Caylee/Casey Anthony Case: Plea Sans Adjudication In Court Today

Orlando, FL– By this afternoon, we could see Casey Marie Anthony convicted of up to 13 felony counts in the fraud trial scheduled for today at 1:30PM EST. Live Link

Over the last week, the legal wranglings, sentencing hypotheticals and LexisNexis databases where burning up the skype accounts of all the legal analysts in Or Lawn Do. I experienced it first-hand as I was in town last week:It was palpable.

According to sources speaking on the condition of anonymity to blinkoncrime.com, the plea negotiations between the State and Jose Baez, defense counsel for Casey Anthony in this matter, broke down over the amount of felonies she would agree to plead to, and the matter of adjudication.  WFTV analyst Bill Schaeffer does a nice job discussing the importance from a legal perspective, here.

The afternoon face off between Linda Drane Burdick, Jeff Ashton and the defense team for Casey Anthony is expected to seek Judge Stan Strickland’s ruling on her sentencing and the issue of withholding adjudication which is the anticipated position of her defense.

Simply stated, there is no basis given the known facts of the case to argue that Casey’s actions constituted a necessity, agreement from the wronged party or victim, or any as yet unknown to us allegations such as needing cash for the nanny or kidnapping ransom.

While the defense does have a strong argument to be made that Ms. Anthony is a first time offender and Judge Strickland has already indicated that he will treat her accordingly, I have a suggestion for the State.

I submit aquiring tacky white sunglasses through fraudulent, felonies means, using said stolen property to perpetuate further fraudulent activity, followed by wearing them to your attorney’s office after you have been arrested for same, constitutes a spree.  Adjudicate at will.

    THE sunglasses, in the photo of Casey in Blink’s story. Already purchased from a stolen and fraudulently used check from her friend, Amy, Casey now flaunts them on her forehead for the overhead camera (Casey was very camera aware, even to her last court hearing entry with big smiley face as she looks for and directly into the lens).

    And we see Casey in her tight short shirt, short shorts, ‘business accessories’ of a binder and Caylee ID type card, and those sunglasses AGAIN.

    Why did Casey flaunt repeatedly, those items that Amy’s money purchased? There had to be a purpose in Casey’s cunning little mind, just as she wore the famous hoodie before the cameras, again from her felony crime spree she has now been convicted of.

    How does this compute with Baez’s statements that Casey always wanted to plead guilty, and how does it jibe with Casey’s statement that she wished she had been ‘a better friend’ to Amy? Does the flaunting of the items she obtained on the felony spree against Amy, and against the Bank of America, Target, Winn Dixie, etc, mean she is sorry for the gain of those items– not likely.

    There has to be a ‘casey explanation’ tied to this behaviour and flaunting of stolen goods, not accidental or necessary, Casey did not need sunglasses, she had others, Casey did not have but one top to wear in her closet, she had others, and Casey had access to the Anthony home, their food cupboards and freezer, and if the Anthony liquor cabinet was empty, she didn’t really need booze as an essential, unless an addict. Does Casey mean in her statement ‘better friend’ mean she considered herself Amy’s friend during the crime spree against Amy, just not a ‘better’ friend?

    Is Casey, or was Casey, using the flaunting of the big white, noticeable glasses, and other items, to support her ‘the devil made me do it’ scenario? How can she reconcile this now? The defense must come up with a plan to explain Caseys apparent complicity in the death of her baby.

    Blink, a spree yes, but this wasn’t immediately after Caylee died, not if the decomp in the Sunfire is related to the baby’s death. This high activity, seems to have been less ‘reactive’ to the act of killing her child, and more of a ‘planned’ spree and Casey had to have a little plan to commit the crime weeks, not hours, later.

    The judge had set a February 1 deadline for the defense to provide information or witnesses to back up its claim that it has proof someone else, other than Casey, put Caylee’s body in the woods near her home last year.

    The defense recently blamed prosecutors for the delay, claiming it still needs more information from the FBI.”

    It seems as though Mac may really be out….Maybe the deadline is being given some slack because of this(?)

    PLUS: There is a softening between the prosecutor’s office and the defense (if you noticed). Lyons is probably keeping the door open in case there is an opportunity to plea later. (if Casey and the state will agree to terms)

    I think you are over analyzing some of Casey’s behaviors with the sunglasses, etc. You are trying to interpret it within ‘the norm’. Casey flaunted a lot of things, counter to reasoning in the past, but always got a ‘pass’. I think it is mental illness or a personality disorder coupled with no ramifications from bad actions in her history. She didn’t think she would ever be ‘had’.

    Applying a mentally healthy person’s perspective does not work in contemplating her actions and boldness.

    Sorry, you sound like you’re frustrated. Perhaps you’ve explained this before? If it bothers you to have people question why comments disappear, could you not have a link to “new comments”, or “new page”, or a simple explanation or set of instructions on how to continue reading?

    It was a way for the computer techs to stop the sluggishness. I think it was resolved without a full explanation to Blink, and maybe without complete logic or continuity for posters: a quick fix. But…It does work! So bravo to that.

