Caylee/Casey Anthony Case: Plea Sans Adjudication In Court Today

Orlando, FL– By this afternoon, we could see Casey Marie Anthony convicted of up to 13 felony counts in the fraud trial scheduled for today at 1:30PM EST. Live Link

Over the last week, the legal wranglings, sentencing hypotheticals and LexisNexis databases where burning up the skype accounts of all the legal analysts in Or Lawn Do. I experienced it first-hand as I was in town last week:It was palpable.

According to sources speaking on the condition of anonymity to blinkoncrime.com, the plea negotiations between the State and Jose Baez, defense counsel for Casey Anthony in this matter, broke down over the amount of felonies she would agree to plead to, and the matter of adjudication.  WFTV analyst Bill Schaeffer does a nice job discussing the importance from a legal perspective, here.

The afternoon face off between Linda Drane Burdick, Jeff Ashton and the defense team for Casey Anthony is expected to seek Judge Stan Strickland’s ruling on her sentencing and the issue of withholding adjudication which is the anticipated position of her defense.

Simply stated, there is no basis given the known facts of the case to argue that Casey’s actions constituted a necessity, agreement from the wronged party or victim, or any as yet unknown to us allegations such as needing cash for the nanny or kidnapping ransom.

While the defense does have a strong argument to be made that Ms. Anthony is a first time offender and Judge Strickland has already indicated that he will treat her accordingly, I have a suggestion for the State.

    Nauseated—I appreciate your comments. I could see that happening after the Casey/Caylee fight. But where was Cindy and/or George when Casey pulled Caylee into the bedroom with her crying for her Nana? If I were C or G I would be taking that bedroom door off the hinges immediately because of Caylee being in the middle of it all. Please respond to how you think, thanks.

    Also, Blink, can you elaborate any further about D Casey and what might be going on?

    Casey Anthony may finally have a trial date: May 2, 2011.

    That date, like many others in the case, is not set in stone.

    Lawyers filed two new motions late Wednesday in the case, according to WESH.com.

    One of the motions dealt with a timeline for the case, the other asked for a private meeting between the State Attorney’s Office and Orange Circuit Judge Stan Strickland.

    The private meeting would be to discuss new material and evidence uncovered by law enforcement and possibly delay that information from being turned over to the defense.

    In the second motion, prosecutors suggested that the trial be pushed back to May 2011. That timeline would require prosecutors to finish questioning under oath witnesses by the end of August, while the defense would have until January. The defense would also have to turn in a witness list by Oct. 31.

    If the timeline is not satisfied, lawyers would have to show why the case is not moving forward.

    The bounty hunter who originally posted bond for Casey Anthony told WESH 2 News Wednesday night that he has offered to pay the $1.35 million bond for Misty Croslin.

    Misty Croslin, the ex-wife of Ronald Cummings, is thought to have been the last person to see missing Putnam County girl Haleigh Cummings.

    New drug trafficking charges were filed on Wednesday against Croslin and Ronald Cummings, adding an additional $400,000 bond each.

    In the motion from prosecution they mention they do not want the defense or Casey Anthony at this meeting. Makes me wonder if it is a new witness, like Dom Casey, Lee or George and they do not want to scare this witness away. Is this not strange that they would specifically mention Casey in the motion? Anyone.

    Do you think the “very unusual” silence from the Anthony camp has anything to do with this new discovery? I hate to even mention this, because in the past, just when I’ve thought G and C would finally be quiet, they would come out swinging again.

    I know this has been speculated on before, but George’s demeanor was so different at the last hearing — he seemed so resigned and more distant from Cindy. If DC has finally told all he knows, or if some new damning evidence has surfaced, this may have finally forced George to face reality again. If so, I truly hope his friends, family and LE are closely watching over him. I don’t know if this man can admit the truth to himself and survive it. I fear it will be too devastating for him to accept. He would likely feel like he has lost everything — his granddaughter, his daughter, his job and ability to work, his reputation (the whole world now knows about the escort searches) and, especially if the rumors about Cindy and DC are true, his wife’s love and respect. It seems that the only way he has been able to maintain a relationship with Cindy is by following her rules and agenda. If he has begun to step away from defending Casey at all costs, then I doubt his marriage will survive. And one more weight/stress he is living with — worrying about what the defense may say about him and his family in mitigation. I’m in no way defending George’s actions — just speculating/empathizing with his possible thought processes and emotions at this time.

