Nittany Nightmare Continues Past Sandusky: Former President Spanier Charged- NEW Charges for Curley and Schultz Filed

Happy Valley- PA On the heels of convicted child molester Jerry Sandusky’s transfer to his new home,  what most predicted would follow- has.

 

 

 

Former Penn State President Graham Spanier,  fired by the Penn State Board of Trust the same day as legendary late-Nittany Lions Coach Joe Paterno, is facing serious charges today filed by Sandusky’s prosecutors.

Spanier is facing counts of obstruction of justice,  perjury, conspiracy, endangering the welfare of children and failure to report allegations of child abuse.

Tim Curley and Gary Schultz,  who were facing perjury and charges based on “non-reporting”,  are now facing all five similar charges as Spanier-  additional filings occurred simultaneously.

Linda L. Kelly stated the men “used their positions to conceal and cover up for years the activities of a known child predator,” on Thursday following the announcement.

    However, it is my guess the depo was oriir to certification as a class in 2013.
    After a motion for summary judgement in 2014, the Judge denied SJ in 2014 & the article quoted his opinion that finding was based specifically in part on Shutt’s testimony which I quoted from the article above on the denial of SH. The question on which that thrned was whether Shutt & co-complainant had ANY managerial duties. Dicjs said Shutt did; Shutt said she didn’t. So I imagine her depo under oath will be used against her at trial. Apparently there is a discrepancy between ber earlier depo then and hos her lawyer wrote his Reslonse to Dick’s Motion for Summary Judgment.

    Shutt is a paralegal. She would certainly know when she is swearing a statement or alleging something of this magnitude her creds will be called into question and if she was dishonest in the Dicks suit it will come back to her, of that I have no doubt.

    So, I suggest 2 or more of the BoC knew they needed a criminal defense attorney for something unknown, had
    approached a local such as Cantorna or Masorti thru Glantz , who likely said let me show you a better way, and the Town will pay. ergo the planning & lead up to Jan 20. And the next week, the BoC answered a reporter that Abom had begun working in the interim before his formal contract vote.

    reading elsewhere the Judge certifying a conditional class referred to in that article said his doing so was based on very “spirited” oral arguments on both sides (and omitted writings). He also had the flavor of I don’t want to spend too much time on the cknd. certification (ie, a 2 step approach)–just let them have a conditional cert. So it’s her attorney who made those arguments that she was the cleaning lady type employee without managerial duties arguments on that one occasion.

    I believe the jist is that the managerial promotion was like a way to not pay O/T but assign tasks that were slated for non-exempt employees when add’l duties as assigned to the lower rung would grant overtime pay. Sort of an empty promotion.

    Nor is the lead accurate. The Court made no findings of law, did not resolve the conflict of laws, did not examine the facts, did not provide reasoning against a Preliminary Injunction. Just denied this particular petition now. Bad for DA as soon Republican friend of Exarchos will be on Biard. My take is SC found the issues in the petition were not ripe or had largely been resolved at a lower level and deference was given to the Statewide GJ. I imagine A-bom will be so busy defending Exarchos and Dershem he’ll have to time to mount a special prosecution.     Robert K Bailey’s hegemony in management of the Centre Cty govt website, the Court Administrator’s pages (to include transcripts), jury management (software I believe is being sold to other PACounties), and so on makes me wonder why any prosecutor’s laptop is needed if his co’s “cloud storage” is used by the DA Office and by the Judges & Court Administrators. I attended tech ceus once at a law school where the lecturer said no attorney should use cloud storage for client matters.

    reading Gricar’s former ADA’s comments on the SPM brouhaha on several CDT articles, one is aghast Gricar considered himself closest in the office to this then young man on his first job. He comes across as intemperate, crude, self-absorbed, and hasty.
    And with the US House lacking commenter Derek as an elected local Repr, merely due to a one-shot domestic type incident, one wonders how many more with a lack of knowledge, reasoning skills, & flexibility to llearn via taking in new info, serve there now, riding to success on raw ambition, money & father’s successes

    Masorti filed a Bar complaint Dec 30, the day his employee signed the affidavit (wonder if production of same was a condition of employment?) I suppose State OAG will have access to her State tax return for 2014 to see when employment commenced. Thus the DA was made aware Dec 31 or Jan 2. SPM apparently gave Sinderson an interview before the 20th. I suppose since he’d been following the story before that, Masorti alerted the press in addition to Bar Counsel. 409 Truthers apparently don’t like Sinderson.