    Blink seemed confused, maybe at a loss, but I wouldn’t take it personally. You’ve been a good contributor.

    Blink, the site has speeded up incredibly, back to normal. Whatever the H is going on, it’s better than in the past days!

    No documents apparently filed with OC by yesterday. Anyone heard about the status of the fight between the defense and Jesse’s attorney’s position that his client does not need to give additional months of cell phone records, for about a year’s worth from March 2008 until well after the body was recovered. Jesse has already complied with all his cell phone records for June and July 2008, the critical time when Caylee was missing.

    This is an old report, but the defense could still be casting it’s wide net to see what they can use, dirt — add water and stir = Baez’s ‘MUCK’.

    Next Monday, Anthony friend, Caylee babysitter, Anthony spokesperson on national media, goes to court on a violent battery with a deadly weapon, with Anthony attorney Brad Conway.

    WHY is this Caylee babysitter not accused by the defense?? She fits the nanny scenario much closer than Kronk, Jesse, Ricardo, etc. And she has been charged and is actually going to trial, with a violence with a deadly weapon apparently involving children present in the home.

    WHY is she not suspected by Cindy, Baez and Casey?

    Kleat you’re so right. Casey could be babysitting Holly Gagne’s kids. Holly was on Nancy Grace supporting Casey and said that she was a great mom, not quite as good as Holly Gagne of course, because her standards are so high as we know (as she told Nancy Grace) and as she has proven with the recent charges against her of assault with a deadly weapon in front of her children. Sounds to me like she is a pathetic excuse for a mother. However she still considers Casey to be a great mom. Maybe she’s Casey Anthony’s only character witness. Hmmmm, who do you think would want to use Holly Gagne as a character witness? Not me!!!! Birds of a feather!!!

    just mulling over the info so far in general. Once in a while I am brought back to Lee and his complete silence and lack of connection at all with Sis. There has to be something there as to his helping Casey with Caylee’s body etc. I just dont see Casey even putting tape on Caylee after death and due to decomp. That would be too hard and to Yukkie for her. I think she was murdered in the Anthony house in a fit of rage–ductaped, maybe dumped in the pool to make sure she was dead, stickered, bagged and put in the trunk. One step after the other. I dont think she even thought of the smell–reason not dumped right away. Maybe Lee helped her carry the bag to the car or helped her at the dump site. I think he is involved though because he has a deal and is so very quiet. that’s what I have been thinking about today—and wishing for the Dom Casey depo—so he can spill his beans and then it will be all over and we can let Casey be out of society for good.

    This smacks of the rules of ‘past practice’. Her bad behavior has been allowed for so long that, in her mind, it is unfair to try to force her to behave any differently now – let alone punish her for any of her bad acts.

    Let me ask one of you Legal Eagles this….if Casey confesses to Baez about what happened, can Baez still defend her, I mean, ethically, morally, and legally? (I’m sure his concious will get to him) Or, Maybe even Dom’s Depo, or the print evidence, or what Lee knows…the mounting evidence against Casey is starting to pile up. If he tells her she needs to plead and she says no, and he knows darn well she’s guilty, can he still play the part that “the nanny did it” or what ever defense they are going with at the time of trial? I read somewhere that they may just drop the nanny story and say Casey lied about that all together and go with a brand new line. I know thats how a lot of defense lawyers get a bad rep, defending someones innocence when it’s plain as day they are guilty, even when they confess it to them or are caught red-handed and continue to lie, lie, lie. Waiting for the next available victim to be thrown under the bus.

    Orlando local TV news is reporting May 2011 trial date and Halloween as deadline for witness list to be turned over so depos can be done by end of Jan 2011.

    Ok, my bad — I heard the May 2011 date on one news station at the tail end — then on another station they said that if the defense interviews everyone on the state’s witness list it will take them from now until Jan 2011, so I guess it’s all date speculation based on the two sides working out the dates per the Judge last week.

    However, it is also being reported that the State is asking the Judge to withhold some evidence from the defense at this time — wonder what that is?

    WFTV new info makes me wonder if Casey put the duct tape on Caylee, Casey would KNOW IT, so why is this news in discovery for the defense? The judge may be able to see whether the state is bluffing on the 104 etc or not– so why would the state need to disclose it to Casey?

    but my reason for suggesting we write to strickland is this. I think that baez does not know what he is doing his lack of experience is only working against the prosecution to bring this case to trial in a timely manor. Where else have we seen that a trial is allowed to drag on for that many years as they are requesting. It is not fair to caylee the victim for this cherade to continue. If baez doesnt know what he is doing and perhaps he is confused and stumped as how to proceed. than he needs to take his incompetent rump roast! off this case. It has become ovious that he doesnt know what he is doing! theres no excuse for this kind of incompetence.

    Sosad, it’s about the last 10% of evidence and the latent discovery not revealed so far. The defense wants it all because they really have no defense other than to methodically attack everything at trial. If Casey’s prints on on the duct tape, for example, she will know of the possibility and can tell her own lawyers. Defend that!
