Nittany Nightmare Continues Past Sandusky: Former President Spanier Charged- NEW Charges for Curley and Schultz Filed

Happy Valley- PA On the heels of convicted child molester Jerry Sandusky’s transfer to his new home,  what most predicted would follow- has.

 

 

 

Former Penn State President Graham Spanier,  fired by the Penn State Board of Trust the same day as legendary late-Nittany Lions Coach Joe Paterno, is facing serious charges today filed by Sandusky’s prosecutors.

Spanier is facing counts of obstruction of justice,  perjury, conspiracy, endangering the welfare of children and failure to report allegations of child abuse.

Tim Curley and Gary Schultz,  who were facing perjury and charges based on “non-reporting”,  are now facing all five similar charges as Spanier-  additional filings occurred simultaneously.

Linda L. Kelly stated the men “used their positions to conceal and cover up for years the activities of a known child predator,” on Thursday following the announcement.

    I was wondering if a sexual relationship were shown to exist, if it violated the Code. If so, imo half the judges in TX and the deep South would’ve violated it in the 50s, 60s IF there had been female prosecutors. I had a brilliant & beautiful cousin in the legal field who probably slept with every judge in her MS town. Many professional females did that to get ahead in provincial towns.

    An interesting part of the Code on duty to report dependency.
    Based on Sloan’s characterization of his boss, I wonder whether Lunsford made a report on Masorti, kicking off tit for tat. I remember a white male lawyer who repped criminal defense & some cps parents. Nice guy. One could always smell mj on him. Imo criminal defense attorney with this dependency–it’s known.

    I would vote against that without an adjunct for competency testing- I know of a protracted case where a judge is hitting 83 and stays on the bench so he can make sure he does not get overturned in his own cases LOL.

    I don’t remember the Corinthian College for profit FL site where she got her paralegal cert, but she began in her own words another online degree (BA) with Ashford (physically in Iowa but online for profit in CA) in “social & criminal justice.” With 2 years & an LSAT to go, that is far from a law student.

    But Sloan avers they are close. Did he influence her affidavit?

    Who are the primary sources other than Sloane himself that Sloane was Gricar’s close confidante?

    Sloane claims ongoing chat and a personal friendship with Shutt, yet he gets major basic facts about Shutt wrong.

    Therefore, he can’t be reliable wrt anything surrounding Gricar.

    I have had some off the record interviews indicating Gricar and Sloan were close- as I noted earlier- one indicated when Sloan was convalescing and intending to return Gricar forced the issue of dealing with a resulting dependency. I do think he was the source for Ganim “dictaphone” find.

    I would be willing to bet that Sloan does not believe Gricar took off- but he may have initially. Good idea to throw this at the mix in that Centre County boiling over pot right now Rose! lol

    @Rose. Sloane was seriously injured in an accident and off work when Gricar disappeared; I’m told he even had difficulty getting to Lewisburg to be interviewed by the profiler. The accident had occurred earlier and he was recovering.

    Someone mentioned that Shutt is at Masorti and Sullivan. She is, and that is Sloane’s old firm. He could easily still have contact with people from there.

    Notice that Sloane indicates he talked to Freeh. Steve tends to be quite voluble.

    As for the text messages, I understand that they are largely parts of conversations, hypothetically, Lunsford saying, “Is October 15 open for you to schedule the Smith hearing,” and Parks Miller saying, “Yes.”

    Just to add to JJ points- Sloan was on medical leave when Gricar disappeared, he was still an employee (ADA) and receiving disability as plan allowed. It is my understanding that this was extended to include a subsequent dependency on pain meds- not uncommon.

    Centre County District Attorney Stacy Parks Miller has created a review board to investigate the 2005 disappearance of former Centre County District Attorney Ray Gricar.

    The case has become a top priority for Parks Miller, who did not name members of the board in her press release but stated that it is made up of several different investigators from Centre County.

    “This review board is simply an extension of my review of the case and a natural format for investigators with many years of experience to lend their expertise to the ongoing investigation,” Parks Miller said in the release, adding the board members are both qualified and “personally motivated” to tackle the investigation.

    Re: Arnold. She has been very sensitive about her role, possibly because she was advocating prosecution or a greater investigation in 1998. She also had minimum involvement. She was removed and Sloane was brought in.

