Convicted Pedophile Jerry Sandusky’s Sniveling Mercy Plea Ignored- Sentenced To 60 Years

Bellefonte, PA-  After a pitiful denial of the charges against him which contained more vitriol geared at his victims and their families was released late yesterday,  Judge Cleland made sure Sandusky knew he was unmoved.

Judge John Cleland issued the sentence Tuesday, three months after a jury convicted Sandusky on 45 counts of child sexual abuse.   Sandusky must do 30 years before he is eligible for parole in Centre County, PA.

Sandusky , if his appeal for a new trial is unsuccessful, will be 100 years old before he would ever appear before a parole board.

This is a big statement that the Edgewater was aware of Sandusky’s abuses by 2005.

Edgewater, a nonprofit, “refused to acknowledge or cooperate with plaintiff’s pre-complaint investigation into these matters” and “was aware of Sandusky’s abuse yet referred the plaintiff to Second Mile exposing him to abuse at the hands of defendant Sandusky,” according to the complaint.

all I can say is from what I’ve seen of some PA attorneys referenced here (not McGettigan or other Vic plaintiff’s reps), I suspect it is very hard to get oneself disciplined by Bar Counsel in PA. You’d have to seriously work at it.
And if one does, kinda reminds me of Jer not to offer any argument during the penalty phase.

Bailey, 66, has had a long career in Pennsylvania politics. A decorated Vietnam combat veteran, he was elected to Congress in 1978. He served two terms before losing a redistricting-forced primary to Rep. John Murtha in 1982. He was elected Pa. Auditor General in 1984, and lost the Democratic primary for U.S. Senate in 1986. He lost his re-election bid for Auditor to Barbara Hafer in 1988, lost the Democratic primary for Auditor in 1992, and lost the Democratic gubernatorial primary to Ivan Itkin in 1998.

Since then, he’s served as an attorney based in Harrisburg with a focus on civil rights. Indeed, the Pa. Civil Rights Law Network endorsed his Attorney General candidacy this week.

“I represented tons of public employees, mostly the whistleblower type, and there’s a great deal of public corruption that I think needs to be revealed,” Bailey said.

He mentioned the Penn State sex abuse scandal specifically, and criticized Governor Tom Corbett’s handling of the case.

“I represent a Sandusky victim,” he said.

But he’s also run into some professional trouble. He came close to being disbarred in 2011, accused by the Disciplinary Board of the Supreme Court of bringing frivolous lawsuits.

  14. erose says:

    FWIW…

In a deposition of Tom Corbett conducted by Bailey in the Kimmett case, a case in which Corbett is a defendant in a corruption scandal while he was Attorney General, Bailey casually asked Corbett the introductory question “do you know who I am”, to which Corbett directly responded, “everybody knows who you are Mr. Bailey”. This is the shit storm. Much like Penn State, the institutions of the courts have much to hide, and Bailey has shown it, and threatens to show even more. That is what the disciplinary case is all about – stopping the shit storm.

A separate investigation involving AG office narcotics Agent Anthony Sassano in November 2010 finally broke the Corbett-imposed logjam in the Sandusky case.

Following standard procedure, Agent Sassano then entered information about those involved in his narcotics investigation into the PACE cross-indexing and intelligence system.

Agent Sassano got a hit on Sandusky and discovered that the former football coach was also under investigation for a pedophile complaint by Corbett’s heretofore-inactive state trooper, and prosecutor.

Office of Attorney General Narcotics Agent Anthony Sassano testified concerning phone records that establish 61 phone calls from Sandusky’s home phone to Victim 1′s home phone between January 2008 and July 2009. In that same time, there were 57 calls from Sandusky’s cell phone to Victim 1′s home phone. There were four calls made from Victim 1′s home phone to Sandusky’s cell phone and one call from Victim 1′s mother’s cell phone to Sandusky’s cell phone. It’s pretty hard to get State Bar counsel to bring charges (is this the attempted rumination beejay refers to, because it’s the only thing affecting him professionally) for any attorney’s conduct of litigation itself. There are other remedies such as tort suits by those he’s represented or litigated against, or overturning verdicts on Appeal. He has to have engaged in a sustained practice of frauduant conduct and repeated violation of Bar rules and even then have refused to engage cooperatively in retraining to remedy his conduct. This is not a mere difference of opinion among peers or pumushment politically for going after corrupt politicians beejay & erose. “When you tell me that, I just say, ‘Wow, it’s been 50 years’,” Bednarik says from a swing on his back patio in Coopersburg, where he and his wife of 62 years, Emma, have lived the last 30 years. “Time really goes quickly.”

