Kyron Horman Missing: New Years Eve Settlement Ends Horman Marriage

Portland, OR- In a surprise court hearing,  Judge Henry Kantor signed off on the agreement between Kaine Horman and Terri Moulton Horman to end their marriage this afternoon.

Details of the agreement have not been released publicly, but according to KGW,  a financial settlement to include child support and a lump payment to Terri Horman has been reached.

In what can only be described as a bitter family court feud-  the divorce matter was last in court on December 16th to decide if the Horman landscaper,  Rodolfo Sanchez Estrada -who alleges Terri Horman tried to hire him to murder Kaine Horman at a lunch meeting – would testify.

Judge Kantor has not yet filed an order from that hearing but Attorneys for Terri Horman were granted a continuance from the pending temporary custody motion scheduled for December 19th and 20th.

The DA’s apparently divorce Court-filed motive is hogwash.
While it is a statutory preference a Judge would give some weight,
it would be completely outweighed by other balancing variables,
most particularly the Courts’ preference for placing a young
toddler girl with mother, particularly a stay at home mother.
It might differ if the kids were teens raised together & stated a pref to
remain together with father, or if father could prove
she was a junkie or current drunk.
Kaine’s ability to take kitty from her (cf Rudy)
only makes sense if Kaine in their fights had threatened to use
her dui against her, & to testify issue was ongoing.

In reference to your post #46 @ 1:45 AM on the previous page pointing out some things that you a CD find to be disturbing about what little K has been told by Kaine and how he keeps Kyron’s room and clothing up-to-date as if he will return.

I agree with you both that Kaine lacks understanding of children and has not thought out what the real effects of his behavior will be on a five year old. Quite some time back I posted that Kaine will pay a big price for this about eight or so years from now and maybe sooner.

What will happen when the first supervised visit with Terri takes place? It depends on the child and how alert she is to what has been going on around her at home. She will have to decide if she can trust her father to tell her the truth. Girls need a father that they can depend on to be dependable and truthful. They don’t ever need to find out that the person that is their father is untrustworthy.

I hope Terri prepares well for the first visit and brings photo evidence that she is her mother and can make the child understand. It totally depends on how sharp little K is mentally.

This whole nonsense of telling little K that her mother is dead is so beyond the pale. Kaine should have someone to kick him in the rear and wake him up.

Did I already ask this about this clip on D.Phil? @4:40 on this video, DY is going over her conversation with TMH on June 4, then says she started to panic after talking with Terri. “Kyron doesn’t have his coat.” How did she know that? She says Terri said she didn’t walk him to his class, but then she says she took the photo, she was in that classroom. So this implies that at the time of the phone call, Terri didn’t mention being in the classroom, so how would she know about the coat & backpack being hung up and still there? Weird. (Unless Susan Hall told her that in their conversation, which is possible I suppose, though she doesn’t mention that in any interview that I recall.)

    http://www.katu.com/news/local/114935669.html?tab=video

Whose truck is that, anyone know? Did LE ever ask after they were given that tip, if anyone saw a gray truck at the science fair that morning, or were they too busy looking at white? I just have a gut feeling that out of some 3000+ tips, there must be something that’s been overlooked. Something hiding in plain sight.

Speaking of overlooking, did you guys read about the 23 year old LEGO cold case just solved? I gotta wonder why it took 23 years to submit collected dna sample of material under the victim’s fingernails. One would think in this day and age anyone assigned a cold case would do that immediately. I wonder how many cold cases out there could be solved, if someone would just take the time to go back and see if there is some collected evidence that could be used to match dna now. Anywho, the Legos had the perp’s 5 year old son’s fingerprints on them as well. Used his own kid to gain access to a vulnerable grandma no doubt.

Reminds me of Kyron being seen with a man and two girls. Another over-looked tip? IDK, just digging again.

