Kyron Horman Missing: Civil Suit Against Terri Horman DELAYED AND SEALED- Prompted By NEW LEADS

Portland, OR-  As many of you have been following since June 2010,  there is a new development today in the disappearance of Kyron Horman.

As predicted at BOC,  the civil suit brought by Deisree Young, Kyron’s  Mother, against Terri Horman, Kyron’s step-mother and the defacto suspect in his disappearance has been granted an abatement.

In a sealed filing,  motions by Assistant District Attorney Michael Schrunk and Multnomah County Sheriff Dan Staton were granted,  delaying the suit .  The motions included supporting affidavits that continuing the action as already ruled would compromise the investigation.

The decision presents an ironic twist .

Terri Horman’s lawyers originally  fought vehemently to abate the action,  but were unsuccessful.  As recently as last week, the Judge in the case ordered medical records to be accessible to both parties to the action.

In Judge Kantnor’s decision to NOT abate the suit at the request of Attorney Peter Bunch for Terri Horman,  the Multnomah County Prosecutors Office declared “no position” on the matter after being contacted by the court.

It is not known if that order prompted the request to delay the suit .

Sheriff Stanton,  Eldin Rosenthal,  Norm Frink and Stephen Houze declined comment at press time.

On Monday, Judge Henry Kantor granted the motions to abate the civil proceeding and ordered the motions and affidavits filed by the district attorney and sheriff sealed.

A  hearing had been scheduled  for Dec. 14 to hear Young’s attorney argue before the court to compel testimony from DeDe Spicher,  an alleged witness in the case.  Today’s ruling is likely to render a postponement of that proceeding.

Sheriff Dan Staton,  told Oregon Live,  it is based on early leads that are now panning out:

“There are a couple of investigative pieces that are going to open up,” Staton told The Oregonian Tuesday. “Our belief is they’re going to open up several investigative doors.”

He said the new “investigative avenues” are based on information collected in the early phase of the investigation that are now yielding some results.

    I thought it might be something like that, thanks grasshopper. It is my source-related understanding that Houze does not intend to give any interviews in the matter, and if that changes you can bet it has to do with a fixed strategy relative to the case. Not sure why they did not use the sound bite however.

    @erose. At a minimum there was a problem in the classroom and school that was unresolved at disappearance.
    Putting myself in Terri’s shoes, I always saw that request as documenting the teacher’s craziness, not the child’s.
    It’s exactly what I’d do (get it in writing) if a teacher was implementing her own bmod system to my child’s detriment before I had a principal conference.

    I assumed that it was Terri who told Kaine she asked for them every day. If Mrs. Porter began the card reporting by calling home for the red or blue cards, maybe Mrs. P. talked to Kaine by phone early in the process. Terri would have to have shown him the cards if she was trying to get him to discipline Kyron, so it’s possible Kaine may have spoken to the teacher for clarification or details at some point. Not saying Kaine was highly involved or up to date on school issues, but it’s entirely possible that Mrs. P. may have told him Kyron was the only one getting daily reports.

    @MBS. If doing a GAL or CPSD investigation, I would never assume Kaine’s words accurate on that or any other matter. I would look for cooboration–teacher, parents of playmates, doctor, as to her disciplinary methods. A “journalist” should too. Ditto for crediting any Desiree reports.
    He was and is in a significant legal adversary situation, utterly resistant to testing his words under oath in Court, and at the time he said it had just lost his son in a terrible manner with all attendant emotion. I would interview Porter in person, interview at length Terri about this parenting accusation (and expect answers to all questions–her attorney present fine), and try to talk to some collateral resources by phone (ie other parents in class with boys subject to same system. But if she did that (a strict version of consequences on bad days), to me it would have no impact on custody for Terri wrt Kiara. All parents have different styles and the State cannot interfere with parental rights (of Terri) because her response to a teachers’ bemod system are those Kaine listed. Beating the crap out if him would do it, but not those parenting choices.

    @Mbs, yes maybe he was told that by Ms. Porter, but somehow I don’t see him being that involved. He didn’t seem to have much of a clue as to what was going on in that school, e.g., talent show. It’s also possible he was told that by Porter after Kyron went missing. Before Kyron’s disappearance, I would think it odd that Porter would be venting to Kaine that his wife Terri is the only parent asking for the cards every day, but after the fact, I can certainly see her offering up that information to him and/or LE. JMO

    Re: Kyron and behavior. It’s not like Kyron is the first little boy she raised. She also raised James (alone?). If problems showed up with Kyron, she probably had good reason to try to figure it all out. Not sure it would be the teacher; just wonder if Kyron was being molested (or had been) by someone close to him. If so, it would explain any behavior problems showing up at school (and probably elsewhere). DY would have probably noticed a difference in Kyron, too. Just didn’t see him daily like Terri.

