Ending The Nittany Nightmare: Penn State Pre-Game Plea, An Open Letter To President Rodney Erickson

An Open Letter to Penn State University President Rodney Erickson

With much respect -Do what I say, and do it today.

Hire the best Public Relations firm in the country for PSU’s needs.   I am redacting that recommendation for the publication of this open letter, but it is included in my email to you.  Don’t spend the time or manpower to run through the approved vendor lists and bid it out- not that kind of gig.  The Board of Trustees can WebEx if necessary and this is the kind of emergency proxy was invented for.

Once retained, have the agency facilitate meetings through their agents with Bill Parcells and Bill Cowher immediately.  Specify no leaks to the press until after they occur and by mutual agreement.   Cowher may be the low hanging fruit on this one,  he is returning to CBS next year.

If neither is interested in a head coach commitment of an 8-1 Big Ten team, follow their recommendations about who to contact next and ask them; beg if necessary, if they would be willing to consider a consulting gig for the recruitment process.  Urban Myer is a fine coach and leader, but regardless of who PSU ultimately chooses, efforts to rebuild the PSU brand must start with a nationally recognizable face of a trusted and respected winner, like yesterday.

Champions attract champions and without that, it is like asking collegiate coaching candidates to walk into the lion’s den (pun intended) wearing a raw steak necklace.  You will not even get one to tour Lasche, trust me on this.

This strategy would likely also include a public facing spokesperson effort, and worth every penny if that is all you can get a commitment for from either coach.

Pay them to sit in the lobby.  Pay them to ride the elevator a few times, but get them on grounds.  Pay them to have a motivational meeting with the team.

If you have some strong players they could attach to quickly and produce an  “I remember when I was a young fig on the tree” memory synapses, it couldn’t hurt.

Instruct all team members never to roll the eyes should the phrase “When I was your age we played ball with pads made of glass and never wore cleats in the snow”;  if they told me that I would believe it.

This is the kind of benchmarking that will revitalize wilting spirits of a young athlete, and the parents with the trembling hand over the eject button.

Half the free world is digging old milk cartons out of the recyclables to see if they recognize any kids they may have seen with Sandusky or on the sidelines of a game- they need a new visual association.

As you already know, if you are lucky enough to get this far, they will advise you to release every staffer from the interim athletic director to the water boys that were ever part of Paterno’s camp or rolled up his pants before the game. Do it.

This might be a good time to allow a try before they buy scenario if either are willing, as “guest coaches” to finish the season.

While I am at it, I might suggest a reality miniseries of the process- I know some folks from HBO familiar with the Hard Knocks of football, I would be glad to make a connection.

Donate those proceeds to Coach Parcells or Coach Cowher’s disadvantaged children’s charity of choice which is vetted in advance by a specially appointed member chosen by the new Ethics officer.

Point is, you need immediate public support and that will require immediate damage control or your Titanic does not even have the measly lifeboat option.

The public perception is that there is more to this horror movie after the commercial, and the commercials are disappearing as well.

Your job is to employ the resources that can change the channel when the public is not looking, and forget what they were watching in favor of the new programming, which includes sponsors aligned with that audience.

It is about as transparent of a plan as I can offer- with hope and promise to the innocent victims of this tragedy.

All the “clinic” posts really come down to one thing, aside from the conversation MMcQ had with JMcQ and Dr.D. I have to address that because putting together what I have read, in my mind, MMcQ went home and called his father. Does Dad say, Call the cops and find the boy? Apparently not. He must say, meet me tomorrow, or come over tomorrow, as we are aware, it was the weekend. The next day, he spoke to his dad in person along with his dad’s “business partner” at the clinic. Seems I read his mother worked there, too. That is when they made plans to see Paterno yet another “next day” scenario. I still cannot get over MD and PA doing that. Why wait? Why indeed.

Back to my main point, which is who funneled those kids in to The Second Mile, and what motive did they have? It was stated in one of the many articles that doctors were providing some of the referrals. Were some of the kids in the program going to CMSA? Is this the motivation to drag feet on notifying anyone?

I’m with Beejay on Raykovitz, and I know Rose was there awhile ago. He, and his wife who preceded, have been around TSM a long while. Someone in his profession would likely be the screener and supplier of vulnerable children.