I’m with you, 4. Financially, in this order 1) KH, 2) DY, 3) TY, 4)TH
Frankly, I cannot even see a financial motive for TH, unless it is more $ for k. Upon divorce, KH faced a potential of losing custody of Kyron and k and paying two women he disdained child support. DY, at the time, responsible for two children in the custody of their fathers. Not sure about OR, but in WA the combined salaries of the noncustodial parent are used to compute support $$, so anytime TY got a raise, KH could have gone to court and got a bonus. From my perspective, Kyron was not TH’s bio-son so she had nothing financial to gain or lose.

Don’t bother Malty. They were gleaned by concealing a recording device without knowledge or permission of the individual being recorded- which is a crime in Oregon. It is completely edited and in some areas where there is an alleged accompanying transcript even that is false.

This for me is one ancillary fall out to Judge Garrison’s allowance of the hater crater to testify in the fashion they did. Green felt empowered by that, although the judge straight up disagreed with their commentary and called it “retribution”. That said, as I am on the record, he simply should have controlled his court content and record to include whatever legal reason they offered to exempt the name change, and everything else was out of bounds.

That said, I do feel that Ms. Green will learn that she finally went to far.

@3.0 wrt You Said “for example- where Rose and others may interpret KH s choice to get a restraining order and keep Kitty away from TH as proof/evidence that he was not looking out for best interests her safety etc that it was selfish and self centered”

I did not give the interpretation above or allude to it. Nor used it as the basis for one of my opinions (the other was specific historical instances of poor parental judgment)
but You have made this statement on other occasions.
    I have not.

about “I did not give the interpretation above or allude to it.”
meaning in my recent post where you wanted the bases fir my past parental judgment opinion.

    ——-
Rose Im sorry, the example was mine- not yours

    Here,
    I wrote:
I was not speaking to any law when I wrote of equitable evidence- I was asking if her thoughts were more than her interpretations of a behavior

for example- where Rose and others may interpret KH s choice to get a restraining order and keep Kitty away from TH as proof/evidence that he was not looking out for best interests her safety etc that it was selfish and self centered

others interpret it differently – as a decision made with her best interests at heart- based on his very real fears at the time
I could have generated a long string without getting to the RO.

Not having an example of yr opinion at the time, I could not include Yr thoughts- I used the word “may interpret” in my example to Blink leaving open the possibility that you may not interpret the RO that way-

The point wasnt to give yr thoughts but to instead offer Blink an example to help illustrate

No matter where you stood on the RO (thank you for sharing yr thoughts since) it would not have changed the meaning of my example-
For you see the ex. was merely to illustrate the behavior decision motivations for same as subjective- open to interpretations/debate

The behavior / decision to gain an RO which you are siting as evidence to support yr opinion that KH motivations were sound that his decision was “of course” reached over a legitimate safety concern is not an indubitable fact the behavior/decision- *the evidence* is not conclusive –
Yr opinion is only one possibility – it is just your interpretation of his motivations for a behavior/decision its only a speculative possibility

I could have flipped the example to read:
for example- where Rose and others *may* interpret it as respectful and over a legitimate safety concern that KH s chose to get a restraining order that his decision to keep Kitty away from TH is proof/evidence that he was looking out for their best interests her safety etc that he wasnt selfish and self centered

others interpret it differently – as a decision made with his own best interests at heart- based on his selfishness his need to punish TH not over any legitimate safety concerns at the time becuase he had to have known his wife and mother of his children was incapable of wanting to harm him or the children

Which opinion/interpretation if any is correct? we cant know we can only speculate.

The point of the example was to highlight the fact this behavior this decision the motivations for same are subjective open to interpretation they are not incontrovertible
None of us can know what he/she felt or why None of us can claim to know the motives behind a decision or behavior all we can offer is our viewpoints which can not be proven true or false.

    You wrote:

If you want the sine qua non of Kaine’s poor parental decision making which was not child centered, it would be mother & allegedly Kyron asking for a residential custody terms modification, which stepmo supported, and Kaine rejecting out of hand. As mbs said, he could have been collaborative. He and Desiree might have met with the pediatrician jointly, obtained a psychologist’s assessment of Kyron’s needs, and so on.

