Caylee/Casey Anthony Case: Casey Anthony’s Defense Has Gone To The Dogs

As previously reported on blinkoncrime.com, the hearing last week ordering Jose Baez and his defense team to submit specific information regarding their expert witnesses, has gone to the dogs.

Woof!

Dr. Fairgrieve, a forensic anthropologist and expert witness listed for the defense, intends to testify that Casey Anthony should have the right to confront her accuser.

Novel, appropriate, good news.

In this instance, one of her accusers with fur, according to her defense attorney, is named Gerus. The other, Bones.

For starters, if the summary of Dr. Fairgrieve’s findings is accurate as presented in this filing, I recommend as a practical matter, he identify exactly what “alerts” he is seeking to debunk.

There are several, all of which are well documented.


Orange County sheriff’s investigator Carlos Padilla told reporters, “We had two different dogs from two different counties that hit on the same exact spot.”

Evidence Bay with a closed car:

Casey Anthony’s Car: Detectives reported a different dog alerted to the same strong smell in the trunk after the white Pontiac had been abandoned in a parking lot.

“They have a hypothesis that the child may have somehow passed away,” Dr. Richard Weinblatt told Eyewitness News.

It is undoubtedly the recent work of Dr. Fairgrieves in a case involving a murdered man, Robert Wone, that got the attention of Jose Baez and his Scheme-Team.

In a successful inlimine motion, Fairgrieves offered testimony in the supporting affidavit that suppressed canine evidence in the Robert Wone murder.

The three male house mates of Mr. Wone were acquitted of the charges they faced as a result, which were not for his murder. The prosecutor himself could not prove his actual cause of death. The trio are currently facing a wrongful death action by the desceadent’s family. 

“My role in the case is basically peer review,” Fairgrieve told the Orlando Sentinel. “I will be reviewing reports on the evidence. So far everything I’ve done has been remotely.”  Scott Fairgrieve, MD

The ole probative vs. prejudicial argument is not unexpected in this case, I get it.

However, two different cadaver dogs, from two different counties, hit in the same area under or near Caylee’s playhouse. This was AFTER the alerts in the evidence bay on the car trunk, and both searches were conducted with permission from the Anthonys.

That would be the car trunk that produced one latent lift from the accused in this case, Casey Anthony.

Under Dr. Fairgrieve’s theory of “necessary corroboration”, we, in fact, have exactly that.

The hairs that were found in the trunk, including the hair with the “signs of decomposition” corroborate the canine’s alert as well as the report from Oak Ridge Labs.

Let us not forget, that a statement from the car’s owner and material witness in this case, concurs with the presence of decomposition in the damn car.

    NancyS, yes, Dominic Casey was interviewed by John Allen of OCSO and some members of the FBI at Brad Conway’s office. Sorry, I could not find the transcript in the document listings, but they were released some time ago. It’s a very long transcript which took me a quite a while to read and as I remember, it’s not as revealing as it is long.

    I think Dominic Casey knows everything. I just want to know if it will ever be released to the public, or even brought up in trial.

    Dom Casey has/had a level of privilege as it relates to work he preformed “as an agent” of Jose Baez. That said, he held agreements with Casey, her parents and Baez, he says simultaneously, imo, so he could get out of testifying altogether. This will not work.

    However, there is some discrepancy, as Baez never paid him, and it is unknown if anyone else has.

    Bottom line Ms. Blink, what do you believe happened to that poor baby, who are the “stars” and who, if any, would be the supporting cast? I am in no way stating this is like a movie at all, I do not want to take anything away from precious Caylee, just looking for a new and refreshed take on what you and all think happened, I have my theory, just wanted to hear someone else’s.

    Blink, how often will Baez waste the courts time with these DP motions. We have already visited this a couple of times with Judge Strickland and of course it stands because of the circumstances of duct tape to Caylee’s face etc.

    I am so behind on this case due to yet another brother getting sick
    this other brother had a heart attack saturday what made it more of a risk is that he is insulin diabetic and has ms and had five other strokes. he had a heart attack saturday and on sunday 1 quadruple bypass looked iffy sure enuff we were called back to the hospital yesterday after just leaving because he had bleeding in his lungs. so please keep us in your prayers.

There was some suggestion in his email that he might not, depending on the resolution of this issue,” Judge Perry said.

    Defense attorney Cheney Mason had said in court earlier this year that Lee would be willing to work for a crate of oranges. However, Lee has billed the state $7,500 for three days of work last summer and was looking to get reimbursed for his travel expenses, as well.

