Kyron Horman Missing: Civil Suit Against Terri Horman DELAYED AND SEALED- Prompted By NEW LEADS

Portland, OR-  As many of you have been following since June 2010,  there is a new development today in the disappearance of Kyron Horman.

As predicted at BOC,  the civil suit brought by Deisree Young, Kyron’s  Mother, against Terri Horman, Kyron’s step-mother and the defacto suspect in his disappearance has been granted an abatement.

In a sealed filing,  motions by Assistant District Attorney Michael Schrunk and Multnomah County Sheriff Dan Staton were granted,  delaying the suit .  The motions included supporting affidavits that continuing the action as already ruled would compromise the investigation.

The decision presents an ironic twist .

Terri Horman’s lawyers originally  fought vehemently to abate the action,  but were unsuccessful.  As recently as last week, the Judge in the case ordered medical records to be accessible to both parties to the action.

In Judge Kantnor’s decision to NOT abate the suit at the request of Attorney Peter Bunch for Terri Horman,  the Multnomah County Prosecutors Office declared “no position” on the matter after being contacted by the court.

It is not known if that order prompted the request to delay the suit .

Sheriff Stanton,  Eldin Rosenthal,  Norm Frink and Stephen Houze declined comment at press time.

On Monday, Judge Henry Kantor granted the motions to abate the civil proceeding and ordered the motions and affidavits filed by the district attorney and sheriff sealed.

A  hearing had been scheduled  for Dec. 14 to hear Young’s attorney argue before the court to compel testimony from DeDe Spicher,  an alleged witness in the case.  Today’s ruling is likely to render a postponement of that proceeding.

Sheriff Dan Staton,  told Oregon Live,  it is based on early leads that are now panning out:

“There are a couple of investigative pieces that are going to open up,” Staton told The Oregonian Tuesday. “Our belief is they’re going to open up several investigative doors.”

He said the new “investigative avenues” are based on information collected in the early phase of the investigation that are now yielding some results.

    Ms. Porter *thought* that Terri took Kyron to the doctor on Friday, June 4, would it not make sense that Porter would have given it back to Terri prior to June 4, or at the very least that morning, so that Terri could take it to the doctor with her? It would make no sense to mail it to the doctor if Porter thought the appointment was the next day.

    None of this is making any sense to me. Terri makes an appointment for Kyron sometime Thursday, June 3rd, for the following Friday, June 11th. She also goes to the school that day (June 3rd) and hands Ms. Porter some eval paperwork requested (I assume) by the doctor. Where and when did Terri get this paperwork, if it is an evaluation form? Why would Porter think that the doctor appointment was the next day?

    I’m confused on “Thursday’s” timeline.
    If TMH made the appointment on that Thursday (June 3), did she do so before she left home that morning to drive Kyron to school with his project?

    Terri could have printed the form(PDF?) on her printer at home from the doctors website . That is what i do if my doctor needs me to fill out a form which the practice has in an online format.

    Or she could have gone to the Doctors office on Thursday and picked up the form. Since the Science fair projects were probably not delivered to the school until after 3:00 PM at the end of the school day on Thursday she would have had all day to obtain the form.

    Neighbor hinted that the projects were delivered after 3:00 PM on Thursday June 3.
    Also I don’t think that the Skyline school would have interrupted or canceled the entire school day on June 3 just to get the science projects set up when the Science fair was on the following Friday June 4.

    I think Kyron probably took the bus to school on June 3 just like another day. Terri took Kyron to school in the morning on Friday june 4. She drove the truck on June 4 to bring the science project home.

    Search for the DAS report recently released (last week?) if you want some really good insight into some of the “leadership.” When I stated Shelby was going from the frying pan to the fryer/fire, I wasn’t kidding.
    What I find interesting is that all these people are getting jobs in the state system when there is a hiring freeze still in play at the state level.

    It was Matt Shelby and Kim Holm who said the teacher(s) thought he went with Terri to a doctor appointment.

    Jaymie Finster (allegedly speaking for Terri) said that Kyron had a doctor appointment on June 11, as well as Terri herself in the email that surfaced.