Rose, respectfully, the word ALLEGED is very important- You are siting things that may have happened or not as objective evidence to which you are relying to support a mere speculative possibility that KH made a parental decision on this matter which was poor and not child centered-

1st we dont know definitely that it appened etc
2nd we can not say that it was poor or that it wasnt in Kys best interests nor can we say it wasnt child centered.

    - Its only one POSSIBILITY- (if true) the other side of the argument is the very real possibility that KH with Kys best interests at heart made the choice Not to relinquish custody to DY- why? perhaps because he feared her full time parenting skills- perhaps he feared a relapse into “bad health” for DY… who knows?

Again the alleged objective behavior /decision is subjective its open to interpretation it is not incontrovertible objective proof of anything

    You wrote:
There are MANY lessor examples. If the color cards were implemented sloppily at school (which I think was Terri’s issue–dishing cards at day’s COB without child understanding & being able to repeat why as to specific behaviors, or
he felt that system didn’t work for Kyron for whatever reason, he could’ve met with Porter & Keefer. Imo at home TH was trying to help K survive that classroom in her homespun inexperienced way.

    — Again respectfully Rose this is merely an interpretation of a behavior a speculative possibility – “IF”- none of the above is indubitable

KIM yr examples do not seem to support yr earlier contention:
“I go by objective past behavior rather than speculative possibilities.
The evidence to date does not reflect KH made parental decisions for either child
based on their best interests, but rather reflects ongoing poor parental judgment as well as self-interest.”

Rose In all kindness and with respect, if you feel his RO decision/motivations were appropriate- then wouldnt that support the *possibility* that he did make decisions IRT the children with what he believed were their best interests at heart ?

-He is the custodial parent – He believes and wants to show the court he has her best interests at heart to ask for a GAL might go to show he is not confident in his own legal and parental decision making skills

    - Besides if you are attempting to use KH lack of asking for obtaining a GAL for Kitty as evidence of poor parental decisions or lack of looking out for her best interests than shouldnt you also include TH failure to do so as proof of same after all it would be she who as the noncustodial parent who would tend to question whther or not the court or TH had kittys best interests at heart…

I found this current letter to Skyline parents interesting, particularly the second paragraph about behavior issues.

    August, 2014
    Dear Skyline Parents,

Historically we have had overload issues on the bus that serves Skyline School which travels along Highway 30 and picks up on both sides of the busy Highway. Many families from the North Portland area transfer into Skyline and take their student(s) across the bridge to catch the bus at the Linnton Community Center or at the stop at Hwy 30 and 105th Ave. In fact, the majority of the students who use those stops are transfer students who do not live in the Skyline Attendance area.

During the 2013-14 school year, the overload condition and the long bus ride contributed to increasing incidents of unsafe behaviors and bullying. Transportation met with parents and school staff in late January to discuss concerns and possible solutions. Families expressed the desire to see their children remain at Skyline School and the hardship that removing transportation would have on their families.

School districts in Oregon are only required to provide bus services to students who attend their neighborhood school and live outside of the walking area. Portland Public Schools does allow students who would not normally be eligible to receive bus service through the “hitcher” process. Through the past years, the District has worked to accommodate as many hitchers as possible. A larger bus was provided to allow for more students to ride. The hitcher policy has not been strictly enforced. However, the capacity of even the larger bus can no longer accommodate the number of students wishing to receive service.

The District has investigated several options that could be implemented for the 2014-15 School Year. Several options were discussed during the parent meeting. The District will offer the following options to Skyline families. We are hoping to provide safe options for families that do not create a financial burden and remove dollars that could be used in classrooms.

    1. Control the authorized hitchers on Route 147 to ensure the safety of students.
•Students who live in the Skyline attendance area would receive first preference for route 147 including those who are in childcare at Linnton Community Center.
•Choice students from outside of the Skyline attendance area who attend Linnton Community Center for childcare would receive the second consideration for assignment to route 147.
•If there is additional room on the bus, choice students who are riding the bus as hitchers will be allowed to ride.
•Currently there are approximately 24 eligible students who reside along route 147. There is additional capacity for an estimated 30 students.

