Kyron Horman Missing: Civil Suit Against Terri Horman DELAYED AND SEALED- Prompted By NEW LEADS

Portland, OR-  As many of you have been following since June 2010,  there is a new development today in the disappearance of Kyron Horman.

As predicted at BOC,  the civil suit brought by Deisree Young, Kyron’s  Mother, against Terri Horman, Kyron’s step-mother and the defacto suspect in his disappearance has been granted an abatement.

In a sealed filing,  motions by Assistant District Attorney Michael Schrunk and Multnomah County Sheriff Dan Staton were granted,  delaying the suit .  The motions included supporting affidavits that continuing the action as already ruled would compromise the investigation.

The decision presents an ironic twist .

Terri Horman’s lawyers originally  fought vehemently to abate the action,  but were unsuccessful.  As recently as last week, the Judge in the case ordered medical records to be accessible to both parties to the action.

In Judge Kantnor’s decision to NOT abate the suit at the request of Attorney Peter Bunch for Terri Horman,  the Multnomah County Prosecutors Office declared “no position” on the matter after being contacted by the court.

It is not known if that order prompted the request to delay the suit .

Sheriff Stanton,  Eldin Rosenthal,  Norm Frink and Stephen Houze declined comment at press time.

On Monday, Judge Henry Kantor granted the motions to abate the civil proceeding and ordered the motions and affidavits filed by the district attorney and sheriff sealed.

A  hearing had been scheduled  for Dec. 14 to hear Young’s attorney argue before the court to compel testimony from DeDe Spicher,  an alleged witness in the case.  Today’s ruling is likely to render a postponement of that proceeding.

Sheriff Dan Staton,  told Oregon Live,  it is based on early leads that are now panning out:

“There are a couple of investigative pieces that are going to open up,” Staton told The Oregonian Tuesday. “Our belief is they’re going to open up several investigative doors.”

He said the new “investigative avenues” are based on information collected in the early phase of the investigation that are now yielding some results.

He said he wonders how serious Kaine Horman’s safety concerns are, considering “they revealed to my client where he was staying.” He also argued that Terri Horman wasn’t prohibited from sharing the information, though a judge had sealed the order.

    I wonder why Kaine’s temporary address was included? Weird, huh? The man took off and went into hiding, from his wife he wanted to kill him, but he gave her the address of his new residence in the court papers? Go figure. Why, if the order was sealed, would it be okay for Terri to share the info? Was it sealed AFTER it was given to her? Curious stuff.

I just spent some time comparing the scores, attendance, and demographics between Skyline and like schools. Try Rieke, and Forest Park for comparable demographics. Remember that Skyline can “fundraise” thru the school auctions an addition 1.5 FTE. The other two schools might be able to get one extra teacher.

    Look at substitute usage and “highly qualified teacher” designations between the three schools, over the years.

    Also, go to an east county school like Beech. Notice the scores and percentage of students on free and reduced lunch compared to skyline. Then look at the scores.

    Short of it, for me? 1. Skyline “forced” many students to stay there by denying automatic transfer to Sylvan Middle School. 2. Skyline’s teachers tale more sub days than other comparable schools. 3. Test scores and enrollment are going down. 4. Compared to neighboring schools with the same SE level, and VERY low concentrations of low-income or minorities, and DESPITE the fact that the got the IB designation in 2010 their scores are lower than other schools across the river.

    The Lewis Lent cases seemed to explode in the news here in 1993. A 12 year old girl, Sara Ann Wood, was never found. She was snatched by Lent — according to his confession — off her bike about 30 minutes from my village. Frustrating case! And his known Massachusetts victim’s body, a 13 yr. old boy, was found in NYS. I believe the girl he attempted to take in 1993 or 1994 in Massachusetts escaped because she was quick to realize that he grabbed her backpack, not her, and she slid out of it and ran like hell. That saved her life. He’s in prison but he has never confirmed the location of Sara Ann’s body.