    Grasshopper, from what we know of Terri’s timeline, IIRC, the unaccounted for time (i.e., according to Terri, the time she was driving Kiara around to try to get her to sleep) was somewhere around 35-40 minutes. It turned out it was not enough time to get to SI and back though. Of course, we don’t know for certain if that timeline is accurate, because it has never been revealed by LE. They may have narrowed it, or they may have found one or more of her alibis are not kosher via witness sightings or something.

    The Mustang should have been adequate then to transport the project if the passengers were only TMH and babyK . . . no need then for the truck as far as transporting Kyron’s project, imo.

    I respectfully disagree WPG, Kiara was still in the rear seat, and the trunk was not large enough for the project, imo. Another question I might posit, is if Kaine was working from home most afternoons as the primary caregiver as he stated- why was it that HE did not drop off the project with Kyron on Thursday in the first place?

    It is my personal belief that is why she drove around for 45 minutes or half an hour so Kiara could sleep and allow whatever meds she got to kick in so she did not have a very unhappy toddler to hand over to someone at the gym. If Kiara had a fever for example, she could not be permitted to stay, and could not come back unless she was fever-free without meds for 24 hours.

    Re disposables. I now have personal experience as to why women
    like the Intel lady who probably relies on text & email by phone
    while out of office would do this. For 7 weeks
    my kid is in part of a State with no reception for a major leading US carrier.
    Only a fool (me) would not buy a Verizon disposable for her. The inability
    to have family and business contact with the world is extraordinariky disruptive
    and stressful. Imo it’s a no brainer for the “ladies.” The false names though–stupid.

    Blink, I was responding to cd who opined the projects may have been dropped off around 3pm Thursday, which would present TMH and babyK the only 2 passengers in a vehicle. The front passenger area of a Ford 2007 Mustang would have accommodated the folded project panel, imo.

    KH’s claims in his divorce filings that he was the primary care-giver is just that – - claims of one side in a divorce case.

    I’m focusing on who actually did whatever they did at Skyline School on June 3 and 4, 2010. Those include, but are limited to (of course): TMH, Kyron, and Ms.P.

Would anyone there at the school have known what was happening to him, did TMH alert Ms.P or ANYONE at the school to this possibility and to keep, you know, a close watch on Kyron?

    EUGENE, Ore. — Photos, police reports, 911 logs. Numerous detectives have reviewed the evidence in Karen Whiteside’s 1978 murder countless times but the crime remains unsolved.

    After 31 years, the detectives have confirmed a person of interest in Whiteside’s murder–and they credit a KVAL News report for leading to the potential break in the case.

    On March 21, 1978, Karen Whiteside was strangled while walking to her friends house. Janitors found the 16-year-old’s body at Fairfield Elementary School the next morning.

    Roth and Detective Mel Thompson took over the case in 2005, returning to the boxes of evidence whenever they had time.
    When they first took on the case, Roth and Thompson reviewed the evidence independently. Both grew suspicious of one person–a male who knew Whiteside. Police interviewed him as part of the original investigation.

    However, there wasn’t much more to go on.

    Then KVAL aired a story about Whiteside’s unsolved murder in June, as part of a piece on EPD’s search for cold case volunteers. Afterward, Roth and Thompson received tips confirming their suspicions.

    “That generated some some information from the public that validated our suspicions of this person,” said Roth.

    After receiving that new information, Thompson returned to the Whiteside evidence. While reviewing the same police reports, personal artifacts and crime scene evidence, Thompson made a major discovery in a crime scene photo.

    “He saw something that’s been in the same photo for 30 years, that everyone’s looked at,” said Roth, adding it is fairly innocuous.

    Police won’t say what that item is or if it is the murder weapon, but will confirm the item was found at the crime scene.

    Detectives have submitted it for DNA testing.

    “We’re hopeful we’re going to come up with this person’s DNA,” said Roth. “Just because of what the item is and the theory Detective Thompson has on how it was used. You would expect to find the killer’s DNA on it.”