    Of course, if TMH and KH were fighting non-stop, or if some of their social activities were affecting Kyron or he had seen them in some private ‘behaviors’, that could also cause him to “act out”.

    Just speculating, but if they had parties at their home and the children were present, how much attention would KH and TMH pay if one of the ‘guests’ decided to get ‘personal’ with Kyron? Kind of sick, but there has to be SOMEthing that started that change in behavior. It could be that it was first noticed at school, especially if parents were self-absorbed.

    That would make more sense to me. As a parent or step-parent, if my child was bringing home behavior cards that demonstrated a behavior different than what I know he/she usually exhibits, I would also be concerned something else was going on, you betcha’.

    Interesting to me that Kaine also states in that scenario that Terri would “ask him” to punish Kyron. I thought it was Terri who was the disciplinarian according to KH. IMO, if Terri Horman did not care about Kyron, she wouldn’t have asked for a darn thing from his teacher. She would not have needed a card in order to be purposefully mean, or punish a child excessively. Would be interesting to see the contents of the emails she sent to DY in this regard. I don’t recall Desiree ever saying she thought Terri was excessive in her demands of Kyron, only Kaine. In fact, at one point Desiree even said she gave him everything he needed, but of course she wasn’t me.

    We all have different ways of disciplining children and we all have different expectations of what we deem as acceptable and unacceptable behavior. IMO, Kaine is blowing this whole thing out of proportion, and his motive is custody. JMO

    No Kidding! The fact that Houze has beet completely silent for 3 years, imo his 3 second sound-bite IS news. Personally, I’d just like to hear what his voice sounds like.. lol His strategy of remaining silent should pack an enormous punch when he finally starts talking and ..hopefully doing. I really cannot wait.

    it’s too bad Terri has been eliminated from the case as far as information, by LE and the media. She answered questions from the time Kyron went missing until after the RO and until Houze was hired, at least 3 weeks. I’d like an explanation of why she scheduled that dr’s appt for kyron. What change did she see that concerned her? Is that really part of the “ongoing investigation”? but no, LE turned her from an asset to a target.

    Speaking of, if TMH was “concerned” about Kyron’s behavioral development at school, and Kaine just wanted him to be a “kid” and argued about disciplining him, what does that say about Kaine and his setting consistent rules at home and for homework.

    If TMH helped with the project (as Carol stated) when did Kyron ever do homework with his dad?
    Kaine never mentions doing that with Kyron. Nor statements about his soccer team.

    I think TMH was frustrated with both Kaine and the teacher, however. Seems that Porter didn’t hold a tight ship certificate, either.

    More lately I have been really considering that TMH was positioning herself to go the way of Ecker and her first husband.

    Not necessarily that summer. But she very well might have been moving toward leaving Kaine with Kyron to let him know how it feels to be the primary parent of Kyron, and work.

    She could get a 50/50 divorce in Oregon. Easy. And have primary custody of Kiara with justification that Kaine was neglectful. If that were the case. Or at least joint custody, as is likely the outcome.

    How would Kaine have fared with Kiara half-time and full custody of Kyron?

    Whether she planned to actively pursue a teaching job in Portland or in Roseburg I have no idea. But she was positioned to do so.

    I’m sure she could have entrtained the thought of only having to support Kiara part-time and getting .5 of the assets.

    There was no reason to disappear Kyron if she was fed up with Kaine. Real revenge would be to have him
    see what it was like to be a real working father and caretaker.

    I’m going to look into this some more. Was trying to get a file on the name-change sequence for James awhile back. Saw it once but it is archived and have never been able to get back when they’d put it on hold for me.

Could that have “shown up” in the polys? Would it be a major reason she would not want to be questioned on her “feelings” about Kyron? Would the “hateful” emails reflect such a potential wish to leave Kyron with Kaine? Could, hypothetically, a conversation regarding getting “even” with Kaine (made about the same time as the name changes) have been misconstrued by the landscaper.

    I politely emailed Maxine at the Oregonian. She didn’t answer. Would have taken her two seconds to do so.

    Lynne Terry, also, has not answered my queries on why she plugged GOFUNDME in two consecutive redundant “Scamming” stories based on ONE possible “scam” call relayed to DY’s sister and then immediately reported to Portland’s only state-read newspaper. I asked her if she had any real information on whether DY intended to pursue the suit. And if not, why pursue the GoFundME donations.

    BTW. GoFundME did receive a new donation post-plug.