    DECLO, Idaho (AP) – A southern Idaho teacher who allowed her fourth-grade students to use markers to draw on the faces of six classmates who failed to meet their reading goals will return to the Declo school for the 2013-14 school year.

    Cassia County school board member Steve Lynch tells The Times-News that Summer Larsen’s contract was renewed based on teacher evaluations performed by principal Rebecca Hunsaker, who recently retired.

    “The evaluation recommended rehiring Larsen,” Lynch said. “The evaluation was done appropriately and professionally and supported that decision.”

    Cindy Hurst said her 10-year-old son came home from school Nov. 5 with his entire face – including his eyelids – scribbled on with green, red and purple markers.

    “He was humiliated, he hung his head and wanted to go wash his face,” Hurst said at the time. “He knows he’s a slow reader. Now he thinks he should be punished for it.”

    In an email to The Times-News, Superintendent Gaylen Smyer said, “I was told any PSC activity in this case would not preclude the school district from renewing Mrs. Larsen’s contract for the 2013-2014 school years.”

    An investigation found nine students who didn’t meet their reading goals were allowed to choose between staying in during recess or having their faces marked. Three chose to forgo recess, while six allowed the other students to draw on their faces.

    You cannot draw conclusions about those test scores without seeing the district scores, knowing the state benchmarks, and seeing the scores of each class from year to year. The only comparison you have is the 3rd grade class 2009-2010 compared to when that class was in the 5th grade 2011-2012. Remember that on state tests, the bar is raised each year; so that, for example, one year 75% of students are expected to be proficient in reading; the next year, it is 78%. You simply do not have enough information to draw those conclusions. Respectfully.

    Funny how that works isn’t it? I think for most of us, it’s human nature to see the good in people. Then after one is known to have done some unthinkable crime, we actually see them in a different physical manner, perhaps noticing things we didn’t before. Which, in Kyron’s case, makes me think about the children who allegedly say they saw a “creepy” guy. I sure hope LE didn’t drop that tip as child’s play.

    Proficient is merely average, not Advanced.
    Probably its those TAG kids at Skyline reaching at least average that pull the school up relative to District.

    As the Harvard study below shows, its the Principal & his autonomy wrt to curriculum & teachers that make the difference. Supt of Los Angeles District was on npr at length last week (D Reihm?) and he made this point–he’s giving every school — it’s principal & teachers — that autonomy, but holding them accountable for results with the goal all kids will graduate and have those average skills.

    My point was at Skyline these tech industry parents who are caucasian with good incomes are as unable to understand the importance of analysing academic skills data measurement wrt to their kids and connecting it to Mr Keefer’s job performance (because he seems to have had autonomy) as they were unable (and simply “looked away”) when it was time to look at his and Porter’s roles in the abduction and hold them and LE accountable for the investigation’s foibles.

    To me it’s shocking to have these low scores which reflect average acquisition of basic skills without some members of the Skyline pta uniting to make very weak data outcomes of their kids a PTA agenda topic.

    Skyline parent leader activists put so much energy into Green Team school innovations, they have the capacity had they chosen to put same energy into principal/teacher accountability for basic skills acquisition and school security. When parents do that (hold principals accountable), test scores rise, families move into tge area for the school, property values rise, and this school would not be in jeopardy of closing. I think the Supt and her team probably put Sage there due to an intent to close the school within a few years.

    @MBS. There was one instance when Keefer was taken to task about not following school policy re security. I put the url here (years ago) to a Skyline Newsletter in which Keefer said there woukd be new practices re door closures etc because he’d been told Skyline was not following policy. He spelled policy out and announced the changes. I said I felt his failure to follow his own announced changes to implement door and other security measures made any lawsuit naming Skyline & him as negligent a slam dunk. If you read Newsletters back as far as his becoming Asst Principal, it’s there somewhere that his Announcement was in response to the schools practices on the Security issue being monitored by some(one) in his accountability chain.