    Thank you JJ- very interesting that Sloan still believes Gricar is not dead. I would be interested to know why he holds that opinion after nearly 8 years. We may be speaking of 2 different witnesses, but I am positive it was Grine’s JA that reported seeing Gricar the afternoon of his disappearance (4/15) in a metallic sedan. Agreed it may not have been him- but she thought so.

    Imo this review board thought it possible or likely 1 or more elected or appointed members of gov’t were involved in order for it to be turned over to OAG. Otherwise ordinarily SPM could & would work with State Police in furthering the investigation on the review board’s suggestions. .The County conflict sending it to OAG had to arise from an ADA, former DA or ADA, member of judiciary, or perhaps local police. Perhaps sending Gricar to OAG in Nov triggered the avalanche of accusation on SPM, with the Kane case example waving a special prosecutor flag, come hither.

    Is it me? I have never heard of Judge’s handling their own schedules directly with counsel and any and all case related conversations are considered ex parte if they do not involve both parties and even then are part of the court record. AND- regardless, if he is on the bench- regardless of material he is using the courts time so it is for public consumption. If I am arguing a case or appearing for same- and my judge is texting during that time- I have a legal right to know the content of that communication- period. Lastly- most courtrooms I have EVER been in, the judge’s require one’s cell to be powered off- not just silent- off. I have seen lawyer’s next up on the docket get booted- I do not understand how this is some sort of standard practice.

    Agreed, but the President Judge sets those tech use in open court rules….It appears the County has a dysfunctional judicial subculture. Magistrate Gillette among others (ADAs Lindsay & Boob) do same.

    We have no idea if any Lunsford text is case-related.
    He could have been ensuring his (hypothetical) 13 yo got home safely from school.
    I have no idea if these County judges have permanent employee clerks who handle their calendars
    & line up the Court jackets. It sounds like wrt Court jacket mgmt, Lunsford had no professional Court clerk advice. .

    One theory is that Fenton was confused about the day and that she saw him on 4/14. It would be significant if Gricar was driving a strange car on 4/14/05.

    I coukd sneer publicity hound, or say bipolar manic phase, but more likely this is a preemptive strike wrt the OAG.
    Ever since Sloane revealed tge OAG offered a plea based on testifying against his boss, in his Comments, and declined it, imo PM has been in the crosshairs of the OAG’s investigator for cultivating marijuana mail order & distribution within his office. And if a State Police or OAG investigator can’t make that stick, maybe something else woukd. It seems to me this is a contest as to who gets disbarred first, & PM is working hard on public opinion. Imo Lunsford will come out the hero, and judicial allies of PM will fare ill.

    So only 1 of 2 of the County Budgetbusting Bruisers can be replaced. But a future 2-1 BoC vote might result in a more professional Solicitor contract, requiring maintenance of liability insurance. I don’t see the LE shooting instructor, gun shop owner, & Eagle Boy Scout Dershem being replaced. Depends on which party gets out the vote, & few in the County probably attend to Chris-Steve’s expenditures. It seems Garrett & Clayton are in their pockets, so no adverse local press.

    on grounds they feel justified, yet don’t halt the trial in its tracks? I don’t think his filing a Bar complaint
    against Miller, in an unrelated matter where he has NO personal knowledge, has a thing to do with the trial at hand.
    Both attorneys are to conduct themselves professionally as to that trial. There has been no evidence
    she won’t. He, however, has a trial strategy into which he has interjected personal animus arguably to
    his client’s deteiment.

    I agree to all of that- but what do you mean no personal knowledge? He absolutely does- in fact, under PA bar regs with that knowledge he was duty bound to file it. Parks-Miller is the subject of a PA Atty General /BOC Commission inquiry- seemingly under Maserti’s complaint- he would absolutely have to inform the court. I agree there is no evidence she might act unprofessionally. But I wonder if we would feel differently if she were not due in court personally on the matter and there was a last minute change?

    @JJ in Phila. 2 “outstandings” as to Centre County & the OAG are the 1998ff Sandusky report KKane commissioned and the Gricar case SPM just sent up last Nov from a secret (as to members) investigative review board. Then in Dec all H broke loose. Both are on the plate of the AG. The secrecy wrt board members can only be due to suspicion of some local members of the Bar or LE.
    if Kane is forced out, does Wolf appoint an interim AG til a special election, & is fellow Dem Seth gunning for AG?
    But for his law school, I’d think Seth just another good old boy like Fina (as he hired him). Seth strikes me as chosing to move up by running with the historical “in” crowd.