    What I don’t understand is that LE can legally lie during an investigation. To anyone about anything. Knowing this, and without bringing LE to the stand or deposing LE, how can the Judge be sure that he isn’t continuing the RO based on LE’s posturing with Kaine. After 3 years and with no arrest, why wouldn’t the Judge want confirmation from LE, before continuing to keep this child from her mother.

    @January Here is Stephen Houze speaking at about the 1:30 mark and he is quoted in the article calling what is happening to Terri as a ‘witch hunt’. The article also specifies that Terri hired Peter Bunch by the time this was written in July of 2010. In the video of Terri wearing a pink shirt and waiting for an elevator, you see Marlene George who was at the recent hearing. What is left OUT of this same video, and was seen by others, is that Mr. Houze stated that Terri didn’t know where Kyron was and wanted him home. You have to ask yourself why is it that the media is constantly cutting out anything that benefits Terri –from asking families at Skyline not to speak (Tanner’s video I posted) to not even allowing a 3 second sound byte from her attorneys. What else has been left out?

    @Bumble – I’m with you, based on decades of hanging around teachers. Made me think of something else too – the number of official progress reports and report cards required of teachers per year is a union issue. I’m assuming the cards Mrs. P. was sending home were not official reports, but something she decided to do on her own although other teachers may have done it too.

    Why add this work for yourself when you already have a grade book and notes you keep for conferences? First thought is that Mrs. P. may have been having trouble keeping her class on track, so either she thought of it or a teacher/mentor suggested it (a supervisor would have been unlikely to officially add to her duties after the school year began since she could have filed a complaint). Desiree said Terri vented about the teacher and thought she should have her job. What do we know Terri was really good at? Discipline and order in her classes.

    So how often did the other kids get cards? To be effective at that age, I’d guess weekly, 2 weeks at the most, but the way the cards are described, they sound more like daily reports you would get from a special ed teacher. If Mrs. P. wanted support from parents, then having more than a week go by makes anything a parent does less effective.
    Often, teachers send home regular (extra) reports only if something needs improving and occasional complimentary notes for doing well. Perhaps she was trying to keep any particular kids from being embarrassed and getting comments from the other kids, so she did cards for all – but the colors were certainly a giveaway. By the time kids got to the bus, they all knew what everybody else in class got. Kids (some or all) in Kyron’s class certainly knew he got daily cards – I wonder what he thought about that.

    It also occurred to me to wonder whether Kaine was friends or at least well acquainted with another parent from Kyron’s class so that he got a little “classroom gossip.” I doubt if Terri would have seen any reason to keep secret that she asked for daily reports.

    Yes, Porter could have told KH that his wife WANTED a card every day. But most parents in that kind of school, moms usually, would have gone thru the backpack and organized the nightly work accordingly.
    Seeing the card color would have indicated more than just “behavior”. It would be a suggestion as to whether or not academic work was getting done or not. It is NOT just a “discipline” issue. That Kaine did not understand the real basis for the card-color is telling. To me.

    If that is her, she is clearly not in touch or being advised by her counsel, imo. She has no standing whatsoever to say anything to anyone about the Horman dissolution case and alleging “these proceedings” are designed to make her talk is not a statement in her best interests. Lastly, her comment about what Judge Kantor will or will not require could imply exparte communication or knowledge- and moreover it is incorrect.

    If I were asking for public donations to fund an abated lawsuit- I would choose my comments accordingly.

    Not a slam to Desiree, a slam to the lack of advisement I feel continues to drive her comments/behavior.

    One way or another these cases need to progress.

    I have always regarded Tanner’s version as accurate. The “oh no there’s only 5, where’s Kyron” is not something a child would make up, too definitive, 5??. Porter’s response, (according to Tanner) that he was probably in the bathroom is another clue that was reinforced on Terri’s FB photo comment. That could probably be a factor in the “report card” issue. Kyron may possibly been problematic to a teacher because he tended to go off without permission. That speaks to less that ideal control in the classroom to my mind. Kaine’s reactions to this issue show a man who is clueless in child behavioral issues.