    I remember that discussion. I doubt, though, that it meant anyone closely monitored what he was doing after that any more than they would any other principal. After all, if he made the required changes, then the “my work here is done” attitude would set in. Again, based on my own opinion and observations.

    Here it’s announced to public in June or July.

    Announcements of principal transfers and new hires depend on a lot of things, unlike other staff which has union deadlines and processes to follow. I won’t give a list of those things b/c it’s OT for here, but some know early, some know late, some tell, some don’t, some are last minute changes, some reduce the time that parents have to object or for staff to try to transfer out – and those things change as the human resources department changes. I don’t know if businesses are this crazy, but as far as I can tell, it has very little to do with effectively educating children.

    Well said, and true. On the other side of the coin (and the river), I sat in a faculty meeting led by a principal new to our building but not the district, and was appalled to hear her say that at her last school she instructed teachers to walk around during state tests and look at the kids answers, touch them on the shoulder and quietly suggest they try again if the teacher could see the answer was wrong. She also suggested they give the kids hints on how to figure out the answer. She suggested that our faculty do the same thing, and said that the increase in her school’s test scores was proof that it helped the kids. It also greatly enhanced her reputation in the district as a successful leader.

    There was a lot of coughing and wiggling in seats – I knew my faculty would never do that, but we also couldn’t believe someone would be so open about cheating. We secretly talked about reporting it, but there were complicated reasons why we didn’t. Just another reason to be wary of comparisons. If you want to know how a school is doing, go there and see for yourself, ask questions, find out what the school’s priorities are and why.

    As for PPS TAG (Talented and Gifted), my experience as parent and counselor was different from that mentioned previously (I’m sure there are many other perspectives as well). My oldest was a TAG student – the activities she participated in were things I had done inside my own classroom years before. My second refused to participate because she didn’t want to miss her own classroom activities, and kids made fun of you. As a counselor in a middle school, I met with kids who consistently tried to get out of TAG because they were called out of class and bussed elsewhere for the activities with other TAG kids (when Rieke School closed, that’s where the TAG groups went). Many other kids labeled and teased them. At one school, their names were called on the intercom when time for the bus. Many of them hated that. Another counselor and I were able to change that to a list and a quiet reminder from each teacher but it didn’t end the problem.

    The TAG budget kept shrinking and PPS had some violations of state TAG policies. I was on the clean-up end of that, making sure things were done by the book. For one example, each TAG student was to have an individual plan kept in their cum file. Some schools thought if you put them in advanced classes or an advanced reading group or whatever, you covered the state requirement for meeting their individual needs. Not necessarily so. Either way, the money wasn’t there to offer much.

    Best TAG advantage – in high school, TAG students could apply for money from pooled TAG funds to pay tuition for a college class during the school year. I don’t know if they even have that anymore. It was a good program when they had a full time coordinator, but that was many, many years ago. Certainly not in Kyron’s years. TAG eligibility could be proposed by a teacher or a parent to begin the process.

    IMO, if anyone thought there was some actual advantage to having Kyron be considered a TAG student, they probably didn’t check it out very thoroughly. It doesn’t automatically qualify you for admission or transfers, and the state had a general percentage of students they thought were likely to be eligible and set cutoffs to indicate that.

    In high school, I had students who were eligible for both Special Ed and TAG. You can be learning disabled in one area and advanced in another. I used to bring that up when I talked to classes about understanding and respecting each other’s differences, and doing away with labels as a way to judge people. I understand the purpose of the TAG program and I agree with the need, but IMO, it wasn’t effectively done most of the time.

Between being so sure that Kyron will return home, Buying clothes that would fit kyron and having no compunction about sending kiara to the very same school where (no matter who took Kyron) the staff was very lax about security Add to that trying to frame Terri for the sexting thing which had nothing to do with finding Kyron and you gotta wonder.