2.Add an additional stop to an existing route that has capacity for additional students.
•After the safe capacity of route 147 has been reached, additional choice students will be assigned to route 144 and route 121.
•Students would arrive to HWY 30 and SW 105th Av at approximately 7:30a on route 144 and 4:15p on route 121.
•Route 144 and route 121 currently have room to transport an estimated additional 20 students.

    3. Accommodate hitchers at stops on other bus routes to Skyline School.
•Families can choose to use an existing stop on other bus routes serving Skyline School.
•Some choices include: Route 144 – 9181 NW Germantown Rd
    Route 146 – 6936 NW Skyline Blvd
•Please contact routing if you need assistance finding an existing bus stop to use.

A District committee has been formed to review existing transportation policies and directives to ensure we are providing equitable bus service to our students. We will be identifying “gaps” in service and areas where we are providing service beyond what is mandated. The service that is being provided to Skyline families will be reviewed as part of the process.

    Carole drops in on Jill.
An alum also at Cornfest: Jared & his co’s involvement with Skyline is mentioned.
delivers backpack meals probably weekly to feed kids on weekends.
Our County foodbank delivers backpack meals to schools too.
Why would he stroll memory lane at this school event?

This org is just one example of how a nonprofit volunteer could be delivering something to Skyline first thing in the morning & need help carrying in.

food-filled backpacks come to school from Pantry on Fri mornings to go home with kids in afternoon.
Unclear if a pta volunteer regularly transports packs to & from Pantry or if Pantry volunteers do.

however, says program began in 2012-13 school year
& startup was reported on to pta as Nov 12.
Looking to see if it existed informally under Keefer.

@mbs. my kid rode a mixed age K-12 bus in K-2 (I had to do it
to drive my other disabled kid out of boundary) & from time to time after.
There was always jeopardy just from overflow of middle-schoolers’ arguments & always some
bullies. A sturdy, much larger K girl dropped out of the private after a year because the bus so
terrified her. Since her Dad was an investment banker partner of a Board member, the Admiss Dir
was horrified, and said, “Didn’t X (my invulnerable-facaded kid) sit with her & help her?” (school expecting
a 5 yo to protect a 5 yo from a 7th grade bully.) Mixing a 5 yo female with an 8th grade male on
buses is foolish. But the Route parents know who the bullies are.
I would be very surprised if wee Kyron had not been a target, & transporting his trifold could
easily have been to prevent a bully trashing it.

  43. Rose says:

@mbs. It sounds like as Skyline boundary students
have fled to private or transfer themselves,
students from North Portland have transferred in to
pick up the slack, keeping the school open. And some use
Linnton CC Child Care to ensure their place.
North Portland K-8 must be pretty bad to put kids thru that journey.
At least when k sees Terri, she’ll have someone to discuss school
    with.

  44. Rose says:

Can tell Milly S is gone at Skyline.
By now she’d have the Eagles
Nest publication grid up for the year.

@Malty. I’ve never read Green’s “new” Roseburg Supports as you have to sign into FB & I won’t.
I gather bio mom is a Friend? Bio mom got another whopping
    $20 this month.
Too bad about Trashys as she was humerous.
But what was the point for Green or Morris or whatever aka?
Trashys had almost no posters/responders & imo was troubling no one
but Tom & Green on a personal level, who more than asked for it.

    @ Mom 3.0 wrt:
You “Rose In all kindness and with respect, if you feel his RO decision/motivations were appropriate- then wouldnt that support the *possibility* that he did make decisions IRT the children with what he believed were their best interests at heart ?”

    Me: Not at all.

    @Mom 3.0.

You: ” you cant say that she was a stranger to Kitty ”

Me: I thought she was imported from KH’s acquaintance circles
in California. I missed she had previously made k’s acquaintance
in California while KH was married.