    Blink, I saw that embarrassing moment of Baez’s- I thought he was very unprofessional- interrupting the media’s response in order to object to “the camera man” taping Casey writing notes- I watched it again- and IMO- nothing new or out of the ordinary occurred. Casey is always writing notes and the camera man wasn’t even focused on the page ect…

    Ms. finell seemed to nudge JB to object though- so maybe they are going to go for a harder stance on all of the media coverage/cameras ect- inorder to make sure their objections are noted come trial time- where they will strongly object to the trial being broadcast?

    Also- Ms. Finell’s whole argument, I found to be nonsensical and hypocritical- (Perhaps it would have been sound if it was given BEFORE Baez opted to have Caey’s case in the media) Ms. Finell argued that the coverage this case is preventing her clievnt from getting a far trial.- She broughtup the fact that the hearing is being televised nationally, online ect- She sighted the Sam Shepard case- -(believe me there is no bushy haired stranger involved here although Casey did say Zanny straightened her naturally curly hair)

    Well pardon me Ms. Finell, I respect your trying to defend Casey Anthony to the best of your ability- but your argument does not make sense because your team member Jose Baez, fought to have Casey’s case in the public eye- He and all of the members of his team that have come & gone & even those that remain- along with Casey’s family, have courted the media from the beginning.

    They have all went on countless national tv shows, held press conferences ect. Why Jose Baez has even went further than nationally, as he is “big” on Telemundo ect- which I believe carries over to other countries….

    If you are having a hard time getting people to want to talk with your team Ms. Finell, perhaps it is only because they are afraid to be part of the circus, that Jose Baez ring-mastered? Or perhaps they are afraid your team will try to ‘Kronk’ them?

    BTW, if I am not mistaken Ms. Finell, your wanting to protect witness’s from public scrutiny must be a new practice for your team, as JB and company had no problem outing several potential witnesses such as Roy Kronk, ect…. Why if I remember correctly, Ms.Linda Kenney-Baden and Ms. Andrea Lyon had no problem in practically accusing Roy Kronk of Caylee’s murder on the national television program, NBC’s Today Show .- My goodness, they went as far as to say:

    “There is as much circumstantial evidence implicating Roy Kronk, as there is implicating our client. And that the state and police should have investigated him as a suspect, there were so many red flags, it was a sea of red,” Lyon said.”He’s the only one who’s been with the body. He’s the only one who magically discovers it. He takes a day off before he discovers it in December. He calls his son a month ahead of time and says, I’m gonna be on TV; I’m gonna be famous.”

    One last thing Ms Finell, you seem to be doing a good job. I commend you. casey Anthony is blessed to have you defending her IMO.

    Ms. Finell, having said this, perhaps since J. Baez and other members of the defense team implicated Roy Kronk- maybe it would be a good idea, if Jose Baez actually set up a hearing inorder to argue for the introduction Roy Kronk’s alleged prior bad acts……It seems the only day left to have this hearing is December 23rd- You might want to nudge JB to get in gear, especially since he and other past members of your team believe he’s the “only one” besides Casey that the evidence is stacked against- circumstantial or not.

    - You asked for it Blink you got it- an opinion on today’s court proceedings. Today in court – man oh man – it seems the that Honorable Judge Perry has decided – ” No More Mr. Nice Guy” JMO

    I think this should come in because- AR can shed light on Casey’s lies & whether or not Caylee was ever there & unsupervised ect… What Casey said- did & how it pertained to her relationship to Caylee & to her relationship to AR ect
    These chats that contain sexual language ect also show how Casey was often times was desperately trying to leave Caylee’s side and go have some fun- It shows she thought being with Caylee was harder than 12 hr shifts at a “real” job They show what she was fixated on- and what seemed to keep her attention….
    It shows that she was willing to take Caylee to a man’s house- that clearly was inviting Casey over for only one thing-and at best thought of Caylee as an inconvenience and hurdle to getting to where she really longed to be- If Anthony R had said yes- where would Caylee have been while their romantic escapades were going on? Who would have been watching Caylee then? It brings up the question of how many times AR is aware of that Caylee was unsupervised while she accompanied Casey on her romantic trysts or how many times Casey wa inconvenienced by her daughter- & couldn’t go… these texts also show Casey’s ease with lying- about her mom, about her job about Caylee’s whereabouts ect. IIRC while she was texting for this amount of time- who was watching Caylee? Did she have her asleep? What? Watching an active 2 year old takes patience &concentration. Every parent knows or soon learns that if you turn your back for one second- anything can happen. Also lets not forget that Casey used a loving term of endearment for Caylee in these texts- snot head-

    Tony- I find his statements extremely relevant- What was Casey like? Where was Caylee when they were together?- If she ever took Caylee to one of his gigs- We know from Tony’s friend that Casey left Caylee in a room full of strangers-with no shoes- we know Caylee answered the door to Tony’s apartment- opening the door that was at least on the second floor by herself…We know that Caylee asked a stranger with help putting on her shoes- we know she wistfully was alone on a balcony- We know that while Caylee was alone- her mother & Tony had skipped out to get some alone time… How often did this happen? Tony can also state what Casey’s demeanor was like throughout the time he dated her..on the evening of the 15th- and then what it was like after the 16th of June- If she was emotional- if she was carefree- ect-

    What about Ricardo???- I definitely think his testimony regarding his entire relationship with Casey should come in- What her habits were, how she treated Caylee- where was Caylee the night he awoke to find Caylee gone…The fact that Casey always had a boyfriend with other guys in waiting ect- How will this motion if granted effect Ricardo’s testimony???- Jesse’s testimony ect?????