I was surprised to read that the state was getting $47 per child per Diem from TSM for foster children. More motivation of a different kind.

Please consider all of this post as JMO, as I have not provided links on the information I have cited as reading.

@lizzy: thanks for sharing your privately-sourced info about JJMcQ’s employment status. I can’t seem to put it together with what erose posted from published info. I’m just trying to get a picture of what the current/subsequent to grand jury investigation relationships are like amongst these folks. Interesting to hear what was said to have transpired in the business. What I don’t get is, if JJMcQ was in that position for a long time (?) surely it didn’t take that long for the practices to have “been run into the ground” by him.

Then Pennsylvania Sen. Rick Santorum thought enough of Jerry Sandusky nine years ago to sponsor the former Penn State defense coordinator for a “Congressional Angels in Adoption” award, citing his work with a non-profit group he founded to provide care for foster children.

Santorum, a 1980 PSU graduate, is one of the school’s most distinguished alumni – a candidate for the Republican presidential nomination who represented Pennsylvania in the U.S. Senate from 1995 to 2007. “Not one thing was said to us,” said Bradley P. Lunsford, a Centre County judge who served on the Second Mile board between 2001 and 2005. “Not a damn thing.”

…Lunsford said …”There are a number of people around that table who have been involved with children’s charities for years and there’s a very good chance that if given accurate information about what the allegation was, there’s a lot of people around that table who could have done something about it.”

…One of Raykovitz’s vice presidents said Raykovitz also shared little information with his managers about a 2008 sexual abuse complaint that led to the current criminal charges against Sandusky.

…Asked what Curley told him, Raykovitz cited a Nov. 6 Second Mile statement that referred only to inappropriate conduct: “At no time was The Second Mile made aware of the very serious allegations contained in the Grand Jury report.””
    ________

There’s more at the link. So, Raykovitz’s judgment was that so long as it was just “inappropriate behavior” and that PSU had done their own look-see into it, he needed to do nothing more? OooooKay, then, be prepared to dig into your retirement savings.

Lunsford and four other former board members at The Second Mile point the finger at Jack Raykovitz, a close friend of Sandusky’s who ran the charity until resigning following the former coach’s Nov. 5 arrest.

But Lunsford said the charity’s board couldn’t take action in 2002 that might have prevented other assaults of children “if there’s a cover-up from the source.”

Even if Raykovitz had only limited information, he still should have acted more aggressively in 2002 when contacted by Curley and should have viewed Curley’s ban on Sandusky bringing Second Mile kids to campus as “a red flag,” Lunsford said.

Were I the DA I’d start looking for probable cause for search warrants to dig the Sandusky and other related properties. The sooner the better. Sandusky may indeed seem to have limited mental capabilities, but IMHO he is a master at portraying such. In any case, his wife and possibly others close to them would be potentially complicit in cleaning up the possibly fatal messes that tend to happen sooner or later – at the hands of others or self – when abusing little kids “en masse”, serially, over a period of decades. As for doctors passing “certain kids” along, make that child psychologists/psychiatrists and yes, in my research that’s been long long proven to be a horrible reality in that profession. There are more than a few names from PA to CA in that regard.

Beejay, this is your judge here. I swear the relationships are more complicated than an incestuous marriage. My take is the DA that replaced Gricar after Gricar disappeared in 2005, is married to a bio sib of one of Sandusky’s adopted male children AND Madeira had some knowledge in 2009 of Sandusky’s proclivities perpetrated on Lisa’s (Madeira’s wife) bio brother. Lunsford (the judge) served on TSM board during the crucial 2002 incident as his term was 2001-2005. No love lost between the DA and the judge. Think Gricar had the same problem?

  15. erose says:

To be clear about my last post, I am wondering if Mike said to Ray, that his wife’s bio-brother, who was adopted by football legend Jerry Sandusky, told her he was molested by Jerry. With knowledge of prior complaints and the inability to have enough evidence to prosecute, Gricar met with Lisa to discuss the case. He didn’t tell Patty, as she worked in the office and did not want to place her in a position to lie about his whereabouts. He wanted to have a conversation with Lisa, about Lisa’s brother and Sandusky where no one else would see them. Lisa and Mike know the truth, Gricar went missing with their information, so they campaigned for the office, so Mike could move the case forward. (Gimme a break, it’s an early working theory.)