    I had family members who were in a similar, seemingly hopeless place and decided it was too much to bear. And have felt near to that place myself a few time. I fear for him and I fear there is a danger that the State could lose an important witness. Sorry for rambling — just something that has been on my mind.

    Steadychick~ Being in that dark place is scary and I’m glad you were able to see the light at the end of the tunnel.
    There’s so many levels of dysfunction in the A household that any one of them desiring to get out of it would be facing a long hard road but to me it would be so much more mentally freeing once the decision was made. Living a lie must be horrible.

    IIRC – George was at work the night of the 15th, therefore, he could not have intervened. And whether it was Cindy or Casey that left the house after the fight – I don’t recall. Maybe Cindy was hoping all would calm down before confronting her again.

    That scenario was just a gut feeling – nothing more, yet as plausible as a zillion others. I do believe that Casey is solely responsible for Caylee’s death. If anyone helped her cover it up after the fact – I feel they should be charged by the state.

    Now I see where the idea of Dom Casey being the possible info source, comes from, didn’t read this wesh story before the wftv one.

    Can the defense ‘scare away’ a witness? It was, remember, Dom Casey being brought into the case by Baez, whose choice during the same time, was also to bring in felon Blodd Tack as spokesperson for himself and his firm. (well, we know BT or TB isn’t a felon, it’s who the name was ‘alias-inating’ that was the convicted felon and on purty durn serious charges)

    Begs the question, what is it about Dom Casey that brings him to work the security line (Casey in tow) with his PI badge, for Baez? And WHY has he been so resistent to being called as a witness in any Casey related case? Did he think becoming private PI for the client, PI for the client’s lawyer, PI for the client’s mommy and daddy, having a closer than close relationship with the client’s mommy-missing subject’s grandmommy? (Essentially all these client relationships seamlessly or concurrently or consecutively connected by a bridge of privilege?)

    WESH writes about the ‘new material from LE’ and requests of delays of sharing same with defense until they can investigate. If this does relate to Dom Casey, maybe there was far more than ‘priv’ sharing that Dom Casey is worried about coming out in court.

    And Richard Hornsby, according to WESH article “said the state needs to determine how the materials affect the murder case against Anthony.     And what of Mr. Morgan? Will he be kept in the dark also? Things have been too quiet on the M&M front, they’ve sat back quietly since the date of their trial was noticed. Will Judge Rodriguez effectively make that case go away by pushing the trial date forward to post spring 2011? There is no apparent need now, given the pace of the capital case and the associated criminal charges, to wait for a June trial. Will M&M be in any position to push their case forward if the capital case is delayed for another full year or more? Will they lose their June 2010 trial date? If the request comes from the defense to defer, if not toss, the civil case once again, will Judge Rodriguez comply or will this proceed without Dom Casey and his testimony?

    Could it be that the person who was calling in the tip that was on the phone with DC, the supposed psychic, is identified and whose story has a little more to it than just her “vision”? I could see that person needing some protection??/ It could be anything. I’m hoping it’s something important.
    It did coincide with the announcement about TM and his wifes illness, maybe it has to do with TES records?

    I’d be really ticked if I were innocent Casey Anthony. Her attorneys have exculpatory evidence, witnesses, that PROVE their client is innocent, the child’s body being placed in those woods after incarceration in October 2008. I’d tell them to reveal it to the judge and the state and the world and now with ‘time served ‘ for the other charges, I’d demand to be let out of jail now.

    What will the defense do? Use the next year to speculate on national tv that the state has learned about the real perpetrator and that’s why they want to ‘hide’ the evidence from the defense? The defense, on the other hand, is buying days, hours, months of life for their client by the delays because they know the DP is a real possibiity for their client because they know she is guilty. And the benefit is in each hour of breath she has before the inevitable sentence is passed? What death row inmate wouldn’t like to spend extra time in, what George told Casey, was far better than other conditions she might face in jail. (of course, Casey thanked the jailers for keeping her in good safe conditions ‘I appreciate it in every way’– every day is a day off death row.)

    MJ, what if the “psychic” is Baez or Cindy & George? George may have given up on his lies if he is worried that Dom has gone to the other side, so to speak. George looked, in court, as though he has had enough. George was also tired of the lies way back when Casey was bonded out. George, I don’t believe, will go to jail for anyone if he can avoid it.

Someone could be trying to help the defense, making claims of some theory of the child’s disappearance that the state would want to investigate and take depos, so the same thing as what happened to Kronk, doesn’t happen again, for the defense’s JPR campaign.