    The knife- I am not sure about it, as Cindy removed it from the car- and I am not sure if she gave the correct one to LE- but I think it is relevant to show the totality of what was in the car that held Caey’s pants, Caseys shoes, her bag, Caylee’s car seat and momma doll, diaper bag, toothbrush, & of course all the evidence in the trunk.

    The shovel- I believe BBs testimony & the shovel should come in as not only did Casey borrow a shovel after her daughter was missing but the dogs hit on the back yard- flower pots and empty potting soil bags/ & an empty play sand bag were found at the remains site. Also he can testify to Casey’s demeanor appearance language (bamboo shoots)the car in the garage ect ect.

    Casey’s past lies and sexual history are very relevant- because it shows that Casey’s lies were centered around Caylee or leaving caylee or around covering for Casey’s inability to go off freely to live the life she wanted- saying things like Sorry I can’t go with you tonight- Caylee is with me- Cindy can’t watch her or Zanny bailed- Oh I have to work=I am with Caylee- =or I am skipping out on you to hang with some other guy…. (just my thoughts not actual quotes)

    Casey’s theft& lying is relevant because Casey said she only stole from Amy because she was desperate- She would lie, cheat and steal and do anything inorder to get her daughter back… when in reality- she was doing what she had always done- lied when it benefited her- to cover-up something she wanted to hide- she stole to support her lies- and play the role she had cast herself in – self supportive single mother who could afford a nanny & could buy her friends stuff ect. She lied – She cheated & She took other money ect because it was convenient and easy. She was doing it long before Caylee disappeared and it only continued after … Jmo

    Tim Miller’s testimony – It should come in but I dont know if the part of what Casey seemed to be about to “mark on the map” will be allowed — perhaps if it is stated as only his opinion? The rest of his testimony should definitely come in.

    Will the defense will be successful in these motions to preclude?- IDK but even if they are, I think the Prosecution has enough to set forth their case against Casey Anthony IMO they also have enough to show why some of these things should be allowed in

    As to whether or not The Kronking of Mr Kronk is “donesky”, at least how it relates to Jose Baez’s inability to set up a time for a hearing – I just don’t know

    I would think that the defense wouldn’t take chances with the person they said was implicated as much as their own client (due to circumstantial evidence only of course)
    but I guess they are willing to go to Plan B- bring it up at trial where The prosecution will object-’undoubtedly’ according to JPerry.

    This turn of events certainly makes me question the defense’s motives in going on numerous tv shows and playing those taped videos of Kronks ex and her family ect.

    BTW- Did Roy Kronk’s son ever get tracked down to give a depo? Does this turn of events mean that the prosecution can stop trying to get Kronk’s son to give a depo??

    Ashton filed motions questioning exactly what the defense’s experts will testify to.

He also cites rules stating an attorney can be subject to “contempt proceedings” and costs by violating discovery rules.

    Ashton says the state will reserve its request for specific sanctions until a hearing is held, but noted that any sanction should enable the state to prepare for trial in a timely way; ensure that the defense will “refrain from future violations of discovery;” and protect Casey Anthony’s “right to a fair trial and an adequate defense.”

    I think Judge Perry is NOT going to be very happy. JMO

    Hi Blink. I know the defence wants to omit Casey’s prior bad acts at trial as it is prejudical. Do you know if the prosecution will be allowed to bring up the fact that Casey is a convicted felon and that she stole checks during the time Caylee was “missing” from Amy, who was her supposed best friend?

    Blink, or someone – could you explain why Baez thinks a mistrial would force a plea? Wouldn’t they just try the case again? Or do you mean he thinks a mistrial would force the state to plea out on His terms? If Casey doesn’t want to plea, they can’t force her to, can they?

    1. A mistrial would be his ticket out and Casey would be assigned a PD.
    2. I do not think it would work, but I think he thinks it is the best shot at getting a plea.
    3. No, in fact if there was any evidence anyone forced her to accept a plea it would be thrown out.

    Defense lawyers Baez and Jonathan Kasen said they intend to attack the state’s case by assailing detective Dan Conlee for zeroing in too quickly on Diaz, by criticizing the work of a medical examiner and by accusing the young mother. They pointed an accusing finger Tuesday at the slain toddler’s mother, saying she had treated the 2-year-old like “an animal.”