    Roth won’t disclose that theory, but says they will be able to arrest him if the killer’s DNA is present. Roth says the man still lives in Oregon.

    Swell, still lives in Oregon. Haven’t heard anything about whether or not the DNA results are back and inconclusive or what. Why doesn’t a reporter follow up on this stuff? There seems to be a lot of kids who went missing or were found murdered in Oregon in 1978. I had never seen Karen’s story, but was looking around for children abducted at or near a school.

    They are so transient (a few secs) and the child doesn’t “stick out,” simply
    pauses very briefly staring in a particular direction. Porter, if she even noticed,
    would’ve called it daydreaming or focus.
    My son at 5 had these. Once his teacher with a class of
    only 10 saw him pause for a few secs during a group activity. I saw it a couple times.
    No one else noticed. Sleep eeg and mri were normal but for a tiny
    temporal lobe cyst attributed to an unknown seasonal virus which resolved
    within the year on mri, as did the absence seizures. In kids this age they
    usually go away on their own. My point I guess is in a
    mixed class of 25, Ms P likely wouldn’t notice a simple absence seizure occurring onstage
    in the talent show. She’d just think he was daydreaming again.

    Terri was doing the right thing
    going to the doctor who would sort out add from absence seizure.

    Now what surprizes me is vw said a source told her Ms Porter was
    in charge of the science fair. Can that be verified? They had no
    dedicated science teacher, but one would expect a middle school teacher.
    If it’s true, I don’t understand Keefer’s choices.

    I know that both Greg and Desiree didnt live at these addresses at the same time as Nancy Dimas-Trejo or Joseph Keefer, but the coincidence of 2 formerly married people each having lived, independently from one another, at the same address as two other people with connections in this case is making my head hurt.  I know its most likely a coincidence and they most likely dont know each other.  If its not a coincidence, though, I dont know what significance it would have in regards to Kyron, but I want so badly for there to be some lead or feel like we’re getting closer to finding Kyron that Ill look at any angle at this point.

    Porter is K/1, and there is now a K-5 Reading Specialist.
    3 paraeducators in addition to the Resource
    (large no. for this size school). Paras are justified staff-wise,

    I don’t think he was having any kind of mini-seizures. I think the kore likely possibility, with his spacy behavior and distracted actions, that he could possibly be a child of abuse. Is this reotely possible? I’m not talking about the stepmom, but rather a male acquainted with either him, the family or the school.

    I was just going over Dede’s *non-deposition* again. Rosenthal asks Dede if she knows Desiree Young. Why? He is digging way back in time…gym time. He later asks if Dede had a trainer at the gym on McKewen in 2008? Asks if Dede knew Terri in 2005 (when she had her DUI, no?). Why would Desiree’s attorney ask if Dede Spicher knew Desiree? Desiree could tell him whether or not they knew each other.

    IDK, weird questions. What could they possibly have to do with a child who went missing in 2010?

    When did Desiree go to Canada? Did SHE work out at the same gym as Dede and Terri? Is it possible that Dede Spicher introduced Terri & Kaine Horman to one another? IDK, just weird questions.

    Are there more than business relationships between any staff and administration at Skyline? moo, but my gut feeling is that there is a great deal of coverup at the school, for reasons I don’t understand. Yeah, I get a protective union, lawyers, and the like, but I wonder if it is not more self-serving than that.

    It’s possible Porter didn’t even know WHEN the posters, etc. would be put aside. Therefore an email from TMH would be ignored.

    Why TMH didn’t tell, if she did, Kaine to go get the poster and Kyron…who knows.
    Why TMH and Kaine, or either one of them didn’t go to the talent fair…well…who was the most exhausted having spent hours with Kyron on getting the poster, diarama done?

    Kaine talks alot about putting on Kitty’s shoes and walking her down the road, and telling Kyron about how proud he was, and they’d go out for ice cream….but he in the beginning didn’t seem to know about the talent show, or didn’t care. A primary parent would know about that, you’d think.

