Caylee/Casey Anthony Case: Plea Sans Adjudication In Court Today

Orlando, FL– By this afternoon, we could see Casey Marie Anthony convicted of up to 13 felony counts in the fraud trial scheduled for today at 1:30PM EST. Live Link

Over the last week, the legal wranglings, sentencing hypotheticals and LexisNexis databases where burning up the skype accounts of all the legal analysts in Or Lawn Do. I experienced it first-hand as I was in town last week:It was palpable.

According to sources speaking on the condition of anonymity to blinkoncrime.com, the plea negotiations between the State and Jose Baez, defense counsel for Casey Anthony in this matter, broke down over the amount of felonies she would agree to plead to, and the matter of adjudication.  WFTV analyst Bill Schaeffer does a nice job discussing the importance from a legal perspective, here.

The afternoon face off between Linda Drane Burdick, Jeff Ashton and the defense team for Casey Anthony is expected to seek Judge Stan Strickland’s ruling on her sentencing and the issue of withholding adjudication which is the anticipated position of her defense.

Simply stated, there is no basis given the known facts of the case to argue that Casey’s actions constituted a necessity, agreement from the wronged party or victim, or any as yet unknown to us allegations such as needing cash for the nanny or kidnapping ransom.

While the defense does have a strong argument to be made that Ms. Anthony is a first time offender and Judge Strickland has already indicated that he will treat her accordingly, I have a suggestion for the State.

I submit aquiring tacky white sunglasses through fraudulent, felonies means, using said stolen property to perpetuate further fraudulent activity, followed by wearing them to your attorney’s office after you have been arrested for same, constitutes a spree.  Adjudicate at will.

    BLINK, I know that you play very close to the vest, but I have heard from some OCSO that I know (I live in Orlando), and I’ve posted before, that they say there is imminant issues with Baez’s relationship with Casey.
    They are also ramping up on a new investigation in the “Case” but won’t say what other than a person of interest has finally given testimony that was delayed by that person for good reason. That the “person” (and I’m reading Dominic Casey into it) was between a rock a hard place due to his contractual obligations to Baez, and some possible unlawful, diffently immoral actions he took due to his over zealousness in this case, and the knowledge of future fame and fortune, if he played his cards right. That there is documentation and possible witness statements that put him in the Hot Seat, and an immunity deal was made for his testimony.
    But again, because of the issues my “sources” won’t give me any good details.
    Please expand on this if you can. No one will hold you to anything if we are being over zealous in what we think the State has in regards to the Ex Parte meeting with Strickland.

    I overstated and misspelled. The OCSO didn’t say specifically the contractual obligation was with Baez, that was my interpretation because there were no other contracts between parties that would have involved more than one party.
    Sorry, don’t want to misrepresent what little I know, and what I gleaned from the conversations, and their “code” talk
    I do think that some major doo doo is going to hit the fan soon

    While I’m at it, its been discussed by attorney’s in blogs that it would have been virtually impossible for Casey to have gotten Baez on board like the story circulating said, thru another inmate.
    I believe it has been proven that Casey knew Baez’s daughter. Is it possible that Baez is the father? I know that’s way out there.
    But what is it that connects Casey to Baez, even though everyone, including her thinks he is so inept and unqualified for this case.
    why is she hanging on to him, and waiving her right to appeal on the ineffective counsel grounds?
    What’s the relationship.

I dont think dom has anything to fear from baez because the baezs !! only weapon is his arrogance. I hope they sock it to him BIGGTIME!!     I would like to think that although the trial has been delayed until May 2011 It will not mean that the Anthony’s can continue to collect Grandollars for even longer than we had hoped . If we have to wait to see Justice for Caylee It would not be so upsetting if I knew that this could not be allowed to continue throughout another 15 months.

    To me, it’s still a puzzle that the person filling out the form would put that there for any reason other than to denote a potential communications problem, even if the arrested person speaks English, they may not be fluent in ‘legal lingo’. And so, why doesn’t Florida just use a check-box, to classify someone who has a mother-tongue other than English? Maybe they don’t want to get into the ‘official language’ debate.

    On the other hand, the investigator in this case, would know by the date of this arrest form being filled out, that if Casey had ever used anyone else’s ID (she wouldnt’ do that, would she!), that she may have used a non-non-Hispanic (aka Hispanic) identity, maybe even got away with a story of not speaking English enough to understand what was going on, in a traffic stop, for example.

    Rubyrose, welcome, and I agree that there is something unsettling about this private conference request.
    Prosecution may be worried about “inadequate counsel,” despite seasoned-attorney Lyon in the passenger seat. I believe they should be worried. They want a clean conviction and sentence.