    Who says it’s inculpatory… could well be the opposite. And unthinkable, but we know possible, from little Shenayah as she was handed over to her rapist and killer. Maybe someone has something to gain from this high publicy case to make a copycat ‘excuse’ to become Casey’s saviour. Maybe the investigations relate to the last ‘unnamed letter’ to judge Strickland.

    Seems to me that this new development is related to Dominic somehow …. he is a “business man” with a Private Investigators business to run, and probably has other clients besides the Anthonys ….. yet he posts on his BUSINESS website that he is up and MOVING to an undisclosed location (no new address given – only a P.O. box with no P.O. NUMBER), with a “temporary” phone number. He asks his “clients” to contact him by EMAIL or the new “temporary” number. Very shady, in my opinion. Normally, a business which is moving, will post the NEW ADDRESS immediately, so as not to lose any customers in the transition.

    I have a question, on an arrest affidavit in Florida, why is someone described as ‘non-Hispanic’? I know that there is a substantial Hispanic population in Florida, but what is the point of saying someone is ‘not’ this cultural or ethnic background or makeup? What do they put on a Hispanic person’s arrest affidavit, non-white and non-black? If this is to simplify language complications, then the arrest warrant would ask about first language, read and write etc.

    Why describe Casey as ‘NON-HISPANIC’? Why not caucasian, or non-some other ethnic background?

    If this has to do with Dom C, what would make him drop everything? Fear, of what? Could there really be “a wealthy family” in Conn. that might have a stake? That seems ridiculous but?? What if his testimony could totally obliterate the entire bunch of them’s dream of making big, big bucks. Not too much call for the big networks to want to make movies with folks that helped cover up a crime, looks too dirty. There’s a lot of folks riding the CMA money train, if he can single handedly derail it, might be best to lay low.

    Kleat- EVERYTHING you fill out in Florida has the category of “non-hispanic”. It hits me like……. press 1 if you’d like this message in English. HELLO!!!!! I always thought that statement was meant for the citizens of Florida who do not understand English. They’d leave it blank in otherwords and the officials would assume they were hispanic then. Kind of backwards thinking but that seems to be the way of the world nowadays!

    The designation of non-Hispanic, an abbreviation of non-Hipsanic White, refers to Caucasians without any ethnic ties to the Hispanic community, as opposed to racial ties.
    In Miami, there are many people who are Caucasian and also Hispanic, some who are blue-eyed blondes. They refer to themselves as Hispanic, and I have not heard anyone referred to as Hispanic White. Many Caucasian people left Europe to live in South/ Central America or Cuba and now live in the U.S. but identify with being Hispanic, and whose native tongue is Spanish.
    It is a common phrase in Miami. My family is non-Hispanic White. I just filled out the 2010 census and I put American for our designation because our family is Irish, English, French, Spanish, Polish, and Russian background, but several generations back. There wasn’t enough space.

    With JB’s obvious lack of experience, inept ability to present in court, do think in the 12th hour Casey will fire JB, hire a new atty and cause another long delay for new atty to “get up to speed”? If this happens I’m sure JB will be in on the new plan but I’m just curious in this scenario how long does a judge usually give a new atty to prepare?

    Every character who stepped into this ring of insanity is either related to the Anthony’s or were chosen by the Anthony’s in some form or another. If there is $$$$ in CT, I don’t doubt it for a second. I believe that the prospect of money tantalized those who had hoped for a better future for themselves — down the road. Yes, there was an important cause… “to find Caylee”, but they expected money and now are left with discontent.

    It an’t over till it’s over. My fear is this will drag out & create reasonable doubt, because the witnesses memory and passion will fade. I believe DC and LA know the truth and their hiding in the bushes till it’s safe to come out.

    RubyRose — Just following your thought a bit. Even though I believe DC figures prominently into the private hearing with the judge, I’m wondering if there is a significant Baez factor as well as a result of the DC info.

    I wonder because, until recently, I was under the impression that the State was pretty close to ready to go to trial and they were constantly trying to get the defense to giddy-up.

    Now, we’re hearing a possible May 2011 date. I’m wondering if there is something imminent concerning JB and they are factoring in the time needed for a replacement defense to come up to speed. Just a thought.

    I am of the opinion that this issue may require a change of counsel.

    My dear friend, I SOOOO needed that cackle.

    You know it’s a funny thing how this works, hard as I try, the cases don’t present themselves to me, I literally have to hump it out there and investigate them, analyze them, and then write on them all having to leave the comfort of my ergonomic desk chair. I am not ready to give up the modship anytime soon. So I apologize for the waylay.