  16. erose says:

Madeira’s opponent J Karen Arnold has a website about Gricar’s disappearance.

    snip>

This, to me, is ‘the rest of the story’, the wall against which you come up in any attempt to find a theory which is based on individual conduct–whether it’s conduct by Ray’s family, conduct by his paramour or conduct of Ray himself. None of it serves to explain the secrecy and the resistance to outside help which has spanned the involvement of Det. Zaccagni, Chief Dixon, First Asst. Smith, Interim Chief Holliday, DA Madeira, AG Corbett, Chief Weaver, and I suppose now by Det. Rikerd. One giant across-the-board stand down.

    fascinating

    April 16-17, 2005:

On the morning of Saturday, April 16, 2005, around 11-11:30 AM, I was making preparations to leave for the trip when I received a phone call at home from Officer Zaccagni telling me that Ray had not returned home the preceding evening. It was presented more as a curious situation than necessarily a foreboding one and he indicated that he was calling each of the staff to ask if anyone had information. I was asked if I had noticed anything unusual about Ray’s behavior that week, and told him that Ray had seemed distraught about something earlier that week. I was told that he had already talked to various other staff members before calling me and that “everyone is telling me the same thing”. That response has stood out for me on each occasion when I have read media statements attributed to police that there was nothing unusual about Ray’s conduct that week. I can discern no reason the comment would have been made to me at all if it were not true. And equally no reason that Ray’s being distraught that week would not have become part of the public account of what was known around the time he disappeared if it were.

Ray had a long-established contact protocol in place, under which if police needed advice or assistance, he was to be contacted first. If he were not personally available when they called or paged, they were to refer the question first to Mr. Smith as First Assistant, and if he were also unavailable, then to ADAs in the office in order of seniority. Each police department had a list of home/cell numbers for the DA staff in order of seniority for that express purpose. I was next in line after Smith.

I asked if Smith were aware of the situation and was told that he was not responding to calls and was believed to be out-of-town for the weekend. I asked if I should cancel my trip and was told that it would probably be a good idea. I was asked to come to the DA Office to let Officer Zaccagni into Ray’s office to look at his computer. I told him I was glad to come down but that I did not have Ray’s personal password and that it would take me a short time to get ready. I called my relatives, explained the circumstances and cancelled the trip. Before I left for the office, I got a second call from Officer Zaccagni, telling me it was no longer necessary that I come, as one of the clerical staff was at the BPD station and would go down and provide the access. I was told there was to be a news conference around 5 PM and that I might want to come down for that. It’s my understanding that police did review the content of Ray’s office computer that Saturday afternoon, but this is based on information from other staff after Ray’s disappearance. I was not present if/when that occurred. Nor do I know who was able to provide Ray’s password.

    The statute book:

I was asked last year by media if I were aware of an incident in which Mr. Smith found a volume of Purdon’s Pennsylvania Statutes addressing County Code on his desk after Ray’s disappearance, which when handled by him opened to the section providing for replacement of an elected DA who has died, become disabled or, in this case, has disappeared. The answer is yes. Smith brought the incident up to me within a fairly short time after Ray’s disappearance.

There are well over a hundred separate volumes of Purdon’s statutes, of which this volume was one. County Code is not something which in my experience routinely, if ever, comes up in criminal cases of the type a local DA Office prosecutes. So the fact that this particular volume appeared off the shelves at all is curious. The matter was presented to me as “Karen, do you want to hear something really strange?’ It was, and it remains, ‘strange.’ I have no answer for it. But for all of the reasons noted I do not believe that it is plausible that Ray had anything to do with its being there.

[for copyright reasons I can't post all the content here; go to the link below if you want to read it, Blinksters]

More interesting to me is the following statement:

…similar letters were sent to…[Curley, Schultz, Raykovitz, and to] two government agencies – the Centre County Office of Children and Youth Services and the Pennsylvania Department of Public Welfare. The letters directed the agencies to preserve all evidence of complaints they received about the sex abuse and investigations and any actions they took to address those complaints. “We expect to name these and perhaps other parties as defendants in one or more lawsuits,” Marshall said.”