    In his closing remarks, Diaz’s lawyer, Jose Baez, attacked prosecutors, sheriff’s Detective Dan Conlee, the state’s medical experts and the child’s mother, suggesting they all distorted the truth in their pursuit of Diaz, the lone suspect in the toddler’s death.

    A jury of eight women and four men deliberated more than seven hours before deciding Nilton Diaz, 30, was guilty of manslaughter and child abuse. Diaz, who had been charged with first-degree murder and aggravated child abuse, seemed stunned by the verdict. He looked to his lawyer for an explanation.

    Defense lawyer Jose Baez asked Circuit Judge Mark Nacke to set aside the verdicts, arguing they were based on undependable, controversial and conflicting medical evidence. Baez said the prosecution’s case was filled with reasonable doubts.

    “We all know something happened to this child, but we still don’t know what,” Baez said. “What it basically boils down to is pure speculation.”

    “This simply can’t stand,” Baez said. He argued the jury’s verdicts were inconsistent. Baez said child abuse is an intentional act, while manslaughter is a death resulting from an unintentional act. He said an appeal would raise that issue.

    Nacke refused to overturn the verdicts.

    In documents seeking a new trial and other post-conviction relief, Diaz says he lost his freedom because of Baez’s trial performance, strategy and failure to disclose evidence to prosecutors, a tactical decision that prevented jurors from viewing a defense video. Diaz said “…Mr. Baez wanted to surprise the prosecution, and the surprise blew up in the defense’s face.”

    Baez, was not allowed to show jurors computer animation that depicted Silva injuring the child, accused the state’s medical experts of “recklessly giving opinions.” The defense has portrayed Silva as a lying child abuser and a bad mother.

    The video, created by a biomechanical expert, would have shown the jury how the toddler’s skull fracture could have been an accident, according to new court filings.

    Nilton Diaz, filed a motion for a new trial, claiming he was convicted due to the “defectiveness” of his defense attorney, Jose Baez.

    Baez called it a common post-conviction strategy that often cites defense mistakes to win a new trial.

    Sorry to be dense but I don’t understand. Do you mean if Baez takes this to trial and it results in a mistrial, he could then go to the SA and ask for a plea rather than the state going for a new trial? It would sure save alot of taxpayer dollars to plea it out instead of retry the whole shebang.

    Mom3.0, that article enrages me beyond belief. Baez is a turkey at best. I really wanted to call him a dink (well there, I said it).

    I would LOVE to see Jose himself KRONKED on the witness stand (relatively speaking). That would be righteous as heaven. Bumbling Bozo would sputter and stutter like Dumbest in Dumb and Dumber.

    The only thing Mr. Kronk is guilty of is finding Caylee’s remains before the Anthony’s and Baez could interfere. I can’t even begin to fathom how they could emotionally transfer themselves from grandparents of a slain baby girl to obstructors of justice without a hiccup.

    Lack of conscience is clearly the one gene that runs in the family.

    It burns my mind at how this whole case is turning out. As I sit on Christmas eve thinking about this little baby girl; Caylee. I think of how many loving couples are longing for a baby of their own. If Casey didn’t want her beautiful baby girl, I am sure there was a loving family out there who would of wanted an angel like Caylee. How do you kill anyone? God forbid a child? I hope Caylee is laughing and dancing around in heaven. Beautiful as ever.

    Merry Christmas all, and justice for Caylee in the new year. I can’t help thinking about her today, on what should have been her 5th Christmas. Watched my own 5 year old angel open her presents and the joy everyone in my family experienced just watching her. Remember seeing the photos of Caylee opening her Christmas presents and have to think: how do George and Cindy stand it? I mean, really? To go from the noise and joy and laughter that a young child brings to life, to….NOTHING. How do they stand it? How do they not break? We lost our beloved cat this week- he got out a door accidentally left open and I’ve been beside myself. Constantly looking for him, walking outside in the cold rattling his food bowl, posting flyers, searching the town. Crying. For a pet. I can’t imagine losing a beloved child. How do they stand it??

Like you, I have wept buckets over lost pets and I can’t imagine the heartbreak of losing a beautiful 2 year old from my life. What are Cindy and George’s first thoughts on awakening every morning? What goes through their minds last thing at night? How do they survive going mad!! Am I more imaginative than most; I don’t thinks so. I visualise sweet Caylee lying rotting in the back of Casey’s car, her remains being bundled into plastic bags, buried, dug up, thrown into a bog and all whilst her trollop of a mother is out on the tiles. No, in a million years I will NEVER understand the behaviour of this whole family!!! May 2011 can’t come soon enough for me.