    The Defense would oppose a change of counsel, I believe, because they don’t see the need (or do and hope for a mistrial) and because it would keep KC in jail so much longer. Right now she’s only got 1 year probation and they (at least Baez does; Lyon, no) think she’ll walk.

    HMMMM—Per Blink–this issue may require a change of counsel. D Casey and J Baez?–the new lawyers would need until May 2011 to prepare once the prosecution’s info is discussed “in camera” before Judge Strickland.

    How would a renewed Casey indigent status affect the current team of attorneys, the indicated wealth of experts on behalf of the defense, the ‘in it for the long haul’ attorneys such as LKB and TM? Casey’s fraud case has not caused financial difficulties for Casey, a paultry 600 plus dollars that someone else covered for her as part of her sentence. But prospects of a year of further investigations, potentially hundreds of depositions by the defense, if each and every material witness must be deposed, and the defense of experts to disprove with reasonable doubt, any state position that the body was put in the woods before Casey Anthony was not incarcerated.

    How will indigent status affect the apparent free reign of Casey to dictate ultra-dollars to her every need?

    Many were critical of Baez’s work, so WFTV reporter Kathi Belich asked WFTV’s legal expert whether Baez’s image might hurt Casey’s case in court.

    There were a lot of negative descriptions of Casey’s defense attorney, Jose Baez, when he questioned potential jurors in an Osceola County case he was defending in December 2008, just four days after Caylee’s remains were found.

    Baez was described as an “ambulance chaser and rat,” “a jerk” who “should find another line of business,” “not a good lawyer” who is “full of himself” and “is out to become famous.” Baez apparently was worried there was fallout over defending Casey and the answers he got proved there was.

    “It’s called damage control. What are we going to do to limit the damage to my current clients, my future clients and, ultimately, the damage to Casey Anthony,” WFTV legal analyst Bill Sheaffer said Friday (watch full interview).

    Sheaffer says the potential jurors likely were focusing their anger on Baez after hearing days earlier how Caylee was found dead, with duct tape over her mouth, tossed in the woods in a trash bag.

    “The community’s emotions were raw,” Sheaffer said.

    Sometimes, time softens those raw edges. In fact, the negative comments about Baez dropped in his questionnaire for a case a year later, from 13 to two.

    Only four people of the 80 questioned had something good to say about Baez, like he’s “working hard to win.”

    About 30 people said they had no opinion of Baez, though most of them at least knew of him.

    “You may well find out they do have an opinion and they have an agenda,” Sheaffer said.

    One potential Osceola County juror, just three months ago, explained what he knew about Casey’s case with one word, “guilty.”

    A little less than half the people questioned in both cases said they did not know a lot about Casey’s case. While the surveys are not scientific, it could mean that if her trial doesn’t happen for another year and a half, they’ll at least try to find a jury in Orlando.

    Sosad, no idea, he is, afterall, the lead attorney for the capital case, as I understand it, AL’s job is to ensure that the penalty phase, should the client be convicted, does not result the DP. Maybe the state wants to ensure that the lead lawyer is responsible for sharing the information with his own team. Maybe Baez didn’t want Lyon to be included at this point. Maybe it’s time to back off with Lyon’s press face, and no longer talk about the DP because they have done what they can to this point, about getting the DP dropped. Let the publicity of the DP talk, die down and let Baez focus on the conviction phase.

    Another guy (latin brotherhood and all that) with an ego the size of Montana would certainly see the potential for fame and money, even way back in the beginning. He’s a sensational type with a penchant for the spectacular drama, fairly early on anyone could see this could be mined for lots of glory.
    His home base has always been in the New York area, stands to reason a wealthy guy would have a country home in Conn.
    You probably asked that rhetorically ,lol, so fill me in if you know!

    Gosh, where can I start…he IMO is not capable of doing that. I don’t think you think so either and I know that that idea is how a ‘normal’ defense team might proceed. That’s probably just how Lyons assumed it would go, she could swoop in, do the DP drum dance and incidently promote her book, while Baez did the bulk of legal work. Do we think she’s been flabbergasted by his unprofessional/borderline painful attempts to do anything? Her face says it all. She looks at him alternately like he’s from Mars or like she’d like to strangle him.

    I’ve blabbed this before~ I don’t think she’s committed to carry this case on her shoulders, spoon feed JB the ABC’s of depos, motions, case law, ethical behavior etc. For whatever the reason the tentative trial date is so far away, we may see it as justice delayed but to her it must seem like someone just unloaded a train wreck in her office and said “fix this would ya”

    They [Hoover and Dominic] admitted that they went out directly to the spot where she was ultimately found. They admitted that they never called the police to meet them there that day. They admitted that they never called the police for days afterwards ever. I mean, they get a tip saying this is where the body is found, but they don`t call the police. It`s just.

    GRACE: Wait a minute, wait a minute, wait a minute. Who gets a tip about where the body is?