Washington, D.C. attorney David J. Marshall, wrote those letters. He is assisting Shubin & Andronici on behalf of the “John Doe” victim (and additional victims) in the criminal charges against Jer.

So, we’re now seeing these attys clearly stating that they’re “…“focusing on the failure of a number of local child welfare agencies, whose mission involved protecting children, to take steps that could have prevented this abuse from continuing.”” [that's a quote from Shubin] This is good.

Erose’s link to the suntimes article is very valuable. We’re seeing names, of those who are willing to speak publicly, of staff and directors of TSM. And who might be suing whom.

A PA lawyer will need to explain how this can all go. But, generally what I’m seeing is this: Hot potato, hot potato, who’s got the hot potato?

That article says that TSM carries liability insurance to cover their directors–that’s errors & omissions insur. Pays for their legal defense if they screw up. Employees SHOULD also have it in their employment contracts with their employer that they are fully indemnified, and E&O insurance is maintained to pay for legal defense,if needed.

Of course, IDK if Raykovitz, Genovese, or other staff have those agreements with TSM.

Anyhow, E&O coverage is VERY expensive and can be cancelled. And the policies differ widely on what period of time they’ll cover, etc. And one can cancel one’s policy and hope the covered persons don’t find out.

But, clearly, TSM has a lot of places its remaining funds must go. And was encouraging donors not to donate once this came to light.
Somebody is gonna be stuck paying for a costly legal defense. No one wants it to be them.

    Great article; thanks erose.

The company named was NanoHorizons, Inc. David Woodle is its Chairman, CEO; Sec of State’s records show corp filed to do business in PA in 2005. That’s the year that Rendell made a move helpful to Woodle’s company:

“…Governor Rendell launched the Pennsylvania Initiative for Nanotechnology, or PIN, in 2005 as a statewide strategy to bring together commonwealth agencies, universities, businesses and economic development organizations to leverage the state’s clusters of research, industry and workforce development assets….”

One of those universities, is PSU–a research group there.

Back to the 2010 press release,

“Centre County Industrial Development Corp. worked with the NanoHorizons and the Governor’s Action Team to secure the commonwealth’s investment offer….”

Referred to as “GAT funding”, Rendell offered to Woodle’s co $975,000 for its expansion project (in Bellefonte), which consisted mostly of an $800,000 loan from the Machinery and Equipment Loan Fund; plus a $75,000 opportunity grant, $40,000 in job training assistance, and $60,000 in job creation tax credits.

In processing all this, it occurs to me that despite the rumor that Jer might have pimped out his TSM kids to wealthy donors, I’m thinking this: if you were gonna get involved in that, you’d be wise NOT to be one of those wealthy donors to TSM. Hand out your money more indirectly.

Of course, people get drunk with power, get arrogant, and think they can do what they want and will get away with it, or someone will get them out of it if it blows up. So, it’s hard to second guess it.

My mind, however, goes beyond that list of TSM donors.

  26. lizzy says:

    @beejay,

If Sandusky was pimping out kids, where did that money go? I know his aw-shucks manner might be an act, but surely his assets have been examined?

Now, if someone else was pimping out the kids, and Jerry was used to groom them, and got to abuse them himself for free, some of the indirect dollar flows start to make more sense to me.

If this happened, will any of those victims be able to come forward? Or are they “too lost” for that to happen?

The district judges office gave the heads-up.
    ———————————————-
Plans were in the works to arrest Sandusky Nov. 7 and have Attorney General Kelly hold a major press conference. Instead, the charges were posted prematurely on the Pennsylvania state court website while Sandusky was on a family vacation in Ohio.

The Patriot-News, which had been closely following the investigation, first reported the charges on PennLive.com. As word spread, police scrambled to find Sandusky and get him to an arraignment arranged hastily for the following day.

It is unclear who made the mistake. The attorney general’s office says they did not do it, and neither did the state police. Finn said they believe the error can be traced back to the district judge’s office.

