Caylee/Casey Anthony Case: Plea Sans Adjudication In Court Today

Over the last week, the legal wranglings, sentencing hypotheticals and LexisNexis databases where burning up the skype accounts of all the legal analysts in Or Lawn Do. I experienced it first-hand as I was in town last week:It was palpable.

According to sources speaking on the condition of anonymity to blinkoncrime.com, the plea negotiations between the State and Jose Baez, defense counsel for Casey Anthony in this matter, broke down over the amount of felonies she would agree to plead to, and the matter of adjudication.  WFTV analyst Bill Schaeffer does a nice job discussing the importance from a legal perspective, here.

The afternoon face off between Linda Drane Burdick, Jeff Ashton and the defense team for Casey Anthony is expected to seek Judge Stan Strickland’s ruling on her sentencing and the issue of withholding adjudication which is the anticipated position of her defense.

Simply stated, there is no basis given the known facts of the case to argue that Casey’s actions constituted a necessity, agreement from the wronged party or victim, or any as yet unknown to us allegations such as needing cash for the nanny or kidnapping ransom.

While the defense does have a strong argument to be made that Ms. Anthony is a first time offender and Judge Strickland has already indicated that he will treat her accordingly, I have a suggestion for the State.

I submit aquiring tacky white sunglasses through fraudulent, felonies means, using said stolen property to perpetuate further fraudulent activity, followed by wearing them to your attorney’s office after you have been arrested for same, constitutes a spree.  Adjudicate at will.

    MJ, not at all. I suspect that Holly might know things from Cindy, nothing direct, except as related to her own experiences with Casey as neighbor’s child and babysitter. Maybe Cindy and Holly had the good friend/neighbor relationship, no competition between these two women. I’m just wondering if there’s a reason that this relationship stood the test of the case of the missing child, maybe Cindy is simply being a good friend in return. Holly has obviously been a supporter of the joint defense, from early on.

    I have questioned several things in this case, but something keeps crossing my mind over and over. And that is; I understand that pictures and videos of Caylee where published/sold in order to pay for the attorney’s for Casey. But, if my child were innocent, the first thing that I would do is bail her out of jail. I mean they are pictures of her child, shouldn’t the proceeds go to bailing her out first then to everyone else. Unless……………..grandparents don’t want her home. There is probably some reason why none of the funds are used as Casey’s bail. hmmmmmmmmmmm

    I would like to see Ms. Blink do a piece on the un-known father of Caylee, I think it is very important, it has nothing to do with guilt in this case I just think it matters…maybe when all this is over, I would rather the family of the father make money on a tell all then the A’s. Maybe it will all come out in the end….Someone please stand up for this baby….!

    I am not sure how I could do that, I think everyone is clear who I think Caylee’s Father is, but that said, without a test, no claim can be made. I share your sentiment on it though, and have tried to make it happen.

    Noticed new activity on the myclerk.myorangeclerk.com page today. A counter transaction for KC. $9 which I think means 9 pages. Wonder what that was? There is no documentation on the in camera meeting posted yet — but don’t know if there would be.

    This truly just my opinion but I think the reason they don’t visit kc is because Baez has forbidden it. I think he tells them that because of the recorded visit issue that the public would misinterpret and dissect their words, but really i think he KNOWS that things would go south in a hurry if they saw each other and he’s right, the public would be able to see the insanity. None of them could keep a lid on it.
    It’s in kc’s best interest (and his) to keep her isolated from any person who could get her talking. She can’t help lying and with all the assorted defense fall guys, she couldn’t be trusted to follow the invented party line. She’s her own worst enemy. The team has worked hard at manipulating the stories, trying to decide which one has a shot, because she did kill Caylee she would be unable to either stick to the story de jour or would start adding her special ‘details’.

    The A’s couldn’t be trusted to just stick to a predetermined safe subjects either. Their life has drastically changed since kc was part of the family. The have spending money, they can go on trips, kc would be very jealous and eventually would go ballistic. Team kc can’t afford that. That’s how I see it anyways!

    Baez Hopes To Gain Access To Search Group’s Records

    ORLANDO, Fla. –

    Casey Anthony’s defense has filed a new motion Tuesday they hope will help gain them access to all of Texas Equusearch’s records.

    In that motion Anthony’s attorney, Jose Baez, said the group that aided in the search for Caylee Anthony, Casey’s daughter, recently made search records available to the media.

    In court, Equusearch argued that revealing such information could have a “chilling effect” on future volunteers.

    Anthony’s defense argues that in light of recent disclosures to the media, “there is no reason to prevent disclosure to Miss Anthony as well.”

    Well this oughta go over big. News 13 had access to the exact records Judge Strickland already said Baez could view, and has chosen not to. I am however looking forward to seeing these 2 in court.