    MORGAN: Dominic Casey gets a tip.
    And he calls this other investigator Hoover, says come to my office. He comes to the office. Hoover says what`s up? He says we have found the body. I`ve got a tip, we`re going to — we have found the body. They get in the car, they go to Suburban Drive. When they get to Suburban Drive, they pull up directly in front of the spot where the body`s actually found.

    This was on a Saturday. They go into the woods, they`re in there for 20 minutes, Dominic Casey`s being filmed. They don`t find the body. They come back the next day, do the same thing. But they never called the
    police, they never told the police, even though Dominic Casey — this is the only time that Dominic Casey ever went out physically looking for this little girl. So I don`t know who Sanchez is.

    GRACE: So you`re telling me. The defense.

    MORGAN: But he`s dead wrong. He needs to read the whole thing.

    GRACE: Mr. Morgan, you`re telling me that under oath, the private I says the Anthony family gets a tip where Caylee`s body is and it`s right there where her
    body was found and they did not call police?
    Is that what I just heard?

    MORGAN: That is what you heard. And it`s a blockbuster. And to me, I asked the investigators, did you think this was an alibi that was being set up?
    He said I don`t know. And so — and I said who made, who gave him the tip? He said he wouldn`t tell me. He said we just found out that the body`s there,
    they drove out there on November 15th and
    returned the next day on November 16th.

    GRACE: (INAUDIBLE) gave the tip? Did the P.I. know who called in the tip?

    MORGAN: My P.I. says he doesn`t know. He says he thinks it`s Lee Anthony.
    And — but Dominic Casey has never told anyone.

    deposed the Anthony family private I today. So the private eye says he gets a tip where the body is. This is before police find out about it.
    He goes to the location where, in fact, the
    body was discovered a couple of weeks later.

    Now when I read the deposition, he`s saying he
    won`t — you can`t find out who gave the tip. He alludes to a psychic. Mr. Morgan, why do you believe the tip came from Lee Anthony?

    MORGAN: Well, I don`t necessarily believe that. What I`ve said was – - I asked the other private I(eye) today. I said, did Dominic Casey ever tell you who gave
    the tip? He said no, he didn`t. I said, well, who do you think gave the tip? And he said, I believe Lee Anthony or something to that effect low probability Lee Anthony. And then he kind of wobble on it.

    But he — Dominic Casey would never tell him,
    even though they`re out there for two days, who gave
    him this tip. Although, they drove directly – - I mean, I`m talking about straight to the — where the body was ultimately found.

    I loved it when he (Geraldo) got punched in the nose. He had it coming too. Early in his career when he did the expose on the abuse that the mentally handicapped patients were enduring in a state hospital, I thought he was great. So did the rest of the world. Now he’s just a twit, IMO.

    Wow, the wheels of justice seem to be turning. If I were Baez I would think after reading some of those surveys he would not be as full of himself.

    I think it is going to be next to impossible to find a jury that has never heard of Casey Anthony. I don’t think it will be quite as hard to find one that doesn’t follow it as closely as we all do. Nor will it be hard to find one that is impartial. IMO

    Ha. Don’t know nuthin’, MJ. But let me tell you, Baez was his buddy-buddy and yacht companion, as you know. Baez! GR is not hobnobbing with the likes of a poverty row ambulance chaser like JB for the heck of it.

    I don’t know how many times JB has been spotlighted on GR’s show. Lost count. And Geraldo has always seemed very sympathetic to the Tot Mom’s plight. I see nothing altruistic in Geraldo’s interest. Nothing like supporting an up-and-comer lawyer defending a poor railroaded single mom. More like, “I get all the interviews with the golden girl when and if you get Casey off, okay?” kind of an arrangement.

    I would believe someone like GR as an interested backer rather than a Mafia kingpin out to make sure Casey gets off without spilling the beans. I have heard that theory, too! lol.

    There is more to that story than what you think. I know some behind the scenes of that, these people have asserted that he had a different attitude about the patients when the camera wasn’t rolling, but I won’t say, as it is passing rumor. However, it is something that I believe. I’ll leave it that- that expose was not the altruistic effort that it came across as, even that early in his career.

    I have a vague recollection of Geraldo suggesting that Baez was being treated unfairly because of his Hispanic roots. It was around the time that Baez announced that he was the first Hispanic attorney in American history to be trying a high profile case blah, blah, blah. Meanwhile the previous Attorney General of the United States was of Hispanic origin. I’d say that was pretty high profile. Baez was being called incompetent due to his incompetence in the court room and his constant idiotic statements to the press. I’ll never forget when he said after a hearing, “who are you going to believe, me or your own eyes?”. What??!!
    I look forward to hearing about Rivera’s involvement in this scam. I can hardly wait!