    ——————————————————————-
Marjorie (“Midge”) Osterlund Rendell (born 1947) is a federal judge on the United States Court of Appeals for the Third Circuit and a former First Lady of Pennsylvania. [1] In 2003, she was named to the PoliticsPA list of “Pennsylvania’s Most Politically Powerful Women”.[2]

Rendell was born in Wilmington, Delaware.[3] Her father was employed as a DuPont executive and she attended Ursuline Academy.

She married Ed Rendell, the former Governor of Pennsylvania, in 1971. On January 21, 2003, Judge Rendell administered the oath of office to her husband after he won the gubernatorial election in November, 2002. During her husband’s campaigns for mayor and governor, Rendell was barred by the federal judicial ethics code from publicly campaigning on his behalf, as well as from taking part in some fundraisers. Media reports, on February 7, 2011, that a joint email from the couple announced that they have amicably separated.[4] They have one adult son, Jesse. [5]

She received a Bachelor of Arts degree, cum laude, from the University of Pennsylvania in 1969 and a Juris Doctor from Villanova University School of Law in 1973.

She is also a trustee of the University of Pennsylvania.[1]

Jan, 2008 DeNaples was charged with perjury for lying about mob connections. The charges were dropped in return for DeNaples bowing out of the casino. BUT, what LDN did was form a family trust–I didn’t keep the link–and it owns the casino (his dentist daughter and his doctor son).

Oh, and LDN is a billionaire, IIRC, not a millionaire. And bought a building and vehicles for a local police dept who were very grateful for his generosity, and someone said people should be grateful for all the good LDN does. I’d bail on my husband, too, if he got in with this crowd.

Perjury charges against DeNaples were expunged in Dauphin County court. (Content taken from same link as one of the above.)

Blink said earlier Jer didn’t have the cash for posting bail. Your guess is as good as mine. In addition to have it routed circuitously, maybe he hid some of it. Maybe he spent some of it on his hobbies. I’ll betcha he’s purchased silence from some people for a long time; he’s been too high profile NOT to have been a blackmail target.

Your connection to DuPont is very possible. DuPont has been very well connected to government contracts since the 1920′s. They built most of the facilities that produced the atomic bombs during WWII and refineries and plastic plants at Beaumont and Corpus Christi, Texas.
DuPont is also responsible for the development of nylon that was first used to replace the silk parachutes for airmen during WWII.

Ed Rendell does not appear to be an honorable man. Each time I have seen him on TV, he reminds me of a mafia guy.

Your link to bereitisnews.com is a convoluted read including the link to the piece about JoPa and the sexual assault statement. One needs to make a chart to chase all the links to people and organizations that may have a part in this bad behavior.

The most disturbing thing is the various connections and behaviors of the NCAA board members over the past thirty years. If the NCAA gets involved in an investigation it is possibly like the “fox watching the henhouse”. No real justice for a victim of rape or assault.

Anyone know if this is true? Is this why the family court papers were sealed? So as not to prejudice the jury?

Matt’s ex-wife filed a restraining order against Jerry Sandusky to keep him away from her little sons (one of which has reported being raped by Sandusky) …that restraining order was requested and granted long before Sandusky was arrested and revealed as a rabid pedophile to the world.

Mainstream reporters go to football drink fests to get seduced to agree to interview Jer? How low can an attorney go? if an inebriate killed someone driving home, couldn’t Joe A have been held liable? He was operating his business at the game–not a social function.

  47. Rose says:

Imo Jer has the attorney he deserves. A gift to the prosecution

  48. beejay says:

@erose: So far as I know, Jill (Matt’s ex-) got a restraining order AFTER Matt took their kids over to Jer’s house on the day he was arrested. (he wasn’t home, so it goes) Don’t know of any other RO that was in effect, though there could be.

So far as I know, the identity of the “family member”, (who must be a minor in order for CYS to be investigating it at this time) has not–and will not–be revealed to protect the minor’s identity. Right, Blink?

This CYS investigation was less than 60 days old, per Sara Ganim when she reported on it on Nov 23, 2011. Doesn’t tell us when the alledged assault took place. See:

    http://www.pennlive.com/midstate/index.ssf/2011/11/attorney_jerry_sandusky_family.html

Not sure I answered your question, but I think those papers would’ve been sealed to protect the child’s identity given the situation–rather than so as not to prejudice the jury.

    Correct.