    Do you think that this has anything to do with the motion by the prosecutor’s office? If not, do you think that the defense took this particular time to file this motion to make it APPEAR that the state’s issue has to do with this? (as not to look bad) They still haven’t responded directly to that motion, in other words.

    The silence is deafening.

    Indirectly, yes and no. I can hear you laughing on this side of the bridge..

    What I mean is I think the entire TES records thing is a fishing expedition to unearth someone/something to counteract whatever the State throws their way.

    MarcyDancer, there is a reason that no one with money from any source, has bailed Casey out of jail.

    (Baez may have implied something other in his court ‘joke’ (bad taste when you have a client fighting for her life) when he joked to the court (and NO ONE laughed) that the judge could always give Casey a lower bond but it was a Baez style joke, nothing more because the bond issue is a NON issue).

    Simply, the documents are written in the section regarding bond as ‘NONE’. This means there is no bond, no amount of money will buy Casey’s freedom.

    My question would be, whether News 13 or any other media or even third party, has taken images, or otherwise copied, made notes, of the information contained in the documents and whether they have now, or have any access to, publish these documents or the information contained in them?

    They may have simply been allowed to view the documents to illustrate that a set of documents that relate to the case, have already been shared or to illustrate that this viewing is also available to the defense in Mr. Nejames offices and under his regulation and control.

    The press is not going to have access to the thousands of TES records, nor would they go do research on each and every one to try to fit them into the ‘culpable’ or any other category of use by the defense.

    This subject could go on until trial?

    NeJame invited the defense to do the same– come have a look, if you see something, NeJame says, let’s take it to the court. This is what NeJame means that the defense is going about things the wrong way, they want everything and is asking the court to give them everything. They’ve got access anyway! They just have to narrow what they are requesting, then go and get it. Simple– NeJame seems to be saying that this is the correct way to decide the issue, not demands of blanket handing over of everything on everyone.

    Wouldn’t KC have access to the motion without having to have a counter transaction? Like from her attorney? I’m not sure that the Texas Equasearch issue is what today transaction was about and that particular motion isn’t even showing up on myorangeclerk.com yet.

    Response to continuance motion by Nejame, with this timing….scared shitless?

    They don’t want whatever the prosecution has to become public either? Or else- that would have been the first well argued motion.

    I am not sure they know why the state is requesting the ex parte hearing.

    But if I were a betting person, and someone somewhere tipped them off, I would assume they are grasping for any low hanging fruit they can. I do not think the defense recovers without a change in counsel, imo.

    If there is a change of counsel, I wonder if Casey would receive a public defender. I do not believe Cindy would give a penny of her new found wealth for Casey’s defense….plus, I’m hoping Cindy needs to hold on to her dollars for her own defense! And then I’m thinking that IF there is a change of counsel & it turns out that Geraldo is financing Casey’s defense, what happens?

    She claimed to have a nanny taking care of her child while she was working. How much money did they think Casey made? A full time nanny would cost more than Casey could ever hope to make. Yet no one questioned her – not her friends – not her family?

    An attorney representing the family of Jesus Ortiz said on Wednesday that as far as they know, Ortiz is not the father of missing toddler Caylee Anthony.

    Ortiz, 20, died in a car crash in Orlando in May 2007. He attended Colonial High School with Caylee’s mother, Casey Anthony.

    In recent weeks, rumors surfaced on the Internet that Ortiz could be the father of Caylee.

    The attorney representing Ortiz’s parents said the family is close-knit and they claim they’ve never heard of or met Casey Anthony.

    But they’re not completely dismissing the possibility that Ortiz could be the father.

    “Miss Anthony never told the family Jesus was the father or that he might be the father. In fact, the family has never met her and does not know her,” attorney Bryan Crews said. “If the child is indeed their grandchild and alive, that is all they have left of their son, Jesus Ortiz. They would like to get to know the child if she is indeed still alive.”

    Crews said as far as the family of Ortiz knows, Casey Anthony and their son never dated, and they have no knowledge of their son ever taking a paternity test.

    The Orange County Sheriff’s Office requested a copy of a report from the Florida Highway Patrol on the crash in which Ortiz died.

    Crews said investigators may be trying to obtain DNA evidence from the autopsy conducted on Ortiz.

    There’s more. FHP through subpoena, preserved a blood sample of Mr. Ortiz. It is not known if it has been tested against Caylee’s DNA.

    Not if it was critical to their case. However, I am of the personal opinion they have not. Caylee’s paternity is a non-issue to the criminal case against her.

    Did ya’ll notice that in Mr. Ortiz’s myspace pictures, there are pictures of him in New York and Miami?? Probably just coincidental, but a little odd given Casey’s association of Zanny with those 2 cities.

    Not odd whatsoever. I think the defense was planning on going that route until they realized his family could have litigious remedies for Caylee. I think it was the basis for the option to do so, if that makes sense.

    He was a good kid. Caylee would have benefitted from him if he was her Poppi.