    My thoughts have not changed wpg- it is my understanding that the emails in question have never been authenticated in the first place. They were not provided to DY, she was given some sort of access to what she believes were emails as stated.

    I am recalling from memory here, but I want to say that the timing of them was particularly interesting. Almost as if someone needed her to be on board.

    I will say that the content of any correspondence that could be authenticated as having been composed by TMH would be of great investigative interest to me as an analyst from both a suspect perspective and victimology profile of Kyron.

    One of the reasons I continue to find the “emails” in question is that they were not offered as support of her tort filing against TMH. The filing itself is beyond vague, and imo, had the response not been a request for abatement prior to filing an appearance by her atty’s, it is likely in “stay” mode to preserve her ability to support it.

    She has never referenced the content past the statements we are all aware of, and as I opined early on, I fear that DY may have been used as a pawn to try to get TMH to react.

    An important clue is that Kaine has not discussed them. They absolutely would have had to come from an account he has access to. He took pride in that specifically.

    I also believe if that content was authenticated and moreover, authenticated as to both parties, TMH would have been indicted.

    Adding on here- in the scope of the tort- to my knowledge, given DY’s comments about those emails- TMH will absolutely be within her rights to seek the origin, and if appropriate, DY’s retraction of same. This is another reason I feel this “info” remains unauthenticated by EVERY party in this case thus far.

    From the deposition, Dede says she worked out pretty regularly at the gym on Cornell in Beaverton from 2000-2009. She told People Mag she met Terri at a gym in 2002. Is that now The Edge gym where the wall of hope is? Isn’t that new, or was it just something else? (These gyms have always confused me.) Or is there another gym on Cornell?

Kaine sends everybody out to watch for Kyron in every crowd, every event, and so believes that his son will come back that Kaine goes ahead and enrolls Kyron in school in the fall, buying him new clothes and school supplies, reserving a desk IN MS. PORTER’S CLASS. The same teacher who did not notice the boy’s absence is holding a desk for the missing boy, and Kaine has not a single doubt in the world about her fitness for the job. Isn’t something wrong with this picture?

    It is my understanding that she marked him absent at some point, so she definitely noticed.

    To your point about the parents inability to hold the school accountable- yes, I definitely find that odd.

    I was incorrect about the presser KH held November 15. That presser was in response to that morning’s appearance by DY’s appearance on The Today Show, but he said he wouldn’t discuss what was presented, including the emails, to the 3 of them by LE the previous Friday.

    Can’t find the right video, think I posted it here not too long ago.
    Oh, well.

    My recollection (ha!) is that he acknowledged the existence of the emails and that they supported his belief of TMH’s use of alcohol . . . something like that. Downplayed them, imo. He didn’t go as far as DY to describe their content in any way.

    So, yes, it could be seen as him not sharing the same sentiment as DY or not “wanting” to publicly share it or admit it.

    Sigh, sigh, sigh. Impatient and totally selfish me says let’s get this moving in the courts already. Dang it.

    There were MANY reports/articles that indicated a VERY LARGE range of potential “markings” of Kyron’s absence.

    They range from NEVER MARKED ABSENT thru SOMETIME THAT AFTERNOON to DISTRICT WILL NOT STATE to AT SOME POINT to AT TEN O’CLOCK.

    Ten O’clock was/is the district’s mandatory time that elementary students must be marked absent. I’ve heard that is changed now and students are marked absent immediately and a call is sent home.

    Regardless, Porter had the cards in her hand. She could and should have followed up on his absence.
    She didn’t.

    That Kaine never, ever questioned this suggests he NEVER was aware of school policies. Or cared. This is not a primay caregiver. Nor is it a parent who truly is digging to find out what happened to his son. Attempts at AWARENESS of Kyron being missing is not the same as attempting to get the complete story from LE…although over the years we have seen that has been informed of those LE is “ruling out” to cement their case.

    But LE has convinced him and DY that Terrry Horman KNOWS WHAT HAPPENED. Why would they seriously question the school, the investigation. or any peripheral entity or perp?