    And yes I know Kaine probably had nothing to do with Kyron being kidnapped.

    IF Terri is not guilty of disappearing Kyron, even if the disappearance had something to do with her, but was not instigated by her (e.g., someone threatening her, or revenge of some kind against her), then it makes sense that she should be VERY concerned about her daughter attending that school. IF she had nothing to do with it and has no idea who took Kyron or why she should be scared to death to let her daughter attend that school for fear of the same thing happening. I know I would be. OTOH, if she was behind Kyron’s disappearance or disappeared Kyron herself, she would not be worried at all.

    Telling situation…don’tcha think?

    I’ve been looking a bit at Skyline’s Eagle’s Nest news. Archives don’t go back to Keefer anymore. What was the deal with the one-year, interim principal after Keefer left. Then Sage for this year. IMO that is strange.
    Usually principals stay 3-6 years – judging from my experience in both elementary and secondary. Secondary can stay MUCH longer. But in my tenure with 12 years of kids at our Skyline-like school down the hill, the first lasted four years, the second 6, and the third…not sure as my daughter is in 9th now.
    But at their middle school, from 2003-now there have been three principals. I think PPS likes to move them around…sometimes for political reasons, other times based on school success.

    As for Skyline and declining enrollement. I don’t think Sage is in there to oversee a shut down of the school. One, even though the board has said that 300 is the goal, and have closed schools with higher populations of students than Skyline it would not be politically wise unless the “investigation” definitely has an indictment stick.

    But the other reason is the “fortunate” position of Skyline. They draw only 1 or two ELL students, 1-4 students African-American or hispanic minorities, a respectable number of tag students (though not that many compared to other schools that have very HIGH parental involvement and strong foundations. It’s really a “private” public school that can afford to have programs that enrich the majority of its students.

    Now that alone would not keep it from being closed. The well-endowed Smith School was closed awhile back. But Skyline is different in that it is the only school around. Position, position, position. Those kids from the very far outlying areas would have to be bused to Forest Grove (highly crowded), or Chapman (very far away). When conditions are such that snow-routes to Skyline are necessary, or “Skyline alone” would be closed, how would those kids get down the hill to Chapman? Also, Sauvie Island Elem. became incorporated into the neighboring district, so that would not be an option.

    Just thinkin’ Bud I did ask a board member who is a fellow mom here about it a couple years ago. We had worked together a decade ago to save our neighborhood SW school from the chopping block.

    Typos in last post. Sorry. Forest Heights- not Forest Grove (an outlying district and school). Forest Heights is closer to Portland Northwest Heights area than Skyline. Oregon…lots of “Forest” adjectives. LOL

    IMO….Desiree Young is willing to let this one drop, rather than take the chance on depos of her, TY etc. finally going through. And, of course her medical records being used in court. I haven’t heard her ranting against Dede. And even if she were does she really think she’ll get dscovery from Dede that would justify herself having to answer questions regarding her mental health that Rosenthal was VERY adamant would NOT get out to the public and would be SEALED in any form before that happened, and could only be “referred to” in court. There is something in those medical records she does NOT want out. More than just late pregnancy depression, suicide ideation, imo.

    @vw Yes 7 years is unusually long to be a school principal (counting co- years). Imo he was allowed to stay as he is a “favorite” administratively and his son was in Skyline. The interim iirc was a central office man working in curriculum who’d never been a principal & needed that on his resume. Perhaps they thought Skyline a manageable one year spot where he could be successful. Love to know which Principal assigned Miss Porter co-head of School Self-Assessment. Remarkabke btw Skyline has no Reading Specialist (per her report) or School Staff Development Resource Teacher (who should’ve led that Assessment).

