s sheriffs have more than plenty of times played games with suspects — acting out specific behaviors in public to coax a suspect to either panic, screw up, attempt to commit a second crime to cover up involvement in a first crime, or just offer LE another another even accidental solid lead.

    Has ransom been a game in this case all along? Ransom not neccessarily to produce Kyron, but to produce the culprit?

    Money donated at fund raising events in this case is sitting still. Why?

    My best friend is head of handicapped education within the schools for this region.She has turned parents for verbal and emotional abuse and so on.This would never have slipped by her.She is on point when it comes to her students.Too bad she wasn’t in this angels district.The step monster would have been in jail, the child with caring adoptive parents.

    Thank you for that link Jan, I did see that webssite earlier today, but iirc correctly someone on an earlier post, possibly another thread, indicated that Bill was no longer with the school this year.

    Hmm interesting about the free wifi. Wasn’t there some talk about her facebook posting times not jiving with her stated timeline. Could she honestly be THAT stupid?
    The SI thing has always bugged me. I hike a lot around here and even on nice day I sometimes don’t see a soul for an hour or two on the fireroads up here. And there are many many deep overgrown culverts so why would someone go to SI? The only thing I can come up with is that since SI is a hunting preserve gunshots wouldn’t be noticed or remembered. Horrible thought.

    @AliceLeeBee: The similarities in the Kyron Horman & Zahra Baker cases I had in mind (other than suspicion turning toward the SM) are the ransom note, the children being kept in their rooms at home, and both children becoming upset on preparing to return home after a visit with another family member. In Kyron’s case I think the ransom note is still speculation and hasn’t been confirmed. I was wondering if, should there be a break in one case (likely Zahra’s), LE in OR would solicit input from LE in NC as to a motive or MO, or personality profile of perp to draw a parallel. Obviously, Zahra wasn’t held for ransom (the ransom note oddly enough suggested that the daughter of Mr. Baker’s boss was kidnapped), and I don’t believe Kyron is being held for ransom even if there was truly a ransom note. Thought it might be a way of getting inside the perp’s head if there were a confession from ZB’s SM and NC LE shared the details with OR LE. Altho the perp in Kyron’s case seems much more sophisticated, there would probably be similarities in the thought processes of both perps. Does this make sense???

    Maybe part of the reason is that she was being homeschooled. If Zahra attended a public school, her absence would’ve been noticed immediately. At this point, LE has no idea how long ZB has been missing. Her parents claim she went missing overnight. Obviously, LE doubts this and that is why her dad is also under suspicion. But, there were other relatives involved in this girl’s life, including the aunt (I think) who confronted the SM about her treament of Zahra. Wouldn’t she have known something was wrong if she hadn’t seen the girl for a whole month?

    Sadly, this is an issue I have with some home school parents and the lack of checks into home life, health and welfare of their children. I know there are many great home schoolers, but there are also those who say they are home schooling, but hide away in those homes and no one out there checks up on them. So the abusers, molesters, etc., are alone with those children and no one is keeping track. Many of those children at the least are NOT being schooled properly, and at the worst, are also being abused and no one knows. This child hadn’t been seen for a month! NO one was looking out for her-no one at all.

    At least out in the school system, someone may have seen something abnormal, reported it, and been able to save her. This case is so far beyond sickening that I can’t bring myself to seriously think about how many balls were dropped by so many people.

    Family members, neighbors and friends have said they knew how bad little Z had it at home, but as far as we know-not ONE person stepped up and tried to help that little girl.

    When Hilary Clinton said the famous “It takes a village to raise a child”, she wasn’t freaking kidding and I just wish that more people took that quote seriously. I am disgusted if no one turned these monster parents in, and even more disgusted if someone did turn them in and CPS did nothing.

    Not trying to hijack Kyron’s space- just thinking of all the other missing and tormented kids out there and wishing that we could save them all….

    Blink, I’m at work but I need to correct what I said yesterday about the abused dogs.

    “Phoenix” is the dog that five kids 10 to 17 years old tied rags around his body and set on fire (miraculously, he’s ready for adoption). And did the family take him for medical care when they found him? No, they let him lay there for about three days because the mother thought her son would be accused of it.

    “Chamberlin” is the dog that was left tied to a tree for 2 months with no food or water and was found by someone mowing the yard. The sorry excuses for humans who moved out of the house leaving him tied there said he wasn’t theirs. The dog left in the house had to be euthanized.

    Stopping on my animal abuse rant but it makes me so mad I could render justice my own self. Back on topic.

    Off topic… I lost my baby brother to Ewings Sarcoma. He was older, in his twenties at the time, but still way too young. Maybe this is why these cases tug so hard at the heart strings… so much potential lost way before their time…

    Your only the second person I know that had a relative die from ewings in their twenties. The other is actually the Father of Christine Sheddy’s daughter. He was 26. Yes, it absolutely drives me that sometimes we lose the good ones and the bad ones roam the earth.