    Regardless of whether tmh was involved or not, it seems, sometimes, incredulous to me that an analytical father and a supossed sensitive mother would NEVER openly question the school, nor the investigation itself.

    I can’t disagree on the point about holding the school responsible, or at least seeking to question the issue openly. Wrt to DY, I was shocked the school was not named in the suit , but I have to be honest, I can find no confirmation DY has ever been to Skyline School for any event of Kyron’s including parent/teacher meetings, etc. I can tell you the witnesses I have interviewed who have kids in Ky’s class have no recollection of ever meeting her on campus and moreover did not realize TMH was not Ky’s bio mom in the first place.

    Hall, the PSU prof, felt he was allegedly targeted due to such things as travels to EGermany and a 10 year old incident in mcso files. Speculation: similarly, someone in the LE or criminal justice systems might have targeted Kyron as a target as the fruit of access to Terri’s dui conviction record, and more likely current criminal behavior such as steroid sales–like from Canby case hopping out.

    The issue with the JTTF was police chiefs like Beaverton’s
    had no supervisory authority over

    From the beginning of this horrible case, I have felt uneasy about DY. Yes, she is the biological mother and I do not doubt her absolute grief at the loss of her son. I do find a lot of fault with the early direction of suspicion by her and her policeman husband, TY. She, in particular, seemed to be all too anxious to point the finger of blame at Terri. I have to wonder how much she was actually “told” by LE to support that and how much was directly due to long suppressed rage that Terri had “stolen” her husband. Her early attack on Terri appeared to me to be her innate guilt surfacing as a shield against any questions as to why her sons were being raised by their Dads and stepmothers. She has been obstinately vague as to that reason to this day.

    I have a huge problem with a mother who gave up custody of 2 children, supposedly due to a mysterious illness and never fought like a tiger to regain that custody when she recovered her health. She has gone on to a 3rd marriage and a good job, content with being a casual part time mother, at her convenience. A weekend or 2 during the month, a cutesy “family” vacation, totally escapes the daily travails of motherhood and allows only for the fun, joyful times to define the relationship with your children.

    Until LE comes forward with some verifiable evidence against TMH, this case reads like the perennial evil stepmother tale to me. And a little boy is still unaccounted for. Shame!

    Paula, I think you make some valid points.

    I feel the need somewhat to defend DY in terms of attempting to regain custody of her sons following her illness. That said, her illness was self-caused by taking “non-fda approved supplements”. That reasoning implies she was unaware of dangers that she needed to seek medical treatment for. Personally, I take umbrage with her explanation of that in the first place when condemning someone she herself willfully entrusted with her son.

    Now the part where I defend her- and I am going to be vague because I absolutely am defensive of this woman because I cannot and will never know the depths of her loss- and I believe it is genuine on her part- complete with very bad advice constantly.

    DY did attempt to regain custody of her other son, and was not successful, moreover she was ordered to pay counsel fees. With Kaine’s resources, and her issue to begin with, she knew that was a losing battle as well. Let’s keep in mind that TMH was in support of DY having at least more custody of Kyron, if not full- at least according to DY.

    Now who has been a regular katu news source….one to whom TH would not blame KH directly but would nevertheless extol the benefits of moving to another home on a boy’s happiness & school adjustment.
    Someone katu calls a news source on the case who hits forward on a private email? Imo not LE/DA employee. Not a friend of TH. Not Kaine or his family because indirectly he’s shown in a bad light. Who said TH send her long emails several times a day?
    Desiree. a regular katu source, and nothing to lose by hitting “forward.” Imo this is one of Terri’s emails seemingly imo trying to persuade Desiree to do for unhappy Kyron what she had done for James. Move him to her home. Imo Kaine in part lost confidence in TH when emails like this revealed her work behind his back to remove the boys to other homes.

    Munchausen reference as opined by some investigator or atty, no doubt in my mind.

    After all, one would need a good reason to believe their spouse who they entrusted with their children up and abducted, arranged for same, or violently murdered their child.

    Yes, I am being glib partially- but I believe the theory floated to Kaine was this.