His nickname “Concrete Charlie” stuck because Bednarik sold the stuff in the off-season to help support Emma and five daughters.

The second oldest of six children, Bednarik was raised three blocks from Lehigh University, where he attended football games and wrestling events for decades.

In the Eagles’ Dick Vermeil era, the Super Bowl coach made Bednarik an honorary coach so he could walk the sidelines at games. “I wanted him to stand as a symbol of a winning tradition that had been lost,” Vermeil says. “I wanted him to be a sign of an Eagle who was a winner.

His favorite number, obviously, is No. 60. Emma, who is spry at age 84, says Chuck constantly reminds her of that: “Anything he sees with that number, he says, ‘See, I made that famous,’” she says.

    Bailey is welcome to crusade.
Whether he will do it as an attorney
will be up to his State Bar’s enforcement
of the Professional Rules of Conduct.
    Every attorney understands licensing rules.

  32. Rose says:

@erose. state disciplinary boards are not made up of “judges” but highly respected peer attorneys bound by the Professional Rules. State Bar Counsels do not go on vendettas. My State is highly aggressive. Others, probably PA, are slow to act. Usually stuff is settled out of the public eye, and at low levels. Often it’s due to mismanaging funds (comingling), not giving accountings or billings properly–or missing filing and statute of limitations deadlines. Imo accusations like his are hard to achieve unless you are trying, in say a bipolar manic way, for the limelight. Attorneys know if a sanction action is brought: 1) hire proficient counsel ( he didnt), 2) mount a defense like substance abuse you can correct (he didnt), 3) cooperate & rectify if possible (he didnt), 4) mea culpa & ask for mercy in penalty phase (like JS, he didnt). Any can claim persecution, but that doesnt evade responsibility to follow professional licensing rules (they allege he didnt as to specific examples).

countless attorneys crusade & litigate in hostile State environments against corruption (ie M Dees) and don’t violate Professional Rules doing so.

  33. erose says:

I get it, but Bailey seems to contend these highly respected peers are siding with the judges for reasons other than merit.

@Rose, When you have time…I get why Beejay says she does not. I skimmed, but paid close attention to pages 8-33 to get the gist of the back story. I’m not trying to defend, just saying my mind is still open. The kids for cash scandal exposed corruption in the PA judiciary, who is to say it is not on going, and in fact Kiesling’s articles address some of the judges Bailey accused of misconduct. Then, if I understand, there is the suit against Fisher. I’ll admit, he threw a plate full of spaghetti, maybe hoping something would stick, but in reading IMO, no one involved, by their own depositions, is 100% pure.

    http://pennsylvaniacivilrightslawnetwork.com/wp-content/uploads/2012/04/BaileyResponseODC.edited.pdf

  36. beejay says:

@erose: right. And my interest here is not in Don Bailey per se. It is in the names and events he, and every other strange situation in PA, brings to our collective attention.

He’s brought several people, including judges and lawyers (Patricia Bednarik, Esq, ex.) to our attention. Whether rightfully or wrongfully. BTW, Bailey and Bill Keisling actually ran against each other in some politcal race.

Bailey has brought our attention to the possibility that a local atty was trafficking in–um–dogs. I intend to ignore Bailey’s personal situation and look into all these other folks. And who they lead to. And where we’ve seen those connections before wrt Sandusky, TSM, Eckerd Seamans, PSU including Board, football boosters. And, with Blink, especially Judges. Because I am positive that several someones within the judiciary of PA and perhaps at a federal level helped conceal Sandusky and his comrades’ crimes. For a long time. And I want to know why they did too.

Repeating an earlier question: anyone remember another Bednarik who was involved as volunteer, staffer, promoter of TSM–other than Chuck Bednarik???

  37. beejay says:

Very long article, and I’ll snip the summary of what Patricia Bednarik, Esq’s role was wrt Bailey. But, there’s another odd thing here. I read this awhile back as a human interest story about Miles and his dog. And I think someone might have linked it at BOC as well. Miles Thomas died in Feb, 2012.