    The important thing about facebook is to not put any personal info on at all. don’t fill out the questions about family. they will ask for your email password so they can mine your address book. don’t give it people can see any pictures you post, even if they are not friends. Back when this case started I was active on various Kyron related discussion boards and didn’t know these things. Since I was not anti-terri, I came under attack in unpleasant ways. My friends and family received emails with accusations. For awhile I battled with them, then set up a second account with massive privacy settings. unsearchable. put family and friends on that one. My old account is used strictly for whatever game I am playing. My “friends’ are people who also play. If nasty things are sent to them, they will ignore because they don’t know me. This account was compromised because they know my id so can always get back to it. I have not posted on any kyron board for a couple of years and will not under any circumstances. I’ve never posted on Oregon-live. The anti-terri horman site has been closed by facebook more than once but they just start a new one. go take a look

    Correct, wpg, but that has no bearing on whether or not she would be a party to the dissolution. Kaine is not a named party in her tort either. She would have no standing to offer any testimony on her own in the divorce- it is not any sort of open proceeding. Technically and legally, neither does LE in terms of the motions for stay and sealing they filed- the Judge is using wide latitude that I personally believe has resulted in him reversing himself on more than one occasion.

    DY, if those were her comments, was stating that she would be a participant in the dissolution case and that is inaccurate. I suppose that she could be under some sort of opinion that she would be called as a witness, however, since we already know her and Kaine are not on speaking terms, and she has publicly stated that TMH was in FAVOR of her taking over primary custody of Kyron, I doubt very highly that would be desirable for Kaine in any way and it would likely HELP TMH. It is an odd commentary overall, and clearly lacks legal understanding- but she thinks TMH is responsible for her son’s disappearance, while I would advise her differently, I can’t imagine the level of emotional rip tides she endures as it is.

    In particular the “no talky” phrase- that statement is contradictory to the Judge’s standing order prior to the stay. As an example, as the procedure is stayed, she is the only person commenting on social media about it to my knowledge. I sincerely wish someone would take the time to walk her through some of the issues and their potential interpretations and outcome influence. These are active legal matters and an open criminal probe.

    This is a typical management plan in the early el ed years used imo by say new probationary teachers and imo fools.
    Colors are displayed for all in class to see.
    I find it offensive in the extreme. The children singled out publically as downgraded before their peers’ eyes are likely already the “different” ones with consequent low social status which this just reenforces to peers. Guaranteed to be the boys mostly, the learning disabled or the reading impaired or the attention impaired or the weak motor skilled.

    The focus should be on how Kyron, represented as sensitive, felt in THAT classroom with THAT teacher. Based on the allegedly frequent bathroom breaks and his “card collection,” I’d say not very good. Gives him some reason to evade her classroom for a few by going out to help a friendly stranger with whatever.

    Didn’t Tmh (and KH?) file to get him into school a year early? Could be that poor Kyron was just not keeping up with a 2nd/3rd curriculum if Porter wasn’t very aware of their developmental strengths, and patient. My daughter’s friends, very bright, went into a 2-3 classroom as 2nd graders and found that the teacher really did focus on the 3rd grade curriculum and they ended up struggling later.

    Neither here nor there, but Porter recently went to K-1, I believe.

    I do think Porter was overwhelmed, especially at the end of the year. You just don’t “forget” about a “dreamy” kid and his backpack and jacket. At the very least she should have called home at the end of the day. It was the middle of the following week before we heard that she “thought” TMH had said he had an appointment. And if Tanner’s story is true, she would be truly negligent. BESC knew that, too.

    I wonder when, exactly, Skyline “lost” the log-on records from that day.

    gofundme certainly solicits the public. K’s foundation solicits on facebook and at events. so this is not an accurate statement, or am I missing something.

    It should state they do not phone solicit. Any public domain publication or post promoting donations from the public in any capacity is legally a public solicitation of funds.

    I presume everyone knows that within those organizations are paid administrative positions and/or functions.

Say for the sake of argument Ky is located- Kaine would be setting himself up for a court record about how little time and interaction he actually had with both Desiree and Kyron in terms of the functioning co-parent relationship. Desiree on record saying TMH was in agreement, no doubt some of those long rambling emails and Kaine- and of course, the respondent’s ability to put on the record deposition on her observations.

    Imo, the dissolution has the best chance of starting back up, absent any indictment of TMH. It would not be prudent to have the framework of the tort really come from any depo from the divorce-

    Lastly, it does give the impression that DY is considering Judge Kantor as a strategist. The Judge that is the same judge in both cases on pause as well as the RO.

    Maybe someone should report Judge Kantor to the Oregon attorney general or the Oregon Bar association? Sounds like he is providing information to Desiree and her lawyer who are the palntiff’s in the tort suit against TH as well giving biased rulings in Kaines divorce a and RO renewal all the whilst being informed about/carrying out the DA’s expectations in all three legal matters.

    Is the state ATG or the Oregon Bar Association the one to report judges to?

    BTW i believe that Anna Canzano of KATU is a friend on the anti-dede spicier page and the anti-terri horman page. Nice to know we have unbiased news coverage from KATU.