    Dear Skyline School Community and Neighbors:

    Many of you are aware that on May 2, 2010, more than 125 volunteers from Sunset Presbyterian spent the day at Skyline School doing inside and outside projects. With the help of several Skyline parents, students and neighbors the amount of work that was done that day was truly amazing. In a continuing effort to support our school and complete the work started on May 2nd, Sunset Presbyterian volunteers will be returning on Sunday, August 29th for “Skyline Service Day”. Here are some of the projects that we will be doing:

    * Finish painting exterior metal handrails.
    * Finish painting trim in two classrooms.
    * Paint one wall in the library.
    * Clean out and reorganize “volunteer” room and “locker rooms” in basement of school.
    * Landscaping around the school.
    * Track maintenance

    This will be our 10th and final year as Skyline parents and we are thrilled to partner with Sunset Presbyterian church for Skyline Service Day. This has been a difficult last few months for our Skyline staff and families, and we want to make sure that our school looks especially great when our kids return to class in September. As the project leaders we are seeking additional volunteers for the day from the Skyline community. In addition, we are looking for donations of water and snacks that we can provide to the volunteers during the day. If you are unable to volunteer we are also seeking monetary donations to help fund the purchase of supplies (paint, equipment, bark dust, etc.) needed for the day.

    Sounds like the painting was done by volunteers from the church in May 2010 and not completed until later. May 2, 2010 was a Sunday, so unless the Horman’s were part of the volunteer group, I doubt Kyron would have been at the school that day.

    I know we decided that the auto-call about Kyron going missing went out to all the district since there was no such auto-call system available to single out just Skyline, but……this sounds like at least by the next day, Saturday, it could be done, because it was done for other reasons:

    11:35 a.m. — Schools spokesman Shelby says parents were notified of the all-day Sunday debriefing with police and federal agents via a robocall Saturday. The oldest students at the school began to arrive at 10 a.m.; kindergarteners and first grade students are set to arrive with parents later in the afternoon.

    Agreed. I have often wondered what else was going on. I can not imagine being pregnant and having a husband in a relationship with another women. It would have been a cold day in he!! before I ever agreed to let my son take a name beginning with the letter “K”. I would never have let Kaine have that satisfaction and I wonder why she did. MOO

    In response to Kyron Horman’s Friday disappearance from Skyline School, all K-8 schools within Portland Public Schools will start using automated dialer systems to notify parents when students are absent without preapproval, Superintendent Carole Smith announced Sunday.

    I remember Keefer mentioning “lead abatement” painting of trim having been done most likely in his back to school summary in Fall ’08. This was a lead job specifically linked to his fundraising for same in March 2008. He would not have given lead abatement painting to a volunteer imo, but it could’ve been to anyone who claimed to paint for a living. Whatever, FBI shoukd’ve gotten names of 2008-09 subs the pra used & interviewed them in their homes. Goes to knowledge of the school & ability to convey an aura of being “at home” there to passers by in the halls.

    @erose. While Google maps may capture crime by fluke, a prior poster here was correct (maybe it was you) that a satellite has to be aimed at the scene (ie Skyline) intentionally. The Google programmer intended to record that location where a crime happened to occur at that time.
    This technology has been around at least 4 decades. I was the first AA for Congress’ new Space Office (1 man) in Congress’ former Office of Tech Assessment). (Too bad Newt deepsixed that tech agency of Congress filled with scientists; we wouldn’t have an NSA gone wild in partnership I’m sure with DIA since Poindexter’s day). My first biggie was audio recording a meeting with Colby & crew. …On satellite resolution of ground images — which were up close but unimaginable to Americans then.     Does anyone have further information? Was it decided that they belonged to someone else? Did someone think that SZ left them for some reason?

    I also wondered about the hair they found on Sauvie Island, but nobody is sayin’ nuthin’ …odd

    It is my unsubstantiated opinion that there is reason to believe that Ky’s glasses were located, or parts of them located, or some glasses related clue surfaced to provoke LE to released his pic without them, and to have DY and KH to discuss his fear of not having them.