The thing of interest is: WHY all this judicial time spent trying to keep this poor man Miles away from his dog? REALLY?? Read the comments and you’ll see the people who took Miles in. IIRC, he was a stockbroker in his younger life, took care of his family and his wife who died of Alzheimers. Not a bum who should have the courts this involved with him and his dog. Something’s wrong in the middle district of PA courts.

“Neither Miles nor I were aware at that time that the lawsuit filed by Thom Lewis in 2007 had been forwarded to the office of disciplinary counsel shortly after it was filed, indeed before it was even served. Patti Bednarik from the office of disciplinary counsel received the case, and went to Sam Stretton, again before the case was even served, with threats that Don Bailey would be disciplined over it – in 2007 – we are in 2012, and these are the disciplinary efforts.

Bednarik, as it turns out, was involved in the illegal transportation of dogs, and used her Pennsylvania Supreme Court Office of Disciplinary Counsel email to run some of the operations, which appears to be big private business in Pennsylvania with personalities connected to the federal courts. Bednarik was reportedly later relocated out of the office of counsel over the matter. Disciplinary matters were proceeding against me as well during the handling of Miles’ case, though all proceedings had been concluded, and were believed to have been resolved. I was later suspended.”

When I read the Ganim article that the following link refers to, I couldn’t quite follow it. Duh. I have no opinion on the content of the link. I just have some of its content in my brain, stewing around with all the other mess. Later some things will coalesce, I hope. A worthwhile read, and despite the negative slant towards Ganim–she has clearly been someone(s)tool, and necessarily in order to get her scoops. Snip:

“What REALLY happened here is that the prosecution has declared that, at least for purposes of the record, they don’t believe that the person suing Penn State is really the victim in that the infamous shower incident. That is why they are saying that they are speaking on behalf of an “unidentified victim.”

That, at the very LEAST, means is that, according to the prosecution, there is no corroborating victim in the case that caused so much damage to Penn State and the legacy of Joe Paterno. That in itself is a remarkable statement, especially given the fact that McQueary’s testimony has dramatically evolved and that several witnesses, as well as other evidence, contradict important elements of his story.”

Did we get Schultz’ attorney’s statement up here? Here’s one link. But, I’m also seeing that “Victim 2″ was interviewed FOUR times by, as reported, both the AG’s office and Postal Inspectors. Last time was in April, 2012. IDK the first time, but if we looked back at Shubin/Vic 2 history we could probably find out.

I wish Blink had time to lend her brain to all this.

    IDK, Beejay. Maybe Adam?

His great-nephew, Adam Bednarik, was the starting quarterback at West Virginia University, before suffering an injury in 2005 that opened the door for fellow freshman Pat White, who never relinquished the starting position.

“I’ve always watched Penn State since I was little. That’s always been kind of my team. I’m just a big fan of them. They’ve been sending me letters. They’re going to be recruiting me. They’re pretty strong right now too. They haven’t called yet. I think they came in to see me and to talk to the coaches about me, but I wasn’t around.”

Adam attended the Nike Camp at Penn State a couple of months ago and enjoyed the experience.

“That was actually the first time I was up there. I had a baseball game the day before I went up to the Nike Camp. I actually pitched that day so I was a little sore up at the camp. It was good though. I saw a lot of good kids there, a lot of good competition, which I think was good for me to see.

“It was a good experience. Just by being at the camp and being around the kids and the coaches, you can tell how much of a step up it is from high school, how things go, how much more strict it is and how much

Adam is related to Chuck Bednarik, the former Eagle who is a member of the NFL Hall of Fame

ok. Beejay you cleared it up a little. I couldn’t understand Ganim’s article.

This could be truly damning if Victim 2 is an imposter or another victim posing as Victim 2 (well, I guess that wouldn’t be as bad), because the prosecution loses that lynchpin (sry) upon which the rest of the case turns. The Defense would have appeal grounds.

As for Vic 2 not knowing the design of the coaches shower area…puh-leeze. A traumatized youth being sodomized by one he idolized is lucky if he remembers his own name.

Socially, I don’t know if we have the grace to interview a victim with compassion.

    sorry for the spaghetti bowl.
